These acts can tear families apart. Not every crime is eligible for the relief offered by a <span data-term-id=\"39131071\">domestic violence <\/span><span data-term-id=\"39131040\">protective order<\/span>. To determine if you are eligible to apply, it&#8217;s essential to understand the requirements.<\/p>\n<p>As discussed in FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/washington-law\/washington-domestic-violence-laws.html\">Washington Domestic Violence Laws article<\/a>, there can&#8217;t be an instance of domestic violence between strangers in Washington. The <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.010#:~:text=(10)%20%22-,Domestic%20violence,-%22%20means%3A\" target=\"_blank\" rel=\"noopener\">abusive acts committed<\/a> must fall under at least one of the following categories as of 7\/01\/2025:<\/p>\n<ul>\n<li><span data-term-id=\"39131109\">Physical harm<\/span><\/li>\n<li>Bodily injury<\/li>\n<li>Assault<\/li>\n<li>The infliction of credible fear of <span data-term-id=\"39131109\">physical harm<\/span>, bodily injury, or assault<\/li>\n<li><span data-term-id=\"39131102\">Nonconsensual sexual conduct<\/span><\/li>\n<li><span data-term-id=\"39131127\">Nonconsensual sexual penetration<\/span><\/li>\n<li><span data-term-id=\"39131132\">Coercive control<\/span><\/li>\n<li><span data-term-id=\"39131115\">Unlawful harassment<\/span><\/li>\n<li>Stalking<\/li>\n<\/ul>\n<p>If an offense that fits one of the categories happens between <span data-term-id=\"39131080\">family members<\/span>, <span data-term-id=\"39131092\">household members<\/span>, or <span data-term-id=\"39131090\">intimate partners<\/span>, it&#8217;s domestic violence in Washington and eligible for a DVPO. Someone suffering <span data-term-id=\"39131126\">sexual abuse<\/span> by their former spouse is domestic violence. A person being punched by a coworker is an assault offense, but not domestic violence.<\/p>\n<h2>Washington Domestic Violence Temporary <span data-term-id=\"39131040\">Protective Orders<\/span> Laws &#8211; How They Work<\/h2>\n<p>Most Washington domestic violence protections have slight differences between them. This is because each DVPO tailors its provisions to cover the specific needs of a victim. While <span data-term-id=\"39131105\">no-contact orders<\/span> and stay-away conditions are common, <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.310\" target=\"_blank\" rel=\"noopener\">DVPOs can address other pending issues<\/a> between the abuser and the victim. These include:<\/p>\n<ul>\n<li>The <span data-term-id=\"39131048\">respondent<\/span> (abuser) must not commit any further acts of domestic violence against the petitioner (victim)<\/li>\n<li>The <span data-term-id=\"39131048\">respondent<\/span> must obey a non-contact order with the petitioner<\/li>\n<li>The <span data-term-id=\"39131048\">respondent<\/span> must vacate a shared residence and not return<\/li>\n<li>The <span data-term-id=\"39131048\">respondent<\/span> must stay a certain distance away from the petitioner&#8217;s residence, workplace, school, or the daycare or school of a <span data-term-id=\"39131096\">minor child<\/span> (1,000 feet is a common distance)<\/li>\n<li>The court may set temporary child custody and child visitation restrictions, which may include supervised visitation or denial of visitation for the <span data-term-id=\"39131048\">respondent<\/span><\/li>\n<li>Ordering mandatory participation by the <span data-term-id=\"39131048\">respondent<\/span> in a state-certified domestic violence perpetrator treatment program<\/li>\n<li>Ordering a mandatory mental health or chemical dependency evaluation for the <span data-term-id=\"39131048\">respondent<\/span><\/li>\n<li>Ordering the <span data-term-id=\"39131048\">respondent<\/span> to switch schools if the threat to the petitioner outweighs the rights of the <span data-term-id=\"39131048\">respondent<\/span><\/li>\n<li>Order the <span data-term-id=\"39131048\">respondent<\/span> to pay the legal fees of the petitioner<\/li>\n<li>Forbidding the <span data-term-id=\"39131048\">respondent<\/span> from harassing the petitioner by any means, including through social media<\/li>\n<li>Ordering electronic monitoring of the <span data-term-id=\"39131048\">respondent<\/span> and requiring the <span data-term-id=\"39131048\">respondent<\/span> to pay all costs<\/li>\n<li>Ordering the <span data-term-id=\"39131048\">respondent<\/span> to surrender all firearms and ammunition and to <span data-term-id=\"39131131\">prohibit weapons<\/span> for the duration of the DVPO<\/li>\n<li>Ordering possession or custody of shared personal items, including pets<\/li>\n<li>Ordering possession of a vehicle or vehicles<\/li>\n<li>Forbidding the <span data-term-id=\"39131048\">respondent<\/span> from filing abusive litigation<\/li>\n<li>Forbidding the <span data-term-id=\"39131048\">respondent<\/span> from committing acts of abandonment, abuse, neglect, or <span data-term-id=\"39131106\">financial exploitation<\/span> against a vulnerable adult (if the vulnerable adult is a <span data-term-id=\"39131080\">family member<\/span>, <span data-term-id=\"39131092\">household member<\/span>, or <span data-term-id=\"39131090\">intimate partner<\/span>)<\/li>\n<li>Requiring an accounting by the <span data-term-id=\"39131048\">respondent<\/span> of the disposition of the vulnerable adult&#8217;s income or other resources<\/li>\n<li>Restraining the transfer of either the <span data-term-id=\"39131048\">respondent<\/span>&#8216;s or vulnerable adult&#8217;s property, or both, for a specified period not exceeding 90 days<\/li>\n<li>Ordering financial relief and restraining the transfer of jointly owned assets<\/li>\n<li>Ordering the <span data-term-id=\"39131048\">respondent<\/span> to surrender intimate images of the petitioner<\/li>\n<\/ul>\n<p>For provisions involving eviction and gathering personal items, <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-320\/\" target=\"_blank\" rel=\"noopener\">Washington <span data-term-id=\"39131051\">law enforcement<\/span> will oversee<\/a> the process. Washington <span data-term-id=\"39131071\">domestic violence <\/span><span data-term-id=\"39131040\">protection orders<\/span> may contain some, all, or none of the listed provisions. The court can add any condition it considers necessary for the victim&#8217;s safety.<\/p>\n<h2>Washington Temporary <span data-term-id=\"39131071\">Domestic Violence <\/span><span data-term-id=\"39131040\">Protective Orders<\/span> &#8211; Getting a DVPO<\/h2>\n<p>If you&#8217;re being abused or in imminent danger of further abuse, call 911. Police officers receive special training for domestic violence situations. This includes making the victim aware of nearby <a href=\"https:\/\/wscadv.org\/washington-domestic-violence-programs\/\" target=\"_blank\" rel=\"noopener\">shelters and domestic violence advocates<\/a>.<\/p>\n<p>Getting a DVPO starts with filing a petition. If you feel your abuser may harm you again in the immediate future, you can apply for a <strong>temporary <span data-term-id=\"39131114\">ex parte<\/span> <span data-term-id=\"39131071\">domestic violence <\/span><span data-term-id=\"39131040\">protection order<\/span><\/strong>. <span data-term-id=\"39131098\">Court forms<\/span> are <a href=\"https:\/\/www.courts.wa.gov\/forms\/?fa=forms.contribute&amp;formID=142\" target=\"_blank\" rel=\"noopener\">available online<\/a> or in the <span data-term-id=\"39131121\">court clerk<\/span>&#8216;s office. You can file in either <span data-term-id=\"39131100\">district court<\/span> or <span data-term-id=\"39131082\">superior court<\/span>. <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-050\/\" target=\"_blank\" rel=\"noopener\">Depending on the details<\/a>, your case may get moved to <span data-term-id=\"39131082\">superior court<\/span>.<\/p>\n<p>There&#8217;s no charge for filing for a DVPO. You (petitioner) should file in your home county, but <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.075\" target=\"_blank\" rel=\"noopener\">other venues are permitted<\/a>. When filling out the petition and affidavit, include as many details about the types of abuse you suffered as possible. While painful to relive, it can help the court agree with your assessment of danger. You can request that\u00a0<span data-term-id=\"39131128\">confidential information<\/span>,\u00a0like a new address, remain hidden from your abuser.<\/p>\n<p>If the court agrees that the <span data-term-id=\"39131048\">respondent<\/span> (abuser) is an active danger, the <span data-term-id=\"39131074\">temporary <\/span><span data-term-id=\"39131040\">protection order<\/span> (TPO) is issued. A copy of the order is served to the <span data-term-id=\"39131048\">respondent<\/span>. In certain situations, this is handled by <span data-term-id=\"39131051\">law enforcement<\/span>. If the order is served <span data-term-id=\"39131094\">in person<\/span>, the <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-305\/\" target=\"_blank\" rel=\"noopener\">temporary DVPO lasts for 14 days<\/a> or until the final <span data-term-id=\"39131108\">court hearing<\/span>. If mailed, it remains valid for up to 30 days or until the court date.<\/p>\n<p>The order is enforceable as soon as it&#8217;s served. <span data-term-id=\"39131051\">Law enforcement<\/span> will assist with <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-320\/\" target=\"_blank\" rel=\"noopener\">eviction from shared dwellings or retrieval of personal items<\/a>. The situation is resolved at a <span data-term-id=\"39131104\">full <\/span><span data-term-id=\"39131119\">hearing<\/span><span data-term-id=\"39131119\"> date<\/span> if:<\/p>\n<ul>\n<li>The <span data-term-id=\"39131048\">respondent<\/span> chooses to oppose the order<\/li>\n<li>You were denied a temporary DVPO<\/li>\n<li>You chose to file for a full DVPO instead of a temporary DVPO<\/li>\n<\/ul>\n<p>At the final <span data-term-id=\"39131129\">protection order<\/span><span data-term-id=\"39131129\"> hearing<\/span>, both parties can offer their side of the story, call witnesses, and present evidence. The burden of proof is on the petitioner <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-225\/\" target=\"_blank\" rel=\"noopener\">to show the <span data-term-id=\"39131048\">respondent<\/span> is an ongoing threat<\/a>. If successful, the court issues a <strong>full <span data-term-id=\"39131071\">domestic violence <\/span><span data-term-id=\"39131040\">protection order<\/span><\/strong>. This goes into immediate effect.<\/p>\n<p>Full DVPOs <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-105-315\/\" target=\"_blank\" rel=\"noopener\">must have a duration of at least one year<\/a>. The exact duration is set by the court and cannot exceed a year if the visitation rights of the <span data-term-id=\"39131120\">restrained person<\/span> are involved. The court can also make the order permanent, which gives it a duration of 99 years. <a href=\"https:\/\/www.hud.gov\/vawa#openModal\" target=\"_blank\" rel=\"noopener\">Under federal law<\/a>, all DVPOs issued in Washington are valid in all fifty states, U.S. territories, and tribal reservations.<\/p>\n<h2>Washington Temporary <span data-term-id=\"39131071\">Domestic Violence <\/span><span data-term-id=\"39131040\">Protective Orders<\/span> &#8211; Penalties for Violations<\/h2>\n<p>Effective <span data-term-id=\"39131040\">protection orders<\/span> have stiff penalties to deter abusers from committing violations. Washington DVPOs consider violations as contempt of court. Violation of <span data-term-id=\"39131070\">a <\/span><span data-term-id=\"39131040\">protection order<\/span> carries <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=7.105.450\" target=\"_blank\" rel=\"noopener\">other penalties<\/a> as well:<\/p>\n<ul>\n<li><strong>First or second violation<\/strong> (gross misdemeanor): Up to 364 days in jail and a fine of up to $5,000<\/li>\n<li><strong>Any violation involving assault or creating a substantial risk of death or serious physical injury<\/strong> (Class C felony): Up to five years in a state correctional institution and a fine of up to $10,000<\/li>\n<li><strong>Third or subsequent violation<\/strong> (Class C felony): Up to five years in a state correctional institution and a fine of up to $10,000<\/li>\n<\/ul>\n<p>Violators may also face mandatory counseling or participation in intervention programs.<\/p>\n<h2>Washington Temporary <span data-term-id=\"39131071\">Domestic Violence <\/span><span data-term-id=\"39131040\">Protective Orders<\/span>: Review<\/h2>\n<p><span data-term-id=\"39131071\">Domestic violence <\/span><span data-term-id=\"39131040\">protection orders<\/span> can help a victim escape their abusers forever.
