Some orders address other issues as well.<\/p>\n\n        <\/div>\n    <\/div>\n<\/div>\n\n\n<p><span data-term-id=\"39269628\">Oregon<\/span> has five different <span data-term-id=\"39269629\">restraining orders<\/span> that victims or their guardians can apply for. Knowing which order you need can be confusing. In this guide, we&#8217;ll examine <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/forms\/pages\/protective-orders.aspx\" target=\"_blank\" rel=\"noopener\">each of the orders<\/a>, explain how they work, and show you how to apply through the <span data-term-id=\"39269628\">Oregon<\/span> court system.<\/p>\n<h2><strong><span data-term-id=\"39269628\">Oregon<\/span> <span data-term-id=\"39269630\">Protective Orders<\/span> Law: <span data-term-id=\"39269634\">Family Abuse Prevention Act<\/span> <span data-term-id=\"39269629\">Restraining Orders<\/span> (<span data-term-id=\"39269632\">FAPA<\/span>), <span data-term-id=\"39269638\">Sexual Abuse <\/span><span data-term-id=\"39269630\">Protection Orders<\/span> (<span data-term-id=\"39269641\">SAPO<\/span>), and <span data-term-id=\"39269635\">Stalking <\/span><span data-term-id=\"39269630\">Protection Orders<\/span> (SPO)<\/strong><\/h2>\n<p>Of the five <span data-term-id=\"39269630\">protective orders<\/span> available in <span data-term-id=\"39269628\">Oregon<\/span>, three operate in a similar manner. While differing in eligible participants and scope of offenses, these <span data-term-id=\"39269629\">restraining orders<\/span> use the <a href=\"https:\/\/oregonlawhelp.org\/topics\/safety\/restraining-orders-oregon\" target=\"_blank\" rel=\"noopener\">same application process and basic functionality<\/a>. Let&#8217;s examine the details of each order before showing how to get one.<\/p>\n<h3><strong><span data-term-id=\"39269634\">Family Abuse Prevention Act<\/span> <span data-term-id=\"39269629\">Restraining Orders<\/span> (<span data-term-id=\"39269632\">FAPA<\/span>)<\/strong><\/h3>\n<p>An <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269628\">Oregon<\/span> <span data-term-id=\"39269634\">Family Abuse Prevention Act<\/span> <span data-term-id=\"39269629\">restraining order<\/span> (<span data-term-id=\"39269632\">FAPA<\/span>)<\/a> protects victims of <span data-term-id=\"39269631\">domestic violence<\/span> or domestic abuse. <span data-term-id=\"39269631\">Domestic violence<\/span> crimes require two qualifying factors. The people involved are categorized as <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-705\/#:~:text=Family%20or%20household%20members%E2%80%9D%20means%20any%20of%20the%20following\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269640\">family members<\/span> and <span data-term-id=\"39269643\">household members<\/span><\/a>. These include:<\/p>\n<ul>\n<li>Spouses and <span data-term-id=\"39269666\">former spouses<\/span><\/li>\n<li>Family related by blood, marriage, or adoption<\/li>\n<li>Parents of a child<\/li>\n<li>Persons who are cohabiting or who have cohabited with each other<\/li>\n<li>Persons who have been involved in a sexually intimate relationship with each other within two years before a filing (<span data-term-id=\"39269647\">intimate partners<\/span>)<\/li>\n<\/ul>\n<p>The other requirement is for the crime to fall into one of the categories that <span data-term-id=\"39269628\">Oregon<\/span> considers <span data-term-id=\"39269631\">domestic violence<\/span>. These <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-705\/#:~:text=Abuse%E2%80%9D%20means%20the%20occurrence%20of%20one%20or%20more%20of%20the%20following%20acts%20between%20family%20or%20household%20members%3A\" target=\"_blank\" rel=\"noopener\">abusive act categories<\/a> are:<\/p>\n<ul>\n<li>Causing or attempting to cause bodily injury with intent<\/li>\n<li>Placing another in fear of imminent bodily injury with intent<\/li>\n<li>Using force or threat of force to cause a victim to engage in involuntary sexual relations<\/li>\n<\/ul>\n<p>If a spouse assaults their spouse, it&#8217;s <span data-term-id=\"39269631\">domestic violence<\/span> under <span data-term-id=\"39269645\">Oregon<\/span><span data-term-id=\"39269645\"> law<\/span>. If a <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-732\" target=\"_blank\" rel=\"noopener\">victim is stalked<\/a> by someone they don&#8217;t know, it&#8217;s not <span data-term-id=\"39269631\">domestic violence<\/span>. It&#8217;s still a crime and subject to prosecution, but <span data-term-id=\"39269631\">domestic violence<\/span> can&#8217;t occur between strangers.<\/p>\n<p>Provisions in a <span data-term-id=\"39269632\">FAPA<\/span> <span data-term-id=\"39269629\">restraining order<\/span> have a much broader scope than those of stalking or <span data-term-id=\"39269638\">sexual abuse <\/span><span data-term-id=\"39269630\">protective orders<\/span>. Since the victim and the abuser share a close personal relationship, <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269632\">FAPA<\/span> <span data-term-id=\"39269629\">restraining orders<\/span><\/a> are tailored to the victim&#8217;s needs. This means the order can go beyond no-contact and stay-away orders. These can include:<\/p>\n<ul>\n<li>Granting the petitioner (victim) <span data-term-id=\"39269644\">temporary custody<\/span> of the children of the parties, with visitation set or revoked by the court<\/li>\n<li>Ordering the <span data-term-id=\"39269633\">respondent<\/span> (abuser) to vacate a shared dwelling and not return<\/li>\n<li>Ordering the <span data-term-id=\"39269633\">respondent<\/span> not to menace, intimidate, interfere with, or molest the petitioner or any minor children<\/li>\n<li>Ordering the <span data-term-id=\"39269633\">respondent<\/span> not to attempt to menace, intimidate, interfere with, or molest the petitioner or any minor children<\/li>\n<li>Ordering the <span data-term-id=\"39269633\">respondent<\/span> to stay away from the petitioner&#8217;s residence, workplace, school, and any other location named in the order<\/li>\n<li>Awarding the petitioner <span data-term-id=\"39269644\">temporary custody<\/span> of minor children<\/li>\n<li>Ordering the <span data-term-id=\"39269633\">respondent<\/span> to pay temporary child support<\/li>\n<\/ul>\n<p>This is not an exhaustive list. The order can use some, all, or none of the provisions listed. The court can add any condition it considers necessary. When child custody is involved, the court can order an <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\">exceptional circumstances hearing<\/a> to expedite a temporary order.<\/p>\n<p>Temporary <span data-term-id=\"39269632\">FAPA<\/span> <span data-term-id=\"39269629\">restraining orders<\/span> last 30 to 51 days or until a full <span data-term-id=\"39269651\">court hearing<\/span>. If a final <span data-term-id=\"39269670\">FAPA<\/span><span data-term-id=\"39269670\"> order<\/span> is issued, it <a href=\"https:\/\/codes.findlaw.com\/or\/title-11-domestic-relations\/or-rev-st-sect-107-718.html\/\" target=\"_blank\" rel=\"noopener\">lasts up to two years and is renewable<\/a>.<\/p>\n<h3><strong><span data-term-id=\"39269638\">Sexual Abuse <\/span><span data-term-id=\"39269630\">Protection Order<\/span> (<span data-term-id=\"39269641\">SAPO<\/span>)<\/strong><\/h3>\n<p>Victims of sexual abuse who aren&#8217;t family or <span data-term-id=\"39269643\">household members<\/span> of their assailant are eligible for an <span data-term-id=\"39269628\">Oregon<\/span> <span data-term-id=\"39269638\">sexual abuse <\/span><span data-term-id=\"39269630\">protection order<\/span> (<span data-term-id=\"39269641\">SAPO<\/span>). If sexual abuse occurs between people with a close personal relationship, the victim might need to file for a <span data-term-id=\"39269632\">FAPA<\/span> <span data-term-id=\"39269629\">restraining order<\/span> instead. Under <span data-term-id=\"39269645\">Oregon<\/span><span data-term-id=\"39269645\"> law<\/span>, <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-760\" target=\"_blank\" rel=\"noopener\">sexual abuse is considered<\/a> sexual contact with:<\/p>\n<ul>\n<li>Someone who doesn&#8217;t consent to the sexual contact<\/li>\n<li>Someone <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-315\/\" target=\"_blank\" rel=\"noopener\">incapable of consenting<\/a> due to age, mental incapacity, physical helplessness, or other reasons<\/li>\n<\/ul>\n<p>Provisions in a <span data-term-id=\"39269641\">SAPO<\/span> focus on keeping the assailant away from the victim. All\u00a0<span data-term-id=\"39269641\">SAPOs<\/span>\u00a0issued orders to the\u00a0<span data-term-id=\"39269633\">respondent<\/span>\u00a0(assaulter) to\u00a0<a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-765\/#:~:text=Shall%20enter%20an%20order%20restraining%20the%20respondent%20from%20contacting%20the%20petitioner%20and%20from%20intimidating%2C%20molesting%2C%20interfering%20with%20or%20menacing%20the%20petitioner%2C%20or%20attempting%20to%20intimidate%2C%20molest%2C%20interfere%20with%20or%20menace%20the%20petitioner\" target=\"_blank\" rel=\"noopener\">have no contact with the petitioner (victim)<\/a>\u00a0and not to intimidate, molest, interfere with, or menace them. Petitioners can also request that the no-contact and stay-away provisions be expanded to cover children, <span data-term-id=\"39269640\">family members<\/span>, and <span data-term-id=\"39269643\">household members<\/span>.<\/p>\n<p>A temporary <span data-term-id=\"39269641\">SAPO<\/span> lasts 30 to 51 days or until the <span data-term-id=\"39269651\">court hearing<\/span> for a final order. If the court issues the final order, <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-765\/\" target=\"_blank\" rel=\"noopener\">it lasts up to five years<\/a>. The court can make the order permanent if the offense involved rape in the third degree, sexual misconduct, or if the <span data-term-id=\"39269633\">respondent<\/span> presents an extreme threat.<\/p>\n<h3><span data-term-id=\"39269635\">Stalking <\/span><span data-term-id=\"39269630\">Protection Order<\/span> (SPO)<\/h3>\n<p>Victims of stalking in <span data-term-id=\"39269628\">Oregon<\/span> can apply for a <span data-term-id=\"39269635\">stalking <\/span><span data-term-id=\"39269630\">protection order<\/span> (SPO). This order is available to those who have suffered <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-730\" target=\"_blank\" rel=\"noopener\">repeated instances of <span data-term-id=\"39269652\">unwanted contact<\/span><\/a> from their stalker. This behavior can cause the victim to have fear for themselves and others in their household and keep them restrained or dominated.<\/p>\n<p>Stalking <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-730\" target=\"_blank\" rel=\"noopener\">covers a broad range of abusive acts<\/a> under <span data-term-id=\"39269645\">Oregon<\/span><span data-term-id=\"39269645\"> law<\/span>. These include, but are not limited to, the following:<\/p>\n<ul>\n<li>Following the victim<\/li>\n<li>Waiting for the victim at their home, workplace, school, or other location<\/li>\n<li>Making <span data-term-id=\"39269652\">unwanted contact<\/span> through any medium<\/li>\n<li>Disclosing personal intimate images to others<\/li>\n<li>Damaging any property of the victim<\/li>\n<li>Communicating with a third party to affect their relationship with the victim<\/li>\n<\/ul>\n<p>Most repeated behaviors that cause a victim fear or disrupt their life may qualify as stalking. <span data-term-id=\"39269635\">Stalking <\/span><span data-term-id=\"39269630\">protective orders<\/span> are designed to act as a buffer between the victim and the stalker. An SPO forbids the stalker from <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-738\/#:~:text=the%20court%20shall%20specify%20the%20conduct%20from%20which%20the%20respondent%20is%20to%20refrain%2C%20which%20may%20include%20all%20contact\" target=\"_blank\" rel=\"noopener\">having or attempting to have any contact with the victim<\/a>. It also forbids further stalking.<\/p>\n<p>SPOs can force a stalker to surrender all firearms and submit to a mental health evaluation. Temporary SROs last 30 days or until the full <span data-term-id=\"39269651\">court hearing<\/span>. A final <span data-term-id=\"39269635\">stalking <\/span><span data-term-id=\"39269630\">protective order<\/span> <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-738\/#:~:text=The%20order%20is%20of%20unlimited%20duration%20unless%20limited%20by%20law\" target=\"_blank\" rel=\"noopener\">has no <span data-term-id=\"39269648\">expiration<\/span> date unless<\/a> the court specifies one.<\/p>\n<h3>Getting a <span data-term-id=\"39269632\">FAPA<\/span>, <span data-term-id=\"39269641\">SAPO<\/span>, or SPO<\/h3>\n<p>These three <span data-term-id=\"39269630\">protection orders<\/span> are obtained through an <span data-term-id=\"39269628\">Oregon<\/span> <span data-term-id=\"39269642\">circuit court<\/span>. Although the orders differ, the process for obtaining them is similar. The first step is filling out the proper forms. If possible, seek assistance from a\u00a0<a href=\"https:\/\/www.ocadsv.org\/find-help\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269631\">domestic violence<\/span>\u00a0advocate<\/a>\u00a0for\u00a0this part. Their experience can make it much easier.<\/p>\n<p>These orders use different forms. The forms are available at the <span data-term-id=\"39269642\">circuit court<\/span> clerk&#8217;s office or online:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/Pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269634\">Family Abuse Prevention Act<\/span> (<span data-term-id=\"39269632\">FAPA<\/span>) <span data-term-id=\"39269629\">Restraining Orders<\/span><\/a><\/li>\n<li><a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/Pages\/sexual-abuse.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269638\">Sexual Abuse <\/span><span data-term-id=\"39269630\">Protection Orders<\/span> (<span data-term-id=\"39269641\">SAPO<\/span>)<\/a><\/li>\n<li><a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/Pages\/stalking.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39269635\">Stalking <\/span><span data-term-id=\"39269630\">Protection Orders<\/span><\/a><\/li>\n<\/ul>\n<p>The court clerk takes the finished forms to a judge, who may ask you additional questions. If the court agrees there&#8217;s an existing threat of further abuse, a temporary <span data-term-id=\"39269630\">protection order<\/span> is issued. <span data-term-id=\"39269637\">Law enforcement<\/span> will serve a <span data-term-id=\"39269661\">copy of the order<\/span> to the abuser. The <span data-term-id=\"39269633\">respondent<\/span> (abuser) has <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-765\/\" target=\"_blank\" rel=\"noopener\">30 days to request a hearing, which must take place within 21 days of the request<\/a>.<\/p>\n<p>At the final hearing, both sides can present evidence, call witnesses, and plead their cases. If the petitioner fears for their safety, the court may allow them to appear remotely. The petitioner <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-765\/\" target=\"_blank\" rel=\"noopener\">must prove the <span data-term-id=\"39269633\">respondent<\/span> is an ongoing threat to their safety<\/a>. If they do so, the final <span data-term-id=\"39269630\">protective order<\/span> is issued and goes into effect.<\/p>\n<h2><span data-term-id=\"39269628\">Oregon<\/span> <span data-term-id=\"39269630\">Protective Orders<\/span> Laws: Other Available Orders<\/h2>\n<p>There are two other <span data-term-id=\"39269630\">protection orders<\/span> available in <span data-term-id=\"39269628\">Oregon<\/span>. They both focus on very narrow circumstances.<\/p>\n<h3><strong><span data-term-id=\"39269649\">Elderly Persons<\/span> and <span data-term-id=\"39269664\">Persons with <\/span><span data-term-id=\"39269664\">Disabilities<\/span><span data-term-id=\"39269664\"> Abuse Prevention Act<\/span> <span data-term-id=\"39269629\">Restraining Orders<\/span> (<span data-term-id=\"39269646\">EPPDAPA<\/span>)<\/strong><\/h3>\n<p>An <span data-term-id=\"39269649\">Elderly Persons<\/span> and <span data-term-id=\"39269664\">Persons with <\/span><span data-term-id=\"39269664\">Disabilities<\/span><span data-term-id=\"39269664\"> Abuse Prevention Act<\/span> <span data-term-id=\"39269629\">restraining order<\/span> (<span data-term-id=\"39269646\">EPPDAPA<\/span>) is designed to help <a href=\"https:\/\/codes.findlaw.com\/or\/title-13-protective-proceedings-powers-of-attorney-trusts\/or-rev-st-sect-124-005\/\" target=\"_blank\" rel=\"noopener\">certain vulnerable groups of people gain protection from abuse<\/a>. This includes the following:<\/p>\n<ul>\n<li>People 65 years of age or older<\/li>\n<li>People with a physical or mental impairment that limits major life activities<\/li>\n<li>People suffering from brain injuries<\/li>\n<\/ul>\n<p><span data-term-id=\"39269646\">EPPDAPA<\/span> orders are intended to keep the abuser away from the victim, but <a href=\"https:\/\/codes.findlaw.com\/or\/title-13-protective-proceedings-powers-of-attorney-trusts\/or-rev-st-sect-124-020.html\/\" target=\"_blank\" rel=\"noopener\">can also enact other conditions as well<\/a>.
