The unlawful distribution or trafficking of controlled substances and illegal drugs in the Commonwealth of Pennsylvania may lead to misdemeanor or felony charges.<\/p>\r\n<p>The state classifies drugs into <a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-104.html\" target=\"_blank\" rel=\"noopener\">one of five schedules<\/a>:<\/p>\r\n<ul>\r\n<li><b>Schedule I<\/b> drugs are those that have a high potential for abuse and no accepted medical use. Examples include heroin, marijuana, and MDMA.<\/li>\r\n<li><b>Schedule II<\/b> drugs have a high potential for abuse and physical or psychological dependence, but they also have some accepted medical uses. Examples include methamphetamine, fentanyl, and cocaine.<\/li>\r\n<li><b>Schedule III<\/b> drugs have a lower potential for abuse than Schedule I or II drugs and have well-documented accepted medical uses. Anabolic steroids are a Schedule III drug.<\/li>\r\n<li><b>Schedule IV<\/b> drugs have a relatively lower potential for abuse than Schedule III drugs. Examples include barbital and tramadol.<\/li>\r\n<li><b>Schedule V<\/b> drugs have a relatively lower potential for abuse and dependence than Schedule IV drugs. Examples include mixtures containing small amounts of codeine or opium.<\/li>\r\n<\/ul>\r\n<p>Criminal penalties for a distribution or trafficking conviction can range from a <a href=\"https:\/\/codes.findlaw.com\/pa\/title-18-pacsa-crimes-and-offenses\/pa-csa-sect-18-7508.html\" target=\"_blank\" rel=\"noopener\">30-day prison sentence to 30 years<\/a>. The state considers many factors to determine a criminal penalty, including the amount and type of drugs and who sold or trafficked them. Section 780-104<\/a> (<i>schedules of controlled substances<\/i>)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Pennsylvania Drug Distribution Offenses and Penalties<\/b><\/p>\r\n<\/th>\r\n<td><p>A person who engages in the following activities violates Pennsylvania\u2019s controlled substances laws:<\/p>\r\n<ul>\r\n<li>Selling, delivering, holding, or offering to sell a controlled substance, drug, device, or cosmetic that is adulterated or misbranded (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(1)<\/a>)<\/li>\r\n<li>Selling or dispensing a controlled substance, drug, device, or cosmetic with the knowledge that the trademark, trade name, or other identifying mark, imprint, or symbol is placed on it with the intent to defraud (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(7-8)<\/a>)<\/li>\r\n<li>The retail sale of a nonproprietary drug (except by a registered pharmacist in a licensed pharmacy or by a practitioner) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(10)<\/a>)<\/li>\r\n<li>Selling, dispensing, distributing, prescribing, or gifting a controlled substance by a practitioner to any person who they know or have reason to know is a drug-dependent person (unless the practitioner prescribes or otherwise gives the drug to them to cure or treat something other than drug dependency) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(13)<\/a>)<\/li>\r\n<li>A practitioner or professional assistant can only administer, dispense, deliver, gift, or prescribe a controlled substance if they do so in good faith in the course of the professional practice, within the scope of the patient relationship, and under treatment principles (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(14)<\/a>)<\/li>\r\n<li>The retail sale or dispensing of a Schedule II, III, or IV controlled substance to any person (unless the person who sold or dispensed it did so upon the written or oral prescription of a person licensed to prescribe it; this subsection does not apply to a licensed practitioner who keeps purchase and dispensing record regarding the date, name, and quantity of the drug dispensed, along with the patient\u2019s information) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(15)<\/a>)<\/li>\r\n<li>A practitioner authorized by law to dispense a controlled substance and who does so without affixing a label bearing the practitioner\u2019s name and address, the date dispensed, the patient\u2019s name, and the drug\u2019s directions (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(17)<\/a>)<\/li>\r\n<li>A pharmacy or distributor of a controlled substance or other drug that sells it without a label stating the drug\u2019s name and proportion or amount (unless the practitioner specifically directs them to do so in writing) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(18)<\/a>)<\/li>\r\n<li>A registrant who knowingly distributes a controlled substance to another registrant or other authorized person when their registration does not authorize them to distribute it (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(25)<\/a>)<\/li>\r\n<li>A registrant who knowingly distributes a Schedule I or II controlled substance (except pursuant to an order form as required by the Controlled Substance, Drug, Device and Cosmetic Act) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(26)<\/a>)<\/li>\r\n<li>Using a registration number in the course of distributing a controlled substance that is fictitious, revoked, suspended, or issued to another person (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(27)<\/a>)<\/li>\r\n<li>Delivering or possessing a controlled substance with the intent to deliver (PWID) it by a person who is not registered to deliver or possess it (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(30)<\/a>)<\/li>\r\n<li>Possessing a small amount of marijuana for personal use or with the intent to distribute it (but not to sell it). A small amount is 30 grams of marijuana (or eight grams of hashish) (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(31)<\/a>)<\/li>\r\n<li>Delivering (or possessing with the intent to deliver) drug paraphernalia while knowing (or under circumstances where one should reasonably know) that a person would use it to plant, cultivate, manufacture, produce, or store a controlled substance or ingest, inhale, or introduce it into the human body (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(33)<\/a>)<\/li>\r\n<li>Distributing, possessing with the intent to distribute, or selling a noncontrolled substance that has a stimulant or depressant effect (other than a prescription drug) that substantially resembles a specific controlled substance (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(35)<\/a>)<\/li>\r\n<li>Knowingly distributing (or possessing with the intent to distribute) a designer drug (<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-113(a)(36)<\/a>)<\/li>\r\n<li>Anyone who is at least 21 years old and is not a drug-dependent person who unlawfully distributes a controlled substance to someone who is under 18 years old and is at least four years younger than them(<a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-114.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-114<\/a>)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><b>Pennsylvania Criminal Penalties for Drug Trafficking and Distribution<\/b><p>&nbsp;<\/p>\r\n<\/th>\r\n<td><p>Upon conviction for violating the following laws, these criminal penalties apply:<\/p>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=The%20following%20acts%20and%20the%20causing%20thereof%20within%20the%20Commonwealth%20are%20hereby%20prohibited\" target=\"_blank\" rel=\"noopener\"><b>Manufacturing and sale of certain controlled substances<\/b><\/a>:<\/p>\r\n<ul>\r\n<li><b>First offense<\/b>: Up to one year of imprisonment and a fine of up to $5,000<\/li>\r\n<li><b>Subsequent drug offense<\/b>: Up to three years of imprisonment and a fine of up to $25,000<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=Placing%20or%20causing%20to%20be%20placed%20upon%20any%20controlled%20substance\" target=\"_blank\" rel=\"noopener\"><b>Selling controlled substances with misleading or fraudulent markings<\/b><\/a><b>:<\/b><\/p>\r\n<ul>\r\n<li><b>First offense<\/b>: Up to three years of imprisonment and a fine of up to $5,000<\/li>\r\n<li><b>Subsequent drug offense<\/b>: Up to three years of imprisonment and a fine of up to $25,000<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/\" target=\"_blank\" rel=\"noopener\"><b>Selling counterfeit controlled substances<\/b><\/a>:<\/p>\r\n<ul>\r\n<li><b>If the controlled substance involved was a Schedule I or II narcotic drug<\/b>: Up to 15 years of imprisonment and a fine of up to $250,000<\/li>\r\n<li><b>If the controlled substance involved was PCP, methamphetamine, cocaine, or over 1,000 pounds of marijuana<\/b>: Up to 10 years of imprisonment and a fine of up to $100,000<\/li>\r\n<li><b>If the controlled substance involved was any other Schedule I, II, or III drug<\/b>: Up to five years imprisonment and a fine of up to $15,000<\/li>\r\n<li><b>If the controlled substance involved was a Schedule IV drug<\/b>: Up to three years of imprisonment and a fine of up to $10,000<\/li>\r\n<li><b>If the controlled substance involved was a Schedule V drug<\/b>: Up to one year of imprisonment and a fine of up to $5,000<\/li>\r\n<li>Per <a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-114.html\" target=\"_blank\" rel=\"noopener\">\u00a7 780-114<\/a>, any person who is at least 21 years old and is not a drug-dependent person who is convicted of unlawfully distributing a controlled substance to someone who is under 18 years old and is at least four years younger than them is punishable by up to twice that of the above-noted term of imprisonments.<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=The%20manufacture%20of%20a%20controlled%20substance\" target=\"_blank\" rel=\"noopener\"><b>Illegal manufacturing or distributing by a registrant<\/b><\/a><b>:<\/b><\/p>\r\n<ul>\r\n<li>Up to three years of imprisonment and a fine of up to $25,000<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=For%20purposes%20of%20this%20subsection%2C%20thirty%20(30)%20grams%20of%20marihuana%20or%20eight%20(8)%20grams%20of%20hashish%20shall%20be%20considered%20a%20small%20amount%20of%20marihuana\" target=\"_blank\" rel=\"noopener\"><b>Small amounts of marijuana<\/b><\/a><b>:<\/b><\/p>\r\n<ul>\r\n<li>Up to 30 days of imprisonment and\/or a fine of up to $500<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=The%20delivery%20of%2C%20possession%20with%20intent%20to%20deliver%2C%20or%20manufacture%20with%20intent%20to%20deliver%2C%20drug%20paraphernalia\" target=\"_blank\" rel=\"noopener\"><b>Drug paraphernalia<\/b><\/a>:<\/p>\r\n<ul>\r\n<li>Up to one year of imprisonment and a fine of up to $2,500<\/li>\r\n<li>If the person delivered drug paraphernalia to someone under 18 years old and who is three or more years younger than the person: Up to two years of imprisonment and a fine of up to $5,000<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=Except%20as%20otherwise%20provided%20by%20law%2C%20manufacturing%2C%20processing%2C%20packaging%2C%20distributing%2C%20possessing\" target=\"_blank\" rel=\"noopener\"><b>Other stimulants or depressants<\/b><\/a>:<\/p>\r\n<ul>\r\n<li>Up to five years of imprisonment and a fine of up to $10,000<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/pa\/title-35-ps-health-and-safety\/pa-st-sect-35-780-113\/#:~:text=The%20knowing%20or%20intentional%20manufacture%2C%20distribution%2C%20possession%20with%20intent%20to%20distribute%2C%20or%20possession%20of%20a%20designer%20drug\" target=\"_blank\" rel=\"noopener\"><b>Designer drugs<\/b><\/a>:<\/p>\r\n<ul>\r\n<li>Up to fifteen years of imprisonment and a fine of up to $250,000<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Pennsylvania Mandatory Minimum Sentences<\/b><\/p>\r\n<\/th>\r\n<td><p>Notwithstanding the above criminal penalties, <a href=\"https:\/\/codes.findlaw.com\/pa\/title-18-pacsa-crimes-and-offenses\/pa-csa-sect-18-7508.html\" target=\"_blank\" rel=\"noopener\">18 Pa. C.S.A. \u00a7 7508<\/a> imposes mandatory minimum sentences and fines for convictions.
