First, it protects your home from being sold to pay most court judgments. Second, it offers <span data-term-id=\"58343674\">homestead <\/span><span data-term-id=\"58343654\">tax exemptions<\/span> that lower your home&#8217;s <span data-term-id=\"58343679\">taxable value<\/span>. Both are set by Texas law, although they operate differently.<\/p>\n<p>The Texas <span data-term-id=\"58343666\">residence <\/span><span data-term-id=\"58343649\">homestead exemption<\/span> differs from those of other states because the homestead creditor protection has no dollar-value cap. Instead of limiting the home&#8217;s value that qualifies, Texas limits the acreage. Even a multimillion-dollar home can receive full protection as long as it falls within the applicable size limits.<\/p>\n<h2><strong><span data-term-id=\"58343649\">Homestead Exemption<\/span> Limits in Texas<\/strong><\/h2>\n<p>In Texas, the size of your land, not its value, sets the limit for <span data-term-id=\"58343661\">homestead protection<\/span> from creditors. <a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-002\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58343659\">Urban homesteads<\/span> can be up to 10 connected acres<\/a>, including any buildings.\u00a0<span data-term-id=\"58343660\">Rural homesteads<\/span>\u00a0can be up to 200 acres for a family or 100 acres for a\u00a0<span data-term-id=\"58343657\">single adult<\/span>. The rural locations do not have to be contiguous.<\/p>\n<p>A property&#8217;s classification as &#8220;urban&#8221; or &#8220;rural&#8221; depends on its location and use. An\u00a0<span data-term-id=\"58343659\">urban homestead<\/span>\u00a0may serve as a residence, a business, or both.<\/p>\n<p><span data-term-id=\"58343650\">Property tax<\/span> rules are different. Under the Texas <span data-term-id=\"58343658\">Tax Code<\/span>, <a href=\"https:\/\/codes.findlaw.com\/tx\/tax-code\/tax-sect-11-13\/\" target=\"_blank\" rel=\"noopener\">all qualifying <span data-term-id=\"58343651\">homeowners<\/span><\/a> get a $140,000 exemption from <span data-term-id=\"58343662\">school district<\/span> <span data-term-id=\"58343650\">property taxes<\/span>. This <span data-term-id=\"58343654\">tax exemption<\/span> took effect on January 1, 2025, following a voter-approved amendment.\u00a0<\/p>\n<p><span data-term-id=\"58343651\">Homeowners<\/span>\u00a0aged 65 and above and <span data-term-id=\"58343702\">claimants<\/span> with a qualifying disability are entitled to an\u00a0<a href=\"https:\/\/comptroller.texas.gov\/taxes\/property-tax\/exemptions\/\" target=\"_blank\" rel=\"noopener\">additional $60,000 exemption<\/a> from\u00a0<span data-term-id=\"58343662\">school district<\/span>\u00a0taxes. This is a significant jump from the previous $10,000 and took effect January 1, 2026.<\/p>\n<p>Counties that collect farm-to-market or flood control taxes must give a $3,000 exemption. Local taxing units can also offer optional exemptions of up to 20% of your property&#8217;s\u00a0<span data-term-id=\"58343664\">appraised value<\/span>, with a minimum of $5,000.<\/p>\n<p>Additional\u00a0<span data-term-id=\"58343650\">property tax<\/span>\u00a0relief is available for specific groups:<\/p>\n<ul>\n<li><strong>Disabled veterans<\/strong>\u00a0may qualify for partial or full exemptions depending on their disability rating, up to a total exemption for 100% service-connected disability.<\/li>\n<li><strong><span data-term-id=\"58343653\">Surviving spouses<\/span> of service members\u00a0<\/strong>killed or fatally injured in the line of duty may be eligible for a total <span data-term-id=\"58343703\">property <\/span><span data-term-id=\"58343654\">tax<\/span><span data-term-id=\"58343703\"> exemption<\/span> on their residence homestead, provided they have not remarried.<\/li>\n<li><strong>Older adults and\u00a0<span data-term-id=\"58343651\">homeowners<\/span>\u00a0with disabilities<\/strong>\u00a0have a\u00a0<span data-term-id=\"58343690\">school tax<\/span>\u00a0&#8220;ceiling,&#8221; which means their\u00a0<span data-term-id=\"58343662\">school district<\/span> taxes will not go up as long as they live in the home.<\/li>\n<\/ul>\n<p>These amounts are subject to change based on amendments to Texas <span data-term-id=\"58343695\">state laws<\/span>. This protection secures your home against certain creditors, reduces your tax burden, and limits how you can transfer or encumber your <span data-term-id=\"58343667\">primary residence<\/span>.<\/p>\n<p>To qualify for\u00a0<span data-term-id=\"58343661\">homestead protections<\/span>, the property must be used as a\u00a0<span data-term-id=\"58343656\">principal residence<\/span>\u00a0and owned by a natural person or a <span data-term-id=\"58343684\">qualifying trust<\/span>. Corporations, limited liability companies, and other business entities don\u2019t qualify. If a homestead is transferred to a business entity, it loses its homestead status.<\/p>\n<p>You can only claim one homestead. If you own multiple homes, only one can receive <span data-term-id=\"58343661\">homestead protections<\/span>.<\/p>\n<h2><strong>Qualifying Property Types<\/strong><\/h2>\n<p>A qualifying homestead does not have to be a traditional single-family house. Under Texas law, a homestead can include the following:<\/p>\n<ul>\n<li>A house, condominium, or other residential structure used as a\u00a0<a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-002\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58343656\">principal residence<\/span><\/a><\/li>\n<li>A manufactured or mobile home, even if situated on leased land (if the owner occupies it as a\u00a0<span data-term-id=\"58343667\">primary residence<\/span>\u00a0and holds a valid\u00a0<a href=\"https:\/\/www.tdhca.texas.gov\/instructions-information-applying-statement-ownership\" target=\"_blank\" rel=\"noopener\">Statement of Ownership<\/a>\u00a0from the Texas Department of Housing and Community Affairs)<\/li>\n<li>A property used partly as a residence and partly as a business, in the case of an\u00a0<a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-002\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58343659\">urban homestead<\/span><\/a><\/li>\n<li>Property held through a qualifying beneficial trust, or in which a\u00a0<span data-term-id=\"58343653\">surviving spouse<\/span>\u00a0holds a\u00a0<span data-term-id=\"58343672\">life estate<\/span><\/li>\n<\/ul>\n<p>For <span data-term-id=\"58343660\">rural homesteads<\/span>, you must live on part of the property and use the remainder to support your family. For <span data-term-id=\"58343659\">urban homesteads<\/span>, the property must be your main home or business. Occasional or recreational use alone is generally not enough to establish homestead status.<\/p>\n<h2><strong>How To Claim a <span data-term-id=\"58343649\">Homestead Exemption<\/span> in Texas<\/strong><\/h2>\n<p>Under the <span data-term-id=\"58343670\">Texas homestead law<\/span>,\u00a0creditor protection begins automatically when you meet the requirements. You don\u2019t have to file any special paperwork, but there are two important steps most\u00a0<span data-term-id=\"58343651\">homeowners<\/span>\u00a0should take.<\/p>\n<p>To get a\u00a0<span data-term-id=\"58343703\">property <\/span><span data-term-id=\"58343654\">tax<\/span><span data-term-id=\"58343703\">\u00a0exemption<\/span>, you need to apply to your county\u00a0<span data-term-id=\"58343652\">appraisal district<\/span>. Use\u00a0<a href=\"https:\/\/comptroller.texas.gov\/taxes\/property-tax\/exemptions\/\" target=\"_blank\" rel=\"noopener\">Form 50-114<\/a>\u00a0and submit it\u00a0by April 30 of the\u00a0<span data-term-id=\"58343676\">tax year<\/span>\u00a0you want the exemption. This requires a Texas\u00a0<span data-term-id=\"58343669\">driver&#8217;s license<\/span>\u00a0or state ID that matches the address on your property.<\/p>\n<p>Once you get the exemption, it usually stays in place without needing to renew each year. However,\u00a0a 2023 law now\u00a0<a href=\"https:\/\/collincad.org\/homestead-exemption-audit-senate-bill-sb-1801\/\" target=\"_blank\" rel=\"noopener\">requires <span data-term-id=\"58343652\">appraisal districts<\/span> to verify<\/a>\u00a0each <span data-term-id=\"58343651\">homeowner<\/span>&#8216;s continued eligibility at least once every five years.\u00a0Many counties let you apply online through their website.<\/p>\n<p>Second, it\u2019s a good idea to record a voluntary homestead designation in the county where your property is located. Under\u00a0the <a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-005.html\" target=\"_blank\" rel=\"noopener\">Texas <span data-term-id=\"58343691\">Property Code<\/span><\/a>, this designation must be signed, acknowledged, filed with the county clerk, and recorded in the county deed records. This process formally notifies creditors and\u00a0<span data-term-id=\"58343685\">lenders<\/span>\u00a0of your homestead claim. Filing doesn\u2019t create\u00a0<span data-term-id=\"58343668\">homestead rights<\/span>, but it helps establish them in legal disputes.<\/p>\n<p>For manufactured homes, include a Statement of Ownership from the Texas Department of Housing and Community Affairs, a sales agreement, or an affidavit proving ownership with your application. This should satisfy the legal requirements.<\/p>\n<h2><strong>Exceptions and Limitations<\/strong><\/h2>\n<p>Texas\u00a0<span data-term-id=\"58343661\">homestead protection<\/span>\u00a0is broad but not absolute.\u00a0<a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-001\/\" target=\"_blank\" rel=\"noopener\">The Texas <span data-term-id=\"58343691\">Property Code<\/span><\/a>\u00a0identifies the types of liens that may be fixed on a homestead, meaning creditors holding these specific claims can still foreclose or collect even over homestead objections. These include:<\/p>\n<ul>\n<li><span data-term-id=\"58343688\">Purchase money<\/span>\u00a0liens, such as your mortgage<\/li>\n<li><span data-term-id=\"58343650\">Property tax<\/span>\u00a0liens<\/li>\n<li>Mechanic&#8217;s and material man&#8217;s liens for improvements contracted for in writing<\/li>\n<li>Home equity loans meeting the requirements of\u00a0<span data-term-id=\"58343655\">Texas Constitution<\/span>\u00a0Article XVI, \u00a7 50(a)(6)<\/li>\n<li><span data-term-id=\"58343683\">Reverse mortgages<\/span><\/li>\n<li>Liens for\u00a0<span data-term-id=\"58343686\">owelty<\/span>\u00a0of partition, which can arise from divorce proceedings<\/li>\n<li>Refinanced liens, including certain federal tax liens<\/li>\n<\/ul>\n<p>Unsecured debts such as credit cards, medical bills, personal loans, and most civil court judgments usually can\u2019t result in a <span data-term-id=\"58343675\">forced sale<\/span> of a Texas homestead. Proceeds from a homestead sale are also protected from\u00a0<a href=\"https:\/\/codes.findlaw.com\/tx\/property-code\/prop-sect-41-001\/#:~:text=(c)%20The%20homestead%20claimant&#039;s%20proceeds%20of%20a%20sale%20of%20a%20homestead%20are%20not%20subject%20to%20seizure%20for%20a%20creditor&#039;s%20claim%20for%20six%20months%20after%20the%20date%20of%20sale.\" target=\"_blank\" rel=\"noopener\">creditors for up to six months<\/a>, allowing time to reinvest in a new home.<\/p>\n<p>A key limitation involves fraudulent transfers. If you convert non-exempt assets into\u00a0<span data-term-id=\"58343671\">homestead property<\/span>\u00a0to shield them from creditors, a court may reverse the transaction. Texas courts use a good-faith standard, but protection can be challenged if the transfer appears intended solely to avoid a creditor&#8217;s claim.<\/p>\n<h2><strong>Federal <span data-term-id=\"58343661\">Homestead Protections<\/span> in Bankruptcy<\/strong><\/h2>\n<p>If you file for bankruptcy, you may be eligible for federal\u00a0<span data-term-id=\"58343661\">homestead protections<\/span>. Texas residents can choose either the Texas state exemptions or the federal bankruptcy exemption set, but not both.<\/p>\n<p>The <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:11+section:522+edition:prelim)#:~:text=By%20notice%20dated%20Jan.%2030%2C%202025%2C%2090%20F.R.%208941%2C%20effective%20Apr.%201%2C%202025%2C%20in%20subsec.%20(d)(1)%2C%20dollar%20amount%20%2227%2C900%22%20was%20adjusted%20to%20%2231%2C575%22;\" target=\"_blank\" rel=\"noopener\">federal <span data-term-id=\"58343649\">homestead exemption<\/span><\/a> protects\u00a0<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:11+section:522+edition:prelim)\" target=\"_blank\" rel=\"noopener\">up to $31,575 in home equity<\/a>\u00a0for cases filed between April 1, 2025, and March 31, 2028. In a joint bankruptcy case, the exemption\u00a0<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:11+section:522+edition:prelim)#:~:text=(m)%20Subject%20to%20the%20limitation%20in%20subsection%20(b)%2C%20this%20section%20shall%20apply%20separately%20with%20respect%20to%20each%20debtor%20in%20a%20joint%20case.\" target=\"_blank\" rel=\"noopener\">applies separately<\/a>\u00a0to each debtor, allowing each spouse to claim up to $31,575.<\/p>\n<p>For most\u00a0<span data-term-id=\"58343677\">Texas <\/span><span data-term-id=\"58343651\">homeowners<\/span>, the state exemption is preferable because it has no dollar cap and can protect a home of any value. To use Texas exemptions in bankruptcy, you must have lived in Texas for\u00a0<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:11+section:522+edition:prelim)#:~:text=(A)%20subject%20to,any%20other%20place;\" target=\"_blank\" rel=\"noopener\">at least 730 days<\/a>\u00a0before filing.
