This is a legal process and whether the decedent left a valid will affects how his or her property is distributed. Probate matters in Wisconsin are handled at the local <a href=\"http:\/\/www.wicourts.gov\/courts\/circuit\/index.htm\" target=\"_blank\" rel=\"noopener\">circuit court<\/a> level.<\/p>\n<p>If there is a <a href=\"http:\/\/county.milwaukee.gov\/CourtServices7714\/ProbateHomePage\/FAQ\/ProbateFAQ.htm#Q4\" target=\"_blank\" rel=\"noopener\">will<\/a>, it must be filed with the court, even if probate isn&#8217;t needed to distribute the decedent\u2019s property. A person who dies without a will is said to have died &quot;<a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/die-without-estate-plan.html\" target=\"_blank\">intestate<\/a>&quot; and Wisconsin&#8217;s <a href=\"http:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/852\" target=\"_blank\" rel=\"noopener\">intestacy laws<\/a> determine how the person&#8217;s assets are distributed. In addition, probate may not be required when a person dies, for example, if there are no assets in his or her estate at death as they were all transferred through other means.<\/p>\n<h2>Medicare Estate Recovery Program<\/h2>\n<p>Wisconsin&#8217;s <a href=\"http:\/\/www.dhs.wisconsin.gov\/medicaid\/erp.htm\" target=\"_blank\" rel=\"noopener\">Estate Recovery Program<\/a> will seek repayment for certain long term care services paid for by Medicaid and <a href=\"http:\/\/www.dhs.wisconsin.gov\/badgercareplus\/\" target=\"_blank\" rel=\"noopener\">BadgerCare Plus<\/a> out of a decedent\u2019s estate. The state is a creditor in this case. However, the state doesn\u2019t seek recovery when the individual who used <a href=\"https:\/\/www.findlaw.com\/healthcare\/medicare-medicaid\/medicaid.html\" target=\"_blank\">Medicaid<\/a> or BadgerCare is survived by a spouse, a child under 21, or a disabled or blind child of any age.<\/p>\n<h2>Estate Tax<\/h2>\n<p>Wisconsin&#8217;s estate tax was eliminated for deaths occurring after December 31, 2012. This is because the federal <a href=\"https:\/\/codes.findlaw.com\/us\/title-26-internal-revenue-code\/\" target=\"_blank\" rel=\"noopener\">estate tax credit<\/a> that was the basis for Wisconsin\u2019s estate tax was repealed. Unless the federal estate tax law is modified to provide a federal estate tax credit for state estate or death taxes, then Wisconsin doesn&#8217;t and won&#8217;t have an estate tax for deaths in 2013 onward.<\/p>\n<p>The following table outlines Wisconsin&#8217;s Probate and Estate Tax Laws.<\/p>\n<table cellspacing=\"0\" cellpadding=\"0\" border=\"1\">\n<tbody><tr><td><p><b>Code Sections<\/b><\/p>\n<\/td>\n<td><p>Wisconsin Statutes Chapters 851-879: <a href=\"http:\/\/docs.legis.wisconsin.gov\/statutes\/prefaces\/toc\" target=\"_blank\" rel=\"noopener\">Probate<\/a><\/p>\n<\/td>\n<\/tr><tr><td><p><b>Types of Estate Administration<\/b><\/p>\n<\/td>\n<td><p>Wisconsin has four main types of <a href=\"http:\/\/www.wripa.org\/types-of-probate-proceedings.html\" target=\"_blank\" rel=\"noopener\">probate proceedings<\/a>:<\/p>\n<ul>\n<li><u>Two Summary Procedures for Smaller Estates<\/u><ul>\n<li><i>Summary Settlement <\/i>&#8211; For settling estates of $50,000 or less when the decedent had a surviving spouse, domestic partner, or minor children. Also available without surviving family if the estate assets don&#8217;t exceed the debts (taxes, funeral, <a href=\"http:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/861\/III\/31\" target=\"_blank\" rel=\"noopener\">family allowances<\/a>, etc).<\/li>\n<li><i>Summary Assignment <\/i>&#8211; Small estate procedure for estates of $50,000 or less that can&#8217;t be settled under summary settlement.<\/li>\n<li><i>Transfers by Affidavit<\/i> &#8211; Transfers decedent&#8217;s assets for estates worth $50,000 or less by a written statement, but requires notice of the <a href=\"http:\/\/www.wicourts.gov\/forms1\/circuit\/ccform.jsp?FormNumber=PR-1831\" target=\"_blank\" rel=\"noopener\">transfer<\/a> to the estate recovery program.<\/li>\n<\/ul>\n<\/li>\n<li><u>Informal Administration<\/u><ul>\n<li>Requires the appointment of a <a href=\"http:\/\/www.wicourts.gov\/services\/public\/selfhelp\/docs\/probateguide.pdf\" target=\"_blank\" rel=\"noopener\">personal representative<\/a>, but doesn&#8217;t require continuous court supervision. The administration is supervised by the <a href=\"http:\/\/www.wripa.org\/\" target=\"_blank\" rel=\"noopener\">Probate Registrar<\/a> and is the most common form of probate in Wisconsin.<\/li>\n<\/ul>\n<\/li>\n<li><u>Formal Administration<\/u><ul>\n<li>A formal, circuit court supervised procedure. Required when the will prohibits informal administration or when not all of the heirs consent to informal administration.<\/li>\n<li>Requires the assistance of an <a href=\"https:\/\/lawyers.findlaw.com\/probate-estate-administration\/wisconsin\/\" target=\"_blank\" rel=\"noopener\">estate administration attorney<\/a> and a personal representative to be appointed.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>What Assets Go Through Probate?<\/b><\/p>\n<\/td>\n<td><p>When a person has property in his or her name or rights to receive property at death, probate is needed. Property includes:<\/p>\n<ul>\n<li>The decedent&#8217;s bank accounts with no co-owner and no <a href=\"https:\/\/dictionary.findlaw.com\/definition\/beneficiary.html\" target=\"_blank\" rel=\"noopener\">beneficiary<\/a><\/li>\n<li>Home(s) or land owned by the decedent alone<\/li>\n<li>Home(s) or land co-owned as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/tenants-in-common.html\" target=\"_blank\" rel=\"noopener\">tenants in common<\/a> without the &quot;right of survivorship&quot;<\/li>\n<li>Stocks and bonds in the decedent\u2019s name alone<\/li>\n<li>Tangible personal property (clothing, jewelry, furniture, cars registered to decedent only, etc.)<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>What Assets Skip Probate Entirely?<\/b><\/p>\n<\/td>\n<td><p>In contrast, some assets skip probate entirely and go directly to the beneficiary or co-owner of the items, such as:<\/p>\n<ul>\n<li>Bank accounts that have a valid Payable on Death (POD) or Transfer on Death (TOD) document<\/li>\n<li>Home(s) or land owned as <a href=\"https:\/\/www.findlaw.com\/realestate\/buying-a-home\/difference-between-joint-tenancy-and-tenancy-in-common.html\" target=\"_blank\">joint tenants with right of survivorship<\/a> or, for married couples, <a href=\"https:\/\/dictionary.findlaw.com\/definition\/tenants-by-the-entirety.html\" target=\"_blank\" rel=\"noopener\">tenancy by the entirety<\/a>, in these cases, the joint tenants own 100% of that real estate at the decedent&#8217;s death.<\/li>\n<li>Life insurance policies and retirement accounts with a designated beneficiary<\/li>\n<li>Property held in a <a href=\"https:\/\/www.findlaw.com\/estate\/trusts\/types-of-trusts.html\" target=\"_blank\">revocable trust<\/a><\/li>\n<li>Vehicles can be transferred to a <a href=\"http:\/\/www.dot.wisconsin.gov\/drivers\/vehicles\/title\/surviving.htm\" target=\"_blank\" rel=\"noopener\">surviving spouse<\/a> or domestic partner (up to five vehicles) or another <a href=\"http:\/\/www.dot.wisconsin.gov\/drivers\/vehicles\/title\/heir.htm\" target=\"_blank\" rel=\"noopener\">heir<\/a> (if the estate value was less than $50,000)<\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td><p><b>Estate Taxes<\/b><\/p>\n<\/td>\n<td><p>Wisconsin has had no estate tax since the end of 2012.<\/p>\n<\/td>\n<\/tr><tr><td><p><b>What Other Taxes Must be Paid?<\/b><\/p>\n<\/td>\n<td><p>The personal representative of a deceased taxpayer in Wisconsin must file all necessary state and federal tax forms, including:<\/p>\n<ul>\n<li>The final individual or fiduciary <a href=\"http:\/\/www.revenue.wi.gov\/faqs\/ise\/estate.html\" target=\"_blank\" rel=\"noopener\">income tax return(s)<\/a> of the decedent<\/li>\n<li>The real estate or other property taxes owed by the decedent at death<\/li>\n<li>The estate income tax return, if the estate had income of $600 or more<\/li>\n<\/ul>\n<\/td>\n<\/tr><\/tbody><\/table>\n<p><b><i>Note:<\/i><\/b> <i>State laws are always subject to change through the passage of new legislation, rulings in the higher courts (including federal decisions), ballot initiatives, and other means.
