Schedule II drugs also have a high potential for abuse, but they have some accepted medical uses. Examples of <a href=\"https:\/\/sdlegislature.gov\/Statutes\/34-20B-16\" target=\"_blank\" rel=\"noopener\">Schedule II drugs<\/a> include the following:<\/p>\r\n<ul>\r\n<li>Methamphetamine<\/li>\r\n<li>Opium poppy<\/li>\r\n<li>Methadone<\/li>\r\n<li>Oxycodone<\/li>\r\n<\/ul>\r\n<p>Heroin is illegal under both federal and state law. If three or more of the following aggravating factors apply, the violation is a <b>Class 3 felon<\/b>y:<\/p>\r\n<ul>\r\n<li>The person possesses $300 or more in cash<\/li>\r\n<li>The person possesses a firearm or other weapon<\/li>\r\n<li>The person possesses bulk materials used for packaging controlled substances<\/li>\r\n<li>The person possesses materials used to manufacture controlled substances (e.g., recipes, laboratory equipment, lighting, etc.)<\/li>\r\n<li>The possession of drug transaction records or customer lists<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/sdlegislature.gov\/Statutes\/22-42-2\" target=\"_blank\" rel=\"noopener\">Distributing heroin, opioids, or opiates to a minor<\/a>: <b>Class 2 felony<\/b><\/p>\r\n<p><a href=\"https:\/\/sdlegislature.gov\/Statutes\/22-42-2\" target=\"_blank\" rel=\"noopener\">Distributing a controlled substance<\/a> that results in the death of a person who used it: <b>Class 2 felony<\/b><\/p>\r\n<ul>\r\n<li>If three or more aggravating factors apply: <b>Class 1 felony<\/b><\/li>\r\n<li>If the controlled substance was fentanyl: <b>Class 1 felony<\/b><\/li>\r\n<li>If the person who died was a minor: <b>Class C felony<\/b><\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>South Dakota Drug-Free Zone Offenses and Penalties<\/b><\/p>\r\n<\/th>\r\n<td><p>Committing a heroin, opioid, or opiate crime in, on, or within 1,000 feet of a school or playground, or in, on, or within 500 feet of a public or private youth center, public swimming pool, or video arcade facility: <b>Class 4 felony<\/b><\/p>\r\n<p>Offenders face a minimum mandatory sentence of five years in a state correctional facility.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>South Dakota Criminal Penalties<\/b><\/p>\r\n<\/th>\r\n<td><p>Penalties for heroin, opioid, or opiate crimes face the following penalties:<\/p>\r\n<ul>\r\n<li><b>First conviction<\/b>: mandatory minimum sentence of at least one year in a South Dakota correctional facility<\/li>\r\n<li><b>Second or subsequent offense<\/b>: mandatory minimum sentence of at least 10 years<\/li>\r\n<li><b>First conviction of distributing controlled substances to a minor<\/b>: mandatory minimum sentence of at least five years<\/li>\r\n<li><b>Second or subsequent offense of distributing controlled substances to a minor<\/b>: mandatory minimum sentence of at least 15 years<\/li>\r\n<\/ul>\r\n<p>Other applicable <a href=\"https:\/\/sdlegislature.gov\/Statutes\/22-6-1\" target=\"_blank\" rel=\"noopener\">criminal penalties<\/a> are as follows (maximum penalties listed):<\/p>\r\n<ul>\r\n<li><b>Class C felony<\/b>: life imprisonment in a state correctional facility and a fine of up to $50,000<\/li>\r\n<li><b>Class 1 felony<\/b>: up to 50 years imprisonment and a fine of up to $50,000<\/li>\r\n<li><b>Class 2 felony<\/b>: up to 25 years imprisonment and a fine of up to $50,000<\/li>\r\n<li><b>Class 3 felony<\/b>: up to 15 years imprisonment and a fine of up to $30,000<\/li>\r\n<li><b>Class 4 felony<\/b>: up to 10 years imprisonment and a fine of up to $20,000<\/li>\r\n<li><b>Class 5 felony<\/b>: up to five years of imprisonment and a fine of up to $10,000<\/li>\r\n<li><b>Class 6 felony<\/b>: up to two years of imprisonment and a fine of up to $4,000<\/li>\r\n<\/ul>\r\n<p>If the defendant was under 18 years old when they committed the offense, and they are convicted of a Class A, B, or C felony, the maximum sentence is a term of years determined by the court in a state correctional facility and a fine of $50,000.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i>Note: South Dakota state laws are subject to change.
