This automatic exemption covers real property up to one acre within city limits or 160 acres in rural areas without requiring any formal filing. The protection does not apply to voluntary mortgages, mechanic’s liens, or property taxes.

South Dakota lets you protect all of your home equity from most creditors, with no dollar cap. The law limits the size of the property you can shield, and it doesn’t protect you from property tax liens or collection for unpaid property taxes.

If you are facing a lawsuit, medical debt, or bankruptcy, South Dakota‘s homestead exemption can protect all of your home equity in your real estate. Not every South Dakotan homeowner qualifies for full protection. The state’s homestead law sets acreage limits, defines what property counts, and includes a separate program for seniors that operates differently from the general exemption. If you’re dealing with a judgment, thinking about bankruptcy, or want to understand your rights, a South Dakota bankruptcy attorney can offer legal advice and explain how much equity you can protect.

How Much of Your Home Can You Protect?

South Dakota doesn’t set a dollar limit on its general homestead protection under the state’s codified laws. If you owe credit card debt, medical bills, or personal loans, your home equity is protected from judgment liens and judicial sale, regardless of the amount.

Property taxes are treated differently. South Dakota‘s homestead exemption doesn’t protect your home from property tax liens or other collection for unpaid property taxes.

The law limits the size of the property you can protect, regardless of your home’s worth. You can shield up to one acre inside city limits or up to 160 acres in a rural area. For mineral lands, coverage is 40 acres for a placer claim outside a city, five acres for a lode mining claim, and one acre within city limits.

South Dakota doesn’t increase these limits based on marital status or disability, but it does have an age-70 property tax rule. You can’t split the exemption across two properties. If you own more than one home, only one gets homestead protection.

What Property Counts as a Homestead?

The homestead exemption in South Dakota covers more than just a single-family house. It applies to real property, such as a house or mobile home, any attached buildings, and part of the property used for business purposes.

If your property spans more than one lot or tract, those tracts often need to be next to each other or used together in good faith as part of your residence. Assets that always fall outside the exemption include:

Gold and silver mines, mills, and related machinery: It doesn’t matter if your home sits on the same piece of land. You can use the exemption on your house, but not on these.

Leaseholds without ownership rights usually do not qualify: The exemption requires ownership or a similar legal interest. If you have a life estate and live on the property as your main home, you can often claim the exemption. Details can vary. If you’re uncertain, an attorney can review your specific situation.

The home being claimed must be your primary residence. A hunting cabin or a vacation home don’t qualify.

How To Claim the Exemption

You don’t need to file paperwork to receive South Dakota‘s basic homestead protection. Under South Dakota law, the exemption applies automatically once your property qualifies as your primary residence. South Dakota doesn’t require a formal declaration.

You may choose to record a description of your homestead with the county register of deeds. This step is optional, but it creates a public record of your property’s boundaries and can help prevent disputes with creditors or in future property disputes.

A separate deferral program for homeowners aged 70 and older lets them postpone paying property taxes altogether until the home is sold or transferred. Another program lets you defer property tax payments until you sell or transfer the home. This option requires you to apply each calendar year and provide proof of age, residency, and income. If you use this deferral, you can’t also claim the state’s sales and property tax refund. Compare the two options to see which offers more savings before you apply.

If you file for bankruptcy, claim the homestead exemption using the standard legal process. List the property on Schedule A/B, claim the exemption on Schedule C, and state whether you plan to keep or surrender the home if you file under Chapter 7 bankruptcy. South Dakota is an opt-out state, so you must use South Dakota‘s exemptions instead of the federal bankruptcy exemptions. Under the federal rule governing which state’s exemptions apply, you often need to have been living in South Dakota for at least 730 days before filing to use its exemptions.

What the Homestead Exemption Doesn’t Cover

The homestead exemption laws protect you from a wide range of creditor claims. However, they don’t wipe out all debts tied to your property. Several debt categories are not covered:

Ordinary judgment liens are covered: The exemption protects your home from most general creditor claims, such as credit card debt, medical bills, and personal loans

Mortgages and deeds of trust are not covered: If you voluntarily signed for a mortgage or deed of trust, the exemption does not protect you from foreclosure by your lender

Mechanic’s and materialmen’s liens are not covered: Contractors and suppliers who worked on your property can still enforce a lien against your home

Property tax liens are generally not covered: Property taxes can still be collected against a homestead

Liens that were recorded before your property became a homestead are not covered: The exemption does not remove liens that already existed

For married spouses, both spouses usually should sign before they can sell, mortgage, or encumber their home. The state law provides exceptions to this rule, such as in cases where one spouse can’t sign because they’re a prisoner of war or missing in action. Transfers made without the required signatures or intended to hide assets from creditors can be challenged as fraudulent conveyances, separate from the homestead exemption.

The Federal Bankruptcy Cap on Home Equity

Even South Dakota bankruptcy law’s unlimited protection has limits. Under the federal rule capping recently acquired home equity, your homestead exemption is capped if you acquired the home within about 1,215 days, or 40 months, before filing. The current cap of $214,000 applies regardless of how broad South Dakota‘s own exemption is.

This provision targets people who convert non-exempt assets, such as certain personal property, into home equity shortly before filing for bankruptcy. It’s often paired with related fraud-based limits. If you bought your home within the past 40 months, or if you’re not sure how the timeline applies to your situation, speaking with an attorney can be a tremendous help.

Get Help Protecting Your Home

If you’re facing a lawsuit, significant debt, or considering bankruptcy, knowing how much of your home is protected can shape every other decision you make.
