What does that mean?<\/p>\n<p>Your \u201cestate\u201d is all of the assets that you own at the time of your death, including personal property and \u201c<span data-term-id=\"41337456\">real property<\/span>\u201d (<span data-term-id=\"41337427\">real estate<\/span>). An <span data-term-id=\"41337416\">estate plan<\/span> is the set of legal <span data-term-id=\"41337432\">estate planning<\/span><span data-term-id=\"41337432\"> documents<\/span> you prepare to provide your <span data-term-id=\"41337441\">family members<\/span> and <span data-term-id=\"41337429\">loved ones<\/span> with instructions about how you want your assets distributed at your death.<\/p>\n<p>Your <span data-term-id=\"41337416\">estate plan<\/span> can also include instructions about how you want your financial matters and <span data-term-id=\"41337448\">healthcare<\/span><span data-term-id=\"41337448\"> decisions<\/span> handled if you become incapacitated. If you die \u201c<a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/die-without-estate-plan.html\"><span data-term-id=\"41337430\">intestate<\/span><\/a>\u201d (without an <span data-term-id=\"41337416\">estate plan<\/span>), the <span data-term-id=\"41337435\">probate<\/span><span data-term-id=\"41337435\"> court<\/span> will distribute your assets according to the state <span data-term-id=\"41337457\">intestate<\/span><span data-term-id=\"41337457\"> succession<\/span> laws.<\/p>\n<p>This article explores what happens if you die without an <span data-term-id=\"41337416\">estate plan<\/span>, the <span data-term-id=\"41337431\">probate<\/span><span data-term-id=\"41337431\"> process<\/span> in <span data-term-id=\"41337415\">Texas<\/span>, and the <span data-term-id=\"41337437\">legal documents<\/span> that make up a comprehensive <span data-term-id=\"41337416\">estate plan<\/span>.<\/p>\n<h2>What Happens if You Die Without an <span data-term-id=\"41337416\">Estate Plan<\/span>?<\/h2>\n<p>If you die without an <a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/what-is-estate-planning.html\"><span data-term-id=\"41337416\">estate plan<\/span><\/a> in place, your assets will likely pass according to the <span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337447\">intestacy<\/span> laws under the <span data-term-id=\"41337435\">probate<\/span><span data-term-id=\"41337435\"> court<\/span>\u2019s supervision. Incapacity planning, which includes <span data-term-id=\"41337426\">durable <\/span><span data-term-id=\"41337418\">powers of attorney<\/span> and a <span data-term-id=\"41337421\">living will<\/span>, is also an important part of a comprehensive <span data-term-id=\"41337416\">estate plan<\/span>. Without the right <span data-term-id=\"41337437\">legal documents<\/span> in place, the court will likely get involved in the <span data-term-id=\"41337462\">important decisions<\/span> that must be made on your behalf during your incapacity.<\/p>\n<h3><span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337447\">Intestacy<\/span> Laws<\/h3>\n<p>The <span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337447\">intestacy<\/span> laws are the state\u2019s best guess at how you would want your assets distributed at your death. It is a one-size-fits-all plan. Generally, the order of priority is:<\/p>\n<ul>\n<li>Surviving spouse<\/li>\n<li>If your child predeceases you, their children (your grandchildren) <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-201-101\/\" target=\"_blank\" rel=\"noopener\">will inherit their parent\u2019s share<\/a><\/li>\n<li>Parents<\/li>\n<li>Siblings<\/li>\n<li>More distant relatives<\/li>\n<\/ul>\n<p>If no surviving relative is found, the assets will go to (escheat) the <span data-term-id=\"41337449\">state of <\/span><span data-term-id=\"41337415\">Texas<\/span>.<\/p>\n<h3>Potential Unintended Consequences of <span data-term-id=\"41337457\">Intestate<\/span><span data-term-id=\"41337457\"> Succession<\/span><\/h3>\n<p>Under <span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337447\">intestacy<\/span> laws, your assets will only pass to <span data-term-id=\"41337441\">family members<\/span>. The type of assets you have and your family makeup will have a significant impact on how much passes to your surviving spouse and children. These unexpected results can cause conflict and heartbreak. There are a couple of possible outcomes for <span data-term-id=\"41337457\">intestate<\/span><span data-term-id=\"41337457\"> succession<\/span>:<\/p>\n<p><strong>No One Outside Your Family Inherits<\/strong>:<\/p>\n<p>If the <span data-term-id=\"41337429\">loved ones<\/span> you want to leave your assets to are also <span data-term-id=\"41337441\">family members<\/span>, the state\u2019s plan may work for you. For assets intended for cherished friends, a lifelong partner, or even a charity, <span data-term-id=\"41337457\">intestate<\/span><span data-term-id=\"41337457\"> succession<\/span> will not reflect your wishes. Your assets will pass only to <span data-term-id=\"41337441\">family members<\/span>, regardless of how close your relationship was.<\/p>\n<p><strong>Surviving Spouse\u2019s Share<\/strong>:<\/p>\n<p>As a <a href=\"https:\/\/www.findlaw.com\/state\/family-laws\/marital-property.html\">community property state<\/a>, <span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337447\">intestacy<\/span> laws treat community property (assets acquired during the marriage) and separate property (assets owned before the marriage or acquired by gift or inheritance during the marriage) differently. The entire half of your <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-201-003\/\" target=\"_blank\" rel=\"noopener\">community property<\/a> will pass to your surviving spouse only if you don\u2019t have any children with anyone other than your surviving spouse. If you do have children outside of your marriage, such as children from a prior relationship, your half of the community estate passes to them. This can result in an uneven distribution of your assets among your children.<\/p>\n<p>The result is even more dire for your surviving spouse with regard to your <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-201-002\/\" target=\"_blank\" rel=\"noopener\">separate property<\/a>. If you are survived by any children, grandchildren, parents, or siblings, your surviving spouse will only receive a portion of your separate property and may end up only with a life estate in any <span data-term-id=\"41337456\">real property<\/span>.<\/p>\n<h2>The <span data-term-id=\"41337444\">Texas<\/span> <span data-term-id=\"41337431\">Probate<\/span><span data-term-id=\"41337431\"> Process<\/span> Overview<\/h2>\n<p>Regardless of whether you have a will when you die, your assets (except assets subject to <span data-term-id=\"41337419\">beneficiary<\/span> <span data-term-id=\"41337436\">designations<\/span>, such as <a href=\"https:\/\/www.findlaw.com\/estate\/probate\/bank-account-beneficiary-rules.html\"><span data-term-id=\"41337453\">bank account<\/span> <span data-term-id=\"41337419\">beneficiaries<\/span><\/a>) don\u2019t pass automatically to your <span data-term-id=\"41337429\">loved ones<\/span>. In most instances, they go through the court-supervised process known as <a href=\"https:\/\/www.findlaw.com\/estate\/probate\/the-probate-basics.html\"><span data-term-id=\"41337417\">probate<\/span><\/a>. The <span data-term-id=\"41337431\">probate<\/span><span data-term-id=\"41337431\"> process<\/span> includes validating the will if one exists, appointing the administrator or executor, gathering and inventorying assets, paying debts, and transferring the remaining assets to your heirs or <span data-term-id=\"41337419\">beneficiaries<\/span>. How well that reflects your wishes depends on whether you have an <span data-term-id=\"41337416\">estate plan<\/span> in place.<\/p>\n<h3>Without an <span data-term-id=\"41337416\">Estate Plan<\/span><\/h3>\n<p>Without a will in place, <a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/intestate-succession-laws-by-state.html\"><span data-term-id=\"41337434\">state law<\/span><\/a> directs how an estate is distributed at death. The <span data-term-id=\"41337435\">probate<\/span><span data-term-id=\"41337435\"> court<\/span> appoints an administrator in accordance with the order of priority set by statute. The court\u2019s involvement in the administration is significant, with court approval required for every significant action the administrator takes.<\/p>\n<p>The court must also determine who the heirs are under the <span data-term-id=\"41337447\">intestacy<\/span> laws. If you leave <span data-term-id=\"41337450\">minor children<\/span>, the court will appoint a guardian and likely supervise their distribution, turning it over in full as the children reach age 18. Together, these factors contribute to both the higher cost of <span data-term-id=\"41337430\">intestate<\/span> administration and its longer timeline.<\/p>\n<h3>With an <span data-term-id=\"41337416\">Estate Plan<\/span><\/h3>\n<p>Instead of leaving it up to <span data-term-id=\"41337434\">state law<\/span>, you can decide who will inherit your assets and who will administer your estate by creating a valid will. The <span data-term-id=\"41337435\">probate<\/span><span data-term-id=\"41337435\"> court<\/span> typically appoints the person you name as executor to oversee the estate\u2019s administration. Your executor can often act with more autonomy than an administrator if your will provides for independent (unsupervised) estate administration or if your heirs agree to it.<\/p>\n<p>In your will, you can nominate a guardian for your <span data-term-id=\"41337450\">minor children<\/span> and create a testamentary trust to hold their inheritance rather than distribute it immediately when they reach age 18. With overall reduced court involvement, the <span data-term-id=\"41337431\">probate<\/span><span data-term-id=\"41337431\"> process<\/span> for an estate with a valid will can be less costly and more streamlined.<\/p>\n<h2>Learn More About <span data-term-id=\"41337420\">Texas<\/span> <span data-term-id=\"41337416\">Estate Planning<\/span> Tools<\/h2>\n<p><span data-term-id=\"41337452\">Texans<\/span> can create a will-based or trust-based\u00a0<span data-term-id=\"41337416\">estate plan<\/span>\u00a0to provide instructions for after they&#8217;re gone. Additional <span data-term-id=\"41337437\">legal documents<\/span>, such as <span data-term-id=\"41337426\">durable <\/span><span data-term-id=\"41337418\">powers of attorney<\/span> and a <span data-term-id=\"41337421\">living will<\/span>, can be used for incapacity planning.<\/p>\n<h3><span data-term-id=\"41337460\">Texas<\/span><span data-term-id=\"41337460\"> Wills<\/span> Laws<\/h3>\n<p>A will must meet specific requirements to be <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/how-to-make-a-will-in-texas-faq.html\">valid <\/a>and admitted to <span data-term-id=\"41337417\">probate<\/span>. Failing to meet a requirement could mean your estate will pass under the <span data-term-id=\"41337447\">intestacy<\/span> laws instead of under your will. The <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-wills-laws.html\">basic statutory requirements<\/a> are:<\/p>\n<ul>\n<li>The testator (person making the will) has <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-251-001\/\" target=\"_blank\" rel=\"noopener\">testamentary capacity<\/a>, which means they are of sound mind and either 18 years old or older, married, or a member of the armed forces<\/li>\n<li>The will must be <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-251-051\/\" target=\"_blank\" rel=\"noopener\">in writing<\/a><\/li>\n<li>The testator must sign (or direct the signing of) the will<\/li>\n<li>The will must be <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-251-051\/\" target=\"_blank\" rel=\"noopener\">attested<\/a> by two qualified witnesses in the testator\u2019s presence (A \u201c<a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-251-052\/#:~:text=Exception%20for%20Holographic%20Wills&amp;text=Notwithstanding%20Section%20251.051%2C%20a%20will,be%20attested%20by%20subscribing%20witnesses.&amp;text=FindLaw%20Codes%20may%20not%20reflect,the%20law%20in%20your%20jurisdiction.\" target=\"_blank\" rel=\"noopener\">holographic<\/a>\u201d or hand-written will does not require witnesses)<\/li>\n<\/ul>\n<p>While not required, it\u2019s helpful to speak with a <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41337420\">Texas<\/span> <span data-term-id=\"41337425\">estate planning<\/span><span data-term-id=\"41337425\"> attorney<\/span><\/a> when drafting a will.<\/p>\n<h3><span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337459\">Trust Laws<\/span><\/h3>\n<p>While a will-based <span data-term-id=\"41337416\">estate plan<\/span> is more familiar to most, a revocable <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-trust-laws.html\"><span data-term-id=\"41337422\">living trust<\/span>-based <span data-term-id=\"41337416\">estate plan<\/span><\/a> is also an option. A revocable <span data-term-id=\"41337422\">living trust<\/span> (RLT) is a <a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-111-001\/https:\/\/codes.findlaw.com\/tx\/property-code\/\" target=\"_blank\" rel=\"noopener\">legal arrangement in which you (the settlor) transfer ownership<\/a> of your assets to the RLT during your lifetime. As the initial trustee, you retain full control over your assets. You can change or even revoke the trust at any time.<\/p>\n<p>At your death, the successor trustee you named steps in and distributes the trust assets to your <span data-term-id=\"41337419\">beneficiaries<\/span> according to your instructions. This happens without <span data-term-id=\"41337417\">probate<\/span> or court oversight, unless there is a dispute. This can hasten the process significantly.<\/p>\n<h2>Incapacity Planning in <span data-term-id=\"41337415\">Texas<\/span><\/h2>\n<p>In addition to planning for your estate after your death, you can prepare for your potential incapacity. If you become incapacitated, the <span data-term-id=\"41337437\">legal documents<\/span> you prepare in advance will guide how you want <span data-term-id=\"41337462\">important decisions<\/span> made on your behalf during your incapacity. Let\u2019s examine a few of them.<\/p>\n<h3><span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337426\">Durable <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span> for Financial Matters<\/h3>\n<p>With a <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/how-to-make-a-power-of-attorney-in-texas-faq.html\"><span data-term-id=\"41337426\">Durable <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span><\/a> for Financial Matters, you can appoint someone you trust as your agent and specify their authority to handle your financial matters. The agent\u2019s authority can either be immediate or only \u201cspring\u201d into effect upon your disability. It is important to note that the document <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-durable-power-of-attorney-laws.html\">must include \u201cdurability\u201d language<\/a>. Without it, the agent\u2019s power ends if you become incapacitated, defeating the purpose of incapacity planning.<\/p>\n<p>While <span data-term-id=\"41337423\">Texas<\/span><span data-term-id=\"41337423\"> law<\/span> does not require witnesses, you do need to sign the document in front of a notary public. The <span data-term-id=\"41337415\">Texas<\/span> <a href=\"https:\/\/codes.findlaw.com\/tx\/estates-code\/est-sect-752-051\/\" target=\"_blank\" rel=\"noopener\">Statutory <span data-term-id=\"41337426\">Durable <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span><\/a> is legally valid if properly executed.<\/p>\n<p>You can also look into <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/how-to-make-a-power-of-attorney\/what-do-i-need-to-know-to-make-a-financial-power-of-attorney-myself.html\">online document services<\/a> for more do-it-yourself options. In addition, you have the option of speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41337420\">Texas<\/span> <span data-term-id=\"41337425\">estate planning<\/span><span data-term-id=\"41337425\"> attorney<\/span><\/a> for a <span data-term-id=\"41337426\">Durable <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span> drafted to meet your specific needs.<\/p>\n<h3><span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337428\">Medical <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-durable-power-of-attorney-laws.html\"><span data-term-id=\"41337428\">Medical <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span><\/a> allows you to appoint someone you trust as your agent to make <span data-term-id=\"41337448\">health care<\/span><span data-term-id=\"41337448\"> decisions<\/span> on your behalf while you are incapacitated. <span data-term-id=\"41337423\">Texas<\/span><span data-term-id=\"41337423\"> law<\/span> requires the document to be either notarized or signed by two adults who witnessed your signature, with several restrictions on who may serve as a witness. <span data-term-id=\"41337415\">Texas<\/span> provides a <a href=\"https:\/\/codes.findlaw.com\/tx\/health-and-safety-code\/health-safety-sect-166-164\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41337428\">Medical <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span><\/a> statutory form. You can also create your own <a href=\"https:\/\/www.findlaw.com\/forms\/estate-planning.html\">document online<\/a> or work with an attorney.<\/p>\n<h3><span data-term-id=\"41337415\">Texas<\/span> <span data-term-id=\"41337421\">Living Wills<\/span> Laws<\/h3>\n<p>With a <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-living-wills-laws.html\"><span data-term-id=\"41337421\">living will<\/span><\/a>, you can express your <span data-term-id=\"41337451\">medical care<\/span> wishes. These can include whether you want life-sustaining treatment continued, withheld, or withdrawn, and under what circumstances. Although more commonly known as a <span data-term-id=\"41337421\">living will<\/span>, the <span data-term-id=\"41337415\">Texas<\/span> term is \u201cDirective to Physicians.\u201d<\/p>\n<p>You must sign your <span data-term-id=\"41337421\">living will<\/span> in front of two witnesses. You can <a href=\"https:\/\/codes.findlaw.com\/tx\/health-and-safety-code\/health-safety-sect-166-033\/\" target=\"_blank\" rel=\"noopener\">use the statutory form<\/a>, an <a href=\"https:\/\/www.findlaw.com\/forms\/estate-planning.html?fli=diyresources:diy_ep:txt\">online do-it-yourself Directive<\/a>, or an attorney-drafted document. Like a <span data-term-id=\"41337428\">Medical <\/span><span data-term-id=\"41337418\">Power of Attorney<\/span>, either two qualified witnesses must watch you sign your Directive, or it must be acknowledged by a notary public.<\/p>\n<h2>Work With an <span data-term-id=\"41337463\">Experienced <\/span><span data-term-id=\"41337425\">Estate<\/span><span data-term-id=\"41337425\"> Planning<\/span><span data-term-id=\"41337425\"> Attorney<\/span><\/h2>\n<p>Today is a good day to get your <span data-term-id=\"41337454\">financial affairs<\/span> in order.
