Property owners establish property boundaries through recognition and acquiescence by showing the following two things:<\/p>\r\n<ul>\r\n<li>Each party has claimed the land on their side of the line as their own<\/li>\r\n<li>The property owners occupy the land for statutory period of 21 years<\/li>\r\n<\/ul>\r\n<h3><b>Establishing Property Lines by Dispute and Compromise<\/b><\/h3>\r\n<ul>\r\n<li>There was a dispute over the location of a boundary line<\/li>\r\n<li>The parties compromise and establish a mutually acceptable property line<\/li>\r\n<li>Both parties consent and withdraw any inconsistent claims<\/li>\r\n<\/ul>\r\n<h3><b>Local Fence Regulations<\/b><\/h3>\r\n<ul>\r\n<li><a href=\"https:\/\/www.allentownpa.gov\/Portals\/0\/adam\/Content\/ZA4uGDS2vE65JOSTHj-TOg\/Url\/ZoningOrdNov2015.pdf\" target=\"_blank\" rel=\"noopener\">City of Allentown<\/a> Fence Ordinances<\/li>\r\n<li><a href=\"https:\/\/www.greensburgpa.org\/planning-development\/pages\/property-permit-requirements#:~:text=Fences%20may%20not%20exceed%20three%20and%20one-half%20feet,inches%20to%20one%20foot%20from%20the%20property%20line.\" target=\"_blank\" rel=\"noopener\">City of Greenberg<\/a> Fence Regulations<\/li>\r\n<li><a href=\"https:\/\/www.cityoflancasterpa.gov\/city-code\/\" target=\"_blank\" rel=\"noopener\">City of Lancaster<\/a> Fence Regulations<\/li>\r\n<li><a href=\"https:\/\/www.pittsburghpa.gov\/Business-Development\/Zoning\" target=\"_blank\" rel=\"noopener\">City of Pittsburgh<\/a> Fence Regulations<\/li>\r\n<li><a href=\"https:\/\/www.phila.gov\/services\/permits-violations-licenses\/apply-for-a-permit\/building-and-repair-permits\/get-a-fence-permit\/\" target=\"_blank\" rel=\"noopener\">Philadelphia<\/a> Fence Regulations<\/li>\r\n<\/ul>\r\n<p><i><b>Note:<\/b><\/i> <i>State laws change frequently through new legislation, higher court rulings, and other means. While we strive to provide the most current information, consult a local <\/i><a href=\"https:\/\/lawyers.findlaw.com\/real-estate-law\/pennsylvania\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><i>real estate attorney<\/i><\/a><i> or conduct further legal research to verify your state laws.<\/i><\/p>\r\n<h2>Fence Law in Pennsylvania<\/h2>\r\n<p>Pennsylvania lawmakers initially passed fence laws to help prevent livestock from wandering and causing property damage. These early fences were known as <a href=\"https:\/\/www.findlaw.com\/state\/pennsylvania-law\/pennsylvania-property-and-real-estate-laws.html\">boundary fences<\/a> because they marked the line between two properties.<\/p>\r\n<p>By the early 20th century, lawmakers had struck down many state fence laws. In 1997, the state Superior Court ruled that residential landowners were exempt from sharing <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/fencing-on-property-line-who-pays-for-and-maintains-it.html\">boundary fence and maintenance costs<\/a>.<\/p>\r\n<p>In 1999, the court exempted residential landowners from sharing <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/fencing-laws-and-your-neighbors-faqs.html\">boundary fence<\/a> costs if one of the neighbors neither wanted nor needed the fence. County governments are left to settle boundary disputes and enforce the remaining state fence laws.<\/p>\r\n<h2>Trees Along Property Lines<\/h2>\r\n<p>A tree can mark a boundary line. Boundary trees belong to both neighbors equally, and neither can cut them down without the other neighbor&#8217;s consent. Neighbors can trim encroaching tree limbs up to the boundary line. They must <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/neighbor-disputes-trees.html\">obtain permission<\/a> to go on the neighbor&#8217;s property to do so, unless the tree limbs were threatening to cause imminent and grave harm.<\/p>\r\n<p>If a property owner cuts a neighbor&#8217;s tree down completely or destroys the structural integrity or cosmetic symmetry of a tree, they may be found liable for damages.<\/p>\r\n<h2>Pennsylvania&#8217;s Doctrine of Consentable Lines<\/h2>\r\n<p>Pennsylvania operates under a system called &quot;<a href=\"https:\/\/caselaw.findlaw.com\/court\/pa-superior-court\/1041648.html\" target=\"_blank\" rel=\"noopener\">Consentable Lines<\/a>.&quot; Under this doctrine, adjacent property owners agree that a specific <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/property-boundaries.html\">property line<\/a> divides their property and maintain this agreement for at least 21 years without interruption. Once the time requirement is met, the agreement can transcend ownership.<\/p>\r\n<p>Let&#8217;s illustrate how this works with an example. Your neighbor wants to put in an above-ground pool and it comes close to crossing your property boundary. Neither of you wants to take the trouble to confirm the legal <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/neighbor-fence-disputes.html\">property boundary lines<\/a>. Since it&#8217;s a part of the yard you rarely use, you tell your neighbor it&#8217;s fine to install the pool.<\/p>\r\n<p>After living in your home for another 25 years, you decide to sell it an move on. The new property owners object to the pool&#8217;s location, stating it <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/what-can-you-do-about-an-encroachment.html\">encroaches<\/a> on their side of the property line, and demand your former neighbor remove it. The neighbor refuses, pointing to the agreement you made 25 years prior.<\/p>\r\n<p>Under the doctrine of consentable lines, Pennsylvania law supports your former neighbor. The new homeowner must respect the agreed-upon boundaries.<\/p>\r\n<h2>Spite Fences in Pennsylvania<\/h2>\r\n<p>Sometimes, a property owner builds a fence to harass their neighbor. The law refers to this as a <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/can-my-neighbor-legally-block-my-view.html\">spite fence<\/a>. Although Pennsylvania doesn&#8217;t have a spite fence law, the courts can address these legal issues under nuisance law principles.<\/p>\r\n<p>To prevail in a nuisance claim, a person must prove all of the following:<\/p>\r\n<ul>\r\n<li>They own the land or have the right to possess it<\/li>\r\n<li>The defendant did something to interfere with the plaintiff&#8217;s <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/property-rights-my-neighbor-is-a-nuisance.html\">enjoyment and use<\/a> of their property<\/li>\r\n<li>The defendant&#8217;s interference was substantial and unreasonable<\/li>\r\n<\/ul>\r\n<p>The court can order the removal of a spite fence. It&#8217;s rare, but they can also award damages to the plaintiffs.<\/p>\r\n<h2>Ordinances and Zoning Rules in Pennsylvania<\/h2>\r\n<p>Local governments have a lot of power over how and where you can install a fence. These laws and local ordinances dictate a fence&#8217;s height and <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/what-is-a-property-line-setback-.html\">fence location and setbacks<\/a>.<\/p>\r\n<p>It may be lawful to erect a six-foot tall privacy fence in your backyard, but not in your front yard.
