Most family law matters <a href=\"https:\/\/www.txcourts.gov\/about-texas-courts\/frequently-asked-questions\/\" target=\"_blank\" rel=\"noopener\">are heard in district courts<\/a>, although county courts at law hear some as well. Some child support cases are heard in a specialty court, which offers treatment instead of incarceration.<\/p>\r\n<p>Legal proceedings involving children are called a Suit Affecting the Parent-Child Relationship (SAPCR). SAPCR orders cover child custody, visitation rights, support payments, and more. The court rules in the best interests of the child.<\/p>\r\n<h2><b>What types of orders can a court enforce?<\/b><\/h2>\r\n<p>In the context of family law, the court may enforce orders dealing with a variety of matters. Issues eligible for enforcement actions include:<\/p>\r\n<ul>\r\n<li>Child visitation orders and rights for the noncustodial parent<\/li>\r\n<li>Property division ordered by a court in a divorce<\/li>\r\n<li><a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/FA\/htm\/FA.8.htm\" target=\"_blank\" rel=\"noopener\">Spousal maintenance<\/a> (alimony)<\/li>\r\n<li>Child custody orders<\/li>\r\n<\/ul>\r\n<p>Child support payments are handled by the <a href=\"https:\/\/www.texasattorneygeneral.gov\/child-support\/paying-and-receiving-child-support\" target=\"_blank\" rel=\"noopener\">Office of the Attorney General<\/a>, but issues can also be addressed through the court.<\/p>\r\n<h2><b>How does a court enforce an order?<\/b><\/h2>\r\n<p>This depends on the situation, but it&#8217;s often dealt with through a <a href=\"https:\/\/codes.findlaw.com\/tx\/government-code\/gov-t-sect-21-002\/\" target=\"_blank\" rel=\"noopener\">contempt of court<\/a> charge. The court can impose both jail time and a fine for the respondent violating the SAPCR or any other temporary order that the court has issued. Non-compliance with most issues in a court order is enforceable.<\/p>\r\n<h2><b>What do I need to file a contempt of court complaint?<\/b><\/h2>\r\n<p>Either you or an agency files the contempt complaint in the court with exclusive jurisdiction (where the family order was issued). You&#8217;ll need the <a href=\"https:\/\/guides.sll.texas.gov\/child-custody-and-support\/legal-forms\" target=\"_blank\" rel=\"noopener\">correct forms<\/a> for your particular SAPCR. It&#8217;s important to make sure your complaint addresses an issue defined in the SAPCR.<\/p>\r\n<h2><b>What about child support payment issues? Should I file a contempt charge or go through the Attorney General&#8217;s office?<\/b><\/h2>\r\n<p>For child support enforcement, the state of Texas recommends you work through the <a href=\"https:\/\/www.texasattorneygeneral.gov\/child-support\" target=\"_blank\" rel=\"noopener\">Office of the Attorney General<\/a>. They have powers the courts don&#8217;t, such as seizing money from tax returns and lottery winnings to pay overdue support. They can also initiate <a href=\"https:\/\/texaslawhelp.org\/article\/income-withholding-for-support-order-iwo-child-support#:~:text=An%20Income%20Withholding%20for%20Support%20Order%20(IWO)\" target=\"_blank\" rel=\"noopener\">an Income Withholding for Support Order (IWO)<\/a>, which takes money from the obligor&#8217;s paycheck.<\/p>\r\n<p>The office tends to fall behind due to the sheer number of cases it&#8217;s handling, so you can address the issue in a courtroom instead. The court <a href=\"https:\/\/texaslawhelp.org\/article\/enforcing-your-child-support-orders-on-your-own#:~:text=The%20court%20can%20take%20a%20variety%20of%20actions\" target=\"_blank\" rel=\"noopener\">can impose an IWO and other measures<\/a>, including:<\/p>\r\n<ul>\r\n<li>Suspension of the non-paying parent\u2019s driver\u2019s license or other professional licenses and certificates<\/li>\r\n<li>Placing a lien on properties, bank accounts, retirement plans, and other assets<\/li>\r\n<\/ul>\r\n<p>While legal assistance isn&#8217;t required for filing contempt charges, Texas recommends it. A <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">Texas family law attorney<\/a> can offer legal help.<\/p>\r\n<h2><b>If a party is found in contempt of court, will the judge always send them to jail?<\/b><\/h2>\r\n<p>No. If the party is employed, sending the party to jail may make payment more difficult or even impossible. A judge may <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/suspended-sentences.html\">suspend the jail sentence<\/a> and instead impose conditions such as a new payment schedule, supervised visitations, or a change to the custody agreement.<\/p>\r\n<p>While contempt can land a defendant in jail, the court can order <a href=\"https:\/\/texaslawhelp.org\/article\/enforcing-your-child-support-orders-on-your-own#:~:text=community%20supervision%20(also%20called%20probation)\" target=\"_blank\" rel=\"noopener\">community supervision (probation)<\/a> for up to ten years. This can require that the defendant:<\/p>\r\n<ul>\r\n<li>Pay all back child support and attorney\u2019s fees<\/li>\r\n<li>Attend financial counseling classes<\/li>\r\n<li>Obtain substance abuse treatment<\/li>\r\n<li>Seek employment services (if unemployed)<\/li>\r\n<\/ul>\r\n<p>When a jail sentence is suspended, the judge will order the party to appear in court at a later date to determine if the party has obeyed the conditions of the suspended jail sentence. If they have not, the party may face <a href=\"https:\/\/codes.findlaw.com\/tx\/government-code\/gov-t-sect-21-002\/\" target=\"_blank\" rel=\"noopener\">jail time for contempt<\/a>.<\/p>\r\n<h2><b>What are the penalties for contempt of court?<\/b><\/h2>\r\n<p>Someone convicted of contempt faces a fine, jail time, or both. The fine is up to $500. Jail time is <a href=\"https:\/\/codes.findlaw.com\/tx\/government-code\/gov-t-sect-21-002\/#:~:text=The%20punishment%20for%20contempt%20of%20a%20court%20other%20than%20a%20justice%20court%20or%20municipal%20court%20is%20a%20fine%20of%20not%20more%20than%20%24500%20or%20confinement%20in%20the%20county%20jail%20for%20not%20more%20than%20six%20months%2C%20or%20both%20such%20a%20fine%20and%20confinement%20in%20jail\" target=\"_blank\" rel=\"noopener\">up to six months<\/a>, with a cap of 18 months for criminal contempt charges from the same matter. Civil contempt charges can end sooner if the defendant remedies the outstanding issue, such as paying the amount of support owed.<\/p>\r\n<h2><b>Are there any limitations on what orders can be enforced by contempt?<\/b><\/h2>\r\n<p>Yes. In divorce cases, it&#8217;s common for the <a href=\"https:\/\/texaslawhelp.org\/sites\/default\/files\/2024-06\/fm-divb-201_decree_divorce_w_kids_english_06_2024.pdf\" target=\"_blank\" rel=\"noopener\">decree to include orders<\/a> requiring a party to pay specific debts, liabilities, or obligations. Such an order is not enforceable by contempt because the law does not allow a party to be imprisoned for non-payment of a debt.<\/p>\r\n<p>Child support is enforceable because it is not considered a debt.
