Texas <\/span>self-defense laws<\/span> allow individuals to defend themselves, others, and their property using a reasonable and proportional level of force<\/span>, including deadly force<\/span> against an aggressor<\/span>, when conditions required under the state law<\/span> are met in criminal cases<\/span>. What Is the Castle Doctrine<\/span>?<\/h2>\n

The Castle Doctrine<\/span> states that a person may use the necessary force, including deadly force<\/span><\/a>, to defend themselves from an intruder in their home or other legally occupied place. It creates a presumption that the defender believes using force is immediately necessary and reasonable when another person is unlawfully and forcefully entering, or attempting to enter, a place to which the defender has a right. This includes the defender\u2019s occupied habitation, vehicle, place of business<\/span>, or employment.<\/p>\n

This doctrine can also apply if the offender is attempting to commit certain serious offenses, such as aggravated kidnapping<\/span>, murder, sexual assault<\/span>, aggravated sexual assault<\/span>, robbery, or aggravated robbery<\/span>. This presumption only applies if the defender is lawfully present, has not provoked the encounter, and is not engaged in criminal activity<\/span> other than minor traffic offenses.<\/p>\n

Many states recognize some form of the Castle Doctrine<\/span>, but differ on whether they also have broad \u201cstand your ground<\/span><\/a>\u201d statutes. For example, states like California, Colorado, Illinois, New Mexico, Oregon, Vermont, Virginia, and Washington recognize a right to defend one\u2019s home but do not have explicit statewide \u201cstand your ground<\/span>\u201d statutes. They may impose a duty to retreat in public in some circumstances.<\/p>\n

Does Texas Law<\/span> Allow You To Stand Your Ground<\/span>?<\/h2>\n

Texas law<\/span> incorporates both Castle Doctrine<\/span> and \u201cstand your ground<\/span>\u201d statutes when facing a home intruder. Under Chapter 9 of the Texas Penal Code<\/span><\/a>, a person who is lawfully present, has not provoked the other party, and is not engaged in criminal activity<\/span> has no legal duty to retreat before using force or deadly force<\/span>. This applies whether at home, in a vehicle, at work, or in any other place where they have a right to be.<\/p>\n

Most jurisdictions limit the use of force<\/span> during the protection of property<\/span>, like your home or your place of business<\/span>.<\/p>\n

While state self-defense laws<\/span> vary, the force you employ when defending yourself must be proportionate<\/span> to the potential harm faced<\/a>. Most self-defense laws<\/span> also require that you have a reasonable belief<\/span> that you will suffer imminent harm<\/span> if you don\u2019t employ any self-defense tactics.<\/p>\n
