Unlike <span data-term-id=\"41160765\">resisting arrest<\/span>, fleeing an\u00a0<span data-term-id=\"41160807\">unlawful arrest<\/span> is not illegal.<\/p>\n<h2><strong>Lawful vs. <span data-term-id=\"41160807\">Unlawful Arrest<\/span><\/strong><\/h2>\n<p>In general, a <span data-term-id=\"41160800\">lawful arrest<\/span> is one in which the <span data-term-id=\"41160779\">arresting officer<\/span> has <span data-term-id=\"41160793\">probable cause<\/span> to believe that the suspect has committed a crime. <span data-term-id=\"41160793\">Probable cause<\/span> includes one or both of the following:<\/p>\n<ul>\n<li>A valid <span data-term-id=\"41160803\">arrest warrant<\/span><\/li>\n<li>Witnessing the offense or having other reasonable belief that the suspect may have committed a crime<\/li>\n<\/ul>\n<p>The officer must identify themselves as a <span data-term-id=\"41160780\">law enforcement<\/span><span data-term-id=\"41160780\"> officer<\/span> for a <span data-term-id=\"41160800\">lawful arrest<\/span>.<\/p>\n<p>An <span data-term-id=\"41160807\">unlawful arrest<\/span> does not meet these criteria. An arrest is unlawful if:<\/p>\n<ul>\n<li>The officer is not clearly identifiable as a <span data-term-id=\"41160780\">law enforcement<\/span><span data-term-id=\"41160780\"> officer<\/span><\/li>\n<li>The warrant is defective or invalid<\/li>\n<li>The officer cannot give a legitimate reason for the arrest<\/li>\n<\/ul>\n<p>A suspect being detained may not resist the arrest, even if they believe the arrest is unlawful. To legally evade arrest, the suspect must know that the arrest is unlawful. In most instances, it\u2019s best to allow the arrest to proceed and let an attorney contest it in court.<\/p>\n<h3>Examples of <span data-term-id=\"41160800\">Lawful Arrest<\/span><\/h3>\n<p>Below are a few common examples of a <span data-term-id=\"41160800\">lawful arrest<\/span>:<\/p>\n<ul>\n<li><strong>Officers witness a crime: <\/strong>An officer observing a driver running a red light and nearly causing an accident could make a legal arrest for <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/reckless-driving.html\">reckless driving<\/a>. Since the officer personally witnessed the offense, the arrest is\u00a0lawful.<\/li>\n<li><strong>\u201cHot pursuit\u201d: <\/strong>An officer sees someone fleeing from a building after a burglar alarm sounds, and witnesses report seeing someone break a window. The officer pursues and arrests the individual. The officer&#8217;s reasonable belief that a crime was just committed provides <span data-term-id=\"41160793\">probable cause<\/span> for a <span data-term-id=\"41160800\">lawful arrest<\/span>.<\/li>\n<li><strong>Valid <span data-term-id=\"41160803\">arrest warrant<\/span>: <\/strong><span data-term-id=\"41160774\">Police officers<\/span> arrive at John&#8217;s home with a valid <span data-term-id=\"41160803\">arrest warrant<\/span> issued by a judge based on <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"41160793\">probable cause<\/span> <\/a>that John committed burglary. The officers identify themselves as police, show John the warrant, and place him under arrest. This is a <span data-term-id=\"41160800\">lawful arrest<\/span> even if John is ultimately innocent of the charges.<\/li>\n<\/ul>\n<p>There are many other types of <span data-term-id=\"41160800\">lawful arrests<\/span>.<\/p>\n<h3>Examples of an <span data-term-id=\"41160807\">Unlawful Arrest<\/span><\/h3>\n<p>The following are examples of situations where the arrest may have been unlawful:<\/p>\n<ul>\n<li><strong>Lack of <span data-term-id=\"41160793\">probable cause<\/span>:<\/strong> Police arrest David simply because he &#8220;looks suspicious&#8221; while walking through a neighborhood at night, without any evidence that he committed or was about to commit a crime. Without specific facts establishing <span data-term-id=\"41160793\">probable cause<\/span>, this arrest would likely be unlawful.<\/li>\n<li><strong>Invalid warrant:<\/strong> Officers take Maria into custody based on an <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-is-an-arrest-a-legal-arrest.html\"><span data-term-id=\"41160803\">arrest warrant<\/span><\/a> that contains the wrong address, incorrect identifying information, or lacks a judge&#8217;s signature. A defective warrant often fails to support a <span data-term-id=\"41160800\">lawful arrest<\/span>.<\/li>\n<li><strong>Failure to identify: <\/strong>A plainclothes officer in an unmarked car attempts to detain someone without clearly identifying themselves as <span data-term-id=\"41160771\">law enforcement<\/span> or displaying a badge. If a reasonable person wouldn&#8217;t know they were being arrested by police, the arrest may be unlawful.<\/li>\n<\/ul>\n<p>Even if you believe your arrest is unlawful based on these examples, <span data-term-id=\"41160777\">Texas<\/span><span data-term-id=\"41160777\"> law<\/span> does not permit you to <span data-term-id=\"41160765\">resist arrest<\/span> using force. Determinations about whether an arrest was lawful or unlawful are made by judges after the fact, not by individuals during the encounter. If you believe you were unlawfully arrested, the best strategy is to raise the issue through your attorney in court, not by physically resisting the officer.<\/p>\n<h2>Penalties for Resisting and <span data-term-id=\"41160773\">Evading Arrest<\/span> in <span data-term-id=\"41160764\">Texas<\/span><\/h2>\n<p><span data-term-id=\"41160765\">Resisting arrest<\/span> is a <span data-term-id=\"41160769\">Class A<\/span> <span data-term-id=\"41160766\">misdemeanor<\/span> with penalties of up to one year in jail, fines of up to $4,000, or both. If the suspect uses a <span data-term-id=\"41160768\">deadly weapon<\/span> while resisting, the crime becomes a <span data-term-id=\"41160770\">third-degree felony<\/span>, with penalties of two to 10 years imprisonment, fines of up to $10,000, or both.<\/p>\n<p><span data-term-id=\"41160773\">Evading arrest<\/span> is a Class B <span data-term-id=\"41160766\">misdemeanor<\/span>. If the defendant has either a previous conviction for evading or used a vehicle to flee, the offense becomes a <span data-term-id=\"41160783\">State Jail felony<\/span>, punishable by a jail term of 180 days to two years&#8217; <span data-term-id=\"41160788\">jail time<\/span>, a fine of up to $10,000, or both.<\/p>\n<p><span data-term-id=\"41160773\">Evading arrest<\/span> is a <span data-term-id=\"41160770\">third-degree felony<\/span> if the offender uses a vehicle and either another person suffers a <span data-term-id=\"41160796\">serious bodily injury<\/span> during the evasion or they employ a <span data-term-id=\"41160804\">tire deflation device<\/span> during their escape, regardless of prior convictions. The offense becomes a second-degree felony if another person dies as a direct result of the attempt to flee.<\/p>\n<h2><span data-term-id=\"41160802\">Potential Defenses<\/span> To <span data-term-id=\"41160776\">Resisting Arrest<\/span><span data-term-id=\"41160776\"> Charges<\/span><\/h2>\n<p><span data-term-id=\"41160764\">Texas<\/span> does not recognize an <span data-term-id=\"41160807\">unlawful arrest<\/span> as a defense to <span data-term-id=\"41160765\">resisting arrest<\/span>.
