Federal wage and hour law sets a <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/wage-and-hour-laws.html\">minimum standard for employees<\/a> across the country, including child labor, minimum wage, and <span data-term-id=\"52761171\">overtime pay<\/span>. The law,\u00a0not\u00a0employers, determines your <span data-term-id=\"52761209\">eligibility<\/span> for <span data-term-id=\"52761171\">overtime pay<\/span>. Misclassifying an employee as an independent contractor or as an exempt employee is illegal. If the legal requirements for these exceptions to <span data-term-id=\"52761171\">overtime pay<\/span> aren\u2019t met, the employee is entitled to <span data-term-id=\"52761171\">overtime pay<\/span>.<\/p>\n<h3>Independent Contractors<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\">Independent contractors<\/a> aren\u2019t required to receive <span data-term-id=\"52761171\">overtime pay<\/span> under <span data-term-id=\"52761172\">Pennsylvania<\/span> law. Employers can\u2019t avoid paying overtime to a <span data-term-id=\"52761185\">nonexempt employee<\/span> by designating them as an independent contractor. Both the <span data-term-id=\"52761175\">FLSA<\/span> and the PMWA apply a totality-of-the-circumstances analysis focused on the worker\u2019s economic realities to determine if the worker is economically dependent on the employer. The economic realities of the working relationship determine employment status.<\/p>\n<h3>Exempt Employees<\/h3>\n<p>When it comes to <span data-term-id=\"52761192\">overtime compensation<\/span>, the distinction between <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">exempt employees and <span data-term-id=\"52761185\">nonexempt employees<\/span><\/a> is key. Exempt employees are not entitled to <span data-term-id=\"52761171\">overtime pay<\/span>. Most exempt employees are paid on a salary basis, earn at least the required minimum salary, and perform <span data-term-id=\"52761187\">job duties<\/span> that qualify for a specific <span data-term-id=\"52761176\">exemption<\/span>. These include:<\/p>\n<ul>\n<li><strong>Salary Pay<\/strong>: Some people equate the way an employee is paid (by salary vs. an <span data-term-id=\"52761202\">hourly wage<\/span>) with being exempt or nonexempt. Being paid a salary doesn\u2019t mean you aren\u2019t entitled to receive overtime. In addition to being paid on a salary basis, your actual <span data-term-id=\"52761187\">job duties<\/span> and weekly income determine if you are exempt from overtime.<\/li>\n<li><strong>Minimum Salary<\/strong>: Under the <span data-term-id=\"52761182\">federal <\/span><span data-term-id=\"52761173\">Fair Labor Standards Act<\/span> (<span data-term-id=\"52761175\">FLSA<\/span>), exempt employees must meet the minimum <span data-term-id=\"52761194\">salary threshold<\/span> of $684 per week ($35,568 annually). The <span data-term-id=\"52761223\">Pennsylvania<\/span> <span data-term-id=\"52761181\">state<\/span><span data-term-id=\"52761181\"> law<\/span> minimum <span data-term-id=\"52761194\">salary threshold<\/span> matches the <span data-term-id=\"52761175\">FLSA<\/span>.<\/li>\n<li><strong><span data-term-id=\"52761187\">Job Duties<\/span>:<\/strong> <span data-term-id=\"52761229\">Overtime <\/span><span data-term-id=\"52761176\">exemptions<\/span> are referred to as \u201cwhite-collar\u201d <span data-term-id=\"52761176\">exemptions<\/span>. <span data-term-id=\"52761184\">Pennsylvania<\/span><span data-term-id=\"52761184\">&#8216;s Minimum Wage Act<\/span> and regulations recognize many of the same <span data-term-id=\"52761176\">exemptions<\/span> as the federal <span data-term-id=\"52761175\">FLSA<\/span>, but they are not identical. The key <span data-term-id=\"52761176\">exemptions<\/span> are for executive, administrative, or professional work. Additional <span data-term-id=\"52761176\">exemptions<\/span> apply to certain <span data-term-id=\"52761219\">outside sales<\/span> employees and to other workers in specific occupations.<\/li>\n<\/ul>\n<p>Employers who misclassify workers, intentionally or not, are likely in violation of both state and <span data-term-id=\"52761186\">federal laws<\/span>.<\/p>\n<h2>How Overtime Is Calculated<\/h2>\n<p>How your employer calculates your <span data-term-id=\"52761171\">overtime <\/span><span data-term-id=\"52761218\">pay<\/span><span data-term-id=\"52761218\"> rate<\/span> depends on how you are paid. Although the calculation varies, overtime is often based on your <span data-term-id=\"52761180\">regular rate of pay<\/span>, which may include more than just your <span data-term-id=\"52761202\">hourly wage<\/span>.<\/p>\n<h3>Standard <span data-term-id=\"52761198\">Overtime Calculation<\/span><\/h3>\n<p><span data-term-id=\"52761223\">Pennsylvania<\/span> <span data-term-id=\"52761181\">state<\/span><span data-term-id=\"52761181\"> law<\/span> mirrors <span data-term-id=\"52761186\">federal law<\/span> by requiring employers to pay &#8220;<span data-term-id=\"52761206\">time and a half<\/span>&#8221; your\u00a0<span data-term-id=\"52761180\">regular rate of pay<\/span>\u00a0for all hours\u00a0worked\u00a0beyond the\u00a0<span data-term-id=\"52761195\">40-hour <\/span><span data-term-id=\"52761174\">workweek<\/span>. If your <span data-term-id=\"52761180\">regular rate of pay<\/span> is $10 an hour, your employer must pay you at least $15 an hour for any time worked over 40 hours in a <span data-term-id=\"52761174\">workweek<\/span>. This excludes any vacation or sick leave pay.<\/p>\n<p>Unlike some states, <span data-term-id=\"52761172\">Pennsylvania<\/span> does not require daily <span data-term-id=\"52761171\">overtime pay<\/span>. Working nine hours as a <span data-term-id=\"52761185\">nonexempt employee<\/span> in a <span data-term-id=\"52761207\">workday<\/span> doesn\u2019t warrant <span data-term-id=\"52761171\">overtime pay<\/span>, but putting in 44 hours in a <span data-term-id=\"52761174\">workweek<\/span> would qualify you for four hours at <span data-term-id=\"52761206\">time-and-a-half<\/span>.<\/p>\n<h3>Bonus and Commission<\/h3>\n<p>If you receive an hourly rate plus <span data-term-id=\"52761230\">nondiscretionary bonus<\/span> pay or commission, your <span data-term-id=\"52761180\">regular rate of pay<\/span> should include those amounts. As a result, your <span data-term-id=\"52761190\">overtime rate<\/span> may be higher than simply one and one-half times your <span data-term-id=\"52761202\">hourly wage<\/span>.<\/p>\n<p>An employer determines a <span data-term-id=\"52761180\">regular rate of pay<\/span> by adding a worker\u2019s hourly earnings and any bonus or commission earned during the <span data-term-id=\"52761174\">workweek<\/span>, then dividing that total by the <span data-term-id=\"52761177\">number of hours<\/span> worked. The employee is then paid an overtime premium based on that <span data-term-id=\"52761180\">regular rate of pay<\/span> for each <span data-term-id=\"52761179\">overtime hour<\/span>.<\/p>\n<h3>Salary Pay<\/h3>\n<p>For <span data-term-id=\"52761185\">nonexempt employees<\/span> paid on a salary basis, the <span data-term-id=\"52761180\">regular rate of pay<\/span> is the salary divided by the <span data-term-id=\"52761177\">number of hours<\/span> the salary is intended to compensate. It may not be common, but some <span data-term-id=\"52761178\">salaried employees<\/span> are eligible for <span data-term-id=\"52761171\">overtime pay<\/span>.<\/p>\n<h2>Some Common Overtime Violations<\/h2>\n<p>Overtime violations range from simple clerical payroll mistakes to willful attempts to avoid paying employees the proper rate. Whether an employer&#8217;s violation is accidental or intentional, employees may be entitled to recover <span data-term-id=\"52761217\">unpaid <\/span><span data-term-id=\"52761228\">overtime<\/span><span data-term-id=\"52761228\"> wages<\/span> and other remedies under federal and <span data-term-id=\"52761172\">Pennsylvania<\/span> law. Here are some common overtime violations.<\/p>\n<h3>Misclassifying Workers<\/h3>\n<p>As discussed above, employers sometimes <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\">misclassify workers<\/a> as independent contractors or as exempt employees to avoid paying them overtime. If done intentionally, employers may also face fines.<\/p>\n<h3>Averaging Hours Over the <span data-term-id=\"52761199\">Pay Period<\/span><\/h3>\n<p>Your employer can\u2019t average the hours of <span data-term-id=\"52761185\">nonexempt employees<\/span> over two or more weeks to avoid paying overtime. Under both federal and <span data-term-id=\"52761181\">state laws<\/span>, overtime is calculated on a single <span data-term-id=\"52761174\">workweek<\/span>-by-<span data-term-id=\"52761174\">workweek<\/span> basis. If you work 50 hours one week and 30 hours the next, your employer owes you 10 hours of overtime for the first week, even though your two-week average is 40 hours.<\/p>\n<h3>Under-Calculating <span data-term-id=\"52761180\">Regular Rate of Pay<\/span><\/h3>\n<p>Overtime is calculated on your <span data-term-id=\"52761180\">regular rate of pay<\/span>. This isn\u2019t always the same as your <span data-term-id=\"52761202\">hourly wage<\/span>. If you receive <span data-term-id=\"52761230\">non-discretionary bonuses<\/span>, shift differentials, or commissions, those amounts are included in your regular rate before calculating overtime. An employer who calculates overtime on your base hourly pay without accounting for bonuses and other compensation is underpaying you for your <span data-term-id=\"52761179\">overtime hours<\/span>.<\/p>\n<h3>Substituting Compensatory Time Off<\/h3>\n<p>Compensatory time off (CTO or \u201ccomp time\u201d) is <span data-term-id=\"52761210\">paid time<\/span> off in lieu of paying overtime. CTO in place of overtime is often limited to certain public-sector employees under the <span data-term-id=\"52761175\">FLSA<\/span>. Private-sector employers in <span data-term-id=\"52761172\">Pennsylvania<\/span> must pay <span data-term-id=\"52761185\">nonexempt employees<\/span> <span data-term-id=\"52761228\">overtime wages<\/span> for hours worked over 40 in a <span data-term-id=\"52761174\">workweek<\/span> and not substitute CTO for <span data-term-id=\"52761171\">overtime pay<\/span>. One narrow exception includes private-sector employees covered by a collective bargaining agreement that permits CTO arrangements.<\/p>\n<h3>Off-the-Clock Work<\/h3>\n<p>Employers sometimes allow or even require employees to perform work before clocking in (for example, to prepare for a shift), after clocking out (for example, to clean up after a shift), during unpaid meal breaks, or while traveling between job sites. This <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/is-it-illegal-to-work-off-the-clock.html\">off-the-clock time<\/a> must be counted toward the 40-hour overtime threshold. Under the <span data-term-id=\"52761175\">FLSA<\/span> and PMWA, all time an employer &#8220;suffers or permits&#8221; an employee to work must be counted, whether or not the employer formally scheduled or authorized it.<\/p>\n<h2>Remedies for Overtime Violations<\/h2>\n<p>If your employer violates overtime laws, you may be entitled to recover more than just your <span data-term-id=\"52761217\">unpaid <\/span><span data-term-id=\"52761228\">overtime<\/span><span data-term-id=\"52761228\"> wages<\/span>. Depending on the circumstances, you may also recover liquidated damages, attorney&#8217;s fees, court costs, and other relief available under the <span data-term-id=\"52761175\">FLSA<\/span> and <a href=\"https:\/\/codes.findlaw.com\/pa\/title-43-ps-labor\/pa-st-sect-43-260-1\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52761172\">Pennsylvania<\/span>\u2019s Wage Payment and Collection Law<\/a>.<\/p>\n<h2>How To File a Wage Complaint<\/h2>\n<p><span data-term-id=\"52761172\">Pennsylvania<\/span> employees can file overtime claims under both the federal <span data-term-id=\"52761175\">FLSA<\/span> and the PMWA. The two laws are not identical, so filing both can maximize the protections and remedies available under federal and <span data-term-id=\"52761181\">state law<\/span>. Information and forms are available at:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/complaints\" target=\"_blank\" rel=\"noopener\">U.S. Department of Labor, Wage and Hour Division<\/a><\/li>\n<li><a href=\"https:\/\/www.pa.gov\/services\/dli\/file-a-minimum-wage-and-overtime-complaint\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52761204\">Pennsylvania<\/span><span data-term-id=\"52761204\"> Department of Labor<\/span> &amp; Industry, Bureau of <span data-term-id=\"52761183\">Labor Law<\/span> Compliance<\/a><\/li>\n<\/ul>\n<p>Employees also have the option of filing a civil lawsuit against their employer for <span data-term-id=\"52761217\">unpaid overtime<\/span>.<\/p>\n<p>There are time limits (statutes of limitations) for filing a wage complaint:<\/p>\n<ul>\n<li>Two years under the <span data-term-id=\"52761175\">FLSA<\/span> for non-willful violations<\/li>\n<li>Three years under the <span data-term-id=\"52761175\">FLSA<\/span> for willful violations<\/li>\n<li>Three years under the PMWA<\/li>\n<\/ul>\n<p>If you believe you\u2019re owed overtime, file sooner rather than later. Waiting may reduce the period of back pay you can recover. Missing the filing deadline may prevent you from recovering at all.<\/p>\n<h2>Retaliation Prohibited<\/h2>\n<p>Your employer can\u2019t retaliate against you for filing a wage claim. If you complain about <span data-term-id=\"52761217\">unpaid overtime<\/span>, file a wage claim, or cooperate with a government investigation into wage violations, your employer is <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/retaliation-and-wrongful-termination.html\">prohibited from retaliating against you<\/a> under the <span data-term-id=\"52761175\">FLSA<\/span> and <span data-term-id=\"52761181\">state law<\/span>. Retaliation includes adverse actions such as firing you, demoting you, or reducing your hours. If you experience retaliation for asserting your overtime rights, you may have a <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/pennsylvania\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">separate legal claim in addition to your wage claim<\/a>.<\/p>\n<h2>Review Your Overtime Claim With an Attorney<\/h2>\n<p>Your paycheck must include all <span data-term-id=\"52761171\">overtime pay<\/span> you\u2019re entitled to.
