The betrayal of trust can be more traumatic than the offenses. Victims can feel hopeless and wonder <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/where-does-one-turn-for-help-in-cases-of-domestic-violence.html\">if there&#8217;s any way out<\/a> of the cycle of intimidation, abuse, and violence. The state of <span data-term-id=\"39117814\">West Virginia<\/span> has resources to help victims escape the nightmare of domestic abuse.<\/p>\n<p>Breaking free of <span data-term-id=\"39117813\">domestic violence<\/span> requires an understanding of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stop-domestic-violence.html\">what it is<\/a>, <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-204\/\" target=\"_blank\" rel=\"noopener\">who can be involved<\/a>, and how to get access to available protections. Read on for a better understanding of <span data-term-id=\"39117850\">domestic violence<\/span><span data-term-id=\"39117850\"> laws<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span>.<\/p>\n<h2>How <span data-term-id=\"39117850\">Domestic Violence<\/span><span data-term-id=\"39117850\"> Laws<\/span> Work in <span data-term-id=\"39117814\">West Virginia<\/span><\/h2>\n<p>Two conditions need to be met for a crime to be considered <span data-term-id=\"39117813\">domestic violence<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span>. People in certain relationships must commit one of a specific subset of criminal acts for the requirement to be met. Let&#8217;s learn about each of them.<\/p>\n<h3><span data-term-id=\"39117814\">West Virginia<\/span> and <span data-term-id=\"39117813\">Domestic Violence<\/span>: The Criminal Acts<\/h3>\n<p>For many, the image of a victim of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/battered-women-s-syndrome.html\">battered woman syndrome<\/a> is what comes to mind when <span data-term-id=\"39117813\">domestic violence<\/span> is mentioned. Some crimes involving physical assault qualify to be <span data-term-id=\"39117813\">domestic violence<\/span>, but so does threatening a family or <span data-term-id=\"39117815\">household member<\/span> with <span data-term-id=\"39117818\">physical harm<\/span>.<\/p>\n<p>The factor present in all <span data-term-id=\"39117813\">domestic violence<\/span> crimes is control. An abuser strives to gain and maintain control of their victim via <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/types-of-domestic-violence.html\">different types of abuse<\/a>. The subset of offenses in <span data-term-id=\"39117827\">West Virginia<\/span><span data-term-id=\"39117827\"> law<\/span> <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-202\/\" target=\"_blank\" rel=\"noopener\">that are considered <span data-term-id=\"39117813\">domestic violence<\/span><\/a> is:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-61-crimes-and-their-punishment\/wv-code-sect-61-8b-7\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39117822\">Sexual assault<\/span><\/a><\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-61-crimes-and-their-punishment\/wv-code-sect-61-8d-5.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39117836\">Sexual abuse<\/span><\/a><\/li>\n<li>Abducting, confining, detaining, or holding another person against their will<\/li>\n<li>Causing intentional <span data-term-id=\"39117818\">physical harm<\/span> to another, with or without dangerous or deadly weapons<\/li>\n<li>Attempting to cause intentional <span data-term-id=\"39117818\">physical harm<\/span> to another, with or without dangerous or deadly weapons<\/li>\n<li>Placing another in reasonable apprehension of <span data-term-id=\"39117818\">physical harm<\/span><\/li>\n<\/ul>\n<p>While any of these offenses need to occur between family or <span data-term-id=\"39117815\">household members<\/span> to be considered <span data-term-id=\"39117813\">domestic violence<\/span>, they&#8217;re still crimes that should be prosecuted, even if the courts rule the relationship doesn&#8217;t qualify. When a crime is classified as <span data-term-id=\"39117813\">domestic violence<\/span>, victims can access protections otherwise unavailable. Abusers face stricter penalties.<\/p>\n<h3><span data-term-id=\"39117814\">West Virginia<\/span> and <span data-term-id=\"39117813\">Domestic Violence<\/span>: The People Involved<\/h3>\n<p><span data-term-id=\"39117813\">Domestic violence<\/span> crimes are egregious because they take place between <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-204\/\" target=\"_blank\" rel=\"noopener\">people who are family or share some sort of close relationship<\/a>. This means a person who is supposed to protect the victim is the one doing the abuse instead. Under <span data-term-id=\"39117814\">West Virginia<\/span>, <span data-term-id=\"39117828\">family members<\/span> or <span data-term-id=\"39117815\">household members<\/span> who are eligible for <span data-term-id=\"39117813\">domestic violence<\/span> must share one of the following relationships:<\/p>\n<ul>\n<li>Spouses<\/li>\n<li><span data-term-id=\"39117837\">Former spouses<\/span><\/li>\n<li>Sexual or <span data-term-id=\"39117819\">intimate partners<\/span><\/li>\n<li>Former sexual or <span data-term-id=\"39117819\">intimate partners<\/span><\/li>\n<li>Are family through consanguinity (blood relatives like siblings, parents, cousins, etc.)<\/li>\n<li>Are family through marriage (step-family or in-laws)<\/li>\n<li>Living together as spouses would<\/li>\n<li>Had lived together as spouses would<\/li>\n<li>Residing in the same household<\/li>\n<li>Had resided in the same household<\/li>\n<li>Have a child in common<\/li>\n<li>Are dating or have dated &#8211; the court will determine if the relationship is serious enough to qualify<\/li>\n<\/ul>\n<p>One of the specified crimes committed by people who fall under one of the categories is <span data-term-id=\"39117813\">domestic violence<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span>.<\/p>\n<h2><strong>Protection From <span data-term-id=\"39117813\">Domestic Violence<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span><\/strong><\/h2>\n<p><span data-term-id=\"39117821\">Victims of <\/span><span data-term-id=\"39117813\">domestic violence<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span> <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-305\/\" target=\"_blank\" rel=\"noopener\">can access specialized protections<\/a> to keep from being abused again. Their abusers face enhanced penalties and other punishments.<\/p>\n<h3><span data-term-id=\"39117814\">West Virginia<\/span> <span data-term-id=\"39117823\">Domestic Violence<\/span><span data-term-id=\"39117823\"> Protective Orders<\/span><\/h3>\n<p><span data-term-id=\"39117823\">Domestic violence<\/span><span data-term-id=\"39117823\"> protective orders<\/span> are designed to keep the abuser away from the victim. While no court order can guarantee the safety of a victim, the conditions associated with protective orders can be effective in deterring the abuser from striking again.<\/p>\n<p>Most protective orders are shaped to meet the differing needs of each case. <span data-term-id=\"39117814\">West Virginia<\/span> takes it a step further by having a <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-502\/\" target=\"_blank\" rel=\"noopener\">set of conditions that are mandatory<\/a> for all <span data-term-id=\"39117823\">domestic violence<\/span><span data-term-id=\"39117823\"> protective orders<\/span>. The requirements elements for the abuser (<span data-term-id=\"39117846\">respondent<\/span>) are:<\/p>\n<ul>\n<li>No abusing, harassing, stalking, threatening, or otherwise intimidating the victim (petitioner) or minor children<\/li>\n<li>No engaging in conduct that would place the petitioner or the minor children in reasonable fear of bodily injury<\/li>\n<li>No possession of any firearm or ammunition for the duration of the order<\/li>\n<li>Being aware that possession of a firearm is a criminal offense<\/li>\n<li>Being made aware that the protective order is in effect in every state<\/li>\n<li>Being made aware that a first violation of the order is punishable by imprisonment for up to one year and by a fine of up to $2,000<\/li>\n<\/ul>\n<p>While these conditions are in every protective order, they aren&#8217;t the only ones available for inclusion. <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-503\/\" target=\"_blank\" rel=\"noopener\">Other provisions include<\/a>:<\/p>\n<ul>\n<li>Granting possession of a shared residence to the petitioner<\/li>\n<li>Ordering the <span data-term-id=\"39117846\">respondent<\/span> to stay away from the petitioner&#8217;s residence, workplace, or other specified locations<\/li>\n<li>Ordering the <span data-term-id=\"39117846\">respondent<\/span> not to make any contact with the petitioner<\/li>\n<li>Awarding the petitioner the exclusive care, possession, or control of any household animal and forbidding the <span data-term-id=\"39117846\">respondent<\/span> from harming the animals in any way<\/li>\n<li>Awarding temporary custody or establishing temporary visitation rights of involved children<\/li>\n<li>Imposing conditions on temporary visitation if necessary<\/li>\n<li>Ordering temporary <span data-term-id=\"39117839\">child support<\/span><\/li>\n<li>Ordering temporary spousal support<\/li>\n<li>Mandatory participation in an intervention program for the <span data-term-id=\"39117846\">respondent<\/span><\/li>\n<li>Allowing the retrieval of personal possessions at a scheduled time and accompanied by law enforcement<\/li>\n<li>Ordering the <span data-term-id=\"39117846\">respondent<\/span> to reimburse the petitioner for expenses incurred as a result of the <span data-term-id=\"39117813\">domestic violence<\/span><\/li>\n<li>Ordering the petitioner and <span data-term-id=\"39117846\">respondent<\/span> to refrain from dealing with property subject to the jurisdiction of the court<\/li>\n<\/ul>\n<p>The court can add any condition it deems necessary.<\/p>\n<p>There are two different types of <span data-term-id=\"39117823\">domestic violence<\/span><span data-term-id=\"39117823\"> protective orders<\/span> in <span data-term-id=\"39117814\">West Virginia<\/span>. <strong>Emergency ex parte protective orders<\/strong> are filed by victims who have been abused or feel they&#8217;re in imminent danger of being abused. Petitioners (victims) <a href=\"https:\/\/www.courtswv.gov\/public-resources\/court-forms\/domestic-violence-forms\" target=\"_blank\" rel=\"noopener\">file forms<\/a> requesting a protective order at a <span data-term-id=\"39117838\">Magistrate Court<\/span>. Someone will be at the court to help them 24 hours a day, seven days a week.<\/p>\n<p>The forms will ask for information recounting the abuse and request details about past abuse as well. While you can download the forms and fill them out before going to court, it&#8217;s difficult to ensure your online activity is hidden.<\/p>\n<p>Once the forms are <a href=\"https:\/\/www.courtswv.gov\/legal-community\/court-rules\/rules-practice-and-procedure-domestic-violence\" target=\"_blank\" rel=\"noopener\">filed with the court<\/a>, there&#8217;s an <a href=\"https:\/\/www.courtswv.gov\/sites\/default\/pubfilesmnt\/2023-06\/DV_Brochure_English_2019.pdf\" target=\"_blank\" rel=\"noopener\">emergency hearing<\/a> held between the petitioner and a Magistrate. If the Magistrate feels there&#8217;s a threat of abuse, they&#8217;ll issue the <span data-term-id=\"39117840\">emergency protective order<\/span>. This is a temporary order in effect until the hearing for a <strong>final protective order<\/strong>, which is often within 10 days.<\/p>\n<p>The <span data-term-id=\"39117846\">respondent<\/span> (defendant) will not be notified about the <span data-term-id=\"39117840\">emergency protective order<\/span> until they&#8217;re served by law enforcement within 72 hours of its issuance. They can present their side of the argument at the hearing, as can the petitioner. Both sides can offer evidence and call witnesses.<\/p>\n<p>If the court rules for the petitioner, the conditions of the final protective order <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-505\/\" target=\"_blank\" rel=\"noopener\">will be in effect for either 90 days, 180 days, or a year<\/a>. The petitioner can file for an extension before the order expires. The <span data-term-id=\"39117846\">respondent<\/span> <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-511\/\" target=\"_blank\" rel=\"noopener\">can request the charges to be purged<\/a> two years after the ruling.<\/p>\n<p><span data-term-id=\"39117814\">West Virginia<\/span> protective orders <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-310\/\" target=\"false\" rel=\"noopener\">are valid in every state and U.S. territory<\/a>, which is also a\u00a0federal requirement under the <a href=\"https:\/\/www.hud.gov\/vawa#close\" target=\"_blank\" rel=\"noopener\">Violence Against Women Act (VAWA)<\/a>. It includes an examination of <span data-term-id=\"39117830\">restraining orders<\/span> that aren&#8217;t for <span data-term-id=\"39117813\">domestic violence<\/span> crimes.<\/p>\n<h3>Other <span data-term-id=\"39117813\">Domestic Violence<\/span> Protections in <span data-term-id=\"39117814\">West Virginia<\/span><\/h3>\n<p>Victims who have moved away from their abuser can make use of <span data-term-id=\"39117814\">West Virginia<\/span>&#8216;s <a href=\"https:\/\/code.wvlegislature.gov\/48-28A\/\" target=\"_blank\" rel=\"noopener\">Address Confidentiality Program<\/a> by <a href=\"https:\/\/sos.wv.gov\/FormSearch\/Administrative-Law\/PPaddress%20confidentiality%20program%20application%20final%20101917.pdf\" target=\"_blank\" rel=\"noopener\">sending in the proper forms<\/a>. This allows the victim to have a second mailing address that keeps their residential address off public records. More information is available on the <a href=\"https:\/\/sos.wv.gov\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"39117814\">West Virginia<\/span> Secretary of State&#8217;s website<\/a>.<\/p>\n<p><span data-term-id=\"39117826\">Law enforcement officers<\/span> responding to a <span data-term-id=\"39117813\">domestic violence<\/span> call can <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-702\/\" target=\"_blank\" rel=\"noopener\">transport a victim to a <span data-term-id=\"39117813\">domestic violence<\/span> shelter<\/a>. Protective orders can be put in place during divorce proceedings as well as after.<\/p>\n<h2><span data-term-id=\"39117813\">Domestic Violence<\/span> Violations and Punishments in <span data-term-id=\"39117814\">West Virginia<\/span><\/h2>\n<p>Being charged with a <span data-term-id=\"39117813\">domestic violence<\/span> crime can have long-lasting effects on an abuser. The order is entered into the\u00a0<span data-term-id=\"39117814\">West Virginia<\/span>\u00a0<span data-term-id=\"39117813\">domestic violence<\/span>\u00a0database and\u00a0also sent to the <span data-term-id=\"39117814\">West Virginia<\/span> State Police. Law enforcement in the abuser&#8217;s jurisdiction is also notified of the restraint order.<\/p>\n<p>Once a protective order is in place, violations are not treated with a slap on the wrist. Victims are likely to get primary custody of shared children, and abusers can have their visitation rights curtailed or supervised.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/wv\/chapter-48-domestic-relations\/wv-code-sect-48-27-903\/\" target=\"_blank\" rel=\"noopener\">first violation of a protective order<\/a> is a <span data-term-id=\"39117820\">misdemeanor<\/span>, punishable by a fine of between $250 and $2,500 and a jail term of between one and 364 days. The <span data-term-id=\"39117832\">second offense<\/span> carries a fine of between $500 and $3,000, along with a term of imprisonment ranging from 90 days to a year, of which at least 30 days must be served in jail.<\/p>\n<p>Any third or subsequent violation within ten years incurs a fine of between $500 and $4,000, as well as a potential jail term of up to one year, with a minimum sentence of six months in jail.
