Some states severely limit your ability to defend yourself. Other states, such as Texas, have broad <span data-term-id=\"39036034\">self-defense laws<\/span>. It creates a presumption that the defender believes using force is immediately necessary and reasonable when another person is unlawfully and forcefully entering, or attempting to enter, a place to which the defender has a right. This includes the defender\u2019s occupied habitation, vehicle, <span data-term-id=\"39036086\">place of business<\/span>, or employment.<\/p>\n<p>This doctrine can also apply if the offender is attempting to commit certain serious offenses, such as <span data-term-id=\"39036060\">aggravated kidnapping<\/span>, murder, <span data-term-id=\"39036056\">sexual assault<\/span>, aggravated <span data-term-id=\"39036056\">sexual assault<\/span>, robbery, or <span data-term-id=\"39036054\">aggravated robbery<\/span>. This presumption only applies if the defender is lawfully present, has not provoked the encounter, and is not engaged in <span data-term-id=\"39036040\">criminal activity<\/span> other than minor traffic offenses.<\/p>\n<p>Many states recognize some form of the <span data-term-id=\"39036029\">Castle Doctrine<\/span>, but differ on whether they also have broad \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/stand-your-ground-laws.html\"><span data-term-id=\"39036026\">stand your ground<\/span><\/a>\u201d statutes. For example, states like California, Colorado, Illinois, New Mexico, Oregon, Vermont, Virginia, and Washington recognize a right to defend one\u2019s home but do not have explicit statewide \u201c<span data-term-id=\"39036026\">stand your ground<\/span>\u201d statutes. They may impose a duty to retreat in public in some circumstances.<\/p>\n<h2>Does <span data-term-id=\"39036028\">Texas Law<\/span> Allow You To <span data-term-id=\"39036026\">Stand Your Ground<\/span>?<\/h2>\n<p><span data-term-id=\"39036028\">Texas law<\/span> incorporates both <span data-term-id=\"39036029\">Castle Doctrine<\/span> and \u201c<span data-term-id=\"39036026\">stand your ground<\/span>\u201d statutes when facing a home intruder. Under Chapter 9 of the <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39036036\">Texas Penal Code<\/span><\/a>, a person who is lawfully present, has not provoked the other party, and is not engaged in <span data-term-id=\"39036040\">criminal activity<\/span> has no legal duty to retreat before using force or <span data-term-id=\"39036027\">deadly force<\/span>. This applies whether at home, in a vehicle, at work, or in any other place where they have a right to be.<\/p>\n<p>However, the <span data-term-id=\"39036028\">Texas law<\/span> states that the \u201c<a href=\"https:\/\/www.ajs.org\/how-stand-your-ground-laws-shape-self-defense-verdicts\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39036026\">stand your ground<\/span>\u201d law<\/a> doesn&#8217;t apply if you provoked the <span data-term-id=\"39036064\">aggressor<\/span>. If you invite someone into your home intending to harm them, you cannot claim self-defense under the <span data-term-id=\"39036029\">Castle Doctrine<\/span>.<\/p>\n<h2><span data-term-id=\"39036044\">Texas <\/span><span data-term-id=\"39036034\">Self-Defense Laws<\/span><\/h2>\n<p>Regardless of where you live, you have a right to defend yourself when someone threatens you. This doesn\u2019t mean that the police won\u2019t arrest someone for doing just that. Depending on the situation, you may end up facing charges for <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/aggravated-assault.html\"><span data-term-id=\"39036087\">aggravated assault<\/span><\/a>, battery, or even homicide.<\/p>\n<p>Each state has its own set of laws governing self-defense. Some states require you to retreat from a <span data-term-id=\"39036098\">threat of violence<\/span> before using force, while others have \u201c<a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/stand-your-ground-laws.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39036026\">stand your ground<\/span>\u201d laws<\/a>. Most jurisdictions limit the <span data-term-id=\"39036030\">use of force<\/span> during the <span data-term-id=\"39036094\">protection of property<\/span>, like your home or your <span data-term-id=\"39036086\">place of business<\/span>.<\/p>\n<p>While state <span data-term-id=\"39036034\">self-defense laws<\/span> vary, the force you employ when defending yourself must be <a href=\"https:\/\/www.nytimes.com\/2021\/04\/07\/us\/proportional-force-minneapolis-police-derek-chauvin.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39036062\">proportionate<\/span> to the potential harm faced<\/a>. Most <span data-term-id=\"39036034\">self-defense laws<\/span> also require that you have a <span data-term-id=\"39036083\">reasonable belief<\/span> that you will suffer <span data-term-id=\"39036092\">imminent harm<\/span> if you don\u2019t employ any self-defense tactics.<\/p>\n<p>Texas has multiple statutes addressing self-defense, including specific rules regarding when the <span data-term-id=\"39036042\">use of <\/span><span data-term-id=\"39036027\">deadly force<\/span> is justified. <span data-term-id=\"39036028\">Texas law<\/span> permits the <span data-term-id=\"39036030\">use of force<\/span>, which includes the <span data-term-id=\"39036042\">use of <\/span><span data-term-id=\"39036027\">deadly force<\/span>, to <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-9-33.html\" target=\"_blank\" rel=\"noopener\">protect a <span data-term-id=\"39036096\">third person<\/span><\/a>.
