This includes failure to provide adequate food, clothing, shelter, medical care, protection, and supervision, sometimes even endangering the child. In some cases, child neglect may even be considered criminal negligence. The state uses a \u201creasonable adult\u201d standard to determine whether a parent, guardian, or caregiver\u2019s actions amount to neglect.<\/i><\/blockquote>\r\n<p>When facing financial hardships or other circumstances that make it difficult to meet your child&#8217;s needs, parents may unintentionally cross the line as to what the law defines as child neglect. A <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">Texas family law<\/a> or a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">criminal law attorney<\/a> can answer questions about rights and ensure the well-being of the child.<\/p>\r\n<p>In this article, we&#8217;ll explain child neglect and abandonment laws in Texas, including how to report suspected neglect and the penalties for violating these laws.<\/p>\r\n<h2><b>Understanding Child Neglect Laws in Texas<\/b><\/h2>\r\n<p>Texas law requires parents, guardians, and caregivers to provide children with safe and adequate food, clothing, shelter, protection, medical care, and supervision. <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/FA\/htm\/FA.261.htm\" target=\"_blank\" rel=\"noopener\">Texas Family Code<\/a> defines child neglect as failure to meet these responsibilities or failure to arrange for someone else to provide for them.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/child-neglect.html\">Child neglect<\/a>, like other forms of abuse, must involve &quot;observable and material impairment&quot; or &quot;substantial risk&quot; to the child&#8217;s well being for the civil statute to apply. There are also criminal sanctions against anyone who knowingly abandons or endangers a child.<\/p>\r\n<h2><b>Understanding Child Abandonment Laws in Texas<\/b><\/h2>\r\n<p><a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-22-041\/\" target=\"_blank\" rel=\"noopener\">Texas state law<\/a> defines criminal child abandonment as leaving a child younger than age 15 in any place without providing reasonable and necessary child care. It applies in circumstances under which no reasonable, similarly situated adult would leave a child of that age and ability.<\/p>\r\n<p>Examples include leaving a six-year-old child alone in the food court of a mall or leaving a two-year-old alone at home. Criminal charges would also extend to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/child-abandonment.html\">intentionally abandoning a child<\/a> in any place that exposes the child to an unreasonable risk of harm or mental impairment.<\/p>\r\n<h2><b>Mandatory Reporting of Neglect and Abandonment<\/b><\/h2>\r\n<p>Texas law requires anyone with knowledge of suspected child abuse or neglect to report it to the appropriate authorities, including the <a href=\"https:\/\/www.dfps.texas.gov\/child_protection\/\" target=\"_blank\" rel=\"noopener\">Child Protective Services (CPS)<\/a> or other law enforcement agencies. <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/mandatory-reporting-laws-child-abuse-and-neglect.html\">Mandatory reporting<\/a> applies to everyone, not just teachers or healthcare professionals. The law even includes individuals whose personal communications are typically seen as privileged, such as attorneys, clergy members, and health care professionals. Failing to report suspected neglect is a Class A misdemeanor, punishable by as much as a year in state jail and a fine of up to $4,000.<\/p>\r\n<h2><b>Punishment for Child Neglect or Abandonment<\/b><\/h2>\r\n<p>Texas state law establishes a graduated system of penalties for child neglect and abandonment cases. The charges vary depending on the circumstances surrounding each case and the severity of the crime.<\/p>\r\n<p>Under the <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-22-041\/\" target=\"_blank\" rel=\"noopener\">Texas Penal Code<\/a>, child abandonment is a <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-12-35\/\" target=\"_blank\" rel=\"noopener\">state jail felony<\/a>. It carries a penalty of 180 days to two years of imprisonment and potential fines. Abandonment of a child without intent to return is a <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-12-34\/\" target=\"_blank\" rel=\"noopener\">third-degree felony<\/a>, punishable by two years to 10 years in prison and a fine of up to $10,000.<\/p>\r\n<p>Abandonment of a child that places the child in imminent danger of bodily injury or mental impairment carries a higher penalty. It can result in a <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-12-33\/\" target=\"_blank\" rel=\"noopener\">second-degree felony<\/a> with punishment ranging form two to 20 years of imprisonment and fines.<\/p>\r\n<p>Severe cases of child endangerment can result to third degree felony or higher. A higher penalty applies particularly when the person also commits family violence or other patterns of neglect.<\/p>\r\n<p>Child endangerment is a <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-12-35\/\" target=\"_blank\" rel=\"noopener\">state jail felony<\/a>, punishable by 180 days to two years of a prison sentence and a fine of up to $10,000. If the child endangerment is with imminent danger, it escalates to a first-degree felony.<\/p>\r\n<p>Child neglect and abandonment can also lead to <a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/termination-of-parental-rights.html\">termination of parental rights<\/a>.
