The general <span data-term-id=\"54566502\">legal definition<\/span> of an accessory is someone who helps another person commit a crime. \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/aiding-and-abetting-accessory.html\"><span data-term-id=\"54566475\">Aiding and abetting<\/span><\/a>\u201d is another familiar phrase. It\u2019s often used to describe the behavior of an accessory.<\/p>\n<p>Under <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-common-law\/\"><u><span data-term-id=\"54566493\">common law<\/span><\/u><\/a>, <span data-term-id=\"54566489\">criminal charges<\/span> can be brought against someone for either being an <span data-term-id=\"54566473\">accessory before the fact<\/span> or an <span data-term-id=\"54566468\">accessory after the fact<\/span>. They may have helped gather tools and materials or provided information like passwords and security codes.<\/li>\n<li><strong>An <span data-term-id=\"54566468\">accessory after the fact<\/span><\/strong> assists the other parties to a crime after it\u2019s already been committed. For example, they may help bury evidence or <a href=\"https:\/\/archive.findlaw.com\/blog\/boy-2-blurts-out-fugitive-dads-hiding-place-to-police\/\" target=\"_blank\" rel=\"noopener\"><u>hide another party<\/u><\/a> from the police.<\/li>\n<\/ul>\n<p>Most jurisdictions bring accessory charges only against someone seen as an <span data-term-id=\"54566468\">accessory after the fact<\/span>. Some jurisdictions may still use the before\/after terminology. This means they face the same <span data-term-id=\"54566489\">criminal charge<\/span> as the principals.<\/p>\n<h2>How Prosecutors Prove Accomplice Involvement<\/h2>\n<p>When <span data-term-id=\"54566488\">law enforcement<\/span> arrests a suspect, they often know whether any other individuals were involved in the <span data-term-id=\"54566474\">commission of the crime<\/span>. Under <a href=\"https:\/\/codes.findlaw.com\/ca\/penal-code\/pen-sect-211\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"54566498\">California<\/span> Penal Code Section 211<\/a>, robbery is a felony charge with the following penalties:<\/p>\n<ul>\n<li><strong><span data-term-id=\"54566477\">First-degree<\/span> robbery: <\/strong>Three, four, or six years in state prison<\/li>\n<li><strong><span data-term-id=\"54566486\">Second-degree<\/span> robbery:<\/strong> Two, three, or five years in state prison<\/li>\n<\/ul>\n<p>If you actively participated in planning or carrying out the robbery, you would be charged as an accomplice (or principal) and face these same penalties.<\/p>\n<p>However, let\u2019s say you helped the robbers after the crime was committed by hiding stolen property or helping them evade police.
