We have answers to common questions about how <span data-term-id=\"39140698\">family law<\/span> deals with <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-laws.html\"><span data-term-id=\"39140756\">domestic abuse<\/span><\/a> in <span data-term-id=\"39140684\">Utah<\/span>. There are many <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">different types of abuse considered to be <span data-term-id=\"39140677\">domestic violence<\/span><\/a>. These include isolation, coercion, sexual assault, and emotional abuse. <span data-term-id=\"39140677\">Domestic violence<\/span> is about the abuser gaining and maintaining <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\">power and control<\/a> over a victim.<\/p>\n<p>For lawmakers in <span data-term-id=\"39140688\">Salt Lake City<\/span>, the acts themselves are not enough to qualify as <span data-term-id=\"39140677\">domestic violence<\/span>. A certain type of relationship has to exist between the abuser and the victim.<\/p>\n<h2>Who can be part of a <span data-term-id=\"39140677\">domestic violence<\/span> crime in <span data-term-id=\"39140684\">Utah<\/span>?<\/h2>\n<p>While most states define those eligible to be part of a <span data-term-id=\"39140677\">domestic violence<\/span> crime as <span data-term-id=\"39140735\">family members<\/span> and household members, <span data-term-id=\"39140684\">Utah<\/span> has a different term for them. <span data-term-id=\"39140689\">Cohabitants<\/span> are <span data-term-id=\"39140684\">Utah<\/span> residents considered possible to be involved in a <span data-term-id=\"39140692\">domestic violence<\/span><span data-term-id=\"39140692\"> offense<\/span>. In addition to being over the age of 16, each <a href=\"https:\/\/le.utah.gov\/xcode\/Title78B\/Chapter7\/78B-7-S102.html?v=C78B-7-S102_2023050320230701\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140689\">cohabitant<\/span> must fall under one of the following categories<\/a>:<\/p>\n<ul>\n<li>Spouses and former spouses<\/li>\n<li>In a serious romantic relationship with each other<\/li>\n<li>Related by marriage (affinity to the second degree &#8211; for example, brother of a spouse)<\/li>\n<li>Related by blood (consanguinity)<\/li>\n<li>Have at least one child together<\/li>\n<li>Pregnant by the abuser<\/li>\n<li>Reside together or resided together in the past<\/li>\n<li>Are consensual sexual partners or were consensual sexual partners in the past<\/li>\n<\/ul>\n<p><span data-term-id=\"39140689\">Cohabitants<\/span> don&#8217;t include parents and their minor children, or siblings who are less than 18 years old. A crime committed between people who are ruled not to be <span data-term-id=\"39140689\">cohabitants<\/span> is still a crime.<\/p>\n<h2>What does <span data-term-id=\"39140684\">Utah<\/span> consider to be <span data-term-id=\"39140677\">domestic violence<\/span>?<\/h2>\n<p>In <span data-term-id=\"39140684\">Utah<\/span>, <span data-term-id=\"39140677\">domestic violence<\/span> occurs when a <span data-term-id=\"39140689\">cohabitant<\/span> commits a specific type of crime against another <span data-term-id=\"39140689\">cohabitant<\/span>. These offenses are abusive in nature and <a href=\"https:\/\/le.utah.gov\/xcode\/Title77\/Chapter36\/77-36-S1.html?v=C77-36-S1_2024090120240501\" target=\"_blank\" rel=\"noopener\">fall under these classifications<\/a>:<\/p>\n<ul>\n<li><span data-term-id=\"39140719\">Sexual offenses<\/span><\/li>\n<li>Assault and aggravated assault<\/li>\n<li>Criminal homicide<\/li>\n<li><span data-term-id=\"39140677\">Domestic violence<\/span> in the presence of a child (considered <span data-term-id=\"39140713\">child abuse<\/span> in <span data-term-id=\"39140684\">Utah<\/span>)<\/li>\n<li><span data-term-id=\"39140740\">Electronic communication harassment<\/span>, destruction, damage, or interruption<\/li>\n<li>Harassment<\/li>\n<li>Kidnapping, child kidnapping, or <span data-term-id=\"39140762\">aggravated kidnapping<\/span><\/li>\n<li>Mayhem<\/li>\n<li>Possession of a deadly weapon with criminal intent<\/li>\n<li>Property offenses (criminal trespass, burglary, robbery, etc.)<\/li>\n<li>Animal cruelty<\/li>\n<li>Retaliation against a victim or witness<\/li>\n<li><span data-term-id=\"39140731\">Disorderly conduct<\/span> (as a plea agreement for a different charge)<\/li>\n<li>Stalking<\/li>\n<li>Threatening to use or using a <span data-term-id=\"39140728\">dangerous weapon<\/span><\/li>\n<li>Threatening violence<\/li>\n<li>Unlawful detention<\/li>\n<li>Discharge of a firearm under certain conditions<\/li>\n<li>Unlawful distribution of an <span data-term-id=\"39140760\">intimate image<\/span> (revenge porn) or a counterfeit <span data-term-id=\"39140760\">intimate image<\/span><\/li>\n<li><span data-term-id=\"39140742\">Voyeurism<\/span><\/li>\n<li>Witness tampering<\/li>\n<li>Violating a <a href=\"https:\/\/www.utcourts.gov\/en\/self-help\/categories\/protect-order\/protective-orders.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140686\">protective order<\/span><\/a><\/li>\n<\/ul>\n<p>Note that the <a href=\"https:\/\/le.utah.gov\/xcode\/Title76\/Chapter5\/76-5-S107.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140699\">threat of violence<\/span><\/a> is enough to be considered a <span data-term-id=\"39140692\">domestic violence<\/span><span data-term-id=\"39140692\"> offense<\/span>. The abuser doesn&#8217;t have to follow through with the violence to be charged with <span data-term-id=\"39140756\">domestic abuse<\/span>.<\/p>\n<h2>What happens when someone commits an act of <span data-term-id=\"39140677\">domestic violence<\/span> in <span data-term-id=\"39140684\">Utah<\/span>?<\/h2>\n<p>In a perfect world, a domestic abuser would be stopped before any abuse was inflicted, and a solution would be worked out that offered a positive ending for all involved. As we don&#8217;t live in a perfect world, the reality is much messier when <span data-term-id=\"39140689\">cohabitants<\/span> harm one another.<\/p>\n<p><span data-term-id=\"39140677\">Domestic violence<\/span> often manifests as a vicious cycle of threats, intimidation, and abuse. <span data-term-id=\"39140684\">Utah<\/span> tries to break this pattern with <a href=\"https:\/\/le.utah.gov\/xcode\/Title77\/Chapter36\/77-36-S2.2.html\" target=\"_blank\" rel=\"noopener\">laws designed to keep the victim and abuser apart<\/a>. The abuser may face incarceration for the crimes they&#8217;ve committed, but there are also protections centered on <span data-term-id=\"39140677\">domestic violence<\/span> that can be utilized for the victim&#8217;s safety.<\/p>\n<p>Abusers convicted of crimes considered to be <span data-term-id=\"39140677\">domestic violence<\/span> may be required to take <span data-term-id=\"39140756\">domestic abuse<\/span> education or rehabilitation programs. They are not eligible for diversion programs to avoid penalties.<\/p>\n<h2>What sort of protections does <span data-term-id=\"39140684\">Utah<\/span> offer <span data-term-id=\"39140690\">victims of <\/span><span data-term-id=\"39140677\">domestic violence<\/span>?<\/h2>\n<p>If you&#8217;re in immediate danger of abuse, call 911. <span data-term-id=\"39140684\">Utah<\/span> police follow certain protocols for responding to disturbances that may involve <span data-term-id=\"39140677\">domestic violence<\/span>.<\/p>\n<p>They have the <a href=\"https:\/\/le.utah.gov\/xcode\/Title77\/Chapter36\/77-36-S2.2.html\" target=\"_blank\" rel=\"noopener\">authority to arrest or cite anyone<\/a> they believe committed an act of <span data-term-id=\"39140677\">domestic violence<\/span>, and they can take someone they believe to be a threat into custody. History and severity of injuries are used to determine the predominant aggressor if dueling claims are made.<\/p>\n<p>The primary defense for <span data-term-id=\"39140690\">victims of <\/span><span data-term-id=\"39140677\">domestic violence<\/span> is <span data-term-id=\"39140684\">Utah<\/span>&#8216;s <a href=\"https:\/\/www.utcourts.gov\/en\/self-help\/categories\/protect-order\/protective-orders.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140677\">domestic violence<\/span> <span data-term-id=\"39140686\">protective orders<\/span><\/a>. Victims file a <a href=\"https:\/\/www.utcourts.gov\/en\/self-help\/categories\/protect-order\/protective-orders.html#Form\" target=\"_blank\" rel=\"noopener\">packet of forms<\/a> in their district court before they&#8217;re reviewed by a judge, often on the same day. If approved, the <strong>temporary ex parte <span data-term-id=\"39140686\">protective order<\/span><\/strong> goes into immediate effect. <span data-term-id=\"39140738\">Law enforcement<\/span> will serve the abuser and notify them of the conditions of the order.<\/p>\n<p>A temporary ex parte <span data-term-id=\"39140686\">protective order<\/span> is good for 21 days or until a hearing between the victim and the abuser. The order is extended if there&#8217;s a delay in serving the abuser, up to 180 days. If the abuser doesn&#8217;t object to the order, they don&#8217;t have to attend the hearing.<\/p>\n<p>At the hearing, the victim and the abuser (if present) tell their version of what\u2019s happened between them. Both sides can present evidence and call witnesses. If the judge agrees that there&#8217;s a threat, a <strong>final <span data-term-id=\"39140686\">protective order<\/span><\/strong> will be drafted and issued. The final <span data-term-id=\"39140686\">protective order<\/span> can have the same conditions as a temporary order, as well as others.<\/p>\n<p><span data-term-id=\"39140686\">Protective orders<\/span> are tailored to each case and offer specific protections. The <a href=\"https:\/\/le.utah.gov\/xcode\/Title78B\/Chapter7\/78B-7-S603.html?v=C78B-7-S603_2023050320230503\" target=\"_blank\" rel=\"noopener\">conditions imposed on the abuser<\/a> can include banning all contact with the victim, removing themselves from a shared residence, surrendering firearms, granting temporary custody of children, and anything else the court deems necessary to ensure the safety of the victim.<\/p>\n<p>A final <span data-term-id=\"39140686\">protective order<\/span> <a href=\"https:\/\/le.utah.gov\/xcode\/Title78B\/Chapter7\/78B-7-S606.html\" target=\"_blank\" rel=\"noopener\">lasts for three years<\/a>, but not all its provisions do. There are two types of provisions in\u00a0<span data-term-id=\"39140686\">protective orders<\/span>: criminal and civil.<\/p>\n<p><strong>Criminal provisions<\/strong> last for three years, and violations are crimes subject to prosecution. <strong>Civil provisions <\/strong>expire 150 days after the order is issued unless extended. Violations of civil provisions are pursued through the <a href=\"https:\/\/www.utcourts.gov\/en\/legal-help\/legal-help\/procedures\/filing\/motions\/enforcement.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140721\">Utah<\/span><span data-term-id=\"39140721\"> court<\/span> system<\/a>.<\/p>\n<p>More information about <span data-term-id=\"39140684\">Utah<\/span>&#8216;s <span data-term-id=\"39140686\">protective orders<\/span> can be found in FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/utah-law\/utah-protective-orders-laws.html\"><span data-term-id=\"39140684\">Utah<\/span> <span data-term-id=\"39140686\">Protective Orders<\/span> Laws<\/a> article.<\/p>\n<h2>My ex keeps violating the <span data-term-id=\"39140686\">protective order<\/span>. Is there anything I can do to make them stop?<\/h2>\n<p>If your abuser violates your <span data-term-id=\"39140686\">protective order<\/span>, call <span data-term-id=\"39140738\">law enforcement<\/span>. In fact, if they <strong>threaten<\/strong> to violate your <span data-term-id=\"39140686\">protective order<\/span>, call <span data-term-id=\"39140738\">law enforcement<\/span>. <span data-term-id=\"39140684\">Utah<\/span> is serious about enforcing all <span data-term-id=\"39140733\">restraining orders<\/span>, and the penalties for violation are severe.<\/p>\n<p><a href=\"https:\/\/le.utah.gov\/xcode\/Title78B\/Chapter7\/78B-7-S607.html\" target=\"_blank\" rel=\"noopener\">Any violation of a criminal provision<\/a> in a <span data-term-id=\"39140677\">domestic violence<\/span> <span data-term-id=\"39140686\">protective order<\/span> is a <span data-term-id=\"39140768\">class A<\/span> <span data-term-id=\"39140700\">misdemeanor<\/span>. Violations of civil provisions constitute contempt of court.<\/p>\n<p>The offense committed by the abuser <a href=\"https:\/\/le.utah.gov\/xcode\/Title77\/Chapter36\/77-36-S1.1.html\" target=\"_blank\" rel=\"noopener\">raises a level of severity<\/a> if the violation occurs within 10 years of the conviction. For example, a crime with a penalty of a class C <span data-term-id=\"39140700\">misdemeanor<\/span> becomes a class B <span data-term-id=\"39140700\">misdemeanor<\/span>. This enhancement increases if a <span data-term-id=\"39140728\">dangerous weapon<\/span> is involved.<\/p>\n<h2>I&#8217;ve filed for divorce from my abuser and want primary custody of our children. Will the <span data-term-id=\"39140756\">domestic abuse<\/span> charges have any effect on the decision?<\/h2>\n<p>When deciding custody and <span data-term-id=\"39140754\">parental rights<\/span>, the court focuses on the <span data-term-id=\"39140752\">best interests of the child<\/span>. The <a href=\"https:\/\/dictionary.findlaw.com\/definition\/presumption.html\" target=\"_blank\" rel=\"noopener\">rebuttable presumption<\/a> is that having both parents involved offers the most for the child, but courts take <a href=\"https:\/\/le.utah.gov\/xcode\/Title30\/Chapter3\/30-3-S34.html?v=C30-3-S34_2024050120240501\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39140692\">domestic violence<\/span><span data-term-id=\"39140692\"> offenses<\/span> into consideration<\/a> when determining custody and parenting time. An abuser can find their parenting time reduced, subject to supervision, or banned in extreme instances.<\/p>\n<p><span data-term-id=\"39140684\">Utah<\/span> permits both fault and no-fault divorces. It&#8217;s not necessary to prove fault, but <a href=\"https:\/\/le.utah.gov\/xcode\/Title30\/Chapter3\/30-3-S1.html?v=C30-3-S1_2024050120240501\" target=\"_blank\" rel=\"noopener\">cruel treatment causing bodily injury or great mental distress<\/a> is considered grounds for divorce. Having a <span data-term-id=\"39140686\">protective order<\/span> in place during a divorce will likely weigh into the outcome.<\/p>\n<h2><strong>The <span data-term-id=\"39140686\">protective order<\/span> made my abuser give up their key to our apartment, but I&#8217;m sure they have another copy. How do I stop them from having access?<\/strong><\/h2>\n<p>Under <span data-term-id=\"39140693\">Utah<\/span><span data-term-id=\"39140693\"> law<\/span>, <a href=\"https:\/\/le.utah.gov\/xcode\/Title57\/Chapter22\/57-22-S5.1.html\" target=\"_blank\" rel=\"noopener\">a landlord is required to change the locks if asked by a <span data-term-id=\"39140690\">victim of <\/span><span data-term-id=\"39140677\">domestic violence<\/span><\/a>. They can ask to see court documents. The victim must pay the cost of the lock change. The landlord is forbidden to give a copy of the new key to the abuser, even if the abuser&#8217;s name is on the lease.<\/p>\n<h2>My abuser is dangerous, and I&#8217;m not waiting around for something worse to happen. Is there anything I can do about my lease?<\/h2>\n<p>Victims of <span data-term-id=\"39140756\">domestic abuse<\/span> crimes <a href=\"https:\/\/le.utah.gov\/xcode\/Title57\/Chapter22\/57-22-S5.1.html\" target=\"_blank\" rel=\"noopener\">can break a rental agreement without penalty<\/a>. Landlords can request to see the police report and other court papers for confirmation. Once the landlord has been alerted, the victim has 15 days to vacate the premises. They are responsible for the rent during that period and any other back rent owed.<\/p>\n<h2>I&#8217;ve moved to a new location in a different part of the state and don&#8217;t want my abuser to find me. Does my <span data-term-id=\"39140686\">protection order<\/span> stay in effect?<\/h2>\n<p>Your <span data-term-id=\"39140686\">protection order<\/span> is good anywhere in <span data-term-id=\"39140684\">Utah<\/span>. Thanks to the <a href=\"https:\/\/www.hud.gov\/vawa#faq\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a>, it stays in effect in all American states and territories. Carry a copy of your order with you when you travel. When you move, it&#8217;s a good idea to notify your local\u00a0<span data-term-id=\"39140738\">law enforcement<\/span> agency.<\/p>\n<p><span data-term-id=\"39140684\">Utah<\/span>&#8216;s <a href=\"https:\/\/safeathome.utah.gov\/about\/\" target=\"_blank\" rel=\"noopener\">Safe at Home Program<\/a> keeps new residential addresses of victims out of the public record by providing them with a second legal address. Mail is forwarded, and state documents, such as driver&#8217;s licenses and voting registrations, use the fictitious address.
