State law requires at least two instances of <span data-term-id=\"40433077\">unwanted contact<\/span> that would make a reasonable person fear for their safety or the safety of their <span data-term-id=\"40433093\">immediate family<\/span> or household. Stalking can be charged as a <span data-term-id=\"40433083\">misdemeanor<\/span> or felony depending on <span data-term-id=\"40433095\">prior convictions<\/span> or violations of protective orders.<\/p>\n\n    <\/div>\n\n\n\n<p>Under <span data-term-id=\"40433085\">Oregon<\/span><span data-term-id=\"40433085\"> law<\/span>, stalking happens when a person knowingly alarms or <span data-term-id=\"40433106\">coerces<\/span> someone by repeatedly making <span data-term-id=\"40433077\">unwanted contact<\/span>, and it is reasonable for that person to have apprehension regarding their <span data-term-id=\"40433100\">personal safety<\/span>.<\/p>\n<p><span data-term-id=\"40433073\">Oregon<\/span>&#8216;s <span data-term-id=\"40433079\">stalking laws<\/span>, found at <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-163-732\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"40433073\">Oregon<\/span> Revised Statutes <span data-term-id=\"40433108\">ORS 163.732<\/span><\/u><\/a>, require:<\/p>\n<ul>\n<li>Repeated contact (two or more times)<\/li>\n<li>Contact that is unwanted<\/li>\n<li>Conduct that knowingly alarms or <span data-term-id=\"40433106\">coerces<\/span> the victim<\/li>\n<li>Reasonable apprehension regarding the <span data-term-id=\"40433100\">personal safety<\/span> of the victim or a <span data-term-id=\"40433051\">member of the victim<\/span>&#8216;s <span data-term-id=\"40433093\">immediate family<\/span> or household<\/li>\n<\/ul>\n<p>This article explains how stalking charges work in <span data-term-id=\"40433073\">Oregon<\/span>, the possible penalties, and common defenses. Each element must be proven beyond a reasonable doubt. If even one part is missing, the charge may not hold up in court.<\/p>\n<h3><strong>Repeated and <span data-term-id=\"40433077\">Unwanted Contact<\/span><\/strong><\/h3>\n<p>Under <span data-term-id=\"40433085\">Oregon<\/span><span data-term-id=\"40433085\"> law<\/span>, &#8220;repeated&#8221; means two or more contacts. The contact must be clearly unwanted, and the accused person must know (or reasonably should know) that it is unwanted. <span data-term-id=\"40433077\">Unwanted contact<\/span> can include following someone, showing up at their home or work, sending repeated messages, making repeated <span data-term-id=\"40433059\">phone calls<\/span>, or sending emails or other <span data-term-id=\"40433071\">electronic communications<\/span>. A single incident, even if upsetting, is usually not enough to qualify as stalking.<\/p>\n<h3><strong>Conduct That Knowingly Alarms or <span data-term-id=\"40433106\">Coerces<\/span><\/strong><\/h3>\n<p>The person must act knowingly, meaning they are aware of what they are doing. The conduct must actually alarm or <span data-term-id=\"40433106\">coerce<\/span> the victim. &#8220;Alarm&#8221; means to frighten or disturb someone, while &#8220;<span data-term-id=\"40433106\">coerce<\/span>&#8221; means to intimidate or pressure someone through fear. This is what separates stalking from accidental or unintentional repeated contact.<\/p>\n<h3><strong>Reasonable Apprehension Regarding <span data-term-id=\"40433100\">Personal Safety<\/span><\/strong><\/h3>\n<p>The alleged victim must have reasonable apprehension regarding their <span data-term-id=\"40433100\">personal safety<\/span> or the safety of a member of their <span data-term-id=\"40433093\">immediate family<\/span> or household (typically including spouses, children, parents, or people living in the same home). This apprehension must be objectively reasonable. In other words, a reasonable person in the same situation would also feel concerned about their safety and not just unusually sensitive or uncomfortable.<\/p>\n<p>It is also important to understand the difference between stalking and harassment <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-166-065\/https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-166-065\/\" target=\"_blank\" rel=\"noopener\">under<\/a> <a href=\"https:\/\/codes.findlaw.com\/or\/title-16-crimes-and-punishments\/or-rev-st-sect-166-065\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40433085\">Oregon<\/span><span data-term-id=\"40433085\"> law<\/span><\/a>. Harassment may involve offensive touching or abusive messages. Stalking, however, requires repeated contact combined with reasonable apprehension regarding <span data-term-id=\"40433100\">personal safety<\/span>. Some stalking cases may also involve <span data-term-id=\"40433087\">domestic violence<\/span> or <span data-term-id=\"40433061\">sexual violence<\/span>, depending on the facts.<\/p>\n<h2>Types of <span data-term-id=\"40433099\">Stalking Behaviors<\/span><\/h2>\n<p><span data-term-id=\"40433099\">Stalking behaviors<\/span> can take many forms. Common examples include:<\/p>\n<ul>\n<li>Following or surveillance<\/li>\n<li>Showing up at someone&#8217;s home or workplace<\/li>\n<li>Repeated <span data-term-id=\"40433059\">phone calls<\/span>, texts, or emails<\/li>\n<li>Harassment through <span data-term-id=\"40433097\">social media<\/span><\/li>\n<li>Using a GPS or other <span data-term-id=\"40433057\">positioning system<\/span> to track someone<\/li>\n<li>Sending unwanted gifts<\/li>\n<li>Contacting someone through third parties<\/li>\n<\/ul>\n<p><span data-term-id=\"40433073\">Oregon<\/span> does not have a separate cyberstalking charge. Online conduct and <span data-term-id=\"40433071\">electronic communications<\/span> can still qualify as stalking if they meet the legal definition.<\/p>\n<p>In some situations, victims of stalking <a href=\"https:\/\/codes.findlaw.com\/or\/title-3-remedies-and-special-actions-and-proceedings\/or-rev-st-sect-30-866\/\" target=\"_blank\" rel=\"noopener\">may also pursue civil remedies<\/a>. This allows for civil <span data-term-id=\"40433075\">stalking protective orders<\/span> and damages. Recent changes to <span data-term-id=\"40433085\">Oregon<\/span><span data-term-id=\"40433085\"> law<\/span>, including <a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2024R1\/Downloads\/MeasureDocument\/HB4156\/Introduced\" target=\"_blank\" rel=\"noopener\"><strong><u><span data-term-id=\"40433073\">Oregon<\/span> <span data-term-id=\"40433055\">House Bill 4156<\/span>,<\/u><\/strong><\/a> have updated parts of the stalking and protective order process.<\/p>\n<h2><span data-term-id=\"40433073\">Oregon<\/span> Stalking Penalties<\/h2>\n<p>Stalking may be charged as either a <span data-term-id=\"40433083\">misdemeanor<\/span> or a felony. The classification depends on factors such as the severity of the offense and whether it has occurred before.<\/p>\n<h3><strong><span data-term-id=\"40433096\">Class A<\/span> <span data-term-id=\"40433083\">Misdemeanor<\/span> (First Offense)<\/strong><\/h3>\n<p>A first stalking conviction is usually a <span data-term-id=\"40433096\">Class A<\/span> <span data-term-id=\"40433083\">misdemeanor<\/span>.<\/p>\n<p>Penalties may include:<\/p>\n<ul>\n<li>Up to 364 days in jail<\/li>\n<li>Up to $6,250 in fines<\/li>\n<li>Probation<\/li>\n<li>A no-contact order<\/li>\n<li>A required <span data-term-id=\"40433065\">mental health evaluation<\/span><\/li>\n<\/ul>\n<p>Judges in <span data-term-id=\"40433073\">Oregon<\/span>\u00a0<span style=\"margin: 0px;padding: 0px\"><a href=\"https:\/\/www.oregon.gov\/cjc\/resources\/documents\/guidelinesgrid.pdf\" target=\"_blank\" rel=\"noopener\"><u><strong>refer to the Oregon Criminal Justice Commission&#8217;s sentencing guidelines grid<\/strong><\/u><\/a><\/span>\u00a0when determining appropriate sentences.<\/p>\n<h3><strong><span data-term-id=\"40433091\">Class C Felony<\/span><\/strong><\/h3>\n<p>Stalking may be charged as a <span data-term-id=\"40433091\">Class C felony<\/span> if one or both of the following apply:<\/p>\n<ul>\n<li>There is a <span data-term-id=\"40433095\">prior conviction<\/span> for stalking<\/li>\n<li>The person violates a <span data-term-id=\"40433102\">court order<\/span>, such as a <span data-term-id=\"40433075\">stalking protective order<\/span> or <span data-term-id=\"40433081\">restraining order<\/span><\/li>\n<\/ul>\n<p>A <span data-term-id=\"40433091\">Class C felony<\/span> carries:<\/p>\n<ul>\n<li>Up to five years in prison<\/li>\n<li>Up to $125,000 in fines<\/li>\n<\/ul>\n<h2><span data-term-id=\"40433075\">Stalking Protective Orders<\/span> and <span data-term-id=\"40433081\">Restraining Orders<\/span><\/h2>\n<p>A <span data-term-id=\"40433075\">stalking <\/span><a href=\"https:\/\/www.findlaw.com\/state\/oregon-law\/oregon-protective-orders-laws.html\"><span data-term-id=\"40433075\">protective order<\/span><\/a> (SPO) is a <span data-term-id=\"40433102\">court order<\/span> that requires the alleged stalker (called the <span data-term-id=\"40433089\">respondent<\/span>) to stop contacting the victim.<\/p>\n<p>A <span data-term-id=\"40433075\">stalking protective order<\/span> may:<\/p>\n<ul>\n<li>Prohibit all contact<\/li>\n<li>Require the <span data-term-id=\"40433089\">respondent<\/span> to stay away from certain locations<\/li>\n<li>Be enforced by <span data-term-id=\"40433092\">law enforcement<\/span><\/li>\n<\/ul>\n<p>The process typically begins in <span data-term-id=\"40433073\">Oregon<\/span>&#8216;s <span data-term-id=\"40433094\">circuit court<\/span>, where a judge may hold a <span data-term-id=\"40433053\">court hearing<\/span> to decide whether the order should remain in place. A <span data-term-id=\"40433075\">stalking protective order<\/span> is different from a <span data-term-id=\"40433081\">restraining order<\/span> issued under the <a href=\"https:\/\/www.courts.oregon.gov\/programs\/family\/domestic-violence\/pages\/restraining.aspx\" target=\"_blank\" rel=\"noopener\"><strong><u><span data-term-id=\"40433098\">Family Abuse Prevention Act<\/span>,<\/u><\/strong><\/a> which usually applies in <span data-term-id=\"40433087\">domestic violence<\/span> situations.<\/p>\n<p>Violating a <span data-term-id=\"40433075\">stalking protective order<\/span> is a separate crime and can lead to arrest and additional penalties. The offender also faces charges for any criminal acts committed during the violation.<\/p>\n<h2>Related Offenses<\/h2>\n<p>Other charges may be filed along with stalking, including:<\/p>\n<ul>\n<li>Harassment<\/li>\n<li>Violation of a <span data-term-id=\"40433081\">restraining order<\/span><\/li>\n<li>Crimes involving <span data-term-id=\"40433087\">domestic violence<\/span> or <span data-term-id=\"40433061\">sexual violence<\/span><\/li>\n<li><span data-term-id=\"40433046\">Unlawful use<\/span> of a tracking device<\/li>\n<\/ul>\n<p>Each charge carries its own penalties and legal standards.<\/p>\n<h2>Common Defenses<\/h2>\n<p>Stalking is a heinous crime, but it can be misconstrued in some situations. Common defenses to stalking charges may include:<\/p>\n<ul>\n<li><strong>The contact was not intentional<\/strong>: If someone repeatedly encounters another person because they work in the same building or live in the same neighborhood, this may indicate the contact was coincidental rather than intentional\u00a0stalking<\/li>\n<li><strong>The contact was not clearly unwanted<\/strong>: If the alleged victim continued responding to messages or did not explicitly ask the person to stop contact, this could support the defense that the person did not know the contact was unwanted<\/li>\n<li><strong>The apprehension was not objectively reasonable<\/strong>: The defense may argue that a reasonable person in the victim&#8217;s situation would not have felt apprehension about their <span data-term-id=\"40433100\">personal safety<\/span>, such as with contact consisting only of friendly messages with no threats or intimidating language<\/li>\n<li><strong>There was only one incident (not repeated)<\/strong>: Since <span data-term-id=\"40433085\">Oregon<\/span><span data-term-id=\"40433085\"> law<\/span> requires two or more contacts, a single encounter, even if unwanted or upsetting, would not meet the legal definition of stalking<\/li>\n<li><strong>The conduct was protected by the Constitution<\/strong>: Some speech or conduct may be protected by the <a href=\"https:\/\/constitution.findlaw.com\/amendment1.html\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a>, such as peaceful protest, news gathering, or certain forms of expression<\/li>\n<\/ul>\n<h2>What You Should Know About <span data-term-id=\"40433079\">Stalking Laws<\/span> in <span data-term-id=\"40433073\">Oregon<\/span><\/h2>\n<p>Stalking charges in <span data-term-id=\"40433073\">Oregon<\/span> are serious.
