The primary protection is a <span data-term-id=\"39137501\">Relief from Abuse<\/span> (RFA) order, which is a <span data-term-id=\"39137505\">court order<\/span> that can prevent contact and impose other restrictions on the abuser. Violations of these orders can result in jail time, fines, and additional criminal charges.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"39137500\">Domestic violence<\/span> crimes are not tolerated under <span data-term-id=\"39137512\">Vermont<\/span><span data-term-id=\"39137512\"> law<\/span>. Anyone considered a family or\u00a0<span data-term-id=\"39137502\">household member<\/span>\u00a0under <span data-term-id=\"39137499\">Vermont<\/span>\u00a0<span data-term-id=\"39137539\">family law<\/span>\u00a0qualifies. They must share <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01101\" target=\"_blank\" rel=\"noopener\"><u>one of the following relationships<\/u><\/a> with someone for an offense to be <span data-term-id=\"39137506\">domestic abuse<\/span>:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li><span data-term-id=\"39137510\">Family members<\/span> by marriage<\/li>\n<li><span data-term-id=\"39137510\">Family members<\/span> by blood (consanguinity)<\/li>\n<li>People in a <span data-term-id=\"39137524\">sexual relationship<\/span> or who were in a <span data-term-id=\"39137524\">sexual relationship<\/span><\/li>\n<li>People sharing a home or who shared a home<\/li>\n<li>People living together or who lived together<\/li>\n<li>People who are dating or have dated (with or without having sex)<\/li>\n<\/ul>\n<p>Dating relationships are examined by the court to determine if the relationship is developed enough to be eligible for a <span data-term-id=\"39137500\">domestic violence<\/span> crime. If those involved aren&#8217;t considered family or <span data-term-id=\"39137502\">household members<\/span>, the crime is still committed. A <span data-term-id=\"39137503\">sexual assault<\/span> that isn&#8217;t deemed <span data-term-id=\"39137500\">domestic violence<\/span> is still <span data-term-id=\"39137503\">sexual assault<\/span> and subject to prosecution.<\/p>\n<h2><strong>Do All <span data-term-id=\"39137500\">Domestic Violence<\/span> Crimes Involve Physical Assault?<\/strong><\/h2>\n<p>Many of the crimes considered <span data-term-id=\"39137500\">domestic violence<\/span> under <span data-term-id=\"39137539\">family law<\/span> in <span data-term-id=\"39137499\">Vermont<\/span> are physical in nature, but other <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01101\" target=\"_blank\" rel=\"noopener\"><u>types of abuse<\/u><\/a> qualify as well. <span data-term-id=\"39137500\">Domestic violence<\/span> is about gaining, maintaining, and exerting control over a victim. The <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01101\" target=\"_blank\" rel=\"noopener\"><u>types of crimes considered <span data-term-id=\"39137500\">domestic violence<\/span> in <span data-term-id=\"39137499\">Vermont<\/span><\/u><\/a> are:<\/p>\n<ul>\n<li>Child abuse<\/li>\n<li><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39137503\">Sexual assault<\/span><\/u><\/a><\/li>\n<li><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\"><u>Stalking<\/u><\/a><\/li>\n<li>Causing physical harm<\/li>\n<li>Attempting to cause physical harm<\/li>\n<li>Causing <span data-term-id=\"39137513\">fear of imminent serious physical harm<\/span><\/li>\n<\/ul>\n<p>Any of these crimes is a <span data-term-id=\"39137500\">domestic violence<\/span> offense when committed against someone considered a family or <span data-term-id=\"39137502\">household member<\/span>. Intimidating a victim with the threat of physical violence is a <span data-term-id=\"39137506\">domestic abuse<\/span> offense, even if the abuser doesn&#8217;t cause actual physical harm. Having <span data-term-id=\"39137500\">domestic violence<\/span> attached to a charge often enhances the penalty.<\/p>\n<h2><strong>What Can I Do To Keep My Abuser Away From Myself and My Kids?<\/strong><\/h2>\n<p>If you&#8217;re being abused or feel in danger of imminent physical harm, call <span data-term-id=\"39137508\">law enforcement<\/span> first. <span data-term-id=\"39137540\">Law enforcement<\/span><span data-term-id=\"39137540\"> officers<\/span> in <span data-term-id=\"39137499\">Vermont<\/span> <a href=\"https:\/\/vcjc.vermont.gov\/training\" target=\"_blank\" rel=\"noopener\"><u>receive special training for handling domestic dispute calls<\/u><\/a>. If your abuser is arrested for a <span data-term-id=\"39137500\">domestic violence<\/span> offense, <a href=\"https:\/\/www.vermontjudiciary.org\/family\/relief-abuse\" target=\"_blank\" rel=\"noopener\"><u>certain powerful protections<\/u><\/a> become available to you. Depending on the crime, your abuser might be incarcerated as well.<\/p>\n<p>If possible, it&#8217;s a good idea to <a href=\"https:\/\/www.thehotline.org\/what-is-a-safety-plan\/\" target=\"_blank\" rel=\"noopener\"><u>have a plan in place<\/u><\/a> with options for different situations. There are both <a href=\"https:\/\/www.ccvs.vermont.gov\/resources-and-other-help\" target=\"_blank\" rel=\"noopener\"><u>state programs<\/u><\/a> and <a href=\"https:\/\/www.vtnetwork.org\/get-help\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39137500\">domestic violence<\/span> assistance organizations<\/u><\/a> that can help.<\/p>\n<p>Available in both temporary and permanent forms, <span data-term-id=\"39137499\">Vermont<\/span> <a href=\"https:\/\/www.vermontjudiciary.org\/family\/relief-abuse\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39137501\">Relief From Abuse<\/span> (RFA) orders<\/u><\/a> are a powerful tool for preventing further <span data-term-id=\"39137500\">domestic violence<\/span> from an abuser. Carrying specific conditions tailored to each case, these <span data-term-id=\"39137505\">court orders<\/span> offer protection to victims and impose penalties on violators.<\/p>\n<p>An <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01104\" target=\"_blank\" rel=\"noopener\"><u>ex parte temporary RFA order<\/u><\/a> is what a victim applies for if they&#8217;ve suffered abuse that qualifies as <span data-term-id=\"39137500\">domestic violence<\/span> or feel harm is imminent. Victims, also known as petitioners, file for a <span data-term-id=\"39137533\">temporary order<\/span> in the <span data-term-id=\"39137535\">Family Division<\/span> of their <a href=\"https:\/\/www.vermontjudiciary.org\/court-locations\" target=\"_blank\" rel=\"noopener\"><u>local Superior Court<\/u><\/a>. Victims can apply for an RFA when the courts are closed by calling the <span data-term-id=\"39137543\">Judiciary<\/span>&#8216;s after-hours number: 800-540-9990.<\/p>\n<p>Petitioners have four options for filing their RFA:<\/p>\n<ul>\n<li><a href=\"https:\/\/vtlawhelp.org\/vtcourtforms\/relief-from-abuse\" target=\"_blank\" rel=\"noopener\"><u>Bring the completed forms<\/u><\/a> to the courthouse<\/li>\n<li>Fill out the forms at the courthouse<\/li>\n<li><a href=\"https:\/\/www.vermontjudiciary.org\/court-locations?f%5B0%5D=court_division:4\" target=\"_blank\" rel=\"noopener\"><u>Email the forms<\/u><\/a> and call to alert the court<\/li>\n<li><a href=\"https:\/\/www.vermontjudiciary.org\/about-vermont-judiciary\/electronic-access\/electronic-filing\" target=\"_blank\" rel=\"noopener\"><u>E-file the documents<\/u><\/a> and call to alert the court<\/li>\n<\/ul>\n<p>If the court rules that abuse occurred and the threat of further abuse exists, an <a href=\"https:\/\/dictionary.findlaw.com\/definition\/ex-parte.html\" target=\"_blank\" rel=\"noopener\"><u>ex parte<\/u><\/a> RFA is issued. They do not need to hear from the abuser, known as the defendant, to approve the ex parte RFA. It will be served by <span data-term-id=\"39137508\">law enforcement<\/span> and may contain conditions, including:<\/p>\n<ul>\n<li>Surrendering all firearms and not possessing firearms while the RFA is in effect<\/li>\n<li>Leaving a shared dwelling and not returning unless on a scheduled appointment to get personal belongings and accompanied by <span data-term-id=\"39137508\">law enforcement<\/span><\/li>\n<li>No contact with the victim, their children, or their family<\/li>\n<li>No contact with the victim at their residence, work, or other specified locations<\/li>\n<li>No abuse of the victim<\/li>\n<li>No violation of the victim&#8217;s personal freedoms<\/li>\n<li>Abiding by any <span data-term-id=\"39137542\">temporary custody<\/span> orders or restrictions on <span data-term-id=\"39137514\">parental rights<\/span><\/li>\n<li>No mistreatment of any shared household animal<\/li>\n<\/ul>\n<p>The court can impose any protection it considers necessary on an RFA. A temporary RFA remains in effect until the court hearing for a <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01103\" target=\"_blank\" rel=\"noopener\"><u>permanent <span data-term-id=\"39137509\">relief from abuse<\/span><span data-term-id=\"39137509\"> order<\/span> takes place<\/u><\/a>. The hearing is often held within two weeks of the defendant being served. Both sides offer their version of what happened, present evidence, and call witnesses at the case hearing.<\/p>\n<p>If either the defendant is incarcerated for a <span data-term-id=\"39137500\">domestic violence<\/span> crime or the court feels the <span data-term-id=\"39137537\">danger of further abuse<\/span> still exists, a permanent RFA is issued. The duration of this <span data-term-id=\"39137528\">final order<\/span> is determined on a case-by-case basis, and the petitioner can request an extension before it expires.<\/p>\n<p>All ex parte conditions can be part of the permanent RFA. It can also include:<\/p>\n<ul>\n<li>Ordering the defendant to return all personal documentation, such as passports, licenses, and other legal documents<\/li>\n<li>Ordering the defendant to pay up to three months of spousal support or <span data-term-id=\"39137515\">child support<\/span><\/li>\n<li>Assigning permanent custody of household animals<\/li>\n<\/ul>\n<p>As with ex parte orders, the court may include any condition in a permanent RFA to ensure the victim&#8217;s safety. The <a href=\"https:\/\/www.hud.gov\/vawa#faq\" target=\"_blank\" rel=\"noopener\"><u>Violence Against Women Act (VAWA)<\/u><\/a> ensures that <span data-term-id=\"39137499\">Vermont<\/span> RFAs are valid in all U.S. states and territories.<\/p>\n<p><span data-term-id=\"39137499\">Vermont<\/span>&#8216;s <span data-term-id=\"39137534\">Legal Help<\/span> website <a href=\"https:\/\/vtlawhelp.org\/roadmap\/relief-from-abuse\/step-1\" target=\"_blank\" rel=\"noopener\"><u>offers a step-by-step walkthrough<\/u><\/a> of the RFA filing process. Some steps include a video to help as well.<\/p>\n<h2><strong>Are There Other Protections Available in <span data-term-id=\"39137499\">Vermont<\/span>?<\/strong><\/h2>\n<p>There are other situational types of protection for <span data-term-id=\"39137519\">victims of <\/span><span data-term-id=\"39137500\">domestic violence<\/span> in <span data-term-id=\"39137499\">Vermont<\/span>. The <a href=\"https:\/\/sos.vermont.gov\/secretary-of-state-services\/safe-at-home\/\" target=\"_blank\" rel=\"noopener\"><u>Safe at Home program<\/u><\/a> offers address confidentiality, which helps keep an abuser from finding a victim who has moved. A fictitious address in Montpellier is used for all public records, and mail is forwarded to the victim&#8217;s residence.<\/p>\n<p>State programs such as voter registration and driver&#8217;s license records are covered by Safe at Home, but real estate transactions are public records and cannot be concealed.<\/p>\n<p>Victims of <span data-term-id=\"39137506\">domestic abuse<\/span> who are in a rental property have special <a href=\"https:\/\/vtlawhelp.org\/housing-protections-victims\" target=\"_blank\" rel=\"noopener\"><u>rights as well<\/u><\/a>. They can request:<\/p>\n<ul>\n<li>A change of locks<\/li>\n<li>Additional security measures, such as cameras<\/li>\n<li>Release from a lease agreement without penalty<\/li>\n<\/ul>\n<p>The landlord has the right to see court papers as proof of <span data-term-id=\"39137500\">domestic violence<\/span>. They cannot share any information with the abuser, even if the abuser&#8217;s name is on the lease.<\/p>\n<p>If you don&#8217;t qualify as a <span data-term-id=\"39137519\">victim of <\/span><span data-term-id=\"39137500\">domestic violence<\/span>, that doesn&#8217;t mean you don&#8217;t have protections available. Depending on the crime, <span data-term-id=\"39137499\">Vermont<\/span> offers different types of <span data-term-id=\"39137516\">restraining orders<\/span>. If you&#8217;re not sure what you qualify for, consult <a href=\"https:\/\/www.vermontjudiciary.org\/sites\/default\/files\/documents\/Protective%20Order%20Chart_5.pdf\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39137499\">Vermont<\/span>&#8216;s <span data-term-id=\"39137504\">protective order<\/span> chart<\/u><\/a>.<\/p>\n<p>Victims of both <span data-term-id=\"39137500\">domestic violence<\/span> and other offenses can seek protection against <a href=\"https:\/\/www.vermontjudiciary.org\/self-help\/abusive-litigation\" target=\"_blank\" rel=\"noopener\"><u>abusive litigation<\/u><\/a>. This forces abusers to ask permission from the court to file any litigation against their victims. The court won&#8217;t permit it if the filing is intended to harass, stalk, or intimidate the victim.<\/p>\n<h2><strong>What Should I Do if They Violate the <span data-term-id=\"39137504\">Protective Order<\/span>?<\/strong><\/h2>\n<p>Call <span data-term-id=\"39137508\">law enforcement<\/span> as soon as possible. If your abuser violates an RFA in any manner, they&#8217;ll discover that <span data-term-id=\"39137499\">Vermont<\/span> is serious about RFA enforcement. A threat to violate an RFA is also a violation. RFAs work best when the victim contacts <span data-term-id=\"39137508\">law enforcement<\/span> for any and every violation.<\/p>\n<p><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/019\/01030\" target=\"_blank\" rel=\"noopener\"><u>Intentional violations of an RFA<\/u><\/a>, either by doing something or not doing something they were supposed to, can lead to up to a year in jail and a fine of up to $5,000. A first violation involving an assault charge, or any subsequent violation, carries a penalty of up to three (3) years in prison and a fine of up to $25,000. That&#8217;s in addition to charges for any crime committed during the violation. Mandatory mental health counseling or sex offender treatment can be ordered at the defendant&#8217;s expense.<\/p>\n<h2><strong>Can I Sue My Abuser?<\/strong><\/h2>\n<p>You can sue your abuser to recover damages for lost wages, medical bills, or pain and suffering, to name a few. <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/vermont-small-claims-courts.html\"><u><span data-term-id=\"39137499\">Vermont<\/span> small claims courts<\/u><\/a> handle cases of up to $10,000. If suing for more in Superior Court, it&#8217;s not a bad idea to consult a <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/vermont?fli=dcta\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39137499\">Vermont<\/span> <span data-term-id=\"39137539\">family law<\/span> attorney<\/u><\/a>.<\/p>\n<h2><strong>How Do <span data-term-id=\"39137500\">Domestic Violence<\/span> Charges Affect Divorce and <span data-term-id=\"39137511\">Child Custody<\/span>?<\/strong><\/h2>\n<p>Permanent RFAs are admissible as evidence in divorce and custody cases between the victim and the abuser. <span data-term-id=\"39137499\">Vermont<\/span> <span data-term-id=\"39137539\">family law<\/span> <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/011\/00665a\" target=\"_blank\" rel=\"noopener\"><u>allows the court to determine<\/u><\/a> if the abuser is permitted to see any children and under what restrictions it deems necessary. It can ban the abuser from seeing them at all if it feels the risk is too great.<\/p>\n<p><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/011\/00551\" target=\"_blank\" rel=\"noopener\"><u>&#8220;Intolerable severity&#8221; is grounds for divorce<\/u><\/a> in <span data-term-id=\"39137499\">Vermont<\/span>, and <span data-term-id=\"39137500\">domestic violence<\/span> convictions are admissible as evidence.
