Let\u2019s identify and examine the differences between them.<\/p>\n<h3><span data-term-id=\"41235473\">Durable Power of Attorney<\/span> for <span data-term-id=\"41235508\">Financial Matters<\/span><\/h3>\n<p>The statutory authority for a financial <span data-term-id=\"41235473\">Durable Power of Attorney<\/span> is in the <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41235521\">Texas<\/span><span data-term-id=\"41235521\"> Estates Code<\/span><\/a>. The statutes address:<\/p>\n<ul>\n<li><strong>Capacity requirement<\/strong>: The principal must be competent at signing. Without this language, the <span data-term-id=\"41235490\">agent\u2019s authority<\/span> terminates at the principal\u2019s <span data-term-id=\"41235482\">incapacity<\/span>.<\/li>\n<li><strong>When the <span data-term-id=\"41235490\">agent authority<\/span> becomes effective<\/strong>: Under <span data-term-id=\"41235484\">Texas<\/span><span data-term-id=\"41235484\"> law<\/span>, a <span data-term-id=\"41235473\">durable power of attorney<\/span> is effective upon execution unless otherwise noted. This may include an effective date in the future or upon the occurrence of a certain contingency, such as the principal\u2019s <span data-term-id=\"41235482\">incapacity<\/span>.<\/li>\n<li><strong>Agent requirements<\/strong>: <span data-term-id=\"41235484\">Texas<\/span><span data-term-id=\"41235484\"> law<\/span> broadly permits the designation of a person, or sometimes a financial institution, to act as an agent. The agent must be able to act as <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-751-101\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41235510\">a fiduciary<\/span><\/a>. The law permits <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-751-023\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41235524\">co-agents<\/span> and successor agents<\/a>.<\/li>\n<li><strong>If the principal regains capacity<\/strong>: In the <span data-term-id=\"41235498\">statutory form<\/span>, the <span data-term-id=\"41235490\">agent\u2019s authority<\/span> does not automatically terminate when the principal regains capacity. The principal may <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-752-051\/\" target=\"_blank\" rel=\"noopener\">revoke<\/a> it at any time.<\/li>\n<\/ul>\n<p>Creating a DPOA can be tricky. In each case, the agent must act within the scope of authority granted by the principal, as defined and constrained by <span data-term-id=\"41235484\">Texas<\/span><span data-term-id=\"41235484\"> law<\/span>.<\/p>\n<h3><span data-term-id=\"41235501\">Medical Power of Attorney<\/span><\/h3>\n<p>Under <span data-term-id=\"41235484\">Texas<\/span><span data-term-id=\"41235484\"> law<\/span>, an agent acting under a <span data-term-id=\"41235501\">medical power of attorney<\/span> may make any <span data-term-id=\"41235504\">healthcare decision<\/span> the principal could make if competent. This includes consenting to or refusing treatment and accessing medical information. This authority only exists during the principal\u2019s <span data-term-id=\"41235482\">incapacity<\/span>.
