It <a href=\"https:\/\/www.avma.org\/sites\/default\/files\/2020-03\/dogbite.pdf\" target=\"_blank\" rel=\"noopener\">happens over 4.5 million times a year<\/a> in the United States, according to the Centers for Disease Control (CDC), and <a href=\"https:\/\/www.iii.org\/press-release\/triple-i-dog-related-injury-claim-payouts-exceeded-1-billion-in-2022-040623\" target=\"_blank\" rel=\"noopener\">injury payouts exceeded $1 billion in 2022<\/a>.<\/p>\r\n<p>Those statistics don&#8217;t mean much to you in the aftermath of a dog attack when you&#8217;re in pain and wondering who&#8217;s liable for your dog bite injury. If you&#8217;re the owner of the dog who bit someone, they&#8217;re probably meaningless to you as well. Whichever side of the dog bite incident you find yourself, one of your concerns is how the dog bite laws in the state of Washington apply to your dog bite case.<\/p>\r\n<p>As either a dog bite victim or the dog owner, it&#8217;s important for you to understand Washington state dog bite laws. In this article, we&#8217;ll show how to determine who is <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/who-is-liable.html\">liable for medical expenses<\/a>, what dog classifications signify, and what to do if a dog bite injury happens.<\/p>\r\n<h2><b>Washington Dog Bite Liability<\/b><\/h2>\r\n<p>Washington recognizes <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-strict-liability-how-does-it-affect-injury-lawsuits\/\">strict liability<\/a> for dog bites. According to <a href=\"https:\/\/codes.findlaw.com\/wa\/title-16-animals-and-livestock\/wa-rev-code-16-08-040\/\" target=\"_blank\" rel=\"noopener\">RCW 16.08.040<\/a>, if your dog bites someone in a public place or someone invited onto your private property, you are liable for their medical bills. Some states have a <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-the-one-bite-rule.html\">one-bite rule<\/a> that waives liability if your dog has no bite history or hasn&#8217;t previously shown aggressive behavior, but there is no such provision in Washington. You don&#8217;t need to be aware of your dog&#8217;s potential viciousness to be liable.<\/p>\r\n<p>While there is no explicit one-bite rule in Washington, others can be liable besides the owner. The dog owner&#8217;s homeowners&#8217; insurance usually covers dog bite injuries. If you&#8217;re unsure about your coverage, check your insurance policy or speak with your insurance company.<\/p>\r\n<p>While strict liability applies to all dog bite wounds in Washington, it does not cover other dog attack-related injuries. For example, if a dog is chasing you and you break your ankle while leaping to safety, your medical expenses won&#8217;t get covered under strict liability.<\/p>\r\n<p>For non-bite injuries, you&#8217;ll have to prove the <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/elements-of-a-negligence-case.html\">owner was negligent<\/a> in preventing the dog attack. This is easier to do if they knew the dog had dangerous propensities. These are below, with the elements specific to each grouping.<\/p>\r\n<h3><b>Potentially Dangerous Dog<\/b><\/h3>\r\n<p>A dog is a potentially dangerous dog if they are guilty of any of the following acts:<\/p>\r\n<ul>\r\n<li>Inflicts bites on a domestic animal or a human on public or private property<\/li>\r\n<li>Approaches or chases a person on the sidewalks, streets, or any public grounds in a menacing fashion or apparent attitude of attack<\/li>\r\n<li>Displaying a known tendency, propensity, or disposition to attack unprovoked, to cause injury, or to cause injury or otherwise to threaten the safety of domestic animals or humans<\/li>\r\n<\/ul>\r\n<p>Potentially dangerous is the least serious of the classifications.<\/p>\r\n<h3><b>Dangerous Dogs<\/b><\/h3>\r\n<p>Having a dog declared dangerous brings added responsibilities and restrictions for the dog&#8217;s owner. The owner must keep the dog inside a secure enclosure unless muzzled and firmly leashed. A canine faces dangerous dog classification if it:<\/p>\r\n<ul>\r\n<li>Without provocation, kills a domestic animal while off the owner&#8217;s property<\/li>\r\n<li>Without provocation, inflicts <a href=\"https:\/\/www.findlaw.com\/injury.html\">severe injury<\/a> on a human being on public or private property<\/li>\r\n<li>Has been found to be potentially dangerous because of injury inflicted on a human and again aggressively bites, attacks, or endangers the safety of humans<\/li>\r\n<\/ul>\r\n<p>A dog can avoid getting classified as a dangerous dog if any of the following defenses apply to the dog attack:<\/p>\r\n<ul>\r\n<li>The injured person was willfully <a href=\"https:\/\/www.findlaw.com\/realestate\/land-use-laws\/trespassing.html\">trespassing<\/a> on the dog owner&#8217;s private property<\/li>\r\n<li>The injured person abused, assaulted, or tormented the dog or had a history of doing so<\/li>\r\n<li>The injured person was committing a crime on the dog owner&#8217;s private property<\/li>\r\n<\/ul>\r\n<p>A local animal control authority makes the classification, and it is subject to appeal. Police dogs can&#8217;t be classified as dangerous dogs.<\/p>\r\n<p>If a dangerous dog attacks or bites a person or a domestic animal, the dog&#8217;s owner is guilty of a Class C felony. If the attack takes place on the owner&#8217;s private property, the owner must prove that the dog bite victim was either trespassing or provoking the properly restrained dog.<\/p>\r\n<p>Producing a preponderance of evidence is a heavy task for a non-lawyer. Having an idea of your next steps can be helpful.<\/p>\r\n<ol>\r\n<li><b>Get to safety:<\/b> Get away from the attacking dog by any means possible.<\/li>\r\n<li><b>Address your injury:<\/b> If possible, <a href=\"https:\/\/health.clevelandclinic.org\/if-a-dog-bites-you-do-these-7-things-now\" target=\"_blank\" rel=\"noopener\">tend to your wounds<\/a> as best you can. If the bite broke your skin at all, delay the other steps and seek medical attention immediately.<\/li>\r\n<li><b>Get contact information:<\/b> Only do this if your injury is minor. Get personal and insurance information from the dog&#8217;s owner. Get contact information from any witnesses.<\/li>\r\n<li><b>If you haven&#8217;t done so already, seek medical attention.<\/b> Let a doctor decide how serious the wound is. Keep copies of all medical bills.<\/li>\r\n<li><b>Report the dog bite injury to the animal control authorities in the county where it happened.<\/b> The dog may face quarantine.<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/how-to-file-a-dog-bite-report.html\"><b>File a dog bite report<\/b><\/a><b> with local authorities.<\/b> You&#8217;ll need the official documentation for any future actions.<\/li>\r\n<\/ol>\r\n<p>If you own a dog that bit someone, alert your insurance company immediately. The summary provided below is in plain English to help you better understand the law.<\/p>\r\n<table cellspacing=\"0\" cellpadding=\"7\" border=\"1\">\r\n<tbody><tr><td><b>Washington dog bite laws<\/b><\/td>\r\n<td><p>Washington Revised Code: <a href=\"https:\/\/codes.findlaw.com\/wa\/title-16-animals-and-livestock\/wa-rev-code-16-08-080\/\" target=\"_blank\" rel=\"noopener\">Title 16, Section 16.08.080<\/a>, et seq.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Washington strict liability for dog bites<\/b><\/td>\r\n<td><p>Owners\/keepers are strictly liable for dog bite injuries if:<\/p>\r\n<ul>\r\n<li>The injured person is in a public place or a private place where they have permission and<\/li>\r\n<li>The injured person didn&#8217;t provoke the dog.<\/li>\r\n<\/ul>\r\n<p>Similarly, owners\/keepers also are strictly liable to the owner of any animal killed or injured by their dog.<\/p>\r\n<p>Strict liability does not apply to injuries that aren&#8217;t bite-related.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Negligence claims for careless dog owners<\/b><\/td>\r\n<td><p>Owners\/keepers whose dogs (or other domesticated animals) cause injuries that aren&#8217;t bite-related to others may get sued if the plaintiff can prove the <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/elements-of-a-negligence-case.html\">negligence<\/a> of the owner\/keeper of the animal.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Legal definition of a dangerous dog in Washington<\/b><\/td>\r\n<td><p>Any dog that:<\/p>\r\n<ul>\r\n<li>Inflicts severe injury on a human being without provocation on public or private property<\/li>\r\n<li>Kills a domestic animal without provocation while the dog is off the owner&#8217;s property<\/li>\r\n<li>Has been previously found to be potentially dangerous because of injury inflicted on a human, the owner having received notice of such, and the dog again aggressively bites, attacks, or endangers the safety of humans<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><b>Legal definition of a potentially dangerous dog in Washington<\/b><\/td>\r\n<td><p>Any dog that, when unprovoked:<\/p>\r\n<ul>\r\n<li>Bites a human or domestic animal either on public or private property<\/li>\r\n<li>Chases or approaches a person upon the streets, sidewalks, or any public grounds in a menacing fashion or apparent attitude of attack, or any dog with a known propensity, tendency, or disposition to attack unprovoked, to cause injury, or otherwise to threaten the safety of humans or domestic animals<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><b>Dogs and livestock<\/b><\/td>\r\n<td><p>State law permits owners\/keepers of livestock (i.e., sheep, poultry, swine) to kill any dogs found chasing, biting, injuring, or killing their livestock.<\/p>\r\n<p>Owners warned about their dog(s) &#8216;s aggressive behavior must keep them on a leash or otherwise confine them; livestock owners may kill such dogs if the dog owner fails to confine them.<\/p>\r\n<p>Owners of dogs warned about such behavior (chasing, biting, injuring livestock) but failing to confine their dog(s) within 48 hours of the warning may get charged with a misdemeanor, and the sheriff or deputy sheriff may kill their dog.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><b>Possible defenses to dog bite claims<\/b><\/td>\r\n<td><ul>\r\n<li>The injured person provoked the dog<\/li>\r\n<li>The injured person was <a href=\"https:\/\/www.findlaw.com\/realestate\/land-use-laws\/trespassing-basics.html\">trespassing<\/a><\/li>\r\n<li>The injured person was committing a crime on the dog owner&#8217;s private property<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><b>Time limit for filing claim<\/b><\/td>\r\n<td><p>Three years (<a href=\"https:\/\/www.findlaw.com\/state\/washington-law\/washington-civil-statute-of-limitations-laws.html\">Washington Civil Statute of Limitations<\/a>) for personal injury and injury to personal property claims.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<p><i><b>Note:<\/b> State laws are always subject to change through the passage of new legislation, rulings in the higher courts that include federal decisions, ballot initiatives, and other means.
