It could be playing with the family pet or meeting a friendly pooch in a park. Sometimes, though, we get a harsh reminder that dogs are animals. They\u2019re susceptible to their base instincts and <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/dog-bites-animal-attacks.html\">capable of causing dog bite injuries<\/a>.<\/p>\r\n<p>Being a dog bite victim is frightening and traumatic. In the aftermath, you might be uncertain of your rights.<\/p>\r\n<p>Being the owner of a dog accused of a dog bite injury is no picnic either. In this article, we\u2019ll examine who\u2019s liable in a dog bite case, what Virginia considers to be a dangerous dog, possible defenses for a dog that\u2019s bitten someone, and much more.<\/p>\r\n<h2><b>Dog Bite Liability and Negligence in Virginia<\/b><\/h2>\r\n<p>While most states use a doctrine of <a href=\"https:\/\/dictionary.findlaw.com\/definition\/liability.html\" target=\"_blank\" rel=\"noopener\">strict liability<\/a> when it comes to dog bite incidents, Virginia does not. Strict liability means the dog\u2019s owner is liable for damage inflicted by the dog and responsible for paying the dog bite victim\u2019s medical bills.<\/p>\r\n<p>Virginia legislates dog attacks with the one bite rule and negligence claims. Let\u2019s look at each and see how they work together.<\/p>\r\n<h3><b>The One Bite Rule<\/b><\/h3>\r\n<p>For dog bite injuries, the <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-the-one-bite-rule.html\">one bite rule<\/a> can allow a dog to have what amounts to a \u201cfree bite.\u201d On the first bite, the dog\u2019s owner is not exposed to liability for the dog bite victim\u2019s medical bills. Under this rule, the owner usually isn\u2019t responsible for a first dog bite because they had no previous knowledge of their dog\u2019s aggressive behavior.<\/p>\r\n<p>But the one bite rule isn\u2019t an automatic get-out-of-jail-free card. If the dog bite victim can prove that the owner should have known their dog was a bite threat or that they didn\u2019t take the same care as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/reasonable-person.html\" target=\"_blank\" rel=\"noopener\">a reasonable person<\/a> to keep their dog from attacking, the dog\u2019s owner is liable.<\/p>\r\n<p>An example of this is the case <i>Butler v. Frieden (1967)<\/i>. A couple was found liable for damages after their unleashed dog bit a four-year-old girl on a public sidewalk, despite their dog having never bitten anyone before.<\/p>\r\n<h3><b>Negligence<\/b><\/h3>\r\n<p>Dog bite victims in Virginia <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/animal-attack-and-dog-bite-resources.html\">carry the burden of proof<\/a> to prove that the dog\u2019s owner\u2019s negligence was responsible for the dog\u2019s attack and their injuries. Dog owners have a duty of care to keep their dogs from attacking others. Violating that duty is the <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/elements-of-a-negligence-case.html\">first step in proving negligence<\/a>. This could be something like not taking reasonable care by letting a dog run at large or not keeping the dog away from people in public places.<\/p>\r\n<p>Proving negligence can be difficult. When attacking another animal, the dog isn\u2019t considered dangerous if one of the following applies:<\/p>\r\n<ul>\r\n<li>There is no serious injury to the other cat or dog<\/li>\r\n<li>The same person owns both animals<\/li>\r\n<li>The attack occurs on the dog owner\u2019s property<\/li>\r\n<\/ul>\r\n<p>When a dog attacks a person, the dog isn\u2019t considered dangerous if a law-enforcement officer or animal control officer determines the injury from the canine only consists of a single bite or nip causing only an abrasion, scratch, or other minor injury.<\/p>\r\n<p>In addition, <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/3.2-6540\/\" target=\"_blank\" rel=\"noopener\">a dog that attacks a person isn\u2019t dangerous<\/a> if the injured person was:<\/p>\r\n<ul>\r\n<li>Committing a crime on the owner\u2019s property<\/li>\r\n<li>Willfully <a href=\"https:\/\/www.findlaw.com\/realestate\/land-use-laws\/trespassing.html\">trespassing<\/a> on private property<\/li>\r\n<li>Provoking, tormenting, or physically abusing the animal, or had a history of doing so<\/li>\r\n<li>Bitten because the dog was defending or protecting itself, its offspring, the dog\u2019s owner, or the owner\u2019s property<\/li>\r\n<\/ul>\r\n<p>A dog also won\u2019t be classified as dangerous if it\u2019s part of a legal hunt, an organized and lawful dog handling event, or if the court rules that the dog isn\u2019t a threat to the community.<\/p>\r\n<h3><b>Responsibilities When You Own a Dangerous Dog<\/b><\/h3>\r\n<p>If classified as a dangerous dog, the dog is added to <a href=\"https:\/\/dd.vdacs.virginia.gov\/Public\/Index\" target=\"_blank\" rel=\"noopener\">Virginia\u2019s Dangerous Dog Registry<\/a>. The dog\u2019s owner also has special responsibilities, which include:<\/p>\r\n<ul>\r\n<li>Registration as a dangerous dog for $150, plus a yearly reregistration fee of $85<\/li>\r\n<li>A special tag identifying the dog as dangerous, to be worn at all times<\/li>\r\n<li>Rabies vaccination<\/li>\r\n<li>Neutering or spaying<\/li>\r\n<li>The dog must be muzzled when not confined<\/li>\r\n<li>Warning signs posted on the owner\u2019s property<\/li>\r\n<li>Microchipping the dog<\/li>\r\n<li>Liability insurance of at least $100,000<\/li>\r\n<\/ul>\r\n<p>The dog\u2019s owner faces a Class 1 misdemeanor for failing to follow any of the requirements.<\/p>\r\n<p>Failure to keep a dangerous dog from attacking again leaves the dog\u2019s owner facing criminal charges. The level of charges depends on the severity of the injury:<\/p>\r\n<ul>\r\n<li><b>Injury or death to a dog or cat<\/b>: <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\">Class 2 misdemeanor<\/a><\/li>\r\n<li><b>Bites or causes a bodily injury to a human<\/b>: Class 1 misdemeanor<\/li>\r\n<li><b>Causes serious bodily injury to a human<\/b>: Class 6 felony<\/li>\r\n<\/ul>\r\n<p>Even dangerous dogs are absolved of blame if the conditions listed above apply.<\/p>\r\n<p>A dog that has killed a person, or caused serious injury before and attacks again, faces possible euthanization. So, below is a summary of Virginia&#8217;s dog bite laws in plain language, with links to applicable statutes.<\/p>\r\n<table>\r\n<tbody><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Virginia Dog Bite Laws<\/b><\/p>\r\n<\/th>\r\n<td><p>Virginia Code, Title 3.2, <a href=\"https:\/\/codes.findlaw.com\/va\/title-3-2-agriculture-animal-care-and-food\/va-code-sect-3-2-6540.html\" target=\"_blank\" rel=\"noopener\">Section 6540<\/a>, et seq.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Virginia&#8217;s One Bite Rule for Dog Bites<\/b><\/p>\r\n<\/th>\r\n<td><p>The burden of proof is on the plaintiff to prove the owner knew or should have known that their dog was dangerous if the dog has no bite on record.<\/p>\r\n<p>If this evidence is accepted as truthful, then the owner may be held liable for injuries to the plaintiff.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Negligence Per Se Claims for Careless Dog Owners<\/b><\/p>\r\n<\/th>\r\n<td><p>Even if the dog has never bitten or injured anyone before, a plaintiff may sue for damages if they&#8217;re able to prove that the owners failed to use <a href=\"https:\/\/dictionary.findlaw.com\/definition\/due-care.html\" target=\"_blank\" rel=\"noopener\">reasonable (or &quot;due&quot;) care<\/a> in controlling their dog(s).<\/p>\r\n<p>For instance, someone who is bitten by a dog whose owner fails to follow an applicable leash law may sue under the legal theory of negligence <a href=\"https:\/\/dictionary.findlaw.com\/definition\/per-se.html\" target=\"_blank\" rel=\"noopener\">per se<\/a>. In other words, the very fact that they failed to use a leash is considered negligent.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Statutory Definition of Dangerous Dog<\/b><\/p>\r\n<\/th>\r\n<td><p>In Virginia law, the term &quot;dangerous dog&quot; classifies:<\/p>\r\n<ul>\r\n<li><p>A dog that has bitten, attacked, or caused injury to a companion animal (dog or cat)<\/p>\r\n<\/li>\r\n<li><p>A dog that has bitten, attacked, or caused injury to a person<\/p>\r\n<\/li>\r\n<\/ul>\r\n<p>A dog isn&#8217;t classified as dangerous if either of the following is true:<\/p>\r\n<ul>\r\n<li><p>A veterinarian determines that the dog or cat hasn&#8217;t suffered a serious injury as a result of the attack, both animals are owned by the same person, or the attack occurred on the property of the attacking dog&#8217;s owner<\/p>\r\n<\/li>\r\n<li><p>A peace officer or animal control officer determines that the injury inflicted on a human is a single nip or bite resulting only in a scratch, abrasion, or other minor injury<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>Legal Procedures for Dogs Known To Be Dangerous<\/b><\/p>\r\n<\/th>\r\n<td><p>If a peace officer or animal control officer has reason to believe a dog is dangerous, they may apply for issuance of a summons requiring the owner to appear in court at a specified time.<\/p>\r\n<p>The dog shall be confiscated and confined to protect the public until the case is adjudicated.
