This law applies to a company\u2019s hiring and firing policies, promotion and <span data-term-id=\"55059512\">demotion<\/span> practices, compensation, and job training opportunities.<\/li>\n<li><strong><span data-term-id=\"55059546\">Americans with Disabilities Act<\/span> (ADA)<\/strong>: The <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">ADA<\/a> protects employees and <span data-term-id=\"55059516\">job applicants<\/span> with disability or\u00a0<span data-term-id=\"55059549\">medical conditions<\/span> that are protected under the law. It also requires most workplaces to be ADA-compliant.<\/li>\n<li><strong><span data-term-id=\"55059540\">Equal Pay Act<\/span> of 1963<\/strong>: This law prohibits employers from paying workers <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-and-discrimination-against-women.html\">different wages for the same work<\/a>. It forbids companies from paying female and male workers different rates for jobs that require substantially the same skills, responsibilities, and effort.<\/li>\n<li><strong>Rehabilitation Act of 1973<\/strong>: Sections 501 and 505 of the <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/rehabilitation-act-of-1973-sections-501-and-505.html\">Rehabilitation Act<\/a> prohibit companies from discriminating against people with disabilities and mandate that employers implement affirmative action programs. It ensures fair pay and hiring procedures.<\/li>\n<li><strong><span data-term-id=\"55059534\">Age Discrimination<\/span> in Employment Act of 1967<\/strong>: This <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/age-discrimination-law.html\"><span data-term-id=\"55059509\">federal law<\/span> <\/a>prohibits employers from discriminating against employees based on age. Human Rights Act<\/a> protects more than 20 characteristics, including personal appearance, family responsibilities, and housing status. California&#8217;s <a href=\"https:\/\/calcivilrights.ca.gov\/employment\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55059529\">Fair Employment<\/span> and Housing Act<\/a> protects against discrimination based on military or veteran status. <a href=\"https:\/\/www.nyc.gov\/site\/eepc\/laws\/state-laws.page\" target=\"_blank\" rel=\"noopener\">New York&#8217;s laws<\/a> protect against discrimination based on familial status and domestic violence victim status.<\/p>\n<h2>Filing With <span data-term-id=\"55059542\">State Agencies<\/span><\/h2>\n<p>Many states have their own <a href=\"https:\/\/www.findlaw.com\/employment\/legal-help-and-resources\/state-labor-agencies.html\"><span data-term-id=\"55059529\">fair <\/span><span data-term-id=\"55059518\">employment<\/span><span data-term-id=\"55059518\"> practices<\/span> agencies<\/a>, often referred to as human rights commissions or <span data-term-id=\"55059508\">civil rights<\/span> divisions. In some cases, you may choose to file directly with your state or local agency instead of, or in addition to, the <span data-term-id=\"55059504\">EEOC<\/span>. <span data-term-id=\"55059542\">State agencies<\/span> may have different procedures, remedies, and timelines than the <span data-term-id=\"55059504\">EEOC<\/span>.<\/p>\n<p>If you file a charge with the <span data-term-id=\"55059504\">EEOC<\/span>, the agency typically shares your charge with the corresponding <span data-term-id=\"55059542\">state agency<\/span> through a work-sharing agreement. This is known as \u201cdual filing,\u201d which protects your rights under both federal and <span data-term-id=\"55059507\">state law<\/span>. Because filing deadlines can vary between federal and state claims, consider <a href=\"https:\/\/lawyers.findlaw.com\/discrimination\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">consulting with an attorney<\/a> to ensure you don&#8217;t miss any.<\/p>\n<h2>Filing a Complaint With the <span data-term-id=\"55059525\">U.S. <\/span><span data-term-id=\"55059506\">Equal Employment Opportunity Commission<\/span><\/h2>\n<p>If you&#8217;re the victim of <span data-term-id=\"55059514\">workplace discrimination<\/span>, you must file a charge with the <span data-term-id=\"55059504\">EEOC<\/span> before you can <a href=\"https:\/\/www.eeoc.gov\/filing-lawsuit\" target=\"_blank\" rel=\"noopener\">file a lawsuit in court<\/a>. The only exception is for <span data-term-id=\"55059540\">Equal Pay Act<\/span> claims, which allow you to go directly to court. Filing with the <span data-term-id=\"55059504\">EEOC<\/span> is a required first step for claims under <span data-term-id=\"55059519\">Title VII<\/span>, ADA, ADEA, and GINA. There&#8217;s always a chance that\u00a0the <span data-term-id=\"55059504\">EEOC<\/span> can resolve the issue without the need for litigation.<\/p>\n<h3>How To File an <span data-term-id=\"55059504\">EEOC<\/span> <span data-term-id=\"55059524\">Discrimination Complaint<\/span><\/h3>\n<p>There is a specific process you must follow to <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/filing-an-eeoc-complaint-or-charge.html\">file a <span data-term-id=\"55059524\">discrimination complaint<\/span><\/a> with the <span data-term-id=\"55059504\">EEOC<\/span>, which is referred to as a \u201ccharge.\u201d Before you <a class=\"editor-rtfLink\" href=\"https:\/\/www.eeoc.gov\/filing-lawsuit\" target=\"_blank\" rel=\"noopener\">file a <span data-term-id=\"55059527\">discrimination lawsuit<\/span><\/a>, you must go through the charge process. If you don\u2019t file your <span data-term-id=\"55059510\">charge of discrimination<\/span> properly or don\u2019t do so by the deadline, you\u2019ll lose your chance to file an <span data-term-id=\"55059504\">EEOC<\/span> claim.<\/p>\n<p>To file an <span data-term-id=\"55059504\">EEOC<\/span> claim, take the following steps:<\/p>\n<ul>\n<li>Confirm that you are eligible to file a charge<\/li>\n<li>File your <span data-term-id=\"55059510\">charge of discrimination<\/span> through the <a class=\"editor-rtfLink\" href=\"https:\/\/publicportal.eeoc.gov\/Portal\/Login.aspx\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55059504\">EEOC<\/span> Public Portal<\/a> online at <a href=\"http:\/\/eeoc.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55059554\">EEOC<\/span><span data-term-id=\"55059554\">.gov<\/span><\/a>, via mail, or in person at a local <span data-term-id=\"55059504\">EEOC<\/span> office<\/li>\n<li>Fill out the relevant forms completely, including the name of your employer and a detailed description of the discrimination<\/li>\n<li>Submit your charge form within 180 days of the alleged discrimination or 300 days if your state has its own <span data-term-id=\"55059529\">fair <\/span><span data-term-id=\"55059518\">employment<\/span><span data-term-id=\"55059518\"> practices<\/span> agency (missing this <span data-term-id=\"55059523\">time limit<\/span> means the <span data-term-id=\"55059504\">EEOC<\/span> will dismiss your charge)<\/li>\n<li>Check the <a class=\"editor-rtfLink\" href=\"https:\/\/www.eeoc.gov\/checking-status-your-charge\" target=\"_blank\" rel=\"noopener\">status of your charge<\/a><\/li>\n<\/ul>\n<p>The <span data-term-id=\"55059504\">EEOC<\/span> will send a notice to you, confirming receipt of your complaint and the initiation of an investigation. Although you cannot file your charge by phone, you can initiate the process by calling the <span data-term-id=\"55059504\">EEOC<\/span> at 1-800-669-4000.<\/p>\n<h3>What Action Will the <span data-term-id=\"55059504\">EEOC<\/span> Take if It Finds Discrimination?<\/h3>\n<p>The <span data-term-id=\"55059504\">EEOC<\/span> will contact your employer and speak with the parties involved in the alleged discriminatory behavior. Once the agent handling your charge gathers the necessary information, they will evaluate your claim and <a class=\"editor-rtfLink\" href=\"https:\/\/www.eeoc.gov\/employers\/what-you-can-expect-after-charge-filed\" target=\"_blank\" rel=\"noopener\">make a final decision<\/a>.<\/p>\n<p>If the agency determines that your employer discriminated against you, it will send you and your employer a <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/eeoc-s-charge-processing-procedures.html\">Letter of Determination<\/a>. This letter will invite both parties to attend a conciliation with the <span data-term-id=\"55059504\">EEOC<\/span>. Conciliation is a form of informal mediation.<\/p>\n<p>If either party refuses to attend this meeting, the <span data-term-id=\"55059504\">EEOC<\/span> will decide whether it will initiate a lawsuit on behalf of the claimant. If the <span data-term-id=\"55059504\">EEOC<\/span> does not believe the discrimination was severe enough to warrant <span data-term-id=\"55059538\">legal action<\/span>, it will notify the parties.<\/p>\n<p>If the <span data-term-id=\"55059504\">EEOC<\/span> does not determine that your employer engaged in discriminatory action, it will send both parties a \u201cDismissal and Notice of Rights.\u201d This notice includes a Notice of Right to Sue, which you&#8217;ll need if you decide to pursue a private <span data-term-id=\"55059527\">discrimination lawsuit<\/span>. Even if the <span data-term-id=\"55059504\">EEOC<\/span> finds in your favor, you may still receive a Right to Sue letter if the agency chooses not to litigate the case itself or if conciliation fails.<\/p>\n<h2>Filing a Private <span data-term-id=\"55059527\">Discrimination Lawsuit<\/span><\/h2>\n<p>After filing your <span data-term-id=\"55059504\">EEOC<\/span> charge, you can decide whether to pursue a <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/how-to-sue.html#:~:text=In%20FindLaw%E2%80%99s%20section%20on%20How%20To%20Sue%2C%20you,lawsuit%20as%20it%20progresses%20from%20beginning%20to%20end.\">private lawsuit<\/a> against your employer after you get a Notice of Right to Sue from the <span data-term-id=\"55059504\">EEOC<\/span>.
