Usually in order to be guilty of criminal trespass, there must be some <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\" target=\"_blank\">intent<\/a>, meaning that accidentally going on another person&#8217;s property isn&#8217;t a punishable offense. In Tennessee, it&#8217;s a defense to prosecution under the criminal trespass statute if a person:<\/p>\r\n<ul>\r\n<li>entered or remained on property they reasonably believed they had the owner&#8217;s consent to enter;<\/li>\r\n<li>didn&#8217;t substantially interfere with the owner&#8217;s use of the property; <b><i>and<\/i><\/b><\/li>\r\n<li>immediately left upon request.<\/li>\r\n<\/ul>\r\n<p>This defense can&#8217;t be used when the property owner posts visible signs indicating that unauthorized people are prohibited from entering the property.<\/p>\r\n<h2>An Overview of Tennessee Criminal Trespassing Laws<\/h2>\r\n<p>Statutes are a good source of information when you&#8217;re looking for an answer to a legal question. Consent may be inferred when property is used for commercial activity open to the public or when a property owner has indicated their intent to have the property open to the public.<\/p>\r\n<p><i>Aggravated criminal trespass<\/i> occurs when a person enters or remains on someone&#8217;s property <b><i>and<\/i><\/b> one of the following conditions are present:<\/p>\r\n<ul>\r\n<li>The person knows that they don&#8217;t have the property owner&#8217;s consent to do so and intends, knows, or is reckless about whether their presence will cause someone else to fear for their safety; or<\/li>\r\n<li>The person destroys, alters, vandalizes, or removes a barrier designed to prevent trespassers from entering the property (i.e. a fence, gate, lock, sign, chain) to gain entry.<\/li>\r\n<\/ul>\r\n<p><i>Trespass by motor vehicle<\/i> occurs when a person drives, parks, or otherwise operates a motor vehicle through or within a parking area or roadway that&#8217;s located on private property that&#8217;s used by patrons, customers or employees of business establishments on that property after being told to leave or stop doing one of the activities mentioned.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Charges<\/b><\/td>\r\n<td><p><i>Criminal trespass<\/i> and <i>trespass by motor vehicle<\/i> are Class C misdemeanors.<\/p>\r\n<p><i>Aggravated criminal trespass<\/i> is a Class A misdemeanor if committed in a <a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-14-401.html\" target=\"_blank\" rel=\"noopener\">habitation<\/a>, hospital, or at a public or private school, and a Class B misdemeanor if committed anywhere else.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Penalties<\/b><\/td>\r\n<td><p>The <a href=\"https:\/\/codes.findlaw.com\/tn\/title-40-criminal-procedure\/tn-code-sect-40-35-111.html\" target=\"_blank\" rel=\"noopener\">authorized penalties for misdemeanors<\/a> are as follows:<\/p>\r\n<ul>\r\n<li><i>Class A misdemeanor<\/i>: up to 11 months, 29 days and\/or a maximum fine of $2,500.<\/li>\r\n<li><i>Class B Misdemeanor<\/i>: not more than 6 months in jail and a $500 fine.<\/li>\r\n<li><i>Class C Misdemeanor<\/i>: not more than 30 days in jail* and a $50 fine.<\/li>\r\n<\/ul>\r\n<p>*the <i>trespass by motor vehicle<\/i> statute doesn&#8217;t permit incarceration.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Related Statute(s)<\/b><\/td>\r\n<td><p>Tennessee Code, Title 39, Chapter 14, Part 4:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-14-402.html\" target=\"_blank\" rel=\"noopener\">Section 39-14-402<\/a> (<i>Burglary<\/i>)<\/li>\r\n<li><a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-14-403.html\" target=\"_blank\" rel=\"noopener\">Section 39-14-403<\/a> (<i>Aggravated Burglary<\/i>)<\/li>\r\n<li><a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-14-404.html\" target=\"_blank\" rel=\"noopener\">Section 39-14-404<\/a> (<i>Especially Aggravated Burglary<\/i>)<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> State laws are always subject to change through the passage of new legislation, rulings in the higher courts (including federal decisions), ballot initiatives, and other means.
