If a company promises <span data-term-id=\"52763634\">paid holidays<\/span>, it must follow its own rules. The state does not force the company to offer them. This is true even for major national observances like <span data-term-id=\"52763635\">Memorial Day<\/span>, <span data-term-id=\"52763636\">Labor Day<\/span>, and <span data-term-id=\"52763643\">Veterans Day<\/span>.<\/p>\n<p>Public employers operate differently. As we will see later, the law dictates their <span data-term-id=\"52763672\">holiday schedules<\/span>.<\/p>\n<h2>Exempt and <span data-term-id=\"52763664\">Nonexempt Employees<\/span><\/h2>\n<p>Holiday rules can feel different depending on whether a worker is classified as an exempt or <span data-term-id=\"52763664\">nonexempt employee<\/span> under the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\">federal Fair Labor Standards Act (<span data-term-id=\"52763679\">FLSA<\/span>)<\/a>. The <span data-term-id=\"52763679\">FLSA<\/span> applies to almost all public and <span data-term-id=\"52763668\">private employers<\/span> in the United States. It sets national standards for overtime, <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/federal-wage-law-the-fair-labor-standards-act.html\">minimum wage, and pay practices<\/a>. The <span data-term-id=\"52763679\">FLSA<\/span> also categorizes employees as either exempt or nonexempt. This classification affects eligibility for overtime and other pay protections.<\/p>\n<p>It can also impact holiday-related outcomes. Below, we explore holiday rules for both groups in the private and public sectors in<a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-employment-laws.html\"> the <span data-term-id=\"52763675\">state of Texas<\/span><\/a>.<\/p>\n<h3><span data-term-id=\"52763664\">Nonexempt Employees<\/span><\/h3>\n<p><span data-term-id=\"52763664\">Nonexempt employees<\/span> are usually paid hourly and<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\"> must receive overtime<\/a> when they work more than 40 hours in a <span data-term-id=\"52763666\">workweek<\/span>. Working on a holiday does not automatically create overtime. Overtime only applies if the total hours exceed 40.<\/p>\n<p>Let\u2019s say <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">a nonexempt worker<\/a> puts in 40 hours by Thursday and then works on <span data-term-id=\"52763655\">Good Friday<\/span>. That extra time may count toward overtime, but the holiday itself does not trigger special pay under state or <span data-term-id=\"52763665\">federal law<\/span>.<\/p>\n<p><strong>Private Sector<\/strong><\/p>\n<p>For private-sector\u00a0<span data-term-id=\"52763664\">nonexempt employees<\/span>, this means\u00a0<span data-term-id=\"52763631\">holiday pay<\/span>\u00a0is entirely at the employer&#8217;s discretion. A private organization may choose to offer premium <span data-term-id=\"52763631\">holiday pay<\/span>, time-and-a-half pay, or<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/vacation-and-sick-leave.html\"> a paid <span data-term-id=\"52763639\">day off<\/span><\/a>. <span data-term-id=\"52763647\">Texas law<\/span> doesn\u2019t require it. If a\u00a0<span data-term-id=\"52763668\">private employer<\/span>\u00a0in\u00a0Texas\u00a0offers holiday benefits, they must follow their\u00a0written policies or <span data-term-id=\"52763670\">employment contracts<\/span>.<\/p>\n<p><strong>Public Sector: State Level<\/strong><\/p>\n<p>For nonexempt <span data-term-id=\"52763649\">state employees<\/span>, <a href=\"https:\/\/codes.findlaw.com\/tx\/government-code\/\" target=\"_blank\" rel=\"noopener\">the Texas <span data-term-id=\"52763644\">Government Code<\/span><\/a> sets an official <span data-term-id=\"52763672\">holiday schedule<\/span>. State agencies are usually closed on these dates, with <span data-term-id=\"52763664\">nonexempt employees<\/span> receiving paid time off (PTO). Public colleges and universities follow separate schedules but still provide the same number of holidays.<\/p>\n<p>If a nonexempt <span data-term-id=\"52763649\">state employee<\/span> must work on a <span data-term-id=\"52763633\">state holiday<\/span>, they may earn <span data-term-id=\"52763667\">compensatory time<\/span> or overtime, depending on agency policy. <a href=\"https:\/\/www.superlawyers.com\/resources\/wage-and-hour-laws\/compensatory-time-and-how-it-works\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52763667\">Compensatory time<\/span> is paid time off<\/a> that public employees can earn instead of overtime for hours worked beyond their scheduled hours.<\/p>\n<p><strong>Public Sector: Federal Level<\/strong><\/p>\n<p>Federal agencies in Texas follow <a href=\"https:\/\/www.opm.gov\/policy-data-oversight\/pay-leave\/federal-holidays\/#url=2026\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"52763669\">federal <\/span><span data-term-id=\"52763672\">holiday<\/span><span data-term-id=\"52763672\"> schedule<\/span><\/a> and close on designated <span data-term-id=\"52763669\">federal holidays<\/span>. Nonexempt federal employees generally receive paid time off for these days. If they must work on a <span data-term-id=\"52763669\">federal holiday<\/span>, they receive premium <span data-term-id=\"52763631\">holiday pay<\/span>.<\/p>\n<h3>Exempt Employees<\/h3>\n<p>Exempt employees are typically <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pay-docking-for-salaried-employees.html\">paid on a salary basis<\/a>. If an exempt employee works any part of a week, they receive their full salary. They aren\u2019t <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/minimum-wage-and-overtime-basics.html\">entitled to overtime<\/a> and tend to earn the same weekly pay regardless of whether there\u2019s an observed holiday. Working on a holiday also doesn\u2019t change an exempt employee\u2019s pay under state or <span data-term-id=\"52763665\">federal law<\/span>.<\/p>\n<p><strong>Private Sector<\/strong><\/p>\n<p>For exempt employees in the private sector, <span data-term-id=\"52763631\">holiday pay<\/span> is determined solely by company policy. A <span data-term-id=\"52763668\">private employer<\/span> may choose to offer <span data-term-id=\"52763634\">paid holidays<\/span>, premium <span data-term-id=\"52763631\">holiday pay<\/span>, or additional time off. <span data-term-id=\"52763647\">Texas law<\/span> doesn\u2019t require any of <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/wages-and-benefits-overview.html\">these benefits<\/a>. These holidays are listed in the Texas <span data-term-id=\"52763644\">Government Code<\/span>. The State Auditor\u2019s Office issues an <a href=\"https:\/\/comptroller.texas.gov\/about\/holidays.php\" target=\"_blank\" rel=\"noopener\">official <span data-term-id=\"52763672\">holiday schedule<\/span> <\/a>for state agencies each fiscal year.<\/p>\n<h3>Paid <span data-term-id=\"52763633\">State Holidays<\/span><\/h3>\n<p><a href=\"https:\/\/www.texas.gov\/texas-state-agencies-departments\/\" target=\"_blank\" rel=\"noopener\">State agencies<\/a> close on the following <span data-term-id=\"52763633\">state holidays<\/span>. If one of them falls on a weekend, Texas doesn\u2019t move it to another weekday.<\/p>\n<p>Exempt and nonexempt <span data-term-id=\"52763649\">state employees<\/span> receive paid time off for these days:<\/p>\n<ul>\n<li><strong><span data-term-id=\"52763637\">New Year\u2019s Day<\/span>:<\/strong> January 1<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/why-every-worker-should-thank-martin-luther-king-jr\/\"><strong><span data-term-id=\"52763663\">Martin Luther King<\/span> <span data-term-id=\"52763657\">Jr<\/span><span data-term-id=\"52763657\">. Day<\/span>.<\/p>\n<h3>Skeleton Crew Holidays<\/h3>\n<p>Texas recognizes holidays that reflect the state\u2019s unique history. On these days, state agencies remain open, but with minimal staffing. These holidays include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"52763650\">Texas Independence Day<\/span>:<\/strong> March 2<\/li>\n<li><strong><span data-term-id=\"52763648\">San Jacinto Day<\/span>:<\/strong> April 21<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/practice-of-law\/how-to-make-juneteenth-more-than-an-exercise-in-branding\/\"><strong><span data-term-id=\"52763638\">Emancipation Day<\/span> (<span data-term-id=\"52763658\">Juneteenth<\/span>):<\/strong> June 19<\/a><\/li>\n<li><strong><span data-term-id=\"52763646\">Lyndon Baines Johnson Day<\/span>:<\/strong> August 27<\/li>\n<\/ul>\n<p>Exempt <span data-term-id=\"52763649\">state employees<\/span> who work on these days may earn <span data-term-id=\"52763667\">compensatory time<\/span>. Agencies may allow employees to use annual <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/leave-laws.html\">leave or other approved leave<\/a> for these observances.<\/p>\n<h2>Should I Get <span data-term-id=\"52763631\">Holiday Pay<\/span>?<\/h2>\n<p><a href=\"https:\/\/codes.findlaw.com\/tx\/labor-code\/\" target=\"_blank\" rel=\"noopener\">Texas <span data-term-id=\"52763660\">labor laws<\/span><\/a> don\u2019t require <span data-term-id=\"52763668\">private employers<\/span> to offer <span data-term-id=\"52763634\">paid <\/span><span data-term-id=\"52763659\">holiday<\/span><span data-term-id=\"52763659\"> leave<\/span>, <span data-term-id=\"52763662\">sick leave<\/span>, or vacation. Both exempt and nonexempt public employees receive PTO for the holidays recognized by their agency.<\/p>\n<p>In addition, the federal <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave.html\">Family and <span data-term-id=\"52763671\">Medical Leave<\/span> Act (<span data-term-id=\"52763656\">FMLA<\/span>)<\/a> provides unpaid job-protected leave for eligible exempt and <span data-term-id=\"52763664\">nonexempt employees<\/span> of covered employers.
