In this article, we&#8217;ll discuss what&#8217;s considered <span data-term-id=\"39056141\">domestic violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span>, examine the penalties and protections it entails, and <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><u>how to apply for a <span data-term-id=\"39056143\">restraining order<\/span><\/u><\/a>. Read on to get a better understanding of <span data-term-id=\"39056141\">domestic violence<\/span> laws in <span data-term-id=\"39056139\">Oregon<\/span>.<\/p>\n<h2>Defining <span data-term-id=\"39056141\">Domestic Violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span><\/h2>\n<p>As one might expect from the name, <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-laws.html\"><u><span data-term-id=\"39056141\">domestic violence<\/span><\/u><\/a> takes place with those you&#8217;d expect to find in your home. The people involved, known as family and <span data-term-id=\"39056147\">household members<\/span>, are only half of the equation. Let&#8217;s take a closer look at what constitutes <span data-term-id=\"39056141\">domestic violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span>.<\/p>\n<h3><span data-term-id=\"39056141\">Domestic Violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span>: The Offenses<\/h3>\n<p><a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\"><u>Control and power<\/u><\/a>. They&#8217;re the driving forces behind <span data-term-id=\"39056141\">domestic violence<\/span> crimes. The abuser gathers and maintains them with a variety of abuses. Through threats, intimidation, coercion, isolation, and violence, abusers keep their victims in a brutal cycle of abuse.<\/p>\n<p>Rather than list specific acts, <span data-term-id=\"39056139\">Oregon<\/span> has <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-705\/\" target=\"_blank\" rel=\"noopener\"><u>categories of offenses<\/u><\/a> that qualify as <span data-term-id=\"39056141\">domestic violence<\/span> crimes. They are:<\/p>\n<ul>\n<li>Causing bodily injury with intent or reckless disregard<\/li>\n<li>Attempting to cause bodily injury with intent or reckless disregard<\/li>\n<li>Placing another in <span data-term-id=\"39056185\">fear of imminent serious physical injury<\/span> with intent or reckless disregard (<span data-term-id=\"39056165\">menacing<\/span>)<\/li>\n<li>Using force to cause a victim to engage in involuntary sexual relations<\/li>\n<li>Using the threat of force to cause a victim to engage in involuntary sexual relations<\/li>\n<\/ul>\n<p>Offenses that fit into one of the categories can qualify as <span data-term-id=\"39056141\">domestic violence<\/span>. For example, <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-192\/\" target=\"_blank\" rel=\"noopener\"><u>one <span data-term-id=\"39056181\">family member<\/span> or <span data-term-id=\"39056147\">household member<\/span> assaulting another<\/u><\/a> is a <span data-term-id=\"39056141\">domestic violence<\/span> offense in <span data-term-id=\"39056139\">Oregon<\/span>. Attempting to do so would qualify, as would threatening to do so.<\/p>\n<p>Offenses that belong to this list aren&#8217;t considered <span data-term-id=\"39056141\">domestic violence<\/span> unless the participants share a qualifying relationship. That doesn&#8217;t mean the crime committed isn&#8217;t prosecutable. <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-732\" target=\"_blank\" rel=\"noopener\"><u>Stalking is still stalking<\/u><\/a>, whether the people involved are <span data-term-id=\"39056181\">family members<\/span> or strangers. <span data-term-id=\"39056165\">Menacing<\/span> is still a <span data-term-id=\"39056208\">class A<\/span> <span data-term-id=\"39056151\">misdemeanor<\/span>, whether classified as <span data-term-id=\"39056141\">domestic violence<\/span> or not. The difference is in which <span data-term-id=\"39056143\">restraining orders<\/span> are available and what penalties apply.<\/p>\n<h3><span data-term-id=\"39056141\">Domestic Violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span>: Family and <span data-term-id=\"39056147\">Household Members<\/span><\/h3>\n<p>Committing an abusive act is only half of the equation for <span data-term-id=\"39056141\">domestic violence<\/span> in <span data-term-id=\"39056139\">Oregon<\/span>. The people involved must share one of <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-705\/\" target=\"_blank\" rel=\"noopener\"><u>a group of qualifying relationships<\/u><\/a>. These associations are any of the following:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39056161\">Former spouses<\/span><\/li>\n<li>Parents of a child<\/li>\n<li>Family by consanguinity (blood relatives)<\/li>\n<li>Family by marriage (in-laws or stepfamily)<\/li>\n<li>Family by adoption<\/li>\n<li>Persons involved in a <span data-term-id=\"39056157\">sexually intimate relationship<\/span> with each other within two years before a filing<\/li>\n<li>Persons who are <span data-term-id=\"39056195\">cohabitating<\/span><\/li>\n<li>Persons who have cohabited with each other<\/li>\n<\/ul>\n<p><span data-term-id=\"39056169\">Unmarried parents of a minor child<\/span> could experience <span data-term-id=\"39056141\">domestic violence<\/span> with each other, but coworkers who are casual friends can&#8217;t. Victims of <span data-term-id=\"39056211\">domestic abuse<\/span> have access to <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\"><u>certain protections and programs<\/u><\/a> designed just for them.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/or\/title-14-procedure-in-criminal-matters-generally\/or-rev-st-sect-137-540\/\" target=\"_blank\" rel=\"noopener\"><u>Probation is an option<\/u><\/a> for first-time <span data-term-id=\"39056141\">domestic violence<\/span> offenders in the <span data-term-id=\"39056201\">state of <\/span><span data-term-id=\"39056139\">Oregon<\/span>. Whether it&#8217;s offered depends on the criminal acts involved and if the court feels the threat of abuse is still present. Conditions of probation can include a mandatory mental health evaluation or offender treatment programs.<\/p>\n<h2><span data-term-id=\"39056197\">Oregon<\/span> <span data-term-id=\"39056197\">Domestic Violence<\/span><span data-term-id=\"39056197\"> Laws<\/span>: Protections, Programs, and Other Aids<\/h2>\n<p>If the abuser, victim, and crime fit the definition, a <span data-term-id=\"39056141\">domestic violence<\/span> crime can occur. This unlocks access to protections designed for <span data-term-id=\"39056141\">domestic violence<\/span> victims. A victim who has suffered abuse within the past 180 days can petition <a href=\"https:\/\/www.courts.oregon.gov\/courts\/Pages\/locations.aspx\" target=\"_blank\" rel=\"noopener\"><u>the circuit court<\/u><\/a> for relief through a <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><u>Family Abuse Prevention Act <span data-term-id=\"39056143\">restraining order<\/span><\/u><\/a>. It&#8217;s also referred to as a FAPA <span data-term-id=\"39056143\">restraining order<\/span>.<\/p>\n<p>The victim (petitioner) begins by <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><u>applying for a <span data-term-id=\"39056143\">restraining order<\/span><\/u><\/a>. The <span data-term-id=\"39056201\">state of <\/span><span data-term-id=\"39056139\">Oregon<\/span> suggests getting help from a <a href=\"https:\/\/www.doj.state.or.us\/crime-victims\/resources\/county-victim-assistance-programs\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39056141\">domestic violence<\/span> advocate<\/u><\/a> or <a href=\"https:\/\/www.doj.state.or.us\/crime-victims\/victims-services\/get-legal-help\/\" target=\"_blank\" rel=\"noopener\"><u>legal aid<\/u><\/a>. You&#8217;ll include an affidavit with your forms stating what abuse you suffered and when it occurred. There is no fee for filing for a FAPA <span data-term-id=\"39056143\">restraining order<\/span>.<\/p>\n<p>The court will often review your petition on the day it&#8217;s filed. The judge may ask you questions. If the court agrees that the threat of further <span data-term-id=\"39056141\">domestic violence<\/span> exists, a temporary ex parte FAPA <span data-term-id=\"39056143\">restraining order<\/span> is issued. The abuser (respondent) is not contacted before the order (ex parte). It goes into effect as soon as your abuser is <a href=\"https:\/\/oregon.public.law\/rules-of-civil-procedure\/orcp-7-summons\/\" target=\"_blank\" rel=\"noopener\"><u>served with the order<\/u><\/a>. Service is often done by an <span data-term-id=\"39056139\">Oregon<\/span> sheriff. The petitioner cannot serve the respondent themselves.<\/p>\n<p>Your temporary FAPA order will have conditions tailored to what you ask for and what the court feels you need for your safety. These provisions include:<\/p>\n<ul>\n<li>The petitioner is granted temporary custody of the children of the parties, with visitation set or revoked by the court<\/li>\n<li>The respondent must move from the petitioner&#8217;s residence if shared<\/li>\n<li>The respondent cannot enter or attempt to enter the petitioner&#8217;s residence<\/li>\n<li>An <span data-term-id=\"39056139\">Oregon<\/span> peace officer must accompany the party leaving a shared residence to remove essential personal effects of the party, including legal paperwork<\/li>\n<li>The respondent cannot menace, intimidate, interfere with, or molest the petitioner<\/li>\n<li>The respondent cannot attempt to menace, intimidate, interfere with, or molest the petitioner<\/li>\n<li>The respondent cannot menace, intimidate, interfere with, or molest any children in the custody of the petitioner<\/li>\n<li>The respondent cannot attempt to menace, intimidate, interfere with, or molest any children in the custody of the petitioner<\/li>\n<li>The respondent cannot menace, intimidate, interfere with, or molest the petitioner at any location, including a workplace or school<\/li>\n<li>The respondent cannot attempt to menace, intimidate, interfere with, or molest the petitioner at any location, including a workplace or school<\/li>\n<\/ul>\n<p>The order may include any, all, or none of the above conditions. The court can add any provision it considers necessary for the victim&#8217;s safety.<\/p>\n<p>The temporary order is in effect for up to 180 days or until a case hearing takes place. Once served, the respondent has 30 days to request a court hearing if they plan on contesting the order. The <a href=\"https:\/\/oregon.public.law\/rules-of-civil-procedure\/orcp-7-summons\/\" target=\"_blank\" rel=\"noopener\"><u>hearing is scheduled within 21 days<\/u><\/a> of the request. If temporary child custody is involved, the hearing must take place within five days.<\/p>\n<p>If the court believes the child custody issue is pressing, it can order an <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\"><u>exceptional circumstances hearing<\/u><\/a>. This can happen when the normal custody arrangement is in question. The judge hears arguments from both sides and issues a temporary custody order.<\/p>\n<p>At the court hearing for the FAPA <span data-term-id=\"39056143\">restraining order<\/span>, the participants state their case, have witnesses testify, and present evidence. Some or all of this can be done remotely. If the court believes the respondent is still a threat, a final FAPA <span data-term-id=\"39056143\">restraining order<\/span> is issued. As of the beginning of 2024, the duration of a final <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\"><u>FAPA <span data-term-id=\"39056143\">restraining order<\/span> was increased to two years<\/u><\/a>.<\/p>\n<p>The court can add or amend conditions from the temporary order as it becomes permanent. <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-725\/\" target=\"_blank\" rel=\"noopener\"><u>Renewal for another two years<\/u><\/a> is permitted. Any FAPA order issued is sent to the <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-720\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39056139\">Oregon<\/span> <span data-term-id=\"39056155\">Law Enforcement<\/span> Data System and NCIC at the Department of Justice<\/u><\/a>.<\/p>\n<p>Orders issued in <span data-term-id=\"39056139\">Oregon<\/span> are valid in any US state or territory, as well as on tribal reservations. This is due to <span data-term-id=\"39056206\">federal law<\/span> under the <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\"><u>Violence Against Women Act (VAWA)<\/u><\/a>.<\/p>\n<p>Violations of FAPA <span data-term-id=\"39056143\">restraining orders<\/span> carry serious penalties. Any violation is a <a href=\"https:\/\/codes.findlaw.com\/or\/title-3-remedies-and-special-actions-and-proceedings\/or-rev-st-sect-33-105\/\" target=\"_blank\" rel=\"noopener\"><u>contempt of court charge<\/u><\/a> that carries a maximum jail term of up to six months and a fine of up to $500. The offender also faces punishment for the crimes committed during the violation. Some charges <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-192\/\" target=\"_blank\" rel=\"noopener\"><u>carry enhanced penalties<\/u><\/a>.<\/p>\n<p><span data-term-id=\"39056139\">Oregon<\/span> peace officers receive special training for handling <span data-term-id=\"39056211\">domestic abuse<\/span> situations. If a <span data-term-id=\"39056191\">police officer<\/span> witnesses an act of <span data-term-id=\"39056141\">domestic violence<\/span> or believes <span data-term-id=\"39056211\">domestic abuse<\/span> has occurred, <a href=\"https:\/\/codes.findlaw.com\/or\/title-14-procedure-in-criminal-matters-generally\/or-rev-st-sect-133-310\/\" target=\"_blank\" rel=\"noopener\"><u>they are required by law to arrest the abuser<\/u><\/a>. <span data-term-id=\"39056167\">Mandatory arrests<\/span> are intended to remove the immediate threat of <span data-term-id=\"39056141\">domestic violence<\/span>.<\/p>\n<p>It&#8217;s common to be unsure which <span data-term-id=\"39056143\">restraining order<\/span> you&#8217;re eligible for. They are required to give the landlord 14 days&#8217; notice and proof of their FAPA order. Victims are responsible for all outstanding rent due. This law also covers victims of <span data-term-id=\"39056153\">sexual assault<\/span> and stalking.<\/p>\n<h3>Address Confidentiality Program<\/h3>\n<p>Fleeing an abuser can seem pointless if they can find your new home through legal documents. <span data-term-id=\"39056139\">Oregon<\/span>&#8216;s <a href=\"https:\/\/www.doj.state.or.us\/crime-victims\/victims-services\/address-confidentiality-program-acp\/\" target=\"_blank\" rel=\"noopener\"><u>Address Confidentiality Program (ACP)<\/u><\/a> helps keep victims\u2019 new addresses hidden. It does this by issuing them a second address that&#8217;s used for all state and legal documents.<\/p>\n<p>First-class mail is forwarded to the actual address, and there&#8217;s no fee for the service. The <a href=\"https:\/\/www.doj.state.or.us\/wp-content\/uploads\/2024\/01\/ACP-Participant-Guide.pdf\" target=\"_blank\" rel=\"noopener\"><u>ACP is also available for victims<\/u><\/a> of <span data-term-id=\"39056153\">sexual assault<\/span>, stalking, hate and bias crimes, and human trafficking.<\/p>\n<h3>The Hope Card Program<\/h3>\n<p><span data-term-id=\"39056139\">Oregon<\/span>&#8216;s Hope Card allows a <a href=\"https:\/\/www.doj.state.or.us\/crime-victims\/victims-services\/hope-card-program\/\" target=\"_blank\" rel=\"noopener\"><u>victim to carry pertinent information about their FAPA <span data-term-id=\"39056143\">restraining order<\/span><\/u><\/a> on a wallet-sized card. It contains the following:<\/p>\n<ul>\n<li>Name of the petitioner (victim\/survivor)<\/li>\n<li>Name and date of birth of the respondent (the person who is restricted from making contact with the petitioner)<\/li>\n<li>Court case number<\/li>\n<li>Date the order was issued<\/li>\n<li>Date the order expires<\/li>\n<li>Names of additional persons protected by the order<\/li>\n<li>Any other essential information about the <span data-term-id=\"39056145\">protective order<\/span><\/li>\n<\/ul>\n<p>This makes it easier for\u00a0<span data-term-id=\"39056155\">law enforcement<\/span>\u00a0to quickly understand your order. There&#8217;s no fee for the Hope Card.
