Rhode Island is an at-fault state, so drivers file insurance claims with the other driver&#8217;s insurance company in a motor vehicle accident. Rhode Island uses a pure comparative negligence rule so even drivers who are partially at fault can still recover damages.<\/p>\r\n<p>Drivers must have the right insurance coverage to avoid liability after an accident. They should also consult a <a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/rhode-island?fli=dcta\" target=\"_blank\" rel=\"noopener\">personal injury attorney<\/a> who knows Rhode Island&#8217;s car accident laws.<\/p>\r\n<h2><b>Rhode Island Car Accident Compensation Laws<\/b><\/h2>\r\n<p>Rhode Island uses an <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/proving-fault-in-accidents.html\">at-fault rule<\/a> for car accident claims. Accident victims file their claims in an at-fault state with the other driver&#8217;s insurance company. The insurance adjusters review all claims and evidence and determine the at-fault driver. That driver&#8217;s insurance pays all claims for injuries and damages.<\/p>\r\n<p>Rhode Island requires all drivers to carry <a href=\"https:\/\/rules.sos.ri.gov\/regulations\/part\/230-20-05-3\" target=\"_blank\" rel=\"noopener\">liability insurance<\/a> to cover claims following an accident. The minimum insurance requirements are:<\/p>\r\n<ul>\r\n<li>$25,000 bodily injury liability coverage per person<\/li>\r\n<li>$50,000 bodily injury liability coverage per accident<\/li>\r\n<li>$25,000 property damage per accident<\/li>\r\n<\/ul>\r\n<p>Rhode Island does not require <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/uninsured-motorist-insurance-coverage-and-claims.html\">uninsured\/underinsured motorist coverage<\/a>. UI\/UIM coverage pays injury claims if the other driver does not have insurance, or their insurance policy limits will not cover your claim. Your insurance company may ask you to opt out of UI\/UIM coverage.<\/p>\r\n<h2><b>Comparative Negligence<\/b><\/h2>\r\n<p>Rhode Island is one of a few states that uses a <a href=\"https:\/\/codes.findlaw.com\/ri\/title-9-courts-and-civil-procedure-procedure-generally\/ri-gen-laws-sect-9-20-4.html\" target=\"_blank\" rel=\"noopener\">pure comparative negligence<\/a> rule. Comparative fault recognizes that in an auto accident, both drivers may share some blame for the injuries and damages. <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/comparative-negligence.html\">Pure comparative fault<\/a> lets both drivers recover damages but reduces their award in proportion to their degree of fault. If a driver is 20% at fault, they can only recover 80% of their damages.<\/p>\r\n<h2><b>Damages and Limits<\/b><\/h2>\r\n<p>In a personal injury lawsuit, &quot;damages&quot; are the monetary losses from the accident. These consequential damages are a direct result of the car crash. You may claim two&nbsp;<a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-pain-and-suffering-damages.html\">types of damages<\/a> in a car accident case.<\/p>\r\n<p><b>Economic damages<\/b> are objective expenses, such as medical expenses, lost income, and out-of-pocket expenses. Adjusters determine <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\">economic damages<\/a> with medical bills, police reports, and witness statements.<\/p>\r\n<p><b>Non-economic damages<\/b> are intangible losses, like <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-pain-and-suffering-damages.html\">pain and suffering<\/a>, emotional distress, and loss of consortium.
