Wade<\/i>&nbsp;in <i>Dobbs v. Jackson Women&#8217;s Health Organization<\/i>. The Court\u2019s decision returned the power to regulate or prohibit abortion to state lawmakers.<\/p>\r\n<p>In 2020, Utah passed a &quot;trigger ban&quot; prohibiting most abortions. That statute became effective when the Supreme Court overturned <i>Roe v. Wade<\/i>.&nbsp;The Utah Supreme Court blocked the trigger law, saying there was no harm in maintaining the status quo. For now, Utah bans most abortions after 18 weeks of pregnancy.&nbsp;<\/p>\r\n<h2><b>Utah Abortion Laws<\/b><\/h2>\r\n<p><a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S302.html\" target=\"_blank\" rel=\"noopener\">Utah\u2019s abortion laws<\/a> are among the most restrictive in America. Abortion restrictions include:<\/p>\r\n<ul>\r\n<li>Abortion must take place before 18 weeks of pregnancy<\/li>\r\n<li>Pregnant person must have <a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S305.html\" target=\"_blank\" rel=\"noopener\">two counseling sessions<\/a>, one not less than 72 hours before the abortion<\/li>\r\n<li>Medicaid and private insurance coverage cannot pay for abortion care, except in specific circumstances<\/li>\r\n<li>Abortion providers must notify parents and receive parental consent before a minor may receive an abortion<\/li>\r\n<li>Telehealth providers cannot prescribe medication abortion (mifepristone a.k.a the &quot;abortion pill&quot;)<\/li>\r\n<li>Only licensed physicians may perform abortions at hospitals or licensed abortion clinics<\/li>\r\n<li>Patients cannot receive abortions if the only reason given is that the fetus <a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S302.4.html\" target=\"_blank\" rel=\"noopener\">has or may have Down syndrome<\/a><\/li>\r\n<\/ul>\r\n<h2><b>Lawful Abortions in Utah<\/b><\/h2>\r\n<p>Although abortion is allowed up to the 18th week of pregnancy, it is <a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S302.html\" target=\"_blank\" rel=\"noopener\">only permitted for the following reasons<\/a>:<\/p>\r\n<ul>\r\n<li>To prevent death or serious bodily harm to the pregnant woman<\/li>\r\n<li>The fetus has an abnormality incompatible with life. Two physicians must verify such an abnormality exists. Doctors must inform the woman about perinatal palliative and hospice care.<\/li>\r\n<li>Cases of rape and incest. Before performing an abortion in these cases, the physician must ensure the patient notified law enforcement.<\/li>\r\n<li>Cases of rape on a child under 14<\/li>\r\n<\/ul>\r\n<p>This table provides an overview of Utah&#8217;s legal code sections on abortion:<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Utah Abortion Code Sections<\/b><\/p>\r\n<\/th>\r\n<td><ul>\r\n<li><p><a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S301.html\" target=\"_blank\" rel=\"noopener\">Utah Code 76-7-301<\/a> &#8211; (<i>definitions<\/i>)<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Statutory Definition of Lawful Abortion<\/b><\/p>\r\n<\/th>\r\n<td><p><a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S302.html\" target=\"_blank\" rel=\"noopener\">Abortion is the act<\/a> by a physician using an instrument or by prescribing a drug with the intent to cause the death of a fetus of a woman known to be pregnant.<\/p>\r\n<p>Abortion does not include the removal of a dead fetus or an ectopic pregnancy.<br>\r\n<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Statutory Definition of Unlawful Abortion<\/b><\/p>\r\n<\/th>\r\n<td><p>Abortions must be performed before the 18th week of pregnancy. Licensed physicians may perform abortions:<\/p>\r\n<ul>\r\n<li>To prevent the mother\u2019s death or substantial physical impairment<\/li>\r\n<li>In cases of rape or incest reported to law enforcement<\/li>\r\n<li>For certified cases of fetal defect incompatible with life<\/li>\r\n<\/ul>\r\n<p>All other abortions are unlawful.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Penalty for Unlawful Abortion<\/b><\/p>\r\n<\/th>\r\n<td><p>Performing an unlawful abortion is a <a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter7\/76-7-S314.html\" target=\"_blank\" rel=\"noopener\">second-degree felony<\/a>, punishable by one to 15 years in prison and a fine of up to $10,000.<\/p>\r\n<p>A woman may not face criminal charges for obtaining a lawful abortion.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> Utah state laws change through the passage of new legislation, court rulings that include federal decisions, ballot initiatives, and other means.
