For one child, 17% of income is allocated, increasing with more children.<\/p>\r\n<p>Special child support guidelines exist for high- and low-income earners, shared placement, and serial families. Courts can adjust payments based on specific circumstances, ensuring fair support that meets children&#8217;s needs while considering parents&#8217; financial abilities.<\/p>\r\n<p>Children have a legal right to receive financial support from both parents. This article examines the child support system in Wisconsin.<\/p>\r\n<h2><b>How Wisconsin Calculates Child Support Payment<\/b><\/h2>\r\n<p>The state of Wisconsin uses the Percentage of Income Standard to calculate the amount of child support payments. The percentage standard approach differs from the <a href=\"https:\/\/www.ncsl.org\/human-services\/child-support-guideline-models\" target=\"_blank\" rel=\"noopener\">Income Shares Model<\/a> other states use. Rather than looking at the perspective of the amount of support payments that the child should have received if the parents stayed together, the <a href=\"https:\/\/dcf.wisconsin.gov\/files\/cs\/guidance-documents\/pdf\/wi-percentage-of-income-standard.pdf\" target=\"_blank\" rel=\"noopener\">Percentage of Income Standard<\/a> looks at each parent\u2019s income and the amount of time that a child spends with each parent. They also look at the number of children that a paying parent supports:<\/p>\r\n<ul>\r\n<li>17% of income for one child<\/li>\r\n<li>25% of income for two children<\/li>\r\n<li>29% of income for three children<\/li>\r\n<li>31% of income for four children<\/li>\r\n<li>34% of income for five or more children<\/li>\r\n<\/ul>\r\n<h2><b>Adjustment of Child Support for Special Circumstances<\/b><\/h2>\r\n<p>The <a href=\"https:\/\/dcf.wisconsin.gov\/cs\/order\/tools\" target=\"_blank\" rel=\"noopener\">Wisconsin Department of Children and Families<\/a> acknowledges that each child support case is unique. With this, they developed tools to help with estimating the child support amounts.<\/p>\r\n<h3><b>Serial Family Cases<\/b><\/h3>\r\n<p>When a parent has child support obligations to children from multiple relationships, the family court makes adjustments to balance the responsibilities.<\/p>\r\n<h3><b>Split Placement<\/b><\/h3>\r\n<p>When families have two or more children and the court orders one or more children to live with each parent, the court may follow the split placement guidelines. With these guidelines, the Child Support Standard prorates the amount for each child based on the total number of children.<\/p>\r\n<h3><b>High-Income Payers Case<\/b><\/h3>\r\n<p>If the parent paying child support earns above $84,000 per year, the court may refer to the high-income payer guidelines.<\/p>\r\n<h3><b>Low-Income Case<\/b><\/h3>\r\n<p>If the parent paying child support earns less than $1,485 per month, the court may adjust the amount and refer to the low-income payer guidelines. The amount of child support may also vary depending on the parents&#8217; monthly income and the number of children supported.<\/p>\r\n<p>You can use the <a href=\"https:\/\/dcf.wisconsin.gov\/files\/cs\/order\/worksheet-split-shared-placement.pdf\" target=\"_blank\" rel=\"noopener\">Wisconsin worksheet<\/a> to estimate the amount of child support payment. There is also a <a href=\"https:\/\/dcf.wisconsin.gov\/cs\/order\/tools\" target=\"_blank\" rel=\"noopener\">child support calculator<\/a> that you can use to help you determine the estimated amount of child support you have to pay.<\/p>\r\n<h2><b>How Are Child Support Obligations Enforced?<\/b><\/h2>\r\n<p>When a parent doesn&#8217;t pay their child support, the debt becomes past due. Starting April 1, 2014, the interest charged on past-due child support in Wisconsin became <a href=\"https:\/\/csos.wisconsin.gov\/login\" target=\"_blank\" rel=\"noopener\">.5% per month or 6% per year<\/a>. In Wisconsin, guidelines are set up for many other circumstances, so there&#8217;s some <a href=\"https:\/\/dcf.wisconsin.gov\/cs\/order\/tools\" title=\"standardization of special cases\" target=\"_blank\" rel=\"noopener\">standardization of special cases<\/a>. However, the court can still deviate from the standard if it would be unfair to either the child or one of the parents. Special child support guidelines exist for parents who:<\/p>\r\n<ul>\r\n<li>Share placement of their children (child with each parent at least 25% of the time)<\/li>\r\n<li>Split the placement of their children. For example: one parent has one child, the other parent has another.<\/li>\r\n<li>Support more than one family (called a \u201cserial family\u201d)<\/li>\r\n<li>Have a low income<\/li>\r\n<li>Have a high income<\/li>\r\n<\/ul>\r\n<p>No matter which guideline the family court uses, the parent&#8217;s income is crucial in determining the amount of support. Wisconsin considers the following sources of income:<\/p>\r\n<ul>\r\n<li>Wages, salaries, earnings, tips, commissions, and bonuses from work<\/li>\r\n<li>Interest and capital gains from investments or property<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/workers-compensation.html\">Workers&#8217; compensation benefits<\/a> or personal injury awards intended to replace income<\/li>\r\n<li>Unemployment insurance<\/li>\r\n<li><a href=\"https:\/\/www.dhs.wisconsin.gov\/ddb\/apply.htm\" title=\"Social Security Disability Income (SSDI)\" target=\"_blank\" rel=\"noopener\">Social Security Disability Income (SSDI)<\/a>, but NOT Supplemental Security Income (SSI) or other public assistance (food stamps, etc)<\/li>\r\n<li>Military allowances and veterans&#8217; benefits<\/li>\r\n<li>Voluntary retirement contributions, cafeteria plans, and undistributed income of a corporation<\/li>\r\n<\/ul>\r\n<p>Child support can also be based on the parents&#8217; ability to earn. The court may look at the parents&#8217; past earnings, current health, education, work experience, history as a primary caregiver, and the availability of jobs locally. The court can also consider the value based on intangible or non-cash sources. These sources may include life insurance, cash, deposit accounts, stocks, bonds, and business interests.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>What Expenses Can the Judge Order?<\/b><\/p>\r\n<\/th>\r\n<td><p>Child support is intended to cover the basic expenses of having a child. These include food, clothing, housing, utilities, transportation, personal care, and <a href=\"http:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/767\/VI\/513\" target=\"_blank\" rel=\"noopener\">health insurance<\/a>.<\/p>\r\n<\/td>\r\n<\/tr><tr><th scope=\"row\" style=\"text-align: left;\"><p><b>How Long Must a Parent Pay Child Support?<\/b><\/p>\r\n<\/th>\r\n<td><p>The parent has a legal obligation to pay child support until the child turns 18, or 19 if still enrolled in high school or a GED course. Note that you still owe past-due child support after your child turns 18.
