These laws allow victims of <span data-term-id=\"55525929\">drunk driving accidents<\/span> and other alcohol-related incidents to sue the business that served alcohol to the <span data-term-id=\"55525913\">intoxicated person<\/span>. <span data-term-id=\"55525911\">Dram shop laws<\/span> exist in 43 states and the District of Columbia, though the specific requirements and scope vary by state.<\/p>\n\n    <\/div>\n\n\n\n<p>When most of us think of DUI arrests and <a href=\"https:\/\/www.findlaw.com\/dui\/charges\/drunk-driving-accidents.html\"><span data-term-id=\"55525929\">drunk driving accidents<\/span><\/a>, we don&#8217;t often think about whether people other than the driver are responsible. However, in many states, restaurant and bar owners may be held liable for injuries caused by customers they overserve.<\/p>\n<p>The laws that hold businesses legally responsible for alcohol-related accidents are called <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-are-dram-shop-laws\/\"><span data-term-id=\"55525911\">dram shop laws<\/span><\/a>. These laws vary by state, but generally, they hold owners of establishments that serve <span data-term-id=\"55525914\">alcoholic beverages<\/span> liable for injuries that <span data-term-id=\"55525913\">intoxicated people<\/span> cause. Of course, this liability only extends to patrons who drank alcohol while at the establishment.<\/p>\n<p>Most <span data-term-id=\"55525911\">dram shop laws<\/span> allow victims of <span data-term-id=\"55525929\">drunk driving accidents<\/span> to sue bars and alcohol retailers after an alcohol-related incident. Here, we&#8217;ll explain how <span data-term-id=\"55525911\">dram shop laws<\/span> work and discuss which states have these laws. The courts enforce these laws through <span data-term-id=\"55525943\">civil actions<\/span>. <span data-term-id=\"55525911\">Dram shop laws<\/span> allow DUI victims and their families to file a <span data-term-id=\"55525946\">personal injury<\/span><span data-term-id=\"55525946\"> case<\/span> against alcohol vendors and retailers.<\/p>\n<h2>Which States Have <span data-term-id=\"55525911\">Dram Shop Laws<\/span>?<\/h2>\n<p>Not all <span data-term-id=\"55525911\">dram shop laws<\/span> are the same. They can differ quite a bit. States that have <span data-term-id=\"55525911\">dram shop laws<\/span> may define specific terms in their statutes differently. Words such as &#8220;<a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/homeowner-liability-invitees-licensees-and-trespassers.html\">guest<\/a>,&#8221; &#8220;patron,&#8221; and &#8220;retailer&#8221; can carry different meanings.<\/p>\n<p>Most courts apply the obvious <a href=\"https:\/\/www.gettips.com\/blog\/intoxication-signs\" target=\"_blank\" rel=\"noopener\">intoxication test<\/a>. This test evaluates whether a retailer knew or should have known that a patron was intoxicated to the point where more alcohol would cause danger to that person or others.<\/p>\n<p>As of 2025, 42 states and the District of Columbia have <span data-term-id=\"55525911\">dram shop laws<\/span> in place. The scope of these <span data-term-id=\"55525941\">state laws<\/span> varies.<\/p>\n<p>States without <span data-term-id=\"55525911\">dram shop laws<\/span> include:<\/p>\n<ul>\n<li>Delaware<\/li>\n<li>Kansas<\/li>\n<li>Louisiana<\/li>\n<li>Maryland<\/li>\n<li>Nebraska<\/li>\n<li>Nevada<\/li>\n<li>South Dakota<\/li>\n<li>Virginia<\/li>\n<\/ul>\n<p><strong>Note<\/strong>: Liability claims for retailers that serve underage patrons may still apply even without full <span data-term-id=\"55525911\">dram shop laws<\/span>. (See the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/dui\/laws-and-resources.html\" target=\"_blank\" rel=\"noopener\">DUI Laws and Resources<\/a> section to learn more about the DUI laws in your state.)<\/p>\n<h2>Who Can Be Held Liable?<\/h2>\n<p>Under <span data-term-id=\"55525911\">dram shop laws<\/span>, the primary parties held liable are businesses that sell or <span data-term-id=\"55525917\">serve alcohol<\/span>. This includes bars, restaurants, nightclubs, taverns, <span data-term-id=\"55525937\">liquor stores<\/span>, and other licensed alcohol retailers.<\/p>\n<p>However, just because a restaurant, bar, or <span data-term-id=\"55525937\">liquor store<\/span> owner may be liable under a state&#8217;s <span data-term-id=\"55525911\">dram shop laws<\/span> doesn&#8217;t mean they will be the only defendant in a <span data-term-id=\"55525923\">dram shop case<\/span>. In fact, many <span data-term-id=\"55525933\">dram shop claims<\/span> involve multiple defendants.<\/p>\n<p>Whether a plaintiff can name multiple parties in a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/bars-sued-after-deadly-car-crash-what-is-dram-shop-liability\/\">dram shop lawsuit<\/a> depends on <span data-term-id=\"55525941\">state law<\/span>. However, in most cases, the plaintiff can pursue damages from the following parties:<\/p>\n<ul>\n<li>\n<p>The dram shop (restaurant, bar, club, etc.)<\/p>\n<\/li>\n<li>\n<p>The <span data-term-id=\"55525921\">intoxicated patron<\/span> (usually a <span data-term-id=\"55525930\">drunk driver<\/span>)<\/p>\n<\/li>\n<li>\n<p>Other restaurants, bars, or clubs that contributed to the <span data-term-id=\"55525913\">intoxicated person<\/span>&#8216;s <span data-term-id=\"55525950\">alcohol consumption<\/span><\/p>\n<\/li>\n<li>\n<p>The driver of another <span data-term-id=\"55525932\">motor vehicle<\/span> in a multi-<span data-term-id=\"55525948\">car accident<\/span><\/p>\n<\/li>\n<li>\n<p>Individual employees who served alcohol to the patron (allowed in some states, such as Texas, Illinois, and Montana)<\/p>\n<\/li>\n<\/ul>\n<p>Your <span data-term-id=\"55525945\">personal injury<\/span><span data-term-id=\"55525945\"> lawyer<\/span> will name all possible defendants in your <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/personal-injury-law-the-basics.html\"><span data-term-id=\"55525915\">personal injury<\/span> lawsuit<\/a> where legally appropriate. This does not guarantee that you&#8217;ll receive damages from each defendant. However, it does increase your chances of collecting the highest amount of compensation.<\/p>\n<h2>Who Can File a <span data-term-id=\"55525933\">Dram Shop Claim<\/span>?<\/h2>\n<p>Anyone who<a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.html\"> suffers injuries<\/a> at the hands of an <span data-term-id=\"55525913\">intoxicated person<\/span> has the option of filing a <span data-term-id=\"55525933\">dram shop claim<\/span>. Of course, to succeed in this type of claim, you must prove that the defendant (dram shop) overserved the person who caused the accident.<\/p>\n<p>Specifically, the following people may have standing to file a dram shop lawsuit:<\/p>\n<ul>\n<li>Victims in a <a href=\"https:\/\/www.findlaw.com\/dui\/charges.html\">DUI <span data-term-id=\"55525948\">car accident<\/span><\/a><\/li>\n<li>Individuals who suffer injuries due to an <span data-term-id=\"55525913\">intoxicated person<\/span>&#8216;s negligence<\/li>\n<li>The family of a person who dies in a fatal DUI crash (<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/wrongful-death.html\"><span data-term-id=\"55525936\">wrongful death<\/span> claim<\/a>)<\/li>\n<li>An individual who suffers injuries in a physical attack by a drunk patron (such as in a barroom brawl)<\/li>\n<li>The parent(s) of a child who was in the car with an <span data-term-id=\"55525925\">intoxicated driver<\/span> during a <span data-term-id=\"55525929\">drunk driving accident<\/span><\/li>\n<\/ul>\n<p>Note that some states, such as Illinois, do not allow the <span data-term-id=\"55525921\">intoxicated patron<\/span> to sue the establishment for their <span data-term-id=\"55525953\">own injuries<\/span>. The laws focus on protecting third-party victims.<\/p>\n<p>Since <span data-term-id=\"55525941\">state laws<\/span> regarding who can file a <span data-term-id=\"55525933\">dram shop claim<\/span> differ, it&#8217;s essential that you meet with an experienced <a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55525915\">personal injury<\/span> attorney<\/a> before filing your claim.<\/p>\n<h2>Proving Fault in a <span data-term-id=\"55525923\">Dram Shop Case<\/span><\/h2>\n<p>It&#8217;s not easy to prove fault in a <span data-term-id=\"55525923\">dram shop case<\/span>. Generally, plaintiffs must show that:<\/p>\n<ul>\n<li>The establishment served alcohol to someone who was <span data-term-id=\"55525912\">visibly intoxicated<\/span><\/li>\n<li>And that doing so led to injuries<\/li>\n<\/ul>\n<p>However, several challenges make this difficult. For example, how can <span data-term-id=\"55525927\">bartenders<\/span> know when a customer is drinking on an empty stomach or has a low tolerance for alcohol? It is also difficult to prove that the patron wasn&#8217;t drunk before entering the defendant&#8217;s establishment.<\/p>\n<p>Every state specifies, either through statute or case law, the elements a plaintiff must prove in a <span data-term-id=\"55525923\">dram shop case<\/span>. Under the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.illinoiscourts.gov\/resources\/f66ca435-2ad2-4924-8ab2-a9a798b21252\/file\" target=\"_blank\" rel=\"noopener\">Illinois <span data-term-id=\"55525924\">Dram Shop Act<\/span><\/a>, for example, the plaintiff must demonstrate the following things to prevail at trial:<\/p>\n<ul>\n<li>The defendant engaged in the <span data-term-id=\"55525934\">sale of alcohol<\/span> to the <span data-term-id=\"55525921\">intoxicated patron<\/span>.<\/li>\n<li>A third party sustained injuries (the <span data-term-id=\"55525921\">intoxicated patron<\/span> cannot sue for <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/worksheet-damage-estimate.html\">damages<\/a> under the <span data-term-id=\"55525911\">dram shop laws<\/span> in the State of Illinois)<\/li>\n<li>The at-fault driver was the <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-proximate-cause\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55525920\">proximate cause<\/span><\/a> of the victim&#8217;s injuries (meaning the driver\u2019s actions directly caused the harm)<\/li>\n<li>Intoxication was at least one of the causes of the third party&#8217;s damages<\/li>\n<\/ul>\n<h2>Special Cases: <span data-term-id=\"55525917\">Serving Alcohol<\/span> to Minors<\/h2>\n<p>In addition to imposing liability on establishments for <span data-term-id=\"55525917\">serving alcohol<\/span> to <span data-term-id=\"55525921\">intoxicated patrons<\/span>, <span data-term-id=\"55525911\">dram shop laws<\/span> also hold establishments liable for serving people under the <a href=\"https:\/\/www.findlaw.com\/education\/higher-education\/underage-drinking-laws-and-school-policies.html\"><span data-term-id=\"55525938\">legal drinking age<\/span><\/a>. An establishment that serves alcohol to someone they knew or should have known was a minor can be held liable for any injuries that result from an alcohol-related accident.<\/p>\n<p>In some states, the bar or restaurant may be liable for injuries caused to the minor and third parties. This means that a minor can sue the store\/retailer for <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/injury-damages.html\">damages<\/a> for their <span data-term-id=\"55525953\">own injuries<\/span>.<\/p>\n<p>Unlike cases involving people over the <span data-term-id=\"55525938\">legal drinking age<\/span>, the plaintiff does not have to prove that the minor was <span data-term-id=\"55525912\">visibly intoxicated<\/span>. In fact, even if the minor used a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-happens-if-youre-caught-with-a-fake-id\/\">fake ID<\/a> to obtain alcohol from the defendant, the establishment may still be liable for damages.<\/p>\n<p>To avoid <span data-term-id=\"55525916\">dram shop liability<\/span>, the establishment must prove that it exercised <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/starting-a-business\/what-is-due-diligence.html\">due diligence<\/a> to determine the underage customer&#8217;s age and the validity of their identification. If the jury doesn&#8217;t believe the defendant exercised such diligence, it may hold them liable for any injuries that result from an alcohol-related accident.<\/p>\n<h2>Do <span data-term-id=\"55525911\">Dram Shop Laws<\/span> Apply to Private Events or Social Hosts?<\/h2>\n<p>Generally, <span data-term-id=\"55525911\">dram shop laws<\/span> only apply to businesses that sell or <span data-term-id=\"55525917\">serve alcohol<\/span>. However, many states have similar laws covering &#8220;<a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/practicing-your-serve-a-look-at-social-host-liability.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55525918\">social host liability<\/span><\/a>.&#8221; These laws apply to private citizens who host parties or other social events where people will be drinking <span data-term-id=\"55525914\">alcoholic beverages<\/span>.<\/p>\n<p>In states that have these laws, individuals who allow their guests to drink alcohol may be liable for any accidents their guests cause. For example, if Joe and Joan Smith host a barbecue and one of their guests drinks enough alcohol to put them over the legal limit and causes a DUI <span data-term-id=\"55525948\">car accident<\/span>, the accident victims can sue the Smiths for <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/i-was-hit-by-a-drunk-driver-who-is-liable.html\">damages<\/a>.<\/p>\n<p>The rationale behind these laws is that social hosts have a responsibility to ensure that their guests do not drink and drive. They can accomplish this in various ways. For example, the Smiths from the example above can take their guests&#8217; car keys and only return them to sober guests at the end of the party.<\/p>\n<p>Another option for social hosts is to cut off any guests who appear to be intoxicated. For instance, the Smiths can enforce a two-drink rule for all guests, or at least those who are driving.<\/p>\n<p>It\u2019s important to note that the social hosts will only be liable for injuries <em>directly related<\/em> to their guests&#8217; intoxication. If one of the partygoers is sober and runs a red light, causing a fatal accident, the social hosts will not be liable. However, if the driver&#8217;s <a href=\"https:\/\/www.findlaw.com\/dui\/arrests\/bac-test-faqs.html\"><span data-term-id=\"55525942\">blood alcohol concentration<\/span><\/a> (<span data-term-id=\"55525949\">BAC<\/span>) is over the legal limit, the hosts could potentially be held responsible.<\/p>\n<h2>What Kind of Damages Can Be Recovered?<\/h2>\n<p>The damages in a <span data-term-id=\"55525911\">dram shop law<\/span> case are similar to the damages in any other <span data-term-id=\"55525915\">personal injury<\/span> lawsuit. Typically, the plaintiff in these cases will demand <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/economic-recovery-for-accidents-and-injuries.htmlhttps:\/\/corporate.findlaw.com\/litigation-disputes\/what-damages-can-be-collected-in-a-personal-injury-or-wrongful.html\">economic and non-economic damages<\/a>. They must demand specific damages when they file their initial complaint.<\/p>\n<p>Economic damages include things you can put a dollar value on, such as:<\/p>\n<ul>\n<li>Medical bills<\/li>\n<li>Lost wages<\/li>\n<li>Lost future income<\/li>\n<\/ul>\n<p>You can also demand non-economic damages. These represent losses that you cannot quantify using receipts and include the following:<\/p>\n<ul>\n<li>Pain and suffering<\/li>\n<li>Emotional distress<\/li>\n<\/ul>\n<p>In some cases, you may also be able to seek <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/what-are-punitive-damages.html#:~:text=Punitive%20damages%20are%20a%20special,particularly%20reckless%20or%20malicious%20behavior.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55525954\">punitive damages<\/span><\/a>. These are designed to punish particularly egregious conduct rather than compensate for losses. However, many states limit or cap the amount of <span data-term-id=\"55525954\">punitive damages<\/span>.<\/p>\n<p>Depending on where you live, there may be limits to how much you can recover in a <span data-term-id=\"55525946\">personal injury<\/span><span data-term-id=\"55525946\"> case<\/span>. For example, Alaska <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/what-is-a-damages-cap.html\">caps<\/a> the amount a person can receive in <span data-term-id=\"55525954\">punitive damages<\/span> at $500,000 or three times their compensatory damages, whichever is lower.<\/p>\n<p>Typically, when a plaintiff wins a lawsuit against both an alcohol vendor and an <span data-term-id=\"55525925\">intoxicated driver<\/span>, the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\" target=\"_blank\" rel=\"noopener\">compensatory damages<\/a> are divided between the two defendants.<\/p>\n<h2>What Defenses Can a Business Raise?<\/h2>\n<p>If an accident victim names a business in a <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/starting-a-lawsuit-initial-court-papers.html\"><span data-term-id=\"55525915\">personal injury<\/span> lawsuit<\/a>, the company&#8217;s attorney will put on a strong defense to help it avoid liability.<\/p>\n<p>The following defenses may be available in a <span data-term-id=\"55525933\">dram shop claim<\/span>:<\/p>\n<ul>\n<li>The patron wasn&#8217;t <span data-term-id=\"55525912\">visibly intoxicated<\/span><\/li>\n<li>The patron consumed alcohol elsewhere<\/li>\n<li>There was a break in causation (other intervening factors)<\/li>\n<li>Compliance with state training requirements<\/li>\n<\/ul>\n<p>Your <span data-term-id=\"55525915\">personal injury<\/span> attorney will consider these <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/personal-injury-defense.html\">defenses<\/a> when filing your claim.<\/p>\n<h2>Time Limits for Filing a Claim<\/h2>\n<p>Every state has laws that dictate the timeframe within which a person must file a <span data-term-id=\"55525955\">personal injury<\/span><span data-term-id=\"55525955\"> claim<\/span>. We refer to these laws as &#8220;<span data-term-id=\"55525928\">statutes of limitation<\/span>.&#8221; The <a href=\"https:\/\/www.findlaw.com\/state\/accident-and-injury-laws\/civil-statute-of-limitations-laws.html\"><span data-term-id=\"55525928\">statute of limitations<\/span><\/a> for <span data-term-id=\"55525915\">personal injury<\/span> varies by state.
