Under Tennessee&#8217;s old contributory negligence rule, a driver even 1% at fault could not recover any damages in an accident.<\/p>\r\n<p>The <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/negligence.html\">modified comparative negligence rule<\/a> used in Tennessee lets drivers recover in an insurance claim if they are less than 50% at fault in the accident. Adjusters determine fault by reviewing medical bills, police reports, and witness statements.<\/p>\r\n<h2><b>Damages and Limits<\/b><\/h2>\r\n<p>In a personal injury claim, &quot;damages&quot; are the monetary costs of injuries and property damage that follow a car crash. There are two types of damages: economic and non-economic.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\">Economic damages<\/a> are objective costs calculated from medical and payroll records. They include:<\/p>\r\n<ul>\r\n<li>Medical treatment costs, including future care<\/li>\r\n<li>Lost income and earning capacity<\/li>\r\n<li>Out-of-pocket repairs and property damage<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/car-accident-pain-and-suffering-damages.html\">Non-economic damages<\/a> are subjective damages resulting from the impact of the accident. These include:<\/p>\r\n<ul>\r\n<li>Pain and suffering<\/li>\r\n<li>Emotional distress<\/li>\r\n<li>Loss of consortium<\/li>\r\n<\/ul>\r\n<p>Tennessee allows <a href=\"https:\/\/codes.findlaw.com\/tn\/title-29-remedies-and-special-proceedings\/tn-code-sect-29-39-104.html\" target=\"_blank\" rel=\"noopener\">punitive damages<\/a> in cases where car accident victims can show the at-fault party acted with malicious, intentional, or reckless intent. Juries seldom award punitive damages in accident claims.<\/p>\r\n<h3><b>Limits<\/b><\/h3>\r\n<p>Tennessee does <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-are-damages-caps\/\">not have caps<\/a> on economic damages. A catastrophic injury is:<\/p>\r\n<ul>\r\n<li>A spinal cord injury resulting in paraplegia or quadriplegia<\/li>\r\n<li>Amputation of both hands, both feet, or one hand and one foot<\/li>\r\n<li>Third-degree burns over 40% of the body or third-degree burns over 40% of the face<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/wrongful-death.html\">Wrongful death<\/a> of a parent leaving a surviving minor child<\/li>\r\n<\/ul>\r\n<p>State law caps punitive damages at two times compensatory damages or $500,000, whichever is greater.<\/p>\r\n<p>Tennessee has a short <a href=\"https:\/\/codes.findlaw.com\/tn\/title-28-limitation-of-actions\/tn-code-sect-28-3-104.html\" target=\"_blank\" rel=\"noopener\">statute of limitations<\/a>, only one year from the date of the accident, to file a personal injury lawsuit. The insurance company may require claimants to wait until they have completed the claims process before beginning legal action.
