The&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/a-divorce-timeline.html\">legal process for dissolving a marriage<\/a>&nbsp;in South Dakota is similar to that of most other states.<\/p>\r\n<p>Many people assume they can handle their divorce case themselves. It isn\u2019t until they\u2019re midway through the divorce process that they realize they\u2019re in over their heads.<\/p>\r\n<p>Here, we\u2019ll explain the basic divorce process in South Dakota. We\u2019ll discuss the legal requirements for divorce, such as the state&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-residency-faq-s.html\">residency requirements<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/why-is-there-a-divorce-waiting-period\/\">waiting periods<\/a>. We\u2019ll also describe how the courts resolve issues such as&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/spousal-support-alimony-basics.html\">spousal support<\/a>,&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support.html\">child support<\/a>, and the&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/divorce-property.html#:~:text=There%20are%20two%20main%20systems,states%2C%20including%20California%20and%20Texas.\">division of marital property<\/a>.<\/p>\r\n<p>This article provides a brief overview of divorce laws in the state of South Dakota. Reference the chart below and the helpful links for further information.<\/p>\r\n<h2><b>South Dakota Divorce Laws: At a Glance<\/b><\/h2>\r\n<p>South Dakota has the most lenient&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-4-30\" target=\"_blank\" rel=\"noopener\">residency requirements<\/a>&nbsp;when it comes to divorce. Most states require the petitioner to live in-state for months or even a year before filing for divorce, but the South Dakota courts only require you to live in-state when you file for divorce.<\/p>\r\n<p>The court may require you to remain in the state during the divorce proceedings. Be aware that if your spouse lives in the state the two of you last resided in, the court may be limited to only granting you a divorce.<\/p>\r\n<p>The South Dakota court may not have jurisdiction over issues such as child custody and support, or distribution of marital property that lies in the state where the other spouse resides.<\/p>\r\n<p>In addition to having no residency requirements, South Dakota divorce law doesn\u2019t require separation before divorce. You and your spouse can live together until the judge issues the decree of divorce. While most people getting divorced would rather not live with their spouse once they file, it\u2019s good to know that this is an option.<\/p>\r\n<p>One legal requirement the South Dakota courts impose is a mandatory 60-day waiting period. The judge cannot issue the final judgment for divorce until at least 60 days have passed since you filed your divorce papers. This \u201ccooling off\u201d period allows the parties to reconcile or modify the divorce settlement agreement.<\/p>\r\n<p>It\u2019s important to point out that the court can enter temporary orders concerning child custody, support, alimony (spousal support), and use of the marital residence during the waiting period.<\/p>\r\n<h2>No-Fault Divorce and Fault-Based Divorce<\/h2>\r\n<p>South Dakota recognizes both&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/an-overview-of-no-fault-and-fault-divorce-law.html\">fault and no-fault divorce<\/a>. A fault-based divorce action allows the petitioner to blame the divorce on their spouse. With a no-fault divorce, you need only cite irreconcilable differences between you and your spouse.<\/p>\r\n<p>South Dakota law recognizes six&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-4-2\" target=\"_blank\" rel=\"noopener\">grounds for divorce<\/a>, including:<\/p>\r\n<ul>\r\n<li>Adultery<\/li>\r\n<li>Extreme cruelty<\/li>\r\n<li>Willful desertion<\/li>\r\n<li>Willful neglect<\/li>\r\n<li>Habitual intemperance<\/li>\r\n<li>Conviction of a felony<\/li>\r\n<\/ul>\r\n<p>You must submit evidence to back it up if you cite specific grounds for divorce. You cannot accuse your spouse of adultery or extreme cruelty without having concrete evidence of such misconduct. This is because marital misconduct, especially domestic violence, can affect the custody of minor children, alimony, and the division of marital property.<\/p>\r\n<h2>Uncontested and Contested Divorce in South Dakota<\/h2>\r\n<p>Once you decide whether to file a fault-based or no-fault divorce, you must determine the type of divorce you will file. There are two types &#8211; contested and uncontested. An uncontested divorce is appropriate for couples who have already negotiated the terms of their divorce. Not only is it less expensive than a contested divorce, but it is also less emotionally draining.<\/p>\r\n<p>Petitioners who file a contested divorce do so because they can\u2019t agree on the material terms of their divorce. Some of these include:<\/p>\r\n<ul>\r\n<li>Alimony\/Spousal support<\/li>\r\n<li>Child custody<\/li>\r\n<li>Child support<\/li>\r\n<li>Equitable distribution of marital property<\/li>\r\n<li>Allocation of marital debts<\/li>\r\n<\/ul>\r\n<p>With a contested divorce, you must pay not only the filing fees but other expenses as well. For example, you\u2019ll have to pay more in attorney fees. Your family law attorney will spend hours negotiating a&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\">settlement agreement<\/a>. You may also incur costs for depositions, private investigators, and appraisers. It all depends on the facts of your case.<\/p>\r\n<h2>Alimony and Spousal Support in South Dakota<\/h2>\r\n<p>According to&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-4-41\" target=\"_blank\" rel=\"noopener\">South Dakota Codified Law Section 25-4-41<\/a>, the courts grant alimony to help the lower-earning spouse become self-supporting. It&#8217;s not something the courts use to punish the spouse it orders to pay support. That doesn&#8217;t mean adultery will not impact spousal support.<\/p>\r\n<p>South Dakota divorce law recognizes <a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-4-40\" target=\"_blank\" rel=\"noopener\">three types of alimony<\/a> &#8211; General, Rehabilitative, and Restitutional. These types of alimony are described as follows:<\/p>\r\n<ul>\r\n<li><b>General alimony<\/b>: Ensures the receiving spouse can maintain housing and provide for their necessities such as food and clothes<\/li>\r\n<li><b>Rehabilitative alimony<\/b>: Helps the receiving spouse return to school or learn skills that will increase their ability to find a good-paying job and be in a position to support themselves<\/li>\r\n<li><b>Restitutional alimony<\/b>: Reimburses the receiving spouse for contributions made toward the other spouse&#8217;s education or training received during the marriage<\/li>\r\n<\/ul>\r\n<p>It&#8217;s important to note that general alimony can be temporary or permanent. Temporary alimony is usually given to the lower-earning spouse to help support them during divorce proceedings. For example, if one spouse can\u2019t afford a divorce attorney, the judge may order the other party to pay them temporary support.<\/p>\r\n<p>Receiving temporary alimony during the divorce case does not guarantee post-divorce support. The court considers several factors to determine whether and for how long the lower-earning spouse will receive spousal support.<\/p>\r\n<p>The judge will consider the following factors when determining separate maintenance\/alimony:<\/p>\r\n<ul>\r\n<li>Standard of living during the marriage<\/li>\r\n<li>The earning capacity and financial resources of both parties<\/li>\r\n<li>Age, health, and general physical condition of the relative spouses<\/li>\r\n<li>Length of the marriage<\/li>\r\n<li>Contributions of each party as it relates to caring for children, homemaking, and other duties<\/li>\r\n<li>Each party&#8217;s fault which led to dissolution of the marriage<\/li>\r\n<li>Any other factors that the court deems relevant and equitable<\/li>\r\n<\/ul>\r\n<p>If the judge orders alimony, they will specify the amount and duration.<\/p>\r\n<p>Permanent alimony terminates upon the death of either party. It will also end when the receiving spouse remarries. In the case of remarriage, the paying spouse must file a motion with the court. Alimony will not terminate automatically in this situation.<\/p>\r\n<h2>Child Custody and Child Support<\/h2>\r\n<p>In most divorce cases, the parties agree on child custody. If they cannot do this, the court will determine who has custody of the minor children. Usually, the parent who was the child&#8217;s primary caretaker will retain primary physical custody. The parties almost always share joint legal custody.<\/p>\r\n<p>South Dakota uses&nbsp;<a href=\"https:\/\/dss.sd.gov\/childsupport\/obligationsdetermined.aspx\" target=\"_blank\" rel=\"noopener\">child support guidelines<\/a>. These guidelines dictate the amount of child support the non-custodial parent must pay.<\/p>\r\n<h2>Division of Marital Assets and Liabilities<\/h2>\r\n<p>South Dakota is not a community property state. The court uses equitable distribution to divide marital property. According to&nbsp;<a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-4-44\" target=\"_blank\" rel=\"noopener\">South Dakota Codified Law Section 25-4-44<\/a>, the courts determine the division of property based on equity and the parties&#8217; financial position.<\/p>\r\n<p>Any property the parties acquire during the marriage will be subject to equitable distribution. This includes, but is not limited to, the following:<\/p>\r\n<ul>\r\n<li>Real estate (Marital home, rental properties, etc.)<\/li>\r\n<li>Personal property (Cars, art, jewelry, etc.)<\/li>\r\n<li>Family pets<\/li>\r\n<li>Bank accounts<\/li>\r\n<li>Retirement accounts<\/li>\r\n<li>Pension plans<\/li>\r\n<\/ul>\r\n<p>The court uses fairness to decide how it will divide marital property and liabilities. The parties get to keep their separate property. Separate property includes anything the parties brought into the marriage. It also includes gifts, inheritances, and personal injury awards\/settlements.<\/p>\r\n<h2>A Review of South Dakota Divorce Laws<\/h2>\r\n<p>While it&#8217;s good to read the laws as written, the legalese can be somewhat difficult to interpret.
