Without these legally binding instructions, <span data-term-id=\"41356841\">Pennsylvania<\/span> state laws automatically determine how a person&#8217;s financial affairs and healthcare decisions are managed.<\/p>\n<p>If you have assets, you have an estate. An <span data-term-id=\"41356843\">estate plan<\/span> is the set of <span data-term-id=\"41356911\">legal documents<\/span> that work together to protect you, your <span data-term-id=\"41356893\">family members<\/span>, and your <span data-term-id=\"41356865\">loved ones<\/span>. The protection comes from the instructions you set out in your <span data-term-id=\"41356884\">estate planning<\/span><span data-term-id=\"41356884\"> documents<\/span>. With a will-based or trust-based <span data-term-id=\"41356843\">estate plan<\/span> that includes <span data-term-id=\"41356868\">incapacity<\/span> planning, you can ensure that your wishes are known. In addition, an <span data-term-id=\"41356843\">estate plan<\/span> helps protect your family\u2019s peace during their time of loss.<\/p>\n<p>This article discusses the key elements of a comprehensive <span data-term-id=\"41356841\">Pennsylvania<\/span> <span data-term-id=\"41356843\">estate plan<\/span>. This includes a will or <span data-term-id=\"41356941\">revocable <\/span><span data-term-id=\"41356853\">living trust<\/span>, an <span data-term-id=\"41356899\">advance healthcare directive<\/span>, and a <span data-term-id=\"41356881\">durable <\/span><span data-term-id=\"41356849\">power of attorney<\/span>. We\u2019ll also show you how to get started.<\/p>\n<h2>What Are Assets?<\/h2>\n<p>Your assets are the things you own. Assets include things like:<\/p>\n<ul>\n<li><span data-term-id=\"41356929\">Personal property<\/span><\/li>\n<li><span data-term-id=\"41356887\">Real estate<\/span><\/li>\n<li><span data-term-id=\"41356872\">Life <\/span><span data-term-id=\"41356920\">insurance<\/span><span data-term-id=\"41356920\"> policies<\/span><\/li>\n<li><span data-term-id=\"41356938\">Retirement accounts<\/span><\/li>\n<li><span data-term-id=\"41356926\">Bank accounts<\/span><\/li>\n<li>Stocks and bonds<\/li>\n<\/ul>\n<p>Together, your assets comprise your estate.<\/p>\n<h2>What Happens if You Don\u2019t Have an <span data-term-id=\"41356843\">Estate Plan<\/span>?<\/h2>\n<p><span data-term-id=\"41356843\">Estate planning<\/span> is about control. It allows you to control who receives what under either your will or <span data-term-id=\"41356941\">revocable <\/span><span data-term-id=\"41356853\">living trust<\/span>, who handles your healthcare decisions when you can\u2019t, and how your financial and legal matters are handled if you are incapacitated. With an <span data-term-id=\"41356843\">estate plan<\/span> in place, <span data-term-id=\"41356857\">Pennsylvania<\/span><span data-term-id=\"41356857\"> law<\/span> determines how your affairs are managed at your death or <span data-term-id=\"41356868\">incapacity<\/span>. The laws are the state\u2019s one-size-fits-all best guess at what most people would want. The outcome may or may not align with your wishes.<\/p>\n<h3>How Your Assets Are Distributed at Death<\/h3>\n<p>Passing without an <span data-term-id=\"41356843\">estate plan<\/span> is known as dying \u201c<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/intestate-succession-laws-by-state.html\"><span data-term-id=\"41356863\">intestate<\/span><\/a>.&#8221; <span data-term-id=\"41356841\">Pennsylvania<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/pa\/title-20-pacsa-decedents-estates-and-fiduciaries\/pa-csa-sect-20-2101\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41356975\">intestacy laws<\/span><\/a> determine how your assets are distributed. The state will look far into the family tree to find an heir. If no suitable recipient can be found, your estate will go to a community fund in <span data-term-id=\"41356841\">Pennsylvania<\/span>.<\/p>\n<p>The <span data-term-id=\"41356863\">intestate<\/span> succession law starts with married <span data-term-id=\"41356870\">decedents<\/span> and the <span data-term-id=\"41356969\">surviving spouse<\/span>\u2019s share. For example:<\/p>\n<ul>\n<li>If you are married and die <span data-term-id=\"41356863\">intestate<\/span> with no children and your parents have died before you, your <span data-term-id=\"41356969\">surviving spouse<\/span> receives all of your estate<\/li>\n<li>If you have no children and a surviving parent or parents, your <span data-term-id=\"41356969\">surviving spouse<\/span> receives $30,000 plus 1\/2 the remaining balance of your <span data-term-id=\"41356863\">intestate<\/span> estate<\/li>\n<li>If all your surviving children are also the children of your <span data-term-id=\"41356969\">surviving spouse<\/span>, your <span data-term-id=\"41356969\">surviving spouse<\/span> receives $30,000 plus 1\/2 the remaining balance of your <span data-term-id=\"41356863\">intestate<\/span> estate<\/li>\n<li>If you have any children outside of the marriage, your <span data-term-id=\"41356969\">surviving spouse<\/span> receives 1\/2 of your <span data-term-id=\"41356863\">intestate<\/span> estate<\/li>\n<\/ul>\n<p>If you are not married at the time of your death or for any share of your estate that does not pass to your <span data-term-id=\"41356969\">surviving spouse<\/span>, the <span data-term-id=\"41356975\">intestacy law<\/span> <a href=\"https:\/\/codes.findlaw.com\/pa\/title-20-pacsa-decedents-estates-and-fiduciaries\/pa-csa-sect-20-2103\/\" target=\"_blank\" rel=\"noopener\">prioritizes <span data-term-id=\"41356893\">family members<\/span><\/a> in this way:<\/p>\n<ul>\n<li>Your children<\/li>\n<li>Your parents<\/li>\n<li>Your brothers and sisters or their children<\/li>\n<li>Your grandparents<\/li>\n<li>Your aunts and uncles, their children, their grandchildren<\/li>\n<\/ul>\n<p>If no heirs can be found, your estate will escheat to the state. If that\u2019s not where you want your assets to go or if there are certain people you wish to exclude from inheriting, you\u2019ll need to have an <span data-term-id=\"41356843\">estate plan<\/span> in place.<\/p>\n<h3>How Your Financial Decisions and <span data-term-id=\"41356944\">Medical Care<\/span> Are Handled if You\u2019re Incapacitated<\/h3>\n<p><span data-term-id=\"41356868\">Incapacity<\/span> planning typically includes an <a href=\"https:\/\/www.findlaw.com\/estate\/living-will.html\">advance directive for healthcare matters<\/a> and a <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/what-is-a-power-of-attorney\/what-is-durable-power-of-attorney.html\"><span data-term-id=\"41356881\">durable <\/span><span data-term-id=\"41356849\">power of attorney<\/span> for financial matters<\/a>. Through these documents, you provide important healthcare instructions (a <span data-term-id=\"41356861\">living will<\/span>) and appoint trusted agents to manage your healthcare decisions (a\u00a0durable <span data-term-id=\"41356905\">healthcare <\/span><span data-term-id=\"41356849\">power of attorney<\/span>). For financial matters, a <span data-term-id=\"41356881\">durable <\/span><span data-term-id=\"41356849\">power of attorney<\/span> designates the person you wish to make decisions if you become incapacitated.<\/p>\n<p>With these important <span data-term-id=\"41356911\">legal documents<\/span>, the transition of authority for your healthcare and financial decisions can be smooth and efficient. Without them, your family could face a time-consuming, costly, and emotionally charged legal process. In addition, you\u2019ve given up control over who speaks for you when you can\u2019t speak for yourself.<\/p>\n<h2><span data-term-id=\"41356841\">Pennsylvania<\/span> Wills Laws<\/h2>\n<p>Your <span data-term-id=\"41356908\">last will and testament<\/span>, or \u201cwill\u201d for short, is the foundation document of a will-based <span data-term-id=\"41356843\">estate plan<\/span>. Wills must be legally valid. Unlike some states, <span data-term-id=\"41356841\">Pennsylvania<\/span> does not provide a statutory will form. The elements for creating a <a href=\"https:\/\/www.findlaw.com\/state\/pennsylvania-law\/pennsylvania-wills-laws.html\">valid will in <span data-term-id=\"41356841\">Pennsylvania<\/span><\/a> are covered by statute. Even with a will, your estate must go through <span data-term-id=\"41356971\">Pennsylvania<\/span><span data-term-id=\"41356971\">\u2019s <\/span><span data-term-id=\"41356879\">probate<\/span><span data-term-id=\"41356879\"> process<\/span> before your <span data-term-id=\"41356985\">estate assets<\/span> are distributed.<\/p>\n<p>Let\u2019s take a closer look at what a valid will requires.<\/p>\n<h3>Elements of a Valid Will<\/h3>\n<p>A will must be in writing. <span data-term-id=\"41356841\">Pennsylvania<\/span> does not recognize oral (nuncupative) wills. Other conditions must also be met, including:<\/p>\n<ul>\n<li><strong>Legal Capacity<\/strong>: The \u201c<span data-term-id=\"41356960\">testator<\/span>\u201d is the person making the will. The <span data-term-id=\"41356960\">testator<\/span> must be at least <a href=\"https:\/\/codes.findlaw.com\/pa\/title-20-pacsa-decedents-estates-and-fiduciaries\/pa-csa-sect-20-2501\/\" target=\"_blank\" rel=\"noopener\">18 years old and of sound mind<\/a>.<\/li>\n<li><strong>Signature<\/strong>: The<strong>\u00a0<\/strong><span data-term-id=\"41356960\">testator<\/span> must sign at the end of the original will. If the <span data-term-id=\"41356960\">testator<\/span> cannot sign, they may make a mark or direct another person to sign the will in the <span data-term-id=\"41356960\">testator<\/span>\u2019s presence and at the <span data-term-id=\"41356960\">testator<\/span>\u2019s direction.<\/li>\n<li><strong>Witnesses<\/strong>:<strong>\u00a0<\/strong><span data-term-id=\"41356841\">Pennsylvania<\/span> generally does not require witnesses for a will that is signed by the <span data-term-id=\"41356960\">testator<\/span>. If the <span data-term-id=\"41356960\">testator<\/span> signs by mark or directs another person to sign on their behalf, the law requires two witnesses.<\/li>\n<li><strong>Self-Proving Affidavit<\/strong>:<strong>\u00a0<\/strong>Though not required, <span data-term-id=\"41356841\">Pennsylvania<\/span> allows a self-proving affidavit with the will. The affidavit is typically signed by the <span data-term-id=\"41356960\">testator<\/span> and two witnesses before a notary public. A self-proving affidavit can simplify the <span data-term-id=\"41356879\">probate<\/span><span data-term-id=\"41356879\"> process<\/span> by helping establish that the will was properly executed without further evidence.<\/li>\n<\/ul>\n<p>A <span data-term-id=\"41356971\">Pennsylvania<\/span> <span data-term-id=\"41356844\">probate<\/span> court may recognize a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/is-a-handwritten-will-legally-valid\/\">holographic will<\/a>, which is handwritten by the <span data-term-id=\"41356960\">testator<\/span> and usually not witnessed. Although witnesses are not required for a will signed by the <span data-term-id=\"41356960\">testator<\/span> in <span data-term-id=\"41356841\">Pennsylvania<\/span>, holographic wills open the door to legal challenges such as authenticity, capacity, and undue influence.<\/p>\n<h3>A Will Must Go Through the <span data-term-id=\"41356879\">Probate<\/span><span data-term-id=\"41356879\"> Process<\/span><\/h3>\n<p>In <span data-term-id=\"41356841\">Pennsylvania<\/span>, the Register of Wills handles the <a href=\"https:\/\/www.findlaw.com\/estate\/probate.html\"><span data-term-id=\"41356879\">probate process<\/span><\/a>. Upon finding a will valid, an overview of the process includes:<\/p>\n<ul>\n<li>The Register of Wills issues Letters Testamentary to the executor (<span data-term-id=\"41356914\">personal representative<\/span>)<\/li>\n<li>The executor notifies <span data-term-id=\"41356845\">beneficiaries<\/span> and publishes a Notice of Estate Administration in local newspapers to provide notice to creditors<\/li>\n<li>The executor gathers and inventories the <span data-term-id=\"41356985\">estate assets<\/span><\/li>\n<li>The executor pays all of the estate\u2019s debts, including taxes, according to statutory priority<\/li>\n<li>The executor distributes the remainder to the <span data-term-id=\"41356845\">beneficiaries<\/span> according to the will and closes the estate<\/li>\n<\/ul>\n<p>The Orphans\u2019 Court handles disputes as well as any other issue that requires a judge.<\/p>\n<p>The <span data-term-id=\"41356879\">probate<\/span><span data-term-id=\"41356879\"> process<\/span> for an <span data-term-id=\"41356863\">intestate<\/span> estate is similar. The Register of Wills grants Letters of Administration to a qualifying applicant, known as the administrator or <span data-term-id=\"41356914\">personal representative<\/span>. Once the initial steps are complete and all debts are paid, the remainder is distributed according to the state\u2019s <span data-term-id=\"41356975\">intestacy laws<\/span>.<\/p>\n<h3>Avoiding <span data-term-id=\"41356844\">Probate<\/span><\/h3>\n<p><span data-term-id=\"41356844\">Probate<\/span> is often a long and trying process. Not all assets must go through the <span data-term-id=\"41356879\">probate<\/span><span data-term-id=\"41356879\"> process<\/span>. For example:<\/p>\n<ul>\n<li><strong>Ownership title<\/strong>: Assets titled by joint tenancy with <span data-term-id=\"41356967\">right of survivorship<\/span> or by tenancy by the entirety (limited to married couples) pass to the surviving joint owner or to the <span data-term-id=\"41356969\">surviving spouse<\/span>, respectively, without <span data-term-id=\"41356844\">probate<\/span><\/li>\n<li><strong><span data-term-id=\"41356935\">Beneficiary<\/span><span data-term-id=\"41356935\"> designation<\/span>: <\/strong>Several types of assets can pass by <span data-term-id=\"41356935\">beneficiary<\/span><span data-term-id=\"41356935\"> designation<\/span>, such as <span data-term-id=\"41356872\">life insurance<\/span> proceeds, <span data-term-id=\"41356938\">retirement accounts<\/span>, and annuities payable to a named <span data-term-id=\"41356845\">beneficiary<\/span>; payable-on-death (POD) <span data-term-id=\"41356926\">bank accounts<\/span>; and transfer-on-death (TOD) brokerage or investment accounts<\/li>\n<li><strong><span data-term-id=\"41356941\">Revocable <\/span><span data-term-id=\"41356853\">Living Trust<\/span>:<\/strong> Assets held in a <span data-term-id=\"41356941\">revocable <\/span><span data-term-id=\"41356853\">living trust<\/span> typically pass according to the trust\u2019s terms without <span data-term-id=\"41356844\">probate<\/span><\/li>\n<\/ul>\n<p>Not having to go through <span data-term-id=\"41356844\">probate<\/span> can save your survivors time, money, and frustration. Given the complexity of <span data-term-id=\"41356844\">probate<\/span> statutes, speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/pennsylvania\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41356855\">Pennsylvania<\/span> <span data-term-id=\"41356859\">estate planning<\/span><span data-term-id=\"41356859\"> attorney<\/span><\/a> and names.<\/p>\n<h2><span data-term-id=\"41356841\">Pennsylvania<\/span> <span data-term-id=\"41356941\">Revocable <\/span><span data-term-id=\"41356853\">Living Trust<\/span> Laws<\/h2>\n<p>A <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/revocable-living-trust.html\"><span data-term-id=\"41356941\">revocable <\/span><span data-term-id=\"41356853\">living trust<\/span><\/a> (RLT) is the foundation document of a trust-based <span data-term-id=\"41356843\">estate plan<\/span>. The <span data-term-id=\"41356965\">settlor<\/span> (the person making the RLT) serves as the initial trustee and names a successor trustee who serves if the <span data-term-id=\"41356965\">settlor<\/span> becomes incapacitated or dies. The trustee manages the <span data-term-id=\"41356977\">trust assets<\/span> and, upon the\u00a0<span data-term-id=\"41356965\">settlor<\/span>\u2019s death, distributes them in accordance with the trust terms.<\/p>\n<p>In addition to avoiding the time and expense of <span data-term-id=\"41356844\">probate<\/span>, other key benefits to a trust-based <span data-term-id=\"41356843\">estate plan<\/span> include:<\/p>\n<ul>\n<li><strong>Privacy<\/strong>: The trust terms, your <span data-term-id=\"41356845\">beneficiaries<\/span>, and your assets don\u2019t become public record<\/li>\n<li><strong>Spendthrift guardrails<\/strong>: Your <span data-term-id=\"41356845\">beneficiary<\/span>\u2019s distributions can be protected from creditors, divorce proceedings, or their own financial irresponsibility with spendthrift provisions<\/li>\n<li><strong>Flexibility<\/strong>: A trust can accommodate more sophisticated planning goals than a will can, which can be especially helpful for blended families<\/li>\n<li><strong><span data-term-id=\"41356868\">Incapacity<\/span> planning<\/strong>: Your successor trustee can step in during your <span data-term-id=\"41356868\">incapacity<\/span> for matters involving the <span data-term-id=\"41356977\">trust assets<\/span><\/li>\n<li><strong>Multi-state properties<\/strong>: <span data-term-id=\"41356977\">Trust assets<\/span> don\u2019t pass through <span data-term-id=\"41356844\">probate<\/span>, which means ancillary <span data-term-id=\"41356844\">probate<\/span> proceedings in each state aren\u2019t necessary, as they would be under a will-based <span data-term-id=\"41356843\">estate plan<\/span><\/li>\n<\/ul>\n<p>It\u2019s important to make sure your trust will be approved by the courts. The <a href=\"https:\/\/codes.findlaw.com\/pa\/title-20-pacsa-decedents-estates-and-fiduciaries\/pa-csa-sect-20-7732\/\" target=\"_blank\" rel=\"noopener\">key elements of a valid <span data-term-id=\"41356841\">Pennsylvania<\/span> trust<\/a> often include:<\/p>\n<ul>\n<li><strong>Capacity<\/strong>: The person making the trust (known as the <span data-term-id=\"41356965\">settlor<\/span>, grantor, or trustmaker) has the capacity to create a trust<\/li>\n<li><strong>In writing<\/strong>: The <span data-term-id=\"41356965\">settlor<\/span> signs a written document that indicates an intention to create the trust and contains provisions of the trust<\/li>\n<li><strong>Definite <span data-term-id=\"41356845\">beneficiary<\/span><\/strong>: The trust has a definite <span data-term-id=\"41356845\">beneficiary<\/span> or falls under an exception<\/li>\n<li><strong>Duties<\/strong>: The trustee has duties to perform<\/li>\n<li><strong>Distinct people<\/strong>: A sole trustee and a <span data-term-id=\"41356845\">beneficiary<\/span> of the trust are not the same person<\/li>\n<\/ul>\n<p>As its name suggests, a <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/revocable-living-trust.html\"><span data-term-id=\"41356941\">revocable <\/span><span data-term-id=\"41356853\">living trust<\/span><\/a> may be revoked or changed during the <span data-term-id=\"41356965\">settlor<\/span>\u2019s lifetime. Since families and relationships are dynamic, your <span data-term-id=\"41356843\">estate planning<\/span> needs and goals may change over time. Once your trust is created, you must fund it. This means all of the intended <span data-term-id=\"41356977\">trust assets<\/span> must be retitled in the trust\u2019s name. Any assets left outside the trust must go through <span data-term-id=\"41356844\">probate<\/span>.<\/p>\n<p>RLTs can be a bit tricky.
