They also apply to nearly all private school students, although Alaska has carved out one narrow exception we detail in the state-by-state breakdown.<\/p>\n<p>The <span data-term-id=\"56328532\">vaccination requirements<\/span> of the other types of schools follow below:<\/p>\n<h3><strong>Homeschooling<\/strong><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/education\/education-options\/education-and-homeschooling-state-laws.html\"><u>How states treat homeschooled students<\/u><\/a> involves some of the largest disparities we see with vaccination policies. Some states require homeschooled students to meet <span data-term-id=\"56328548\">immunization<\/span><span data-term-id=\"56328548\"> requirements<\/span> only if they <a href=\"https:\/\/www.findlaw.com\/education\/education-options\/home-schooled-student-access-to-public-school-facilities-and.html\"><u>participate in public\u2011school activities<\/u><\/a>, like sports and testing. Examples include Florida, Arizona, and Colorado.<\/p>\n<p>In others, the state\u2019s requirements apply to homeschoolers. North Carolina and Pennsylvania are examples of states using this policy. On the other end of the scale,\u00a0<span data-term-id=\"56328548\">immunization<\/span><span data-term-id=\"56328548\"> requirements<\/span> don\u2019t apply\u00a0to\u00a0<a href=\"https:\/\/www.findlaw.com\/education\/education-options\/home-schooling-alternatives.html\"><u>homeschoolers<\/u><\/a> in Illinois, Indiana, and Michigan. The state-by-state breakdown in this article shows exactly where your state stands regarding required <span data-term-id=\"56328527\">immunizations<\/span>.<\/p>\n<h3><strong>Preschool and Daycare<\/strong><\/h3>\n<p>The state <span data-term-id=\"56328565\">mandates<\/span> in this article apply only to K-12 students. <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/childcare-and-covid-19-what-is-legal\/\"><u>Preschools, daycares, and <span data-term-id=\"56328535\">childcare<\/span> centers<\/u><\/a> often have stricter <span data-term-id=\"56328548\">immunization<\/span><span data-term-id=\"56328548\"> requirements<\/span>.<\/p>\n<p>Nearly all states require vaccines for licensed <span data-term-id=\"56328535\">childcare<\/span> centers. Exemption rules for these types of facilities may also differ from K-12 laws.<\/p>\n<h3><strong>Colleges and Universities<\/strong><\/h3>\n<p>State K\u201312 laws don\u2019t govern college <span data-term-id=\"56328548\">immunization<\/span><span data-term-id=\"56328548\"> requirements<\/span>. They are usually set by:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.usa.gov\/state-health\" target=\"_blank\" rel=\"noopener\"><u>State health departments<\/u><\/a><\/li>\n<li>University systems<\/li>\n<li>Individual institutions<\/li>\n<\/ul>\n<p>Most colleges require <span data-term-id=\"56328546\">MMR<\/span>, <span data-term-id=\"56328542\">Tdap<\/span>, and <span data-term-id=\"56328544\">meningococcal<\/span> vaccines (for\u00a0<span data-term-id=\"56328576\">meningitis<\/span>\u00a0prevention). Some also make <span data-term-id=\"56328533\">Hepatitis B<\/span> and <a href=\"https:\/\/www.findlaw.com\/coronavirus-laws.html\"><u><span data-term-id=\"56328570\">COVID-19<\/span><\/u><\/a><span data-term-id=\"56328570\"> vaccines<\/span> mandatory.<\/p>\n<h2><strong>Types of Exemptions<\/strong><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/vaccine-exemption-laws-by-state.html\"><u>All states allow exemptions<\/u><\/a> from these <span data-term-id=\"56328565\">mandates<\/span> for medical reasons. Many states also allow <span data-term-id=\"56328573\">vaccine exemptions<\/span> for non\u2011medical reasons. These could include <span data-term-id=\"56328559\">religious beliefs<\/span> or philosophical objections. Let\u2019s take a look at some different types of exemptions:<\/p>\n<h3><strong>Medical Exemptions<\/strong><\/h3>\n<p>A medical exemption is available when a licensed <span data-term-id=\"56328541\">health care provider<\/span> determines a child cannot safely receive a vaccine. Reasons may include severe allergies or certain medical conditions.<\/p>\n<p>To request a medical exemption, each state requires, at a minimum, signed documentation from a licensed <span data-term-id=\"56328541\">health care provider<\/span>. Some require little else. For others, state approval or strict alignment with <a href=\"https:\/\/www.cdc.gov\/acip\/index.html\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"56328550\">ACIP<\/span> guidance<\/u><\/a> is also necessary.<\/p>\n<h3><strong>Religious Exemptions<\/strong><\/h3>\n<p>Some states allow exemptions based on sincerely held <span data-term-id=\"56328559\">religious beliefs<\/span>. For example, someone\u2019s faith may prohibit certain medical interventions. Parents must typically submit a signed form or <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/how-to-find-a-notary.html\"><u>notarized statement<\/u><\/a>.<\/p>\n<h3><strong>Philosophical Exemptions<\/strong><\/h3>\n<p>A smaller number of states allow exemptions based on personal or philosophical beliefs. This might include a parent\u2019s conviction that the <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-a-vaccine-manufacturer.html\"><u>potential risks of vaccination<\/u><\/a> outweigh the benefits for their child. These are sometimes grouped under <span data-term-id=\"56328560\">non-medical exemptions<\/span>.<\/p>\n<h2><strong>General Exemption Process<\/strong><\/h2>\n<p>While each state has its own rules, the exemption process usually includes:<\/p>\n<ul>\n<li>Completing a state\u2011approved exemption form<\/li>\n<li>Providing documentation<\/li>\n<li>Renewing the exemption each <span data-term-id=\"56328577\">school year<\/span> in some states<\/li>\n<\/ul>\n<p>Many states require parents to acknowledge that exemptions can be suspended <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law_and_life\/2020\/04\/6-things-that-are-now-illegal-after-covid-19.html\"><u>during an outbreak<\/u><\/a>, but not all.<\/p>\n<h2><strong><span data-term-id=\"56328532\">Vaccine Requirements<\/span> by State<\/strong><\/h2>\n<p>All states require schoolchildren to be vaccinated against communicable diseases.
