Federal and state laws were developed to protect these brave <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers.html\">whistleblowers<\/a> from being fired or disciplined at work.<\/p>\n<p>Sometimes, whistleblowers feel torn about whether they will be held accountable as participating in the crime or exposed to personal liability for illegal activity at work they discover if they do nothing, or whether they may also lose their job if they do something about it. Most Americans today <a target=\"_blank\" href=\"http:\/\/money.cnn.com\/2013\/06\/24\/pf\/emergency-savings\/\" rel=\"noopener\">are living paycheck to paycheck<\/a> and even temporarily losing a job can result in losing your home or car. Many employees also feel a sense of loyalty to their employers and the act of whistleblowing can feel like a betrayal.<\/p>\n<p>The tables below outline the main Utah <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/state\/employment-laws\/details-on-state-whistleblower-laws.html\">whistleblower laws<\/a>.<\/p>\n<table width=\"652\" cellspacing=\"0\" cellpadding=\"2\" border=\"1\">\n<tbody><tr><td width=\"200\" valign=\"top\"><b>Code Sections<\/b><\/td>\n<td width=\"450\" valign=\"top\">Utah Code Title 67, Chapter 21: <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title67\/Chapter21\/67-21.html?v=C67-21_1800010118000101\" rel=\"noopener\">Protection of Public Employees Act<\/a><\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>What is an Employer Prohibited From Doing?<\/b><\/td>\n<td width=\"450\" valign=\"top\">An employer can\u2019t discharge, threaten, or otherwise discriminate if an employee reports, testifies, or refuses to carry out a directive that violates a law or regulation of the local, state, or federal government or shows the waste of public funds, property, or workforce.<\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>What Employees Are Protected?<\/b><\/td>\n<td width=\"450\" valign=\"top\">Only public or government employees.<\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Remedies<\/b><\/td>\n<td width=\"450\" valign=\"top\">The employee can file a civil action <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title67\/Chapter21\/67-21-S4.html?v=C67-21-S4_1800010118000101\" rel=\"noopener\">within 180 days<\/a> of the employer\u2019s violation for an injunction stopping the firing or other discrimination or for actual damages, as well as court and attorney&#8217;s fees. In addition, the court can award reinstatement, back pay, full fringe benefits, and seniority rights to the whistleblowing employee.<\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Penalties<\/b><\/td>\n<td width=\"450\" valign=\"top\">The violator is subject to a <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title67\/Chapter21\/67-21-S6.html?v=C67-21-S6_1800010118000101\" rel=\"noopener\">civil fine<\/a> of at most $500. In comparison, a knowingly <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title67\/Chapter21\/67-21-S10.html?v=C67-21-S10_1800010118000101\" rel=\"noopener\">false accusation<\/a> by an employee can be punished by termination and up to a $5,000 fine.<\/td>\n<\/tr><\/tbody><\/table>\n<p>Another area where there are <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/osha-whistleblower-protection.html\">legal protection against retaliation<\/a> for whistleblowers is OSHA (Occupational Safety and Health Administration) complaints about <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety.html\">unsafe working conditions<\/a>. The OSHA wants to encourage workers to inform the agency of problems so it can do its job keeping the nation\u2019s workplaces safe. Utah also protects whistleblowers in this area from, for example, informing the <a target=\"_blank\" href=\"http:\/\/laborcommission.utah.gov\/divisions\/UOSH\/index.html\" rel=\"noopener\">Labor Commission<\/a> about hazards likely to cause death or physical harm.<\/p>\n<table width=\"652\" cellspacing=\"0\" cellpadding=\"2\" border=\"1\">\n<tbody><tr><td width=\"200\" valign=\"top\"><b>Code Section<\/b><\/td>\n<td width=\"450\" valign=\"top\">Utah Code Section 34A-6-203: <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title34A\/Chapter6\/34A-6-S203.html?v=C34A-6-S203_1800010118000101\" rel=\"noopener\">Discharge or Discrimination Against Employee Prohibited<\/a><\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>What is an Employer Prohibited From Doing?<\/b><\/td>\n<td width=\"450\" valign=\"top\">An employer can\u2019t discharge or discriminate in any manner against an employee for filing a complaint, testifying, or exercising any other right granted under the <a target=\"_blank\" href=\"http:\/\/le.utah.gov\/xcode\/Title34A\/Chapter6\/34A-6.html\" rel=\"noopener\">Utah Occupational Safety and Health Act<\/a>.<\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>What Employees Are Protected?<\/b><\/td>\n<td width=\"450\" valign=\"top\">Public and private employees are both protected.<\/td>\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>Remedies<\/b><\/td>\n<td width=\"450\" valign=\"top\">The employee must <a target=\"_blank\" href=\"http:\/\/laborcommission.utah.gov\/media\/pdfs\/uosha\/forms\/Whistleblower%20Protection.pdf\" rel=\"noopener\">file a complaint<\/a> with the Labor Commission about the employer\u2019s violation within 30 days and stopping the violation and reinstatement of employee and back pay can be ordered.<\/td>\n<\/tr><\/tbody><\/table>\n<p>If you feel you were retaliated against for doing the right thing and exposing or declining to do something illegal, than you should speak with a lawyer who knows how to represent whistleblowers.
