Which employees are exempt?<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/california-law.html\"><span data-term-id=\"56864070\">California law<\/span><\/a> presumes that all employees are <span data-term-id=\"56864072\">non-exempt employees<\/span>. The employer must prove a worker is exempt from the protections, which is a difficult burden. California\u2019s exemptions from the wage and hour protections are strictly applied, favoring non-<span data-term-id=\"56864081\">exempt status<\/span>. <span data-term-id=\"56864075\">California employers<\/span> who <span data-term-id=\"56864080\">misclassify<\/span> <span data-term-id=\"56864072\">non-exempt employees<\/span> as exempt employees may face severe penalties.<\/p>\n<h2>Wage and Hour Protections for <span data-term-id=\"56864072\">Non-Exempt Employees<\/span><\/h2>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/\" target=\"_blank\" rel=\"noopener\">California <span data-term-id=\"56864092\">Labor Code<\/span><\/a> is the primary source of the wage and <span data-term-id=\"56864098\">hour laws<\/span>. The <a href=\"https:\/\/www.dir.ca.gov\/iwc\/iwc.html\" target=\"_blank\" rel=\"noopener\">Industrial Welfare Commission<\/a> (IWC) Wage Orders provide details on overtime, breaks, reporting time pay, paid time off, and split shifts. California\u2019s regulations and case law provide additional guidance.<\/p>\n<p>In general, the wage and <span data-term-id=\"56864098\">hour laws<\/span> protect each <span data-term-id=\"56864099\">California employee<\/span>\u2019s right to be paid the right amount and on time. Some <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-wage-and-hour-laws.html\">California wage and <span data-term-id=\"56864098\">hour laws<\/span><\/a> apply to both exempt and <span data-term-id=\"56864072\">non-exempt employees<\/span>. Others apply only to <span data-term-id=\"56864072\">non-exempt employees<\/span>.<\/p>\n<p>The key wage and <span data-term-id=\"56864098\">hour laws<\/span> that apply only to <span data-term-id=\"56864111\">non-exempt workers<\/span> require:<\/p>\n<ul>\n<li><span data-term-id=\"56864077\">Overtime pay<\/span><\/li>\n<li>Meal and <span data-term-id=\"56864093\">rest breaks<\/span><\/li>\n<li>Specific timekeeping requirements<\/li>\n<\/ul>\n<p>Let\u2019s take a look at what each of these provides:<\/p>\n<h3><span data-term-id=\"56864077\">Overtime Pay<\/span><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-overtime-laws.html\">California\u2019s <span data-term-id=\"56864116\">overtime law<\/span><\/a> requires employers to pay <span data-term-id=\"56864111\">non-exempt workers<\/span>:<\/p>\n<ul>\n<li>1.5x their regular <span data-term-id=\"56864088\">hourly rate<\/span> for more than eight hours of work in a <span data-term-id=\"56864110\">workday<\/span><\/li>\n<li>1.5x their regular <span data-term-id=\"56864088\">hourly rate<\/span> for more than 40 hours in a <span data-term-id=\"56864071\">workweek<\/span><\/li>\n<li>Double time for more than 12 hours of work in a <span data-term-id=\"56864110\">workday<\/span><\/li>\n<li>1.5x for the first eight hours worked on the seventh consecutive day of work in a <span data-term-id=\"56864071\">workweek<\/span><\/li>\n<li>Double time each hour over eight on the seventh consecutive day<\/li>\n<\/ul>\n<p>Employers don\u2019t have any leeway with these types of pay for <span data-term-id=\"56864111\">non-exempt workers<\/span>. Those who fail to properly pay their workers face fines.<\/p>\n<h3>Meal and <span data-term-id=\"56864093\">Rest Breaks<\/span><\/h3>\n<p><span data-term-id=\"56864075\">California employers<\/span> must provide <span data-term-id=\"56864111\">non-exempt workers<\/span> with:<\/p>\n<ul>\n<li>An unpaid 30-minute <span data-term-id=\"56864090\">meal break<\/span> after five hours of work<\/li>\n<li>Paid 10-minute <span data-term-id=\"56864093\">rest breaks<\/span> after every four hours worked<\/li>\n<\/ul>\n<p>By comparison, the federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/federal-wage-law-the-fair-labor-standards-act.html\">Fair Labor Standards Act (FLSA)<\/a> and several other states do not require <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\">meal and <span data-term-id=\"56864093\">rest breaks<\/span><\/a>.<\/p>\n<h3>Timekeeping<\/h3>\n<p>When it comes to <span data-term-id=\"56864072\">non-exempt employees<\/span>, employers must account for each minute worked. The detailed <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1174\/\" target=\"_blank\" rel=\"noopener\">timekeeping requirements<\/a> ensure <span data-term-id=\"56864111\">non-exempt workers<\/span> can check their pay stubs to be sure their pay is correct.<\/p>\n<h3>A Note on Minimum Wage<\/h3>\n<p><span data-term-id=\"56864089\">California\u2019s <\/span><a href=\"https:\/\/www.dir.ca.gov\/dlse\/minimum_wage.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56864089\">minimum wage<\/span><\/a> law doesn\u2019t directly apply to exempt employees. A test for an exempt employee requires a <span data-term-id=\"56864079\">minimum salary<\/span> of twice the <span data-term-id=\"56864076\">state minimum wage<\/span>. In this way, exempt employees are also assured a minimum wage.<\/p>\n<h2>How Workers Are Classified Under <span data-term-id=\"56864070\">California Law<\/span><\/h2>\n<p>When it comes to understanding your wage and hour protections, it is important to know if you are exempt, non-exempt, or <span data-term-id=\"56864080\">misclassified<\/span>. Not having the proper classification can cost you both money and benefits.<\/p>\n<h3>Employers Must Prove an Employee\u2019s <span data-term-id=\"56864081\">Exempt Status<\/span><\/h3>\n<p><span data-term-id=\"56864070\">California law<\/span> presumes employees are not exempt from the wage and hour protections. The burden is on the employer to prove an employee is exempt. Employers must prove all three of these elements to overcome the presumption that an employee has non-<span data-term-id=\"56864081\">exempt status<\/span>:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56864087\">Salary basis<\/span><\/strong>: The employer pays the employee a fixed salary each\u00a0<span data-term-id=\"56864071\">workweek<\/span>, regardless of\u00a0hours worked. This is distinct from paying an <span data-term-id=\"56864088\">hourly rate<\/span> or a piece rate.<\/li>\n<li><strong><span data-term-id=\"56864079\">Minimum salary<\/span><\/strong>: The employer must pay the employee at least twice the current <span data-term-id=\"56864076\">state minimum wage<\/span>. An employee paid less than the <span data-term-id=\"56864123\">salary threshold<\/span> is non-exempt. Based on the current <span data-term-id=\"56864089\">California minimum wage<\/span> of $16.90\/hour, the <span data-term-id=\"56864079\">minimum salary<\/span> for <span data-term-id=\"56864081\">exempt status<\/span> is $70,304 ($16.90 x 2 x 40 x 52).<\/li>\n<li><strong><span data-term-id=\"56864082\">Job <\/span><span data-term-id=\"56864091\">duties<\/span><span data-term-id=\"56864091\"> test<\/span><\/strong>: The employee performs exempt duties as an executive, an administrative employee, or a professional. What matters is the work the employee does, not the <span data-term-id=\"56864117\">job title<\/span> or <span data-term-id=\"56864124\">job description<\/span>. For example, an employer cannot give the employee the <span data-term-id=\"56864117\">job title<\/span> \u201cmanager\u201d to avoid paying overtime. The employee must actually perform any management-level <span data-term-id=\"56864082\">job duties<\/span>.<\/li>\n<\/ul>\n<h3>What About <span data-term-id=\"56864108\">Independent Contractors<\/span>?<\/h3>\n<p><span data-term-id=\"56864104\">Employee classification<\/span> also matters for <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\">employee vs. <span data-term-id=\"56864108\">independent contractor<\/span><\/a> status. While the wage and hour protections do not apply to <span data-term-id=\"56864108\">independent contractors<\/span>, employers often <span data-term-id=\"56864080\">misclassify<\/span> employees as <span data-term-id=\"56864108\">independent contractors<\/span>. If you think your employer has <span data-term-id=\"56864080\">misclassified<\/span> you as an <span data-term-id=\"56864108\">independent contractor<\/span> and not an employee, you may want to speak with a <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56864086\">California <\/span><span data-term-id=\"56864073\">labor law<\/span> attorney for advice<\/a>.<\/p>\n<h2>The Three \u201cWhite-Collar\u201d Exemptions<\/h2>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-515\/\" target=\"_blank\" rel=\"noopener\">California <span data-term-id=\"56864092\">Labor Code<\/span><\/a> exempts certain employees from the protections. The so-called \u201cwhite collar\u201d exemptions, which remove executives, administrators, and professionals from these protections, are the key exemptions. Section One of all <a href=\"https:\/\/www.dir.ca.gov\/iwc\/iwc.html\" target=\"_blank\" rel=\"noopener\">IWC Wage Orders<\/a> further explains the <span data-term-id=\"56864107\">white-collar exemptions<\/span>.<\/p>\n<p>In addition to the <span data-term-id=\"56864087\">salary basis<\/span> and <span data-term-id=\"56864079\">minimum salary<\/span> tests, each <span data-term-id=\"56864107\">white-collar exemption<\/span> includes specific <span data-term-id=\"56864082\">job-duty<\/span> requirements for <span data-term-id=\"56864081\">exempt status<\/span>. The employee must primarily perform duties that meet the <span data-term-id=\"56864082\">job-<\/span><span data-term-id=\"56864091\">duties<\/span><span data-term-id=\"56864091\"> test<\/span>.<\/p>\n<p>Let\u2019s take a closer look at each of the possible exceptions:<\/p>\n<ul>\n<li><strong>Executive Exemption<\/strong>: Executive <span data-term-id=\"56864082\">job duties<\/span> include managing a company or a department, overseeing two or more employees, and having the authority to hire and fire<\/li>\n<li><strong>Administrative Exemption<\/strong>: Hallmarks of the administrative exemption include performing office work (distinct from manual labor) that requires <span data-term-id=\"56864074\">independent judgment<\/span> on significant matters, such as management policies or general <span data-term-id=\"56864106\">business operations<\/span><\/li>\n<li><strong><span data-term-id=\"56864102\">Professional Exemption<\/span><\/strong>: Requiring advanced learning, this includes state-licensed professionals such as doctors, engineers, and lawyers, as well as creative professionals who meet certain requirements<\/li>\n<\/ul>\n<p>There are other exemptions recognized by California. Some are called out in the IWC wage orders, such as inside and outside <span data-term-id=\"56864083\">salespeople<\/span>. Others, <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-515-5\/\" target=\"_blank\" rel=\"noopener\">such as <span data-term-id=\"56864100\">computer professionals<\/span><\/a>, are carved out in the <span data-term-id=\"56864092\">labor code<\/span>. These exemptions may have different pay thresholds and other specific requirements, like the employee\u2019s physical location when working.<\/p>\n<h2><span data-term-id=\"56864097\">Federal Law<\/span><\/h2>\n<p><span data-term-id=\"56864099\">California employees<\/span> are protected under both state and federal wage and <span data-term-id=\"56864098\">hour laws<\/span>. The parallel <span data-term-id=\"56864097\">federal law<\/span> is the Fair Labor Standards Act (FLSA). The FLSA covers <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/minimum-wage-and-overtime-basics.html\">minimum wage and overtime protections<\/a> for <span data-term-id=\"56864084\">full-time<\/span> employees. It also includes <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">exemption tests<\/a>, but they are often easier for an employer to overcome than California\u2019s requirements. These include:<\/p>\n<ul>\n<li><strong>Federal <span data-term-id=\"56864079\">minimum salary<\/span><\/strong>: The <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/overtime\/salary-levels\" target=\"_blank\" rel=\"noopener\">federal <span data-term-id=\"56864079\">minimum <\/span><span data-term-id=\"56864121\">salary<\/span><span data-term-id=\"56864121\"> requirements<\/span><\/a> are in litigation. Although the thresholds were set to increase, the Department of Labor is currently enforcing the 2019 thresholds. The standard salary level from 2019 is $684 per week.<\/li>\n<li><strong>Federal <span data-term-id=\"56864082\">job-<\/span><span data-term-id=\"56864091\">duties<\/span><span data-term-id=\"56864091\"> tests<\/span><\/strong>: These include categories similar to the California tests. Federal tests often have different specific requirements.<\/li>\n<\/ul>\n<p>When state and <span data-term-id=\"56864097\">federal laws<\/span> differ, <span data-term-id=\"56864075\">California employers<\/span> must follow the law that is more protective of employees. This is almost always <span data-term-id=\"56864070\">California law<\/span>, which tends to offer greater protection in most areas.<\/p>\n<p><span data-term-id=\"56864097\">Federal law<\/span> can preempt state law in certain industries and situations. For example, <span data-term-id=\"56864097\">federal law<\/span> may control in the transportation context (motor carrier, railway, airline, maritime).<\/p>\n<h2>Reporting and Enforcement<\/h2>\n<p>If you think your employer has <span data-term-id=\"56864080\">misclassified<\/span> you as an exempt employee, you can:<\/p>\n<ul>\n<li>Meet with the <span data-term-id=\"56864095\">human resources<\/span> office for clarification<\/li>\n<li>File a wage claim with the <span data-term-id=\"56864112\">Department of Industrial Relations<\/span><\/li>\n<li>File a lawsuit in civil court<\/li>\n<\/ul>\n<p>You can ask your HR department for more information about your <span data-term-id=\"56864081\">exempt status<\/span>. Whether by mistake or intentionally, employers sometimes <span data-term-id=\"56864080\">misclassify<\/span> employees as exempt.<\/p>\n<p>The Department of Labor Standards Enforcement (DLSE) enforces <span data-term-id=\"56864099\">California employee<\/span> rights. Filing a <a href=\"https:\/\/www.dir.ca.gov\/dlse\/howtofilewageclaim.htm\" target=\"_blank\" rel=\"noopener\">wage claim<\/a> with the DLSE (also known as the <span data-term-id=\"56864113\">California Labor Commissioner<\/span>) is an informal and quick administrative process. In most cases, you have three years to file a wage claim related to being <span data-term-id=\"56864080\">misclassified<\/span> as an exempt employee.<\/p>\n<p>Filing a lawsuit in civil court is also an option. This process is more formal and usually takes more time than a wage claim.<\/p>\n<h2>Legal Help for <span data-term-id=\"56864080\">Misclassified<\/span> Employees<\/h2>\n<p><span data-term-id=\"56864094\">Misclassification<\/span> is a costly mistake for employers. <span data-term-id=\"56864075\">California <\/span><span data-term-id=\"56864078\">employment<\/span><span data-term-id=\"56864078\"> law<\/span> favors employees, but it\u2019s complex and can be difficult to navigate on your own. An employer that <span data-term-id=\"56864080\">misclassifies<\/span> you as exempt may owe you money. This might include back pay for <span data-term-id=\"56864120\">unpaid overtime<\/span>, <span data-term-id=\"56864090\">meal break<\/span> and rest period premiums, statutory penalties, and attorney&#8217;s fees.<\/p>\n<p>A <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56864086\">California <\/span><span data-term-id=\"56864073\">labor law<\/span> attorney<\/a> can help you determine if your employer has <span data-term-id=\"56864080\">misclassified<\/span> you.
