A victim (the petitioner) may file a petition for a protective order to stop their alleged abuser (the respondent) from harassing or abusing them.<\/p>\r\n<p>Courts in South Dakota may issue several different types of protection orders, including the following:<\/p>\r\n<ul>\r\n<li>Stalking protection orders<\/li>\r\n<li>Domestic protection orders<\/li>\r\n<li>Physical injury protection orders<\/li>\r\n<li>No-contact orders<\/li>\r\n<li>Permanent protection orders<\/li>\r\n<li>Vulnerable adult protection orders<\/li>\r\n<\/ul>\r\n<p>This article briefly overviews South Dakota law on domestic protection orders. It begins with a brief overview of <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-proof-do-you-need-to-get-a-restraining-order\/\">domestic protection orders<\/a> and how to file one. It then gives a table with information about South Dakota protection order laws. It concludes with a list of resources you may find helpful as you continue your legal research.<\/p>\r\n<h2><b>Filing a Protection Order in South Dakota<\/b><\/h2>\r\n<p>To get a domestic protection order, the petitioner must file a petition and affidavit with the clerk of the court&#8217;s office at their local circuit court or magistrate court. South Dakota&#8217;s <a href=\"https:\/\/ujslawhelp.sd.gov\/protectionorders.aspx\" target=\"_blank\" rel=\"noopener\">self-help website<\/a> offers the forms the petitioner needs, and the court clerk can give them the necessary forms.<\/p>\r\n<p>Once filed, the judge will take one of the three following actions:<\/p>\r\n<ul>\r\n<li>Grant a temporary protection order (or an ex parte temporary protection order)<\/li>\r\n<li>Grant a court hearing for a permanent protection order<\/li>\r\n<li>Decline to grant the protection order<\/li>\r\n<\/ul>\r\n<p>If the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/restraining-order-basics\/\">court holds a hearing<\/a>, the petitioner must present evidence of why they believe the court should issue the order. The respondent does not have to appear but can if they object to the petition. Both parties may hire attorneys to represent them at the hearing.<\/p>\r\n<p>South Dakota has a <a href=\"https:\/\/ujslawhelp.sd.gov\/protectionorders.aspx\" target=\"_blank\" rel=\"noopener\">self-help website<\/a> that provides resources you may find useful as you research or prepare to file a protective order. The website allows you to draft a protection order form and provides information about the filing and hearing processes. Your local clerk of courts can also provide basic information about filing a petition for a protective order.<\/p>\r\n<h3><b>Definition of Domestic Abuse<\/b><\/h3>\r\n<p><a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-10-1\" target=\"_blank\" rel=\"noopener\">Domestic abuse<\/a>, when it happens between people in a relationship, is:<\/p>\r\n<ul>\r\n<li>Physical harm<\/li>\r\n<li>Bodily injury<\/li>\r\n<li>Attempts to cause physical harm or bodily injury<\/li>\r\n<li>The infliction of fear or imminent physical harm or bodily injury<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/sdlegislature.gov\/Statutes\/25-10-3.1\" target=\"_blank\" rel=\"noopener\">People in a relationship<\/a> include the following people:<\/p>\r\n<ul>\r\n<li>Spouses and former spouses<\/li>\r\n<li>Anyone who is in a significant romantic relationship with the abusing party (or was in one during the past 12 months)<\/li>\r\n<li>Has a child or is expecting a child with the abusing party<\/li>\r\n<li>Parents and children (including adopted children, guardians, and through marriage)<\/li>\r\n<li>Siblings<\/li>\r\n<\/ul>\r\n<p>Consult the table below for more information about the specifics of South Dakota&#8217;s protective order laws.<\/p>\r\n<h2><b>Protective Orders Laws in South Dakota<\/b><\/h2>\r\n<p>The following table highlights the main provisions of South Dakota&#8217;s protective orders laws.
