Exceptions include employers of <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/domestic-workers-bill-of-rights.html\">domestic<\/a> and <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/farm-workers-and-h2b-workers-rights.html\">agricultural<\/a> workers. Several occupational diseases are explicitly compensable as personal injuries under Rhode Island workers&#8217; compensation law, including <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2015\/05\/can-i-get-workers-compensation-for-a-hernia.html\">hernia<\/a>, disability arising from <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/silicosis-silica-faq.html\">silicosis<\/a> or <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/mesothelioma-and-asbestos.html\">asbestosis<\/a>, and anthrax poisoning. Mental injuries are covered so long as the injury stems from either physical injury or emotional stress greater than day-to-day stresses. This means that medical treatment for anxiety stemming from a work review is unlikely to be covered.<\/p>\r\n<h2>Benefits<\/h2>\r\n<p>Injured employees are entitled to wage replacement benefits equal to 75 percent of their <a href=\"http:\/\/www.dlt.ri.gov\/wc\/infowages.htm\" target=\"_blank\" rel=\"noopener\">average spendable weekly wage<\/a>, subject to state-imposed limits. In addition to <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-benefits-explained.html\">traditional medical treatment benefits<\/a>, Rhode Island offers <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/rehabilitation-rights-of-injured-workers.html\">services<\/a> to injured workers through the <a href=\"http:\/\/www.dlt.ri.gov\/donley\/\" target=\"_blank\" rel=\"noopener\">Dr. John E. Donley Rehabilitation Center<\/a>. Services available here include physical and occupational therapy, psychological counseling, vocational counseling, and pain management treatment programs.<\/p>\r\n<p>Rhode Island is one of the few states which protects your right to return to your job (in most cases). You must claim your right to reinstatement within 10 days of your doctor releasing you for work. However, ultimately Rhode Island is an <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/at-will-employee-faq-s.html\">at-will employment<\/a> state, so your employer may legally terminate your employment despite this right. Finally, if your loved one <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2015\/04\/death-at-work-workers-comp-or-wrongful-death-claim.html\">died<\/a> due to a workplace injury or occupational disease, you may be entitled to death benefits.<\/p>\r\n<h2>Dispute Resolution<\/h2>\r\n<p>If your claim is <a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation\/workers-comp-denied-here-are-your-next-steps.html\">denied<\/a>, you may request a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2014\/09\/denied-workers-comp-5-first-steps-to-appeal.html\">hearing<\/a>, where you or your attorney will have the opportunity to present evidence supporting your position.
