The <span data-term-id=\"41155173\">resisting arrest<\/span> statute specifically requires that you commit the offense by applying force against the officer or a person acting in the <span data-term-id=\"41155189\">officer&#8217;s direction<\/span>.<\/p>\n<p>This means prosecutors need evidence that you actually resisted arrest by using any type of power or force. Take the case of <a href=\"https:\/\/www.tncourts.gov\/sites\/default\/files\/applegatebillyopn.pdf\" target=\"_blank\" rel=\"noopener\"><em>State v. Applegate<\/em><\/a> (2016). Here, the <span data-term-id=\"41155169\">Tennessee<\/span> Court of Criminal Appeals addressed the level of physical resistance that would constitute &#8220;force&#8221; under the <span data-term-id=\"41155173\">resisting arrest<\/span> statute. The defendant in this case pulled and tugged away from the officers. He was also yelling and being uncooperative when the officers were trying to put him in handcuffs. The defendant also pulled his hands away and struggled to avoid being handcuffed.<\/p>\n<p>What this means is that acts such as pulling your arm away or struggling while being handcuffed and being uncooperative are sufficient force for a <span data-term-id=\"41155173\">resisting arrest<\/span> conviction.<\/p>\n<h2><strong>How <span data-term-id=\"41155173\">Resisting Arrest<\/span> Differs from <span data-term-id=\"41155203\">Evading Arrest<\/span><\/strong><\/h2>\n<p><span data-term-id=\"41155201\">Tennessee<\/span><span data-term-id=\"41155201\"> law<\/span> treats <span data-term-id=\"41155173\">resisting arrest<\/span> and <span data-term-id=\"41155203\">evading arrest<\/span> very differently, even though both involve responding to a <span data-term-id=\"41155177\">police officer<\/span>&#8216;s attempt to arrest you.<\/p>\n<p><span data-term-id=\"41155173\">Resisting arrest<\/span> requires <em>using force<\/em> against <span data-term-id=\"41155170\">law enforcement officers<\/span>, a person acting in their direction, or a civil process server. <span data-term-id=\"41155203\">Evading arrest<\/span>, on the other hand, occurs when you <a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-16-603\/\" target=\"_blank\" rel=\"noopener\">intentionally flee<\/a> from a <span data-term-id=\"41155170\">law enforcement officer<\/span> you know is attempting to arrest you.<\/p>\n<h2><strong>The Unlawful Arrest Paradox<\/strong><\/h2>\n<p>One of the most confusing parts of <span data-term-id=\"41155169\">Tennessee<\/span>&#8216;s <span data-term-id=\"41155173\">resisting arrest<\/span> statute involves what happens when officers unlawfully arrest you. You can still face charges for resisting even when the officer had no legal grounds for the arrest. <span data-term-id=\"41155169\">Tennessee<\/span> <span data-term-id=\"41155196\">state law<\/span> essentially requires you to comply with police authority, regardless of whether the authority is exercised lawfully or not.<\/p>\n<p>Meanwhile, <a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-16-603\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41155202\">Tennessee<\/span><span data-term-id=\"41155202\"> Code<\/span><span data-term-id=\"41155202\"> Title<\/span> 39-16-603<\/a> explicitly allows the unlawfulness of the arrest as a defense to evading charges.<\/p>\n<p>So, for example, let&#8217;s say an officer pulls you over without reasonable suspicion or <span data-term-id=\"41155193\">probable cause<\/span> and orders you out of the <span data-term-id=\"41155190\">motor vehicle<\/span>. This is an unlawful stop. You initially refuse to stop, continue driving for several blocks, then finally pull over \u2014 this is <span data-term-id=\"41155203\">evading arrest<\/span>. When the officer approaches and tries to handcuff you, you pull your arm back and do not cooperate \u2014 this is resisting.<\/p>\n<p>You may have a defense to the <span data-term-id=\"41155203\">evading <\/span><span data-term-id=\"41155205\">arrest<\/span><span data-term-id=\"41155205\"> charge<\/span> because the stop was unlawful. However, you have no defense to the <span data-term-id=\"41155173\">resisting <\/span><span data-term-id=\"41155205\">arrest<\/span><span data-term-id=\"41155205\"> charge<\/span>, even though it is from the same unlawful stop.<\/p>\n<h2><strong>When Can You Resist an Arrest?<\/strong><\/h2>\n<p><span data-term-id=\"41155201\">Tennessee<\/span><span data-term-id=\"41155201\"> law<\/span> recognizes situations in which you can\u00a0<a href=\"https:\/\/codes.findlaw.com\/tn\/title-39-criminal-offenses\/tn-code-sect-39-11-611\/#:~:text=(3\" target=\"_blank\" rel=\"noopener\">physically resist arrest.<\/a><\/p>\n<p>First, the officer must be using or trying to use more force than the situation requires.
