If you simply forgot to return the victim&#8217;s property or only intended to borrow the item(s), the prosecutor will have a difficult time securing a <span data-term-id=\"55779486\">theft conviction<\/span>.<\/li>\n<li><strong>Mistake of fact<\/strong>: Your attorney may be able to prove that you took property mistakenly believing it belonged to you or that you had permission to take it.
