This protection comes in the form of <span data-term-id=\"52754011\">bankruptcy exemptions<\/span>.<\/p>\n<p>In general, <span data-term-id=\"52754011\">bankruptcy exemptions<\/span> allow debtors to protect a specific amount of equity in their home, motor vehicle, <span data-term-id=\"52753998\">bank accounts<\/span>, and <span data-term-id=\"52753972\">personal property<\/span>. The courts are strict when it comes to the amount of equity you can protect and who can claim them.<\/p>\n<p>The <span data-term-id=\"52753971\">homestead exemption<\/span> allows <span data-term-id=\"52753978\">homeowners<\/span> to protect a significant amount of equity in their <span data-term-id=\"52753989\">primary residence<\/span>. As long as you meet the eligibility requirements to claim the <span data-term-id=\"52753971\">homestead exemption<\/span>, you\u2019ll have a chance to keep your home.<\/p>\n<p>Whether you can depends on how much <span data-term-id=\"52754013\">home equity<\/span> you have. If the exemption covers all your equity, the trustee has no reason to sell your house. As long as you can demonstrate that the property is your <span data-term-id=\"52753989\">primary residence<\/span>, be it real or <span data-term-id=\"52753972\">personal property<\/span>, you can apply the <span data-term-id=\"52753971\">homestead exemption<\/span>.<\/p>\n<p>The <span data-term-id=\"52754010\">Code of Virginia<\/span> allows <span data-term-id=\"52753978\">homeowners<\/span> to apply the exemption to the following types of property:<\/p>\n<ul>\n<li>Single-family home<\/li>\n<li>Condominium<\/li>\n<li>Townhouse<\/li>\n<li>Mobile home\/Manufactured home<\/li>\n<\/ul>\n<p>The <span data-term-id=\"52753997\">exemption laws<\/span> should protect you as long as you list the property on your Schedule A\/B and claim the exemption for the property on Schedule C.<\/p>\n<h2>Is There a Federal <span data-term-id=\"52753971\">Homestead Exemption<\/span>?<\/h2>\n<p>There is a federal <span data-term-id=\"52753971\">homestead exemption<\/span>. According to the U.S. <span data-term-id=\"52753987\">Bankruptcy Code<\/span>, each individual bankruptcy filer can claim up to $31,575 of protection for the equity in their home. <span data-term-id=\"52754005\">Married couples<\/span> filing jointly can claim double protection in the amount of $63,150.<\/p>\n<p>Virginia is an \u201copt-out\u201d state, which means debtors can\u2019t claim <span data-term-id=\"52753986\">federal exemptions<\/span> instead of <span data-term-id=\"52753996\">state exemptions<\/span>.
