The amount of child support depends on the noncustodial parent&#8217;s net monthly income and other financial resources.<\/p>\r\n<p>Judges write child support orders with the best interests of the child in mind. All support orders contain provisions for health care, education, and other needs. In general, child support is separate from child custody matters. Under Texas law (<a href=\"https:\/\/codes.findlaw.com\/tx\/family-code\/fam-sect-154-011\/\" target=\"_blank\" rel=\"noopener\">Texas Family Code \u00a7 154.011<\/a>), a support order can&#8217;t make child support payments conditional on visitation rights.<\/p>\r\n<h3><b>Determining Child Support Payments<\/b><\/h3>\r\n<p>Courts calculate a parent&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-child-support-calculations.html\">child support obligation<\/a> after determining the obligor&#8217;s monthly gross income. Income is derived from the parent&#8217;s net resources and includes:<\/p>\r\n<ul>\r\n<li>All wages, salary, and other compensation<\/li>\r\n<li>Self-employment income<\/li>\r\n<li>Interest, dividends, and royalties<\/li>\r\n<li>Net rental income<\/li>\r\n<li>Pensions, unemployment benefits, disability and retirement benefits<\/li>\r\n<\/ul>\r\n<p>The court deducts allowable expenses, including:<\/p>\r\n<ul>\r\n<li>Social Security taxes<\/li>\r\n<li>Federal income tax (based on the tax rate for a single person claiming one personal exemption and the standard deductions)<\/li>\r\n<li>State income tax<\/li>\r\n<li>Union dues (if they are withheld)<\/li>\r\n<li>Expenses for health insurance coverage for obligor&#8217;s children (if these payments are withheld).<\/li>\r\n<\/ul>\r\n<p>Using the monthly net resources as a guide, the court will then apply a percentage based on the number of children before the court. The guideline <a href=\"https:\/\/csapps.oag.texas.gov\/monthly-child-support-calculator\" target=\"_blank\" rel=\"noopener\">child support chart<\/a> does not state how much child support each additional child must receive. The amount must match the needs of the child before the parents&#8217; separation.<\/p>\r\n<p>Child support must cover the child&#8217;s food, clothing, shelter, and education needs. The court may order more child support for other needs, such as:<\/p>\r\n<ul>\r\n<li>Medical support<\/li>\r\n<li>Dental insurance<\/li>\r\n<li>Child care expenses<\/li>\r\n<li>Education or medical coverage for special needs children<\/li>\r\n<\/ul>\r\n<p>If the obligor has health care or dental coverage for the child through employer health insurance, the order divides the cost by the number of dependents (<a href=\"https:\/\/codes.findlaw.com\/tx\/family-code\/fam-sect-154-062\/\" target=\"_blank\" rel=\"noopener\">\u00a7 154.062<\/a>). Court orders can include a requirement to pay out-of-pocket medical expenses not covered by insurance.<\/p>\r\n<h2><b>Texas Child Support Guidelines at a Glance<\/b><\/h2>\r\n<p>If you owe child support or are trying to secure support for your child, an attorney can handle the finer points of Texas family law.
