But emergency vehicles are held to a different standard, permitting them to operate in a way other drivers could not. But generally, the duty to all others in Wisconsin is to act reasonably to <strong>avoid foreseeable harm<\/strong> to others.&#8221;<\/p>\n<p>For example, if Debbie is speeding on the interstate and collides with Patricia&#8217;s car, she might be held liable for the damage. Let\u2019s apply the elements of negligence:<\/p>\n<ul>\n<li><strong>Duty:<\/strong> As a driver, Debbie has a duty to other motorists, such as Patricia, to operate her vehicle safely and obey traffic laws.<\/li>\n<li><strong>Breach:<\/strong> By speeding, Debbie breached that duty of reasonable care.<\/li>\n<li><strong><span data-term-id=\"59372653\">Causation<\/span>:<\/strong> The collision and Patricia&#8217;s resulting injuries would not have occurred <em>but for<\/em> Debbie&#8217;s speeding, and it was a foreseeable result of that action.<\/li>\n<li><strong>Harm:<\/strong> Patricia suffered tangible harm, including vehicle damage and <span data-term-id=\"59372651\">medical expenses<\/span>.<\/li>\n<\/ul>\n<p>Because all four elements are present, Debbie would likely be found negligent.<\/p>\n<h3><span data-term-id=\"59372672\"><strong>Ordinary Negligence<\/strong><\/span><strong> vs. Gross Negligence<\/strong><\/h3>\n<p>While most <span data-term-id=\"59372674\">personal injury lawsuits<\/span> involve a failure to exercise <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/standards-of-care-and-the-reasonable-person.html\">reasonable care <\/a>(<span data-term-id=\"59372654\">ordinary care<\/span>), Wisconsin law also recognizes situations in which conduct is far more reckless. This distinction is important because it can affect the type of damages a person can recover.<\/p>\n<p>In many Wisconsin injury cases, the focus is <span data-term-id=\"59372672\">ordinary negligence<\/span>, and the phrase &#8220;gross negligence&#8221; usually matters only in specific legal contexts, such as where a statute uses that term, rather than as a separate, stand-alone <span data-term-id=\"59372652\">personal injury claim<\/span>. As Kasieta explains:<\/p>\n<p>&#8220;Conduct might be placed on a linear spectrum from &#8216;totally reasonable&#8217; to &#8216;malicious intent.&#8217; &#8216;Reckless disregard&#8217; and &#8216;gross negligence&#8217; fall just short of &#8216;malicious intent&#8217; on the scale. The same act, for example, crashing into a vehicle, might be mere negligence (i.e., unreasonable behavior) or it could be malicious conduct, depending entirely on the mindset of the one doing the crashing.&#8221;<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/what-are-punitive-damages.html\"><span data-term-id=\"59372650\">Punitive damages<\/span><\/a> are not available for <span data-term-id=\"59372672\">ordinary negligence<\/span> in Wisconsin. Instead, <span data-term-id=\"59372650\">punitive damages<\/span> may be awarded only if the plaintiff proves by clear and convincing evidence that the defendant acted maliciously toward the plaintiff, or in intentional disregard of the plaintiff&#8217;s rights.<\/p>\n<h3><strong>Comparative Negligence<\/strong><\/h3>\n<p>As mentioned above, <span data-term-id=\"59372653\">causation<\/span> is important when we\u2019re talking about negligence. Not only does a plaintiff have to show that the other party\u2019s negligence <em>caused <\/em>their harm, but under some state negligence laws, they might lose some or even all of their damage amount if they are partially at fault for their own injuries. This is called \u201c<a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/comparative-negligence.html\"><span data-term-id=\"59372643\">comparative negligence<\/span><\/a>.\u201d<\/p>\n<p>States set their own rules on how fault impacts what someone can recover in a <span data-term-id=\"59372646\">personal injury case<\/span>. They tend to fall into one of the following categories:<\/p>\n<ul>\n<li><strong>Pure <span data-term-id=\"59372643\">comparative negligence<\/span>:<\/strong> The amount of damages you can recover is reduced by your <span data-term-id=\"59372647\">percentage of fault<\/span>, no matter what that amount is. For example, if Patricia was found to be 10% at fault for the car accident above in a pure <span data-term-id=\"59372643\">comparative negligence<\/span> state, she would recover 90% of whatever amount the judge or jury determined she was owed in damages. Even if she was found to be 80% at fault, she could still recover 20% of her damages.<\/li>\n<li><strong>Modified <span data-term-id=\"59372643\">comparative negligence<\/span>: <\/strong>A plaintiff can recover damages only up to a certain <span data-term-id=\"59372647\">percentage of fault<\/span> (either 50% or 51%). Essentially, these states require that the plaintiff be either less at fault than the defendant or equally at fault in order to recover damages.<\/li>\n<li><strong>Pure <span data-term-id=\"59372644\">contributory negligence<\/span>:<\/strong> In a few states, a plaintiff recovers <em>no damages<\/em> if they are at all at fault for the accident. This strict <span data-term-id=\"59372656\">comparative fault<\/span> rule is only used in Alabama, Maryland, North Carolina, and Virginia.<\/li>\n<\/ul>\n<h3><strong>Wisconsin Comparative Negligence Laws<\/strong><\/h3>\n<p>Wisconsin follows the <span data-term-id=\"59372676\">modified <\/span><span data-term-id=\"59372676\">comparative negligence<\/span><span data-term-id=\"59372676\"> system<\/span>. Under the state\u2019s <a href=\"https:\/\/codes.findlaw.com\/wi\/miscellaneous-actions-proceedings-and-procedure-ch-895-to-900\/wi-st-895-045\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59372655\">comparative negligence<\/span><span data-term-id=\"59372655\"> statute<\/span><\/a>, the person bringing a claim of negligence will not be able to recover damages if they\u2019re found to be more responsible for the injury for which they are seeking damages. For the person bringing the claim to recover compensation, they must not be more than 50% at fault.<\/p>\n<p>Taking the above example, if Patricia failed to signal before changing into Debbie&#8217;s lane, Patricia might be found to have contributed to the accident. Wisconsin negligence law states that a plaintiff&#8217;s negligence is only a bar to a claim if they are found more negligent than the person they\u2019re suing.<\/p>\n<p>Kasieta explains how this can impact damages:<\/p>\n<p>\u201cIf plaintiff suffers damages of $100,000 but plaintiff is found by a jury to be 50% to blame for the incident causing injury, plaintiff will recover $50,000 (which is 50% of $100,000). If plaintiff\u2019s negligence exceeds 50% of the total blame for the injury, plaintiff recovers nothing.\u201d<\/p>\n<h2><strong>Do I Have a Personal Injury Case?<\/strong><\/h2>\n<p>If you believe someone else&#8217;s negligence caused you harm, you may have a <span data-term-id=\"59372646\">personal injury case<\/span>.
