This &#8220;all-or-nothing&#8221; doctrine is only used in a handful of states, as most have adopted a <span data-term-id=\"54635626\">comparative negligence<\/span> system instead.<\/p>\n\n    <\/div>\n\n\n\n<p>It is rare for someone to be fully blameless in an accident. Although sometimes a flowerpot can just fall from a windowsill, it is more common for multiple parties to share responsibility. Even accident victims might bear some responsibility for their <span data-term-id=\"54635630\">own injuries<\/span>.<\/p>\n<p>Each state&#8217;s <span data-term-id=\"54635636\">negligence laws<\/span> determine when a party can recover damages in a <span data-term-id=\"54635627\">personal injury<\/span> lawsuit (and how much they can recover). Most states allow recovery even with some shared fault. This is known as <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/comparative-negligence.html\"><span data-term-id=\"54635626\">comparative negligence<\/span><\/a>.<\/p>\n<p>But a few states will not permit you to recover damages if you share any blame in the accident. These states follow the <strong><span data-term-id=\"54635643\">contributory negligence<\/span><span data-term-id=\"54635643\"> doctrine<\/span><\/strong>.<\/p>\n<p>For example, when parties file claims with their <span data-term-id=\"54635637\">insurance companies<\/span> after a <span data-term-id=\"54635628\">car accident<\/span>, the companies must <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/who-is-liable.html\">determine liability<\/a>. Maybe one party was speeding, but the other ran a red light. Assigning each party a <span data-term-id=\"54635631\">percentage of fault<\/span> lets the insurers make timely and accurate payments to their clients.<\/p>\n<p>However, in a <span data-term-id=\"54635625\">contributory negligence<\/span> state, if the driver who was hit is found to be just 1% at fault for speeding, they <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/what-to-do-after-a-car-accident-that-is-your-fault.html\">could be completely barred<\/a> from recovering any money from the driver who ran the red light.<\/p>\n<h2>What Is Negligence?<\/h2>\n<p>Negligence is an important part of <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/intentional-vs-negligent-torts.html\"><span data-term-id=\"54635664\">tort claims<\/span><\/a> (civil claims related to <span data-term-id=\"54635627\">personal injuries<\/span>). Before a court can consider <span data-term-id=\"54635625\">contributory negligence<\/span>, a plaintiff (the <span data-term-id=\"54635668\">injured person<\/span>) must first prove that the defendant (the person they are suing) was negligent.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/proving-fault-what-is-negligence.html\">Negligence<\/a> is more than just carelessness. In a <span data-term-id=\"54635653\">negligence case<\/span>, a plaintiff generally must show that:<\/p>\n<ul>\n<li>The defendant had a <span data-term-id=\"54635651\">duty of care<\/span> (can be a legal duty, or what a reasonable person would do)<\/li>\n<li>They breached that duty<\/li>\n<li>The <span data-term-id=\"54635657\">defendant\u2019s negligence<\/span> directly caused the <span data-term-id=\"54635635\">plaintiff&#8217;s injuries<\/span> and damages<\/li>\n<\/ul>\n<p>For example, all drivers have a legal duty to obey traffic signals. If a driver runs a red light and causes a collision, they have breached that duty. The injuries and vehicle damage suffered by the other driver are the direct result of that breach, which could make the at-fault driver liable for negligence.<\/p>\n<h2><span data-term-id=\"54635626\">Comparative Negligence<\/span><\/h2>\n<p>The majority of states use a form of <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/comparative-negligence.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span data-term-id=\"54635626\">comparative negligence<\/span><\/a> when weighing parties\u2019 fault in <span data-term-id=\"54635665\">tort cases<\/span>. This method gives each party a <span data-term-id=\"54635631\">percentage of fault<\/span> and then compares the <span data-term-id=\"54635654\">degrees of fault<\/span>.<\/p>\n<ul>\n<li><strong>Pure comparative negligence<\/strong> permits recovery regardless of the victim\u2019s <span data-term-id=\"54635631\">percentage of fault<\/span>.<\/li>\n<li><strong>Modified comparative negligence<\/strong> (the most common approach) allows recovery up to a certain <span data-term-id=\"54635654\">degree of fault<\/span>.<\/li>\n<\/ul>\n<p>Some <span data-term-id=\"54635646\">modified <\/span><span data-term-id=\"54635626\">comparative negligence<\/span> states follow a \u201c50% rule.\u201d There, you can recover damages as long as you are found either equally or less at fault than the other party. Other states use a \u201c49% rule,\u201d where recovery is limited to parties who are less than 50% at fault.<\/p>\n<p>Both systems reduce the plaintiff\u2019s recovery by their <span data-term-id=\"54635631\">percentage of fault<\/span>. For example, if you were awarded $100,000 in damages but your <span data-term-id=\"54635654\">degree of fault<\/span> was 20%, you\u2019d still get $80,000.<\/p>\n<p>However, a few states do not use <span data-term-id=\"54635644\">comparative fault<\/span>. Instead, they bar plaintiffs from recovering damages if they are found at all responsible for their injuries.<\/p>\n<h2>Contributory Fault States<\/h2>\n<p>Four states and the <span data-term-id=\"54635660\">District of Columbia<\/span> use contributory fault when awarding damages. Under this method, a plaintiff cannot recover if they are even 1% responsible for their injuries. This method comes from <span data-term-id=\"54635647\">common law<\/span> and case law, and has its roots in British <span data-term-id=\"54635647\">common law<\/span>. Whether the states have codified the rule or not, the basic rule is the same.<\/p>\n<h3><span data-term-id=\"54635633\">Alabama<\/span><\/h3>\n<p><span data-term-id=\"54635633\">Alabama<\/span> does not have a statute for <span data-term-id=\"54635625\">contributory negligence<\/span>. Instead, <span data-term-id=\"54635633\">Alabama<\/span>\u2019s Rules of Civil Procedure make \u201c<span data-term-id=\"54635625\">contributory negligence<\/span>\u201d an affirmative defense. A defendant may present evidence that the <span data-term-id=\"54635645\">plaintiff\u2019s negligence<\/span> contributed to the accident in response to a <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/starting-a-lawsuit-initial-court-papers.html\">legal complaint<\/a>.<\/p>\n<p><span data-term-id=\"54635633\">Alabama<\/span>\u2019s rule is a complete bar to recovery, meaning that if a defendant prevails, the plaintiff cannot recover <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\">damages<\/a>.<\/p>\n<p>But a plaintiff has some legal arguments available to them:<\/p>\n<ul>\n<li>\n<p><strong>There was a <span data-term-id=\"54635641\">last clear chance<\/span>:<\/strong> If the plaintiff was in a dangerous situation, and the defendant was aware that they could have avoided the harm and did not (the <span data-term-id=\"54635641\">last clear chance<\/span>), then the plaintiff is not at fault. An example is someone who is jaywalking. If a driver has time to safely stop and avoid a collision, then the jaywalker\u2019s negligence in crossing in the middle of the street is offset by the driver\u2019s \u201c<span data-term-id=\"54635641\">last clear chance<\/span>.\u201d<\/p>\n<\/li>\n<li>\n<p><strong>Wanton misconduct:<\/strong> <span data-term-id=\"54635625\">Contributory negligence<\/span> does not excuse wanton, malicious, or intentional harm<\/p>\n<\/li>\n<\/ul>\n<p>One notable exception to the <span data-term-id=\"54635633\">Alabama<\/span> <span data-term-id=\"54635625\">contributory negligence<\/span> rule is <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability.html\"><span data-term-id=\"54635640\">product liability<\/span> claims<\/a>. <span data-term-id=\"54635633\">Alabama<\/span> standards for <span data-term-id=\"54635652\">strict liability<\/span> are higher for manufacturers in defective product cases.<\/p>\n<h3>Maryland<\/h3>\n<p>Maryland\u2019s <span data-term-id=\"54635625\">contributory negligence<\/span> rule comes from case law, with cases reaching as far back as 1847 (<em>Irwin v. Spriggs<\/em>, where a gentleman fell into a hole which the defendant argued he should have seen).<\/p>\n<p>Like other <span data-term-id=\"54635634\">jurisdictions<\/span> that follow <span data-term-id=\"54635625\">contributory negligence<\/span>, Maryland\u2019s rule requires defendants to show that a plaintiff\u2019s <span data-term-id=\"54635662\">own negligence<\/span> helped cause their accident. Maryland follows the \u201c<span data-term-id=\"54635641\">last clear chance<\/span>\u201d doctrine for plaintiffs to refute a <span data-term-id=\"54635658\">negligent defendant<\/span>\u2019s claim.<\/p>\n<p>Appeals have gone to Maryland&#8217;s courts twice in efforts to overturn the <span data-term-id=\"54635661\">state law<\/span>. The courts have rejected the request both times. Maryland\u2019s highest court believes that a legislative change, rather than case law, must update\u00a0<span data-term-id=\"54635625\">contributory negligence<\/span>\u00a0in the courts.<\/p>\n<h3><span data-term-id=\"54635639\">North Carolina<\/span><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-1-civil-procedure\/nc-gen-st-sect-1-139\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"><span data-term-id=\"54635639\">North Carolina<\/span>\u2019s statute<\/a> follows the <span data-term-id=\"54635647\">common-law<\/span> definition of <span data-term-id=\"54635625\">contributory negligence<\/span> and bars recovery if the <span data-term-id=\"54635632\">injured party<\/span> bears any responsibility for their <span data-term-id=\"54635630\">own injuries<\/span>. <span data-term-id=\"54635625\">Contributory negligence<\/span> is an affirmative defense. The defendant must prove the <span data-term-id=\"54635655\">claimant<\/span>\u2019s actions contributed to the accident.<\/p>\n<p>In <span data-term-id=\"54635639\">North Carolina<\/span>, the defendant must show <span data-term-id=\"54635638\">causation<\/span> by the plaintiff. In other words:<\/p>\n<ul>\n<li>The <span data-term-id=\"54635645\">plaintiff\u2019s negligence<\/span> was a \u201ccause in fact\u201d of the accident<\/li>\n<li>The <span data-term-id=\"54635635\">plaintiff\u2019s injury<\/span> was a reasonably foreseeable result (<span data-term-id=\"54635666\">proximate cause<\/span>) of their actions<\/li>\n<\/ul>\n<p>For instance, if the plaintiff makes an illegal left turn, the accident would not have occurred \u201cbut for\u201d their unlawful turn. It is reasonably foreseeable that the plaintiff could suffer an injury in such an accident. A jury could find the plaintiff partially responsible in this <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/personal-injury-law-the-basics.html\"><span data-term-id=\"54635648\">personal injury<\/span><span data-term-id=\"54635648\"> case<\/span><\/a>. In <span data-term-id=\"54635639\">North Carolina<\/span>, that would be enough to prevent them from receiving a <span data-term-id=\"54635669\">damages award<\/span>.<\/p>\n<p><span data-term-id=\"54635639\">North Carolina<\/span> uses the \u201c<span data-term-id=\"54635641\">last clear chance<\/span>\u201d doctrine to soften the impact of <span data-term-id=\"54635625\">contributory negligence<\/span>. Courts also use the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-proximate-cause\/\">\u201c<span data-term-id=\"54635666\">proximate cause<\/span>\u201d doctrine<\/a>. If a <span data-term-id=\"54635635\">plaintiff\u2019s injury<\/span> was not a reasonably foreseeable result of their negligent behavior, then <span data-term-id=\"54635625\">contributory negligence<\/span> may not apply.<\/p>\n<p>As in other states, <span data-term-id=\"54635625\">contributory negligence<\/span> does not apply to <span data-term-id=\"54635667\">intentional torts<\/span>, gross negligence, or wanton or malicious misconduct.<\/p>\n<h3>Virginia<\/h3>\n<p>Virginia\u2019s <span data-term-id=\"54635625\">contributory negligence<\/span> rule comes from case law. The initial case, <em>Baskett v. Banks<\/em> (1947), established that \u201cno person is entitled to recover from another for damages which have been occasioned by his own act or his own neglect.\u201d<\/p>\n<p>In simple terms, an <span data-term-id=\"54635668\">injured person<\/span> cannot recover damages if they caused their <span data-term-id=\"54635630\">own injury<\/span>.<\/p>\n<p>In addition to the \u201c<span data-term-id=\"54635641\">last clear chance<\/span>,\u201d Virginia statutes make a specific <a href=\"https:\/\/codes.findlaw.com\/va\/title-8-01-civil-remedies-and-procedure\/va-code-sect-8-01-58\/\" target=\"_blank\" rel=\"noopener\">exception for employees of \u201ccommon carriers,\u201d<\/a> primarily commercial railroads.<\/p>\n<p>Virginia\u2019s Supreme Court has held that \u201creasonable minds could differ\u201d as to whether a plaintiff contributed to their <span data-term-id=\"54635630\">own injuries<\/span>, so awards in <span data-term-id=\"54635642\">personal injury<\/span><span data-term-id=\"54635642\"> claims<\/span> rest with fact-finders like judges and juries.<\/p>\n<h3><span data-term-id=\"54635660\">District of Columbia<\/span><\/h3>\n<p>Washington, D.C., generally follows the <span data-term-id=\"54635625\">contributory negligence<\/span> rule. However, it has a significant exception for certain types of <span data-term-id=\"54635659\">motor vehicle accidents<\/span>. The <span data-term-id=\"54635660\">District of Columbia<\/span> Code <a href=\"https:\/\/codes.findlaw.com\/dc\/division-viii-general-laws\/dc-code-sect-50-2204-52\/\" target=\"_blank\" rel=\"noopener\">limits <span data-term-id=\"54635625\">contributory negligence<\/span><\/a> for cases involving \u201cpedestrians or vulnerable users\u201d of highways.<\/p>\n<p>This provision uses a <span data-term-id=\"54635646\">modified <\/span><span data-term-id=\"54635626\">comparative negligence<\/span> standard for pedestrians and cyclists involved in a motor vehicle collision. The rule holds that individuals are likely to suffer more serious injuries in an accident and should have some ability to recover damages. Under the rule, pedestrians can recover if they are 50% or less at fault in the accident.<\/p>\n<p>For example, if a cyclist rides outside a bike lane and is hit by a driver who is swerving to make an illegal turn, the cyclist can still recover damages.<\/p>\n<p>Washington, D.C., also uses the \u201c<span data-term-id=\"54635641\">last clear chance<\/span>\u201d doctrine for plaintiffs who wish to counter defendants\u2019 claim of\u00a0<span data-term-id=\"54635625\">contributory negligence<\/span>.<\/p>\n<h2>Get Legal Advice about <span data-term-id=\"54635625\">Contributory Negligence<\/span><\/h2>\n<p>While the strict rule of <span data-term-id=\"54635625\">contributory negligence<\/span> is the general standard for <span data-term-id=\"54635642\">personal injury<\/span><span data-term-id=\"54635642\"> claims<\/span> in these <span data-term-id=\"54635634\">jurisdictions<\/span>, several important exceptions may apply. And the doctrine isn&#8217;t limited to traffic accidents. In <span data-term-id=\"54635650\">medical malpractice<\/span> lawsuits, defendants can present evidence of a patient&#8217;s <span data-term-id=\"54635662\">own negligence<\/span>, such as ignoring a doctor&#8217;s instructions.
