These orders prohibit an abuser from contacting or approaching the victim and may require surrendering firearms or leaving a shared home.<\/p>\n\n    <\/div>\n\n\n\n<p>Depending on where you are, <span data-term-id=\"39301452\">protective orders<\/span> may be called different things. For victims of abuse in <span data-term-id=\"39301453\">Vermont<\/span>, it doesn&#8217;t matter what they&#8217;re called as long as they offer protection. By keeping abusers away from their victims, <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\"><span data-term-id=\"39301452\">protective orders<\/span><\/a> offer a solid form of relief.<\/p>\n<p>With several different orders of protection available in <span data-term-id=\"39301453\">Vermont<\/span>, it&#8217;s challenging to know <a href=\"https:\/\/www.vermontjudiciary.org\/sites\/default\/files\/documents\/Protective%20Order%20Chart_5.pdf\" target=\"_blank\" rel=\"noopener\">which one works best for your situation<\/a>. Read on to keep the focus on <span data-term-id=\"39301452\">protective orders<\/span> in the state of <span data-term-id=\"39301453\">Vermont<\/span>.<\/p>\n<h2><strong><span data-term-id=\"39301452\">Protective Orders<\/span> in <span data-term-id=\"39301453\">Vermont<\/span>: Basics<\/strong><\/h2>\n<p>If you&#8217;re in <span data-term-id=\"39301487\">immediate danger<\/span>, call 911.<\/p>\n<p>The different <span data-term-id=\"39301477\">types of <\/span><span data-term-id=\"39301452\">protective orders<\/span> in <span data-term-id=\"39301453\">Vermont<\/span> are keyed to certain crimes committed by certain people. There&#8217;s little to no overlap between them when it comes to victims, but many of the conditions used to restrict abusers are shared between them. While every order is tailored for each case, some provisions are common:<\/p>\n<ul>\n<li>The abuser must stop abusing, <span data-term-id=\"39301490\">harassing<\/span>, or threatening to abuse the victim<\/li>\n<li>The abuser may have to surrender all firearms<\/li>\n<li>The abuser must not contact the victim<\/li>\n<li>The abuser must stay away from the victim and any <span data-term-id=\"39301467\">minor child<\/span><\/li>\n<li>The abuser may have to <span data-term-id=\"39301481\">vacate<\/span> a shared dwelling and stay away<\/li>\n<li><span data-term-id=\"39301491\">Temporary custody<\/span> of children awarded to the victim<\/li>\n<\/ul>\n<p><span data-term-id=\"39301452\">Protective orders<\/span> may contain some of these conditions, all of these conditions, none of these conditions, or anything the court deems necessary for the victim&#8217;s safety.<\/p>\n<p><span data-term-id=\"39301452\">Protective orders<\/span> issued in <span data-term-id=\"39301453\">Vermont<\/span> are valid anywhere else in the United States, including on Native American reservations, under <a href=\"https:\/\/www.hud.gov\/vawa#close\" target=\"_blank\" rel=\"noopener\">federal law<\/a>. This applies to orders from elsewhere in <span data-term-id=\"39301453\">Vermont<\/span> as well. The state refers to these as &#8220;<a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01108\" target=\"_blank\" rel=\"noopener\">foreign <span data-term-id=\"39301452\">protective orders<\/span><\/a>.&#8221; Considered civil contempt of court, <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01108\" target=\"_blank\" rel=\"noopener\">violators face a fine of up to $1,000 and up to six months in jail<\/a>.<\/p>\n<p>Violating <span data-term-id=\"39301452\">protective orders<\/span> issued in <span data-term-id=\"39301453\">Vermont<\/span> carries harsh penalties. A first violation of most types of orders can result in <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/019\/01030\" target=\"_blank\" rel=\"noopener\">up to a year in jail and a fine of up to $5,000<\/a>. A second offense, or a first one involving domestic or aggravated assault, means up to three years in prison and a fine of up to $25,000.<\/p>\n<p>The courts can also mandate participation in mental health counseling or sex offender treatment. This is in addition to any penalties from convictions of criminal acts committed during the order violation.<\/p>\n<h2><span data-term-id=\"39301452\">Protective Orders<\/span> in <span data-term-id=\"39301453\">Vermont<\/span>: Types of Orders<\/h2>\n<p>The <span data-term-id=\"39301452\">protective order<\/span> you apply for will depend on both the criminal act committed and your relationship with the other person involved. No <span data-term-id=\"39301453\">Vermont<\/span> <span data-term-id=\"39301452\">protective order<\/span> covers all situations, <a href=\"https:\/\/www.vermontjudiciary.org\/sites\/default\/files\/documents\/Protective%20Order%20Chart_5.pdf\" target=\"_blank\" rel=\"noopener\">so let&#8217;s look at what&#8217;s available<\/a> to make it clear which one&#8217;s for you.<\/p>\n<h3><span data-term-id=\"39301455\">Relief From Abuse Order<\/span> (RFA)<\/h3>\n<p><span data-term-id=\"39301455\">Relief from abuse orders<\/span> (RFAs) are designed to help victims of <span data-term-id=\"39301470\">domestic abuse<\/span>. To qualify as eligible for RFA protection, the offense must fit the definition of <span data-term-id=\"39301470\">domestic abuse<\/span>. The victim and the abuser must be considered <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/15\/021\/01101\" target=\"_blank\" rel=\"noopener\">family or <span data-term-id=\"39301454\">household members<\/span><\/a>, which means they share one of the following relationships:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li>Former spouses<\/li>\n<li><span data-term-id=\"39301457\">Family members<\/span> by consanguinity (blood relatives)<\/li>\n<li><span data-term-id=\"39301457\">Family members<\/span> by marriage (stepfamily or in-laws)<\/li>\n<li>People who are sharing a home or have shared a home<\/li>\n<li>People who are living together or have lived together<\/li>\n<li>People who have a\u00a0<span data-term-id=\"39301464\">sexual relationship<\/span>\u00a0or have had a <span data-term-id=\"39301464\">sexual relationship<\/span><\/li>\n<li>People who are dating or have dated (the court rules on whether a relationship qualifies)<\/li>\n<\/ul>\n<p>If people who fit one of the categories above have an abusive crime committed between them, it&#8217;s <span data-term-id=\"39301460\">domestic violence<\/span>. <span data-term-id=\"39301460\">Domestic violence<\/span> abuse acts in <span data-term-id=\"39301453\">Vermont<\/span> are:<\/p>\n<ul>\n<li><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\">Stalking<\/a><\/li>\n<li><a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39301456\">Sexual assault<\/span><\/a><\/li>\n<li>Abuse of children<\/li>\n<li>Causing physical harm<\/li>\n<li>Attempting to cause physical harm<\/li>\n<li>Causing fear of imminent physical harm<\/li>\n<li>A pattern of coercive and controlling behavior<\/li>\n<\/ul>\n<p>If the conditions are met, the victim is eligible for an RFA. RFAs come in two forms: temporary\u00a0<span data-term-id=\"39301485\">ex parte<\/span>\u00a0RFAs and permanent RFAs. While victims can file for relief on their own, it&#8217;s a good idea to get <a href=\"https:\/\/vtnetwork.org\/get-help\/\" target=\"_blank\" rel=\"noopener\">help from an advocate<\/a>.<\/p>\n<p>If you&#8217;ve been abused or feel that abuse is imminent, call 911. <span data-term-id=\"39301476\">Law enforcement<\/span><span data-term-id=\"39301476\"> agencies<\/span> can help you begin the filing process and may arrest your abuser if they see just cause.<\/p>\n<p><a href=\"https:\/\/vtlawhelp.org\/roadmap\/relief-from-abuse\/step-1\" target=\"_blank\" rel=\"noopener\">The first step<\/a> is petitioning for a temporary <span data-term-id=\"39301485\">ex parte<\/span> RFA. <a href=\"https:\/\/vtlawhelp.org\/vtcourtforms\/relief-from-abuse\" target=\"_blank\" rel=\"noopener\">Some forms need to be filled out<\/a>, including an <span data-term-id=\"39301472\">affidavit<\/span> detailing what happened. These can be emailed, taken to the Family Division of the courthouse, or filled out there. If you need relief and the courts are closed, call the <span data-term-id=\"39301488\">Vermont<\/span><span data-term-id=\"39301488\"> Judiciary<\/span>&#8216;s after-hours number to begin the process: <strong>800-540-9990<\/strong>.<\/p>\n<p>Next, <a href=\"https:\/\/vtlawhelp.org\/roadmap\/relief-from-abuse\/step-4\" target=\"_blank\" rel=\"noopener\">you&#8217;ll speak with a judge<\/a>, who&#8217;ll review your petition and ask you questions. If the court agrees that a threat of <span data-term-id=\"39301460\">domestic violence<\/span> exists, a temporary <span data-term-id=\"39301485\">ex parte<\/span> RFA is issued. Your abuser isn&#8217;t present for this (&#8220;<span data-term-id=\"39301485\">ex parte<\/span>&#8220;), and <span data-term-id=\"39301458\">law enforcement<\/span> serves the order to them. The temporary RFA lasts until the <span data-term-id=\"39301499\">court hearing<\/span>, which is scheduled within 14 days.<\/p>\n<p>At the hearing, <a href=\"https:\/\/vtlawhelp.org\/roadmap\/relief-from-abuse\/step-5\" target=\"_blank\" rel=\"noopener\">both sides offer their version of what happened, present evidence, and call witnesses<\/a>, including <span data-term-id=\"39301495\">law enforcement<\/span><span data-term-id=\"39301495\"> officers<\/span>. If the preponderance of evidence proves abuse occurred and could occur again, the court can make the RFA into a permanent order. The duration is up to the judge, and permanency is possible.<\/p>\n<p>Amendments and additions to the conditions are common. These include rulings on <span data-term-id=\"39301483\">child custody<\/span>, <span data-term-id=\"39301478\">child support<\/span>, and any other matters the court deems necessary.<\/p>\n<h3>Relief From Abuse for a Vulnerable Adult<\/h3>\n<p>An <span data-term-id=\"39301463\">RFA order<\/span> for a vulnerable adult <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/33\/069\/06933\" target=\"_blank\" rel=\"noopener\">works much the same way a regular RFA does<\/a>. The main difference is that this RFA doesn&#8217;t require the abuser to be a family or\u00a0<span data-term-id=\"39301454\">household member<\/span>. The victim&#8217;s abuser could be a caregiver or someone involved with the adult&#8217;s well-being.<\/p>\n<p>Protections are focused on removing the abuser from the victim&#8217;s life. Penalties for violation of a vulnerable adult RFA <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/33\/069\/06913\" target=\"_blank\" rel=\"noopener\">depend on the offense<\/a>. Crimes committed during a violation face separate prosecution.<\/p>\n<h3>Order Against Stalking\/Order Against <span data-term-id=\"39301456\">Sexual Assault<\/span><\/h3>\n<p>These civil court <span data-term-id=\"39301461\">restraining orders<\/span> are for victims of either stalking or <span data-term-id=\"39301456\">sexual assault<\/span> by someone who isn&#8217;t a family or <span data-term-id=\"39301454\">household member<\/span>. In <span data-term-id=\"39301453\">Vermont<\/span>, <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\">stalking is<\/a> considered repeated following, surveillance, monitoring, or threatening, while <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05131\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39301456\">sexual assault<\/span> covers abusive sexual crimes<\/a>.<\/p>\n<p>Unlike RFAs, <span data-term-id=\"39301456\">sexual assault<\/span> and <span data-term-id=\"39301501\">stalking <\/span><span data-term-id=\"39301452\">protective orders<\/span> are filed in Civil Court. Otherwise, they <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05133\" target=\"_blank\" rel=\"noopener\">follow the same procedure<\/a> of petitioning for a <span data-term-id=\"39301466\">temporary order<\/span> before a <span data-term-id=\"39301499\">court hearing<\/span> on a final <span data-term-id=\"39301452\">protective order<\/span>. If the <span data-term-id=\"39301471\">danger of further abuse<\/span> exists, the conditions will focus on keeping the abuser away from the victim and ceasing all contact.<\/p>\n<p>The court determines the <span data-term-id=\"39301474\">period of time<\/span> for the <span data-term-id=\"39301473\">final order<\/span>. Permanency is an option. <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/12\/178\/05133\" target=\"_blank\" rel=\"noopener\">Violations carry up to six months in jail and a fine of up to $1,000 in addition<\/a> to penalties for criminal acts.<\/p>\n<h3><span data-term-id=\"39301468\">Extreme Risk <\/span><span data-term-id=\"39301452\">Protection Order<\/span> (ERPO)<\/h3>\n<p><span data-term-id=\"39301468\">Extreme risk <\/span><span data-term-id=\"39301452\">protection orders<\/span> (ERPO) are also known as red flag laws. They&#8217;re <span data-term-id=\"39301459\">court orders<\/span> filed when it&#8217;s believed that someone with access to firearms <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/085\/04051\" target=\"_blank\" rel=\"noopener\">is a danger to both themselves and others<\/a>. ERPOs are designed to separate the person named in the order (<span data-term-id=\"39301469\">respondent<\/span>) from firearms to lower the possibility of violence.<\/p>\n<p>ERPOs are <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/085\/04053\" target=\"_blank\" rel=\"noopener\">filed by <span data-term-id=\"39301453\">Vermont<\/span> state attorneys, the attorney general&#8217;s office, or family and <span data-term-id=\"39301454\">household members<\/span> of the <span data-term-id=\"39301469\">respondent<\/span><\/a>. Like RFAs, a temporary <span data-term-id=\"39301485\">ex parte<\/span> order is issued by the court before a hearing within 14 days. The <span data-term-id=\"39301469\">respondent<\/span> can argue to keep their firearms by explaining why they&#8217;re not a threat.<\/p>\n<p>If the court agrees that the ERPO is necessary, a final ERPO is issued with a duration of six months. If the order expires or an extension is refused, the <span data-term-id=\"39301469\">respondent<\/span> <a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/085\/04059\" target=\"_blank\" rel=\"noopener\">has 90 days to reclaim their firearms<\/a>. Refusal to surrender weapons under a temporary ERPO\u00a0<a href=\"https:\/\/legislature.vermont.gov\/statutes\/section\/13\/085\/04058\" target=\"_blank\" rel=\"noopener\">carries a fine of up to $1,000 and up to a year in jail<\/a>.
