Each state has its own <span data-term-id=\"41016239\">employment laws<\/span> that may strengthen these protections or address other, state-specific needs. This article discusses some of the federal protections but focuses on <span data-term-id=\"41016244\">Pennsylvania<\/span> <span data-term-id=\"41016239\">employment<\/span><span data-term-id=\"41016239\"> laws<\/span>.<\/p>\n<h2>Who Is Covered by <span data-term-id=\"41016244\">Pennsylvania<\/span> <span data-term-id=\"41016239\">Employment<\/span><span data-term-id=\"41016239\"> Laws<\/span>?<\/h2>\n<p>Not every worker is covered by all of the state\u2019s <span data-term-id=\"41016239\">employment laws<\/span>. Independent contractors don\u2019t have the same rights and protections as employees, and exempt employees aren\u2019t eligible to receive <span data-term-id=\"41016247\">overtime pay<\/span>. <span data-term-id=\"41016242\">State law<\/span> also includes special protections for <span data-term-id=\"41016243\">minors<\/span>. Some <span data-term-id=\"41016239\">employment laws<\/span> apply only to public employers, not <span data-term-id=\"41016265\">private employers<\/span>. Let\u2019s take a closer look at how some of <span data-term-id=\"41016236\">Pennsylvania<\/span>\u2019s <span data-term-id=\"41016239\">employment laws<\/span> work.<\/p>\n<h3>Employee vs. Independent Contractor<\/h3>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span> uses different legal standards to determine whether a worker is an employee or an\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/independent-contractors-overview.html\">independent contractor<\/a>, depending on the law at issue, which could be either wage and hour law, <span data-term-id=\"41016249\">unemployment compensation<\/span>, or <span data-term-id=\"41016241\">workers\u2019 compensation<\/span>. The court or enforcement agency will look beyond the contract language and consider the actual relationship between the worker and the hiring entity. Employers can\u2019t designate a worker as an independent contractor if they\u2019re actually an employee.<\/p>\n<h3>Exempt vs. Nonexempt Employees<\/h3>\n<p>The distinction between <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">exempt and nonexempt employees<\/a> is important. Exempt employees are not entitled to <span data-term-id=\"41016247\">overtime pay<\/span>. <span data-term-id=\"41016236\">Pennsylvania<\/span> law has the same salary threshold as the current federal provisions.<\/p>\n<p>Most exempt employees must be paid a salary, earn at least the required minimum, and perform duties that qualify for a specific <span data-term-id=\"41016277\">exemption<\/span>, such as executive, administrative, or professional work. Exempt employees are commonly known as \u201cwhite-collar\u201d employees. Although they are not entitled to <span data-term-id=\"41016247\">overtime pay<\/span>, exempt employees receive coverage from <span data-term-id=\"41016250\">payday<\/span> protections, workplace safety laws, and anti-discrimination laws.<\/p>\n<h2><span data-term-id=\"41016243\">Minor<\/span> Employees<\/h2>\n<p>In addition to the federal <span data-term-id=\"41016263\">child labor<\/span> requirements under the <span data-term-id=\"41016254\">FLSA<\/span>, the <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-40-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016236\">Pennsylvania<\/span> <span data-term-id=\"41016263\">Child Labor<\/span> Act<\/a> protects <span data-term-id=\"41016243\">minors<\/span> under 18 <span data-term-id=\"41016299\">years of age<\/span> by placing limits on their employment. Most employees 18 <span data-term-id=\"41016299\">years of age<\/span> and under must have a <span data-term-id=\"41016298\">work permit<\/span>. The state\u2019s absolute minimum age for most employment is 14 <span data-term-id=\"41016299\">years of age<\/span>, and parental consent is required for ages 14 to 16.<\/p>\n<p>A <span data-term-id=\"41016243\">minor<\/span>\u2019s <span data-term-id=\"41016275\">work hours<\/span> are limited by age, with stricter limits on <span data-term-id=\"41016262\">school days<\/span>. <span data-term-id=\"41016243\">Minor<\/span> employees may not perform certain dangerous work. For children working in the entertainment industry, a specific <span data-term-id=\"41016298\">work permit<\/span> issued by school authorities is required, and additional safeguards apply.<\/p>\n<h3><span data-term-id=\"41016236\">Pennsylvania<\/span> Civil Rights Laws<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/pennsylvania-law\/pennsylvania-civil-rights-laws.html\"><span data-term-id=\"41016236\">Pennsylvania<\/span> civil rights protections<\/a> are similar to <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/employees-rights-101.html\">federal civil rights laws<\/a>, with a few differences. The <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-952\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016256\">Pennsylvania<\/span><span data-term-id=\"41016256\"> Human Relations Act<\/span><\/a> (PHRA) protects citizens against <span data-term-id=\"41016300\">workplace discrimination<\/span> based on protected characteristics, including race, color, religion, ancestry, age, sex, <span data-term-id=\"41016251\">national origin<\/span>, disability, and the use and training of support animals. The PHRA also prohibits discrimination based on sexual orientation, gender identity, and gender expression. The federal Genetic Information Nondiscrimination Act of 2008 (GINA) protects genetic information, but the PHRA does not contain an equivalent statewide protection.<\/p>\n<p>While the primary <span data-term-id=\"41016238\">federal law<\/span> (Title VII of the Civil Rights Act of 1964) applies to employers with 15 or more employees and the Age Discrimination in Employment Act to employers with 20 or more, the PHRA offers broader coverage by including employers with four or more employees. Unlike federal protections, <span data-term-id=\"41016236\">Pennsylvania<\/span> does not allow punitive damages under the PHRA, which can result in lower awards.<\/p>\n<p>Before filing most employment discrimination lawsuits under the PHRA, an employee often must first file a charge with the <span data-term-id=\"41016236\">Pennsylvania<\/span> Human Relations Commission (PHRC). <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/filing-an-eeoc-complaint-or-charge.html\">Federal claims<\/a> have the same requirement with the Equal Employment Opportunity Commission (EEOC). The PHRC and EEOC have a cross-filing agreement, so filing with one agency often preserves claims with the other. Employees often bring both state and federal claims together to maximize the available protections and remedies.<\/p>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-336-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016272\">Equal Pay<\/span> Law<\/a> closely tracks the federal <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-and-discrimination-against-women.html\"><span data-term-id=\"41016272\">Equal Pay<\/span> Act of 1963<\/a>. Both laws prohibit employers from paying employees of one sex less than employees of the opposite sex for equal work, unless the pay difference is based on one of four lawful factors:<\/p>\n<ul>\n<li>Seniority system<\/li>\n<li>Merit system<\/li>\n<li>System that measures earnings by quantity or quality of production<\/li>\n<li>Any factor other than sex<\/li>\n<\/ul>\n<p>Those who feel they\u2019ve been discriminated against for any of the above reasons should consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/pennsylvania\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016244\">Pennsylvania<\/span><span data-term-id=\"41016244\"> employment<\/span> attorney<\/a>.<\/p>\n<h2><span data-term-id=\"41016236\">Pennsylvania<\/span> Leave Time<\/h2>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span> does not have a comprehensive statewide leave law for private-sector employees. <span data-term-id=\"41016242\">State law<\/span> provides protections for certain types of leave, but most employee leave rights are governed primarily by <span data-term-id=\"41016238\">federal law<\/span>, employer policies, and <span data-term-id=\"41016297\">collective bargaining<\/span> agreements.<\/p>\n<h3>Family and Medical Leave<\/h3>\n<p>For eligible <span data-term-id=\"41016282\">Pennsylvania<\/span><span data-term-id=\"41016282\"> employees<\/span> working for covered employers, the federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/family-and-medical-leave.html\"><span data-term-id=\"41016246\">Family and Medical Leave Act<\/span><\/a> (<span data-term-id=\"41016268\">FMLA<\/span>) is the primary source of family and medical leave protections. Under the <span data-term-id=\"41016268\">FMLA<\/span>, eligible employees of covered employers may take up to 12 weeks of job-protected, <span data-term-id=\"41016266\">unpaid leave<\/span> in a 12-month period for qualifying reasons. These may include the birth or adoption of a child, a serious health condition, or caring for certain <span data-term-id=\"41016259\">family members<\/span> with a serious health condition. The <span data-term-id=\"41016268\">FMLA<\/span> also provides up to 26 weeks of leave to care for a covered servicemember with a serious injury or illness.<\/p>\n<h3><span data-term-id=\"41016258\">Sick Leave<\/span><\/h3>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span> does not have a <span data-term-id=\"41016242\">state law<\/span> requiring employers to provide employees with <span data-term-id=\"41016276\">time off<\/span> for <span data-term-id=\"41016258\">sick leave<\/span>. <span data-term-id=\"41016258\">Sick leave<\/span> rights or protection may come from:<\/p>\n<ul>\n<li>Employer\u2019s policy or <span data-term-id=\"41016297\">collective bargaining<\/span> agreement<\/li>\n<li>Local laws, such as those in <span data-term-id=\"41016240\">Philadelphia<\/span> and <span data-term-id=\"41016267\">Pittsburgh<\/span><\/li>\n<li><span data-term-id=\"41016238\">Federal law<\/span> (such as the <span data-term-id=\"41016268\">FMLA<\/span> and the Americans with Disabilities Act)<\/li>\n<li>Other applicable <span data-term-id=\"41016239\">employment laws<\/span><\/li>\n<\/ul>\n<p><span data-term-id=\"41016265\">Private employers<\/span> are under no obligation to provide <span data-term-id=\"41016258\">sick leave<\/span>, but if it\u2019s part of their employee handbook, they must honor the terms.<\/p>\n<h3><span data-term-id=\"41016276\">Time Off<\/span> for <span data-term-id=\"41016245\">Jury Duty<\/span><\/h3>\n<p>In general, <span data-term-id=\"41016236\">Pennsylvania<\/span> law entitles employees to <a href=\"https:\/\/codes.findlaw.com\/pa\/title-42-pacsa-judiciary-and-judicial-procedure\/pa-csa-sect-42-4563\/\" target=\"_blank\" rel=\"noopener\">job-protected leave for jury service<\/a>, but certain smaller employers are exempt. <span data-term-id=\"41016265\">Private employers<\/span> aren\u2019t required by <span data-term-id=\"41016242\">state law<\/span> to pay employees for their <span data-term-id=\"41016245\">jury duty<\/span>. Whether <span data-term-id=\"41016245\">jury duty<\/span> leave is paid depends on the employer&#8217;s policy or other applicable agreements, such as an employment agreement or a <span data-term-id=\"41016297\">collective bargaining<\/span> agreement.<\/p>\n<h3><span data-term-id=\"41016278\">Military Leave<\/span><\/h3>\n<p><span data-term-id=\"41016278\">Military leave<\/span> protections for Pennsylvanians are mostly found under <span data-term-id=\"41016238\">federal law<\/span>. The <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/military-leave-law.html\">Uniformed Services Employment and Reemployment Rights Act<\/a> (USERRA) provides <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/military-service-benefits-scra-and-userra.html\">job protection and reemployment rights<\/a> for members of the uniformed services. The law also prohibits employers from discriminating against employees who serve in the military. USERRA applies to all employers, regardless of the business\u2019s size. <span data-term-id=\"41016236\">Pennsylvania<\/span> law also provides certain reemployment rights and <span data-term-id=\"41016278\">military leave<\/span> protections in specific circumstances, but these provisions are more limited in scope than USERRA and don\u2019t create a general paid <span data-term-id=\"41016278\">military leave<\/span> requirement for <span data-term-id=\"41016265\">private employers<\/span>.<\/p>\n<h2>Statutory Income Protections for Employees<\/h2>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span>\u2019s <span data-term-id=\"41016253\">Department of Labor<\/span> and Industry administers two primary wage replacement programs for workers. <span data-term-id=\"41016241\">Workers&#8217; compensation<\/span> provides benefits for work-related injuries and illnesses, while <span data-term-id=\"41016249\">unemployment compensation<\/span> provides temporary income to eligible workers who lose their jobs through no fault of their own.<\/p>\n<h3><span data-term-id=\"41016241\">Workers\u2019 Compensation<\/span><\/h3>\n<p>Most <span data-term-id=\"41016244\">Pennsylvania<\/span><span data-term-id=\"41016244\"> employers<\/span> must carry <span data-term-id=\"41016241\">workers\u2019 compensation<\/span> insurance. <a href=\"https:\/\/www.pa.gov\/agencies\/dli\/programs-services\/workers-compensation\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016241\">Workers\u2019 compensation<\/span><\/a> covers work-related injuries and occupational diseases, regardless of fault. The benefits available may include medical treatment, wage-loss benefits, benefits for permanent impairment, and death benefits for eligible dependents. In exchange for these no-fault benefits, employees can\u2019t sue their employer for damages arising from the workplace injury. Limited exceptions exist.<\/p>\n<h3><span data-term-id=\"41016249\">Unemployment Compensation<\/span><\/h3>\n<p><a href=\"https:\/\/www.pa.gov\/agencies\/dli\/programs-services\/unemployment\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016249\">Unemployment compensation<\/span><\/a> is available for workers who, through no fault of their own, experience job loss or a qualifying reduction in hours. <span data-term-id=\"41016279\">Unemployment benefits<\/span> may provide partial wage replacement for a limited time while looking for another job.<\/p>\n<h2><span data-term-id=\"41016236\">Pennsylvania<\/span> Wage and Hour Laws<\/h2>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span>\u2019s wage and hour laws include the state <span data-term-id=\"41016237\">minimum wage<\/span>, the rules for calculating <span data-term-id=\"41016247\">overtime pay<\/span>, meal and rest break requirements, and <span data-term-id=\"41016250\">payday<\/span> requirements. The <span data-term-id=\"41016253\">Department of Labor<\/span> and Industry&#8217;s <span data-term-id=\"41016274\">Bureau of Labor Law Compliance<\/span> is the primary state agency responsible for enforcing <span data-term-id=\"41016236\">Pennsylvania<\/span> wage and hour laws.<\/p>\n<h3><span data-term-id=\"41016237\">Minimum Wage<\/span><\/h3>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span> law requires employers to pay most employees at least the state <span data-term-id=\"41016237\">minimum wage<\/span>. As of 2026, this still mirrors the <span data-term-id=\"41016261\">federal <\/span><span data-term-id=\"41016237\">minimum wage<\/span> of $7.25 per hour. <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-333-114a\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41016236\">Pennsylvania<\/span> law<\/a> prohibits local governments from imposing their own higher <span data-term-id=\"41016237\">minimum wages<\/span>.<\/p>\n<p>The <span data-term-id=\"41016248\">Pennsylvania<\/span> <span data-term-id=\"41016237\">minimum wage<\/span> for <span data-term-id=\"41016260\">tipped employees<\/span> is $2.83 per hour. If a <span data-term-id=\"41016260\">tipped employee<\/span>\u2019s hourly rate falls below $7.25 per hour when tips and regular hourly rate are combined, the employer must make up the difference.<\/p>\n<h3><span data-term-id=\"41016247\">Overtime Pay<\/span><\/h3>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span>\u2019s overtime law follows federal standards. <span data-term-id=\"41016244\">Pennsylvania<\/span><span data-term-id=\"41016244\"> employers<\/span> must pay most nonexempt employees an overtime rate of 1.5 times the regular pay rate for any hours worked over a 40-hour <span data-term-id=\"41016264\">workweek<\/span>.<\/p>\n<h3>Meal and Rest Breaks<\/h3>\n<p><span data-term-id=\"41016236\">Pennsylvania<\/span> law does not require <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\">meal or rest breaks<\/a> for most adult employees. Whether employees receive meal breaks or rest breaks is usually determined by the employer&#8217;s policies, an <span data-term-id=\"41016270\">employment contract<\/span>, or a <span data-term-id=\"41016297\">collective bargaining<\/span> agreement. If an employer voluntarily provides breaks, they must comply with <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\">federal rules<\/a> governing whether the break time is payable.
