Knowing more about <span data-term-id=\"40862849\">legal holidays<\/span> in <span data-term-id=\"40862829\">Pennsylvania<\/span> can help you understand which ones you may or may not be getting off.<\/p>\n<p><span data-term-id=\"40862849\">Legal holidays<\/span> are the days officially recognized by state and federal governments for purposes such as administrative operations, calculating certain legal deadlines, and court schedules. Most government offices are closed, and public employees typically receive a paid day off.<\/p>\n<p>In general, <span data-term-id=\"40862837\">private employers<\/span> aren\u2019t required to provide paid holidays, <span data-term-id=\"40862844\">holiday leave<\/span>, or premium pay for employees who work on a <span data-term-id=\"40862849\">legal holiday<\/span>. Most choose to voluntarily recognize <span data-term-id=\"40862849\">legal holidays<\/span> by closing for the day, providing a paid day off, or paying a premium <span data-term-id=\"40862835\">holiday pay<\/span> rate for employees who work. There are numerous reasons they do so, such as enticing employees.<\/p>\n<p>This article explores the <span data-term-id=\"40862849\">legal holidays<\/span> in <span data-term-id=\"40862829\">Pennsylvania<\/span>. They must provide <span data-term-id=\"40862844\">holiday leave<\/span> if the benefit is promised in:<\/p>\n<ul>\n<li>the employee handbook or written policy<\/li>\n<li>an <span data-term-id=\"40862833\">employment contract<\/span><\/li>\n<li>a collective bargaining agreement<\/li>\n<\/ul>\n<p>If an employer does provide paid <span data-term-id=\"40862844\">holiday leave<\/span>, these hours do not count toward the <span data-term-id=\"40862861\">overtime pay<\/span> calculation for <span data-term-id=\"40862855\">nonexempt<\/span> employees. Under both the federal <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\"><span data-term-id=\"40862858\">Fair Labor Standards Act<\/span><\/a> (FLSA) and the <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-333-102\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40862829\">Pennsylvania<\/span> <span data-term-id=\"40862839\">Minimum Wage<\/span> Act<\/a> (PMWA), overtime is generally calculated based on hours actually worked in a <span data-term-id=\"40862866\">workweek<\/span>. For example, an employee who receives 48 hours of pay in a <span data-term-id=\"40862866\">workweek<\/span>, consisting of eight hours of paid <span data-term-id=\"40862844\">holiday leave<\/span> plus 40 hours of work, isn\u2019t entitled to <span data-term-id=\"40862861\">overtime pay<\/span> unless the employer&#8217;s policy or a collective bargaining agreement requires it.<\/p>\n<h2>Other Key Employment <span data-term-id=\"40862871\">Leave Laws<\/span><\/h2>\n<p><span data-term-id=\"40862831\">State law<\/span> provides protections for certain types of leave, but most employee leave rights are governed by <span data-term-id=\"40862830\">federal law<\/span>, employer policies, and collective bargaining agreements. Let\u2019s examine some additional types of employment leave and how they relate to <span data-term-id=\"40862829\">Pennsylvania<\/span> employees.<\/p>\n<h3><span data-term-id=\"40862860\">Vacation Leave<\/span><\/h3>\n<p><span data-term-id=\"40862857\">Pennsylvania<\/span><span data-term-id=\"40862857\"> labor laws<\/span> don\u2019t require employers to provide <span data-term-id=\"40862854\">vacation time<\/span> to employees. If an employer promises paid <span data-term-id=\"40862860\">vacation leave<\/span> through an <span data-term-id=\"40862833\">employment contract<\/span>, collective bargaining agreement, or established policy, accrued (earned but unused) vacation pay may be considered &#8220;wages&#8221; under the <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-260-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40862829\">Pennsylvania<\/span> Wage Payment and Collection Law<\/a> (WPCL). In this case, the WPCL requires employers to pay employees their accrued <span data-term-id=\"40862854\">vacation time<\/span> as wages in accordance with the terms of the promised benefit.<\/p>\n<h3><span data-term-id=\"40862834\">Sick Leave<\/span><\/h3>\n<p>Unlike some states, <span data-term-id=\"40862829\">Pennsylvania<\/span> does not require <span data-term-id=\"40862837\">private employers<\/span> to provide a minimum amount of paid <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/vacation-and-sick-leave.html\"><span data-term-id=\"40862834\">sick leave<\/span><\/a> or <span data-term-id=\"40862882\">mandate<\/span> that employees accrue sick time. An employee may have <span data-term-id=\"40862834\">sick leave<\/span> rights under:<\/p>\n<ul>\n<li>An employer\u2019s policy, an <span data-term-id=\"40862833\">employment contract<\/span>, or a collective bargaining agreement<\/li>\n<li>Local ordinances, such as those in <span data-term-id=\"40862848\">Philadelphia<\/span> and Pittsburgh<\/li>\n<li><span data-term-id=\"40862830\">Federal law<\/span> (such as unpaid, protected leave for a serious health condition under the <span data-term-id=\"40862856\">Family and Medical Leave Act<\/span> and leave as a reasonable accommodation under the Americans with <span data-term-id=\"40862851\">Disabilities<\/span> Act)<\/li>\n<li>Other applicable <span data-term-id=\"40862852\">employment laws<\/span><\/li>\n<\/ul>\n<p>If you\u2019re unsure, reach out to an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/pennsylvania\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40862852\">employment law<\/span> attorney<\/a>.<\/p>\n<h3>Family and Medical Leave<\/h3>\n<p>For eligible <span data-term-id=\"40862829\">Pennsylvania<\/span> employees working for covered employers, the federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/family-and-medical-leave.html\"><span data-term-id=\"40862856\">Family and Medical Leave Act<\/span><\/a> (FMLA) is the primary source of family and medical leave protections. <span data-term-id=\"40862829\">Pennsylvania<\/span> does not have a statewide law requiring paid family and medical leave or expanding the rights under the FMLA.<\/p>\n<p>The <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/family-and-medical-leave-act.html\">FMLA<\/a> entitles eligible employees to take up to 12 weeks of job-protected, <span data-term-id=\"40862862\">unpaid leave<\/span> in a 12-month period for qualifying reasons. These may include the birth or adoption of a child, a serious health condition, or caring for certain <span data-term-id=\"40862853\">family members<\/span> (spouse, child, or parent) with a serious health condition. The FMLA also provides up to 26 weeks of leave to care for a covered servicemember with a serious injury or illness.<\/p>\n<h3><span data-term-id=\"40862878\">Military Leave<\/span><\/h3>\n<p><span data-term-id=\"40862878\">Military leave<\/span> protections for Pennsylvanians primarily come from <span data-term-id=\"40862830\">federal law<\/span>. The <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/military-leave-law.html\">Uniformed Services Employment and Reemployment Rights Act<\/a> (USERRA) provides <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/military-service-benefits-scra-and-userra.html\">job protection, reemployment rights, and anti-discrimination protections<\/a> for members of the uniformed services. USERRA applies to all employers, regardless of size. <span data-term-id=\"40862829\">Pennsylvania<\/span> doesn\u2019t impose a general paid <span data-term-id=\"40862878\">military leave<\/span> requirement on <span data-term-id=\"40862837\">private employers<\/span>, but it provides additional protections for certain categories of employees, such as <span data-term-id=\"40862829\">Pennsylvania<\/span> National Guard members and some public employees.<\/p>\n<h3>Bereavement Leave<\/h3>\n<p><span data-term-id=\"40862837\">Private employers<\/span> are not required to provide bereavement leave under federal or <span data-term-id=\"40862831\">state law<\/span>. Bereavement leave may be available under an employer&#8217;s policy, an <span data-term-id=\"40862833\">employment contract<\/span>, or a collective bargaining agreement.<\/p>\n<h3><span data-term-id=\"40862868\">Jury Duty<\/span><\/h3>\n<p>In general, <span data-term-id=\"40862829\">Pennsylvania<\/span> law entitles employees to <a href=\"https:\/\/codes.findlaw.com\/pa\/title-42-pacsa-judiciary-and-judicial-procedure\/pa-csa-sect-42-4563\/\" target=\"_blank\" rel=\"noopener\">job-protected leave for jury service<\/a>. The protection does not apply to employees of any employer in a retail or service industry with 15 or fewer employees, or any employer in any manufacturing industry with fewer than 40 employees.
