This differs from&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/wyoming-law\/wyoming-legal-ages-laws.html\" title=\"the state&#039;s general age of majority\">the state&#8217;s general age of majority<\/a>, which is 18.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Mandatory Arrest?<\/b><\/p>\r\n<\/td>\r\n<td><p>No. Wyoming Statute \u00a7 35-21-107 allows local law enforcement officers responding to a domestic violence call to take steps &quot;reasonably necessary&quot; to prevent further abuse. This can include arresting the abuser when appropriate. However, they are not required to make an arrest.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h2>Orders of Protection in Wyoming<\/h2>\r\n<p>Wyoming courts can issue&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/wyoming-law\/wyoming-protective-orders-laws.html\" title=\"protection orders\">protection orders<\/a>&nbsp;to safeguard victims of domestic abuse. The following are types of protection orders that the court can issue:<\/p>\r\n<h3>Ex Parte Protection Orders<\/h3>\r\n<p>Wyoming courts can issue an&nbsp;<a href=\"https:\/\/www.courts.state.wy.us\/wp-content\/uploads\/2017\/03\/DVInstructions-1.pdf\" title=\"emergency protection order\" target=\"_blank\" rel=\"noopener\">emergency ex parte protection order<\/a>&nbsp;to give the victim immediate protection from domestic abuse. &quot;Ex parte&quot; means the judge can issue this order without the respondent (the alleged abuser) being present or even notified.<\/p>\r\n<p>The court will grant an ex parte temporary order if the danger of further abuse appears imminent. The temporary order of protection and hearing notice is then served on the alleged perpetrator. Within 72 hours, the court will hold another hearing to decide whether to issue a final protection order.<\/p>\r\n<h3>Final Protection Order<\/h3>\r\n<p>A&nbsp;<a href=\"https:\/\/codes.findlaw.com\/wy\/title-35-public-health-and-safety\/wy-st-sect-35-21-105\/\" title=\"final protection order\" target=\"_blank\" rel=\"noopener\">final protection order<\/a>&nbsp;gives comprehensive legal protection the the victim. This can include multiple provisions to safeguard the victim and their children from further abuse. A typical order might include any of the following:<\/p>\r\n<ul>\r\n<li>Grant exclusive possession of the house to the victim of domestic abuse or order the abuser to provide alternative housing. The court may also grant custody of pets.<\/li>\r\n<li>Prohibit the abuser from initiating contact with the victim of the abuser and order them to stay away from the victim\u2019s residence or place of work.<\/li>\r\n<li>The judge may also prohibit the abuser from abducting or concealing the children or transferring or disposing of the properties of the victim.<\/li>\r\n<li>Award temporary child custody and set a supervised visitation.<\/li>\r\n<li>Order child support payments.<\/li>\r\n<li>The court may also order additional remedies, such as requiring the abuser to attend counseling or treatment.<\/li>\r\n<\/ul>\r\n<p>The court can extend the final protection order for up to three years, with the possibility of repeated extensions after showing good cause.<\/p>\r\n<h2>Penalties for Domestic Violence in Wyoming<\/h2>\r\n<p>Under&nbsp;<a href=\"https:\/\/codes.findlaw.com\/wy\/title-6-crimes-and-offenses\/wy-st-sect-6-2-510\/\" title=\"Wyoming statute\" target=\"_blank\" rel=\"noopener\">Wyoming statute<\/a>, the penalties for domestic assault are as follows:<\/p>\r\n<table>\r\n<tbody><tr><td><p><b>First offense<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li>Up to 6 months imprisonment<\/li>\r\n<li>A fine of up to $750, or<\/li>\r\n<li>Both imprisonment and fine<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Second offense<\/b><\/p>\r\n<\/td>\r\n<td><p>Penalties increase if the person has previously been convicted of domestic assault or similar offenses against a household member within the last five years:<\/p>\r\n<ul>\r\n<li>Up to 1 year of imprisonment<\/li>\r\n<li>A fine of up to $1,000, or<\/li>\r\n<li>Both imprisonment and fine<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Multiple convictions within 10 years<\/b><\/p>\r\n<\/td>\r\n<td><p>If, in the past ten years, the abuser faced two or more convictions of domestic battery or one conviction of domestic battery plus another qualifying offense, the penalty increases to:<\/p>\r\n<ul>\r\n<li>Up to 10 years of imprisonment<\/li>\r\n<li>A fine of up to $10,000 or<\/li>\r\n<li>Both imprisonment and fine<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n<h3><b>Enhancing Circumstances<\/b><\/h3>\r\n<p>Conviction of any of the following acts enhances the penalties:<\/p>\r\n<ul>\r\n<li>Simple assault<\/li>\r\n<li>Aggravated assault and battery<\/li>\r\n<li>Domestic battery<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/family\/child-abuse\/child-abuse-laws.html#:~:text=Child%20abuse%20is%20any%20mistreatment%20or%20harm%20inflicted,of%20physical%20injury%2C%20sexual%20abuse%2C%20and%20sexual%20exploitation.\" title=\"Child abuse\">Child abuse<\/a><\/li>\r\n<li>Reckless endangerment<\/li>\r\n<li>Unlawful contact<\/li>\r\n<li>Strangulation of a household member<\/li>\r\n<li>Kidnapping<\/li>\r\n<li>Felonious restraint<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/false-imprisonment.html\" title=\"False imprisonment\">False imprisonment<\/a><\/li>\r\n<\/ul>\r\n<p><i>Note: State laws are subject to change.
