Washington has laws in place to provide relief for <span data-term-id=\"39031604\">victims of <\/span><span data-term-id=\"39031594\">domestic violence<\/span>.<\/p>\n<p>The legalese surrounding <span data-term-id=\"39031594\">domestic violence<\/span> laws in Washington is complex and difficult to parse. This article will explain the <span data-term-id=\"39031628\">state of Washington<\/span>&#8216;s <a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=10.99.020\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u><span data-term-id=\"39031605\">definition of <\/span><span data-term-id=\"39031594\">domestic violence<\/span><\/u><\/a>, how the legal system treats the crimes, and the protections available for victims. Read on for a better understanding of <span data-term-id=\"39031594\">domestic violence<\/span> laws in Washington.<\/p>\n<h2><span data-term-id=\"39031637\">Washington <\/span><span data-term-id=\"39031637\">Domestic Violence<\/span><span data-term-id=\"39031637\"> Laws<\/span>: The Basics<\/h2>\n<p><span data-term-id=\"39031635\">Domestic violence<\/span><span data-term-id=\"39031635\"> crimes<\/span> are about <a href=\"https:\/\/www.thehotline.org\/identify-abuse\/power-and-control\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>power and control<\/u><\/a>. While the name suggests physical violence, other <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\" aria-expanded=\"false\"><u>types of abuse<\/u><\/a> are employed as well by abusers to keep victims feeling helpless and in fear. Not every abusive crime is <span data-term-id=\"39031594\">domestic violence<\/span> in Washington. Let&#8217;s review the requirements.<\/p>\n<h3><span data-term-id=\"39031594\">Domestic Violence<\/span> in <span data-term-id=\"39031597\">Washington State<\/span>: The Participants<\/h3>\n<p>As the name suggests, <span data-term-id=\"39031635\">domestic violence<\/span><span data-term-id=\"39031635\"> crimes<\/span> take place between people at or close to home. In Washington, the people involved must be <a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=10.99.020\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>family members, <span data-term-id=\"39031600\">household members<\/span>, or <span data-term-id=\"39031608\">intimate partners<\/span><\/u><\/a>. Those considered family and <span data-term-id=\"39031600\">household members<\/span> are:<\/p>\n<ul>\n<li>Adults related by blood (consanguinity)<\/li>\n<li>Adults related by marriage (in-laws and stepfamily)<\/li>\n<li>Adults related by domestic partnership<\/li>\n<li>Family related by adoption<\/li>\n<li>People who reside together<\/li>\n<li>People who resided together<\/li>\n<li>Parents and children, including stepparents, stepchildren, grandparents, grandchildren, or a parent&#8217;s <span data-term-id=\"39031608\">intimate partner<\/span> and children<\/li>\n<li>A legal guardian<\/li>\n<li>Someone who <span data-term-id=\"39031596\">was<\/span> a legal guardian<\/li>\n<\/ul>\n<p><span data-term-id=\"39031608\">Intimate partners<\/span> are considered the following:<\/p>\n<ul>\n<li>Spouses or <span data-term-id=\"39031636\">domestic partners<\/span><\/li>\n<li><span data-term-id=\"39031606\">Former spouses<\/span> or former <span data-term-id=\"39031636\">domestic partners<\/span><\/li>\n<li>People who have a child in common<\/li>\n<li>People who have a <span data-term-id=\"39031611\">dating relationship<\/span> where both persons are at least 16 years of age<\/li>\n<li>People who had a <span data-term-id=\"39031611\">dating relationship<\/span> where both persons were at least 16 years of age<\/li>\n<li>People at least 16 years of age who reside together and are dating<\/li>\n<li>People at least 16 years of age who reside together and have dated<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-organizations.html\" aria-expanded=\"false\"><u><span data-term-id=\"39031635\">Domestic violence<\/span><span data-term-id=\"39031635\"> crimes<\/span><\/u><\/a> cannot take place between strangers or casual acquaintances. Being stalked by someone you dated and lived with can qualify as <span data-term-id=\"39031594\">domestic violence<\/span>. If a coworker stalks you, it&#8217;s not <span data-term-id=\"39031594\">domestic violence<\/span> but still very much a crime.<\/p>\n<h3><span data-term-id=\"39031594\">Domestic Violence<\/span> in <span data-term-id=\"39031597\">Washington State<\/span>: Qualifying Crimes<\/h3>\n<p>The people involved are half of the requirement for a <span data-term-id=\"39031594\">domestic violence<\/span> classification. The other part is the offense committed. Washington legal codes <a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=10.99.020\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>list the abusive crimes it considers eligible<\/u><\/a> for consideration as <span data-term-id=\"39031594\">domestic violence<\/span> criminal acts:<\/p>\n<ul>\n<li>Assault in the first degree<\/li>\n<li>Assault in the second degree<\/li>\n<li>Assault in the third degree<\/li>\n<li>Assault in the fourth degree<\/li>\n<li>Drive-by shooting<\/li>\n<li><span data-term-id=\"39031620\">Reckless endangerment<\/span><\/li>\n<li>Coercion<\/li>\n<li>Burglary in the first degree<\/li>\n<li>Burglary in the second degree<\/li>\n<li><span data-term-id=\"39031616\">Criminal trespass<\/span> in the first degree<\/li>\n<li><span data-term-id=\"39031616\">Criminal trespass<\/span> in the second degree<\/li>\n<li><span data-term-id=\"39031619\">Malicious mischief<\/span> in the first degree<\/li>\n<li><span data-term-id=\"39031619\">Malicious mischief<\/span> in the second degree<\/li>\n<li><span data-term-id=\"39031619\">Malicious mischief<\/span> in the third degree<\/li>\n<li>Kidnapping in the first degree<\/li>\n<li>Kidnapping in the second degree<\/li>\n<li>Unlawful imprisonment<\/li>\n<li>Violation of the provisions of a <span data-term-id=\"39031625\">restraining order<\/span>, <span data-term-id=\"39031598\">no-contact order<\/span>, or <span data-term-id=\"39031595\">protection order<\/span><\/li>\n<li>Rape in the first degree<\/li>\n<li>Rape in the second degree<\/li>\n<li>Residential burglary<\/li>\n<li>Stalking<\/li>\n<li>Interference with the <span data-term-id=\"39031631\">reporting of <\/span><span data-term-id=\"39031594\">domestic violence<\/span><\/li>\n<\/ul>\n<p>Other crimes can also qualify, depending on the situation. If people in a qualifying relationship commit one of the offenses above, it&#8217;s <span data-term-id=\"39031594\">domestic violence<\/span>. If the act isn&#8217;t <span data-term-id=\"39031594\">domestic violence<\/span>, it&#8217;s still a crime and prosecutable. It won&#8217;t be eligible for <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\" aria-expanded=\"false\"><u>protections and programs available<\/u><\/a> for <span data-term-id=\"39031594\">domestic violence<\/span> victims.<\/p>\n<h2><span data-term-id=\"39031637\">Washington <\/span><span data-term-id=\"39031637\">Domestic Violence<\/span><span data-term-id=\"39031637\"> Laws<\/span>: Types of Relief and Penalties<\/h2>\n<p>Washington has protections and programs in place to help victims break the relentless cycle of abuse caused by <span data-term-id=\"39031594\">domestic violence<\/span>. There are <a href=\"https:\/\/wscadv.org\/washington-domestic-violence-programs\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"39031594\">domestic violence<\/span> advocates<\/u><\/a> who offer assistance as well. There are stiff penalties for abusers. Knowing the available types of aid in Washington is crucial, so let&#8217;s explore them.<\/p>\n<h3><span data-term-id=\"39031597\">Washington State<\/span> <span data-term-id=\"39031632\">Domestic Violence<\/span> <span data-term-id=\"39031595\">Protection<\/span><span data-term-id=\"39031595\"> Orders<\/span> (DVPO)<\/h3>\n<p>If you&#8217;ve suffered <span data-term-id=\"39031594\">domestic violence<\/span>, a <a href=\"https:\/\/wscadv.org\/washington-domestic-violence-programs\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>Washington <span data-term-id=\"39031632\">domestic violence<\/span> <span data-term-id=\"39031595\">protection<\/span><span data-term-id=\"39031595\"> order<\/span> (DVPO)<\/u><\/a> is an effective form of protection available to you. A DVPO isn&#8217;t foolproof, but the provisions it carries can keep the abuser away from the victim.<\/p>\n<p>To apply for a DVPO, you&#8217;ll need to <a href=\"https:\/\/www.courts.wa.gov\/forms\/?fa=forms.contribute&amp;formID=142\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>fill out the required forms<\/u><\/a>. This can be done at the courthouse, but you can also fill them out at home or with the <a href=\"https:\/\/wscadv.org\/washington-domestic-violence-programs\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>help of a <span data-term-id=\"39031594\">domestic violence<\/span> advocate<\/u><\/a>. There is no charge for filing. Once you apply, a judge or commissioner may speak with you (petitioner). If the court agrees that an immediate danger of abuse exists, an ex parte temporary DVPO is issued.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-305\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>Ex parte temporary DVPOs<\/u><\/a> are issued without hearing from the abuser (<span data-term-id=\"39031634\">respondent<\/span>). The <span data-term-id=\"39031634\">respondent<\/span> is served the order by <span data-term-id=\"39031603\">law enforcement<\/span>. You are not permitted to serve the order to the <span data-term-id=\"39031634\">respondent<\/span>, nor should you try to. Temporary DVPOs last for 14 days or until your case hearing. They can last for 30 days if the <span data-term-id=\"39031634\">respondent<\/span> is served by mail.<\/p>\n<p>DVPOs contain provisions based on the particulars of each case. You can request specific conditions. The court may include those it feels are necessary. While DVPOs differ, some <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-310\/\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>relief provisions are common inclusions<\/u><\/a>:<\/p>\n<ul>\n<li>The abuser must not commit any further acts of <span data-term-id=\"39031594\">domestic violence<\/span> against the victim<\/li>\n<li>The abuser must obey a non-contact order with the victim<\/li>\n<li>The abuser must vacate a shared residence and not return<\/li>\n<li>The abuser must stay away from the victim&#8217;s residence, workplace, school, daycare, or school of a minor child (1000 feet is a common distance)<\/li>\n<li>The court may set temporary child custody and child visitation parameters, which may include supervised visitation or denial of visitation for the abuser<\/li>\n<li>Mandatory participation by the abuser in a state-certified <span data-term-id=\"39031594\">domestic violence<\/span> perpetrator <span data-term-id=\"39031621\">treatment program<\/span><\/li>\n<li>A mandatory mental health or chemical dependency evaluation for the abuser<\/li>\n<li>Ordering the <span data-term-id=\"39031634\">respondent<\/span> to switch schools if the threat to the victim outweighs the rights of the abuser<\/li>\n<li>Order the abuser to pay the legal fees of the victim<\/li>\n<li>Forbidding the abuser from harassing the victim by any means, including through social media<\/li>\n<li>Ordering <span data-term-id=\"39031615\">electronic monitoring<\/span> of the abuser and requiring the abuser to pay all costs<\/li>\n<li>Ordering the abuser to surrender all firearms and ammunition and not to possess either during the duration of the DVPO<\/li>\n<li>Order possession or custody of shared personal items, which includes pets<\/li>\n<li>Order possession of a vehicle or vehicles<\/li>\n<li>Forbidding the abuser from filing abusive litigation<\/li>\n<li>Forbidding the <span data-term-id=\"39031634\">respondent<\/span> from committing acts of abandonment, abuse, neglect, or financial exploitation against a vulnerable adult<\/li>\n<li>Require an accounting by the <span data-term-id=\"39031634\">respondent<\/span> of the disposition of the vulnerable adult&#8217;s income or other resources<\/li>\n<li>Restrain the transfer of either the <span data-term-id=\"39031634\">respondent<\/span>&#8216;s or the vulnerable adult&#8217;s property, or both, for a specified period not exceeding 90 days<\/li>\n<li>Order financial relief and restrain the transfer of jointly owned assets<\/li>\n<li>Ordering the abuser to surrender intimate images of the victim<\/li>\n<\/ul>\n<p>The court can include any condition it considers necessary for the victim&#8217;s safety and well-being. Provisions in a temporary DVPO often remain in a <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-310\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">full <span data-term-id=\"39031632\">domestic violence<\/span> <span data-term-id=\"39031595\">protection<\/span><span data-term-id=\"39031595\"> order<\/span><\/a>. Amendments and additions are permitted.<\/p>\n<p>Even if the court doesn&#8217;t grant you a temporary DVPO, you can make your case for a full DVPO at the case hearing. You&#8217;ll also <a href=\"https:\/\/www.dshs.wa.gov\/esa\/division-child-support\/domestic-violence-information\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u>have a case hearing<\/u><\/a> if the <span data-term-id=\"39031634\">respondent<\/span> opposes the order. At the case hearing, each person tells their side of the story, presents evidence, and calls witnesses.<\/p>\n<p>If the court feels the threat of <span data-term-id=\"39031594\">domestic violence<\/span> is ongoing, the <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-315\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">full DVPO is issued<\/a>. A permanent duration is possible, or the court will set the duration for a fixed period. There is a maximum of one year for full DVPOs that impose restrictions on visitation rights. Orders are renewable up to 90 days before expiration.<\/p>\n<p>Any DVPOs issued in Washington remain in effect anywhere in the United States under federal law as per the <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/federal-domestic-violence-legislation-the-violence-against-women.html\" aria-expanded=\"false\">Violence Against Women Act (VAWA)<\/a>. This means that orders from outside the state are valid in Washington as well.<\/p>\n<p><span data-term-id=\"39031635\">Domestic violence<\/span><span data-term-id=\"39031635\"> crimes<\/span> often carry enhanced penalties. Abusers who violate DVPOs face stiff penalties. Violations are considered <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.450\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">contempt of court<\/a>. The punishments are based on the type of offense used to violate the order and the frequency of violations:<\/p>\n<ul>\n<li>If the offense is a <strong>misdemeanor or <span data-term-id=\"39031610\">gross misdemeanor<\/span><\/strong>, violators face up to 364 days in jail and a fine of up to $5,000<\/li>\n<li>If there have been <strong>more than two previous violations <\/strong>or<strong> the violation involves assault<\/strong>, penalties include up to five years in prison and a fine of up to $10,000<\/li>\n<\/ul>\n<p>The penalties apply to both temporary and full DVPO violations. If you have further questions about <span data-term-id=\"39031595\">protective orders<\/span> in Washington, FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/washington-law\/washington-protective-orders-laws.html\" aria-expanded=\"false\"><u>Washington <span data-term-id=\"39031595\">Protective Orders<\/span> Laws<\/u><\/a> article should have the information you&#8217;re looking for.<\/p>\n<h3>Address Confidentiality Program (ACP)<\/h3>\n<p>The <a href=\"https:\/\/www.sos.wa.gov\/statewide-programs\/address-confidentiality-program-acp\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\"><u><span data-term-id=\"39031597\">Washington State<\/span> Address Confidentiality Program (ACP)<\/u><\/a> helps victims who have fled their abusers keep their new address hidden. A second legal address is issued to the victim and used for public records, such as a driver&#8217;s license or voter registration. First-class mail is forwarded to the true address. The ACP can&#8217;t hide property records. There&#8217;s no charge for the ACP.<\/p>\n<h3>Hope Cards (In effect 1\/1\/2025)<\/h3>\n<p>Hope Cards contain <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.352\" target=\"_blank\" rel=\"noopener\" aria-expanded=\"false\">pertinent information and scannable links about a victim&#8217;s DVPO on a wallet-sized card<\/a>. This allows <span data-term-id=\"39031603\">law enforcement<\/span> to gain instant access to the provisions of a DVPO. There&#8217;s no charge for Hope Cards.<\/p>\n<h3>Breaking a Lease\/Changing Locks<\/h3>\n<p>Whether a victim flees a rental property or wishes to remain, <a href=\"https:\/\/codes.findlaw.com\/wa\/title-59-landlord-and-tenant\/wa-rev-code-59-18-575\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39031601\">Washington law<\/span> has provisions to help<\/a>. Victims can make a legal break of a lease by providing a written letter and showing proof of their DVPO within 90 days of the abusive act(s). They are liable for paying the rent for the last month they&#8217;re there. Victims also have the legal right to change the locks at their own expense, provided they give notice to the landlord.<\/p>\n<h3>Protections Against Abusive Litigation<\/h3>\n<p>Some abusers will file so-called &#8220;nuisance&#8221; litigation designed to harass victims or try to learn their new location. <span data-term-id=\"39031601\">Washington law<\/span> has a <a href=\"https:\/\/codes.findlaw.com\/wa\/title-26-domestic-relations\/wa-rev-code-26-51-030\/\" aria-expanded=\"false\" target=\"_blank\" rel=\"noopener\">specific code designed to keep abusers from doing this<\/a>.
