Questions about <span data-term-id=\"56695102\">marital status<\/span> during an employment interview are prohibited in many states and unlawful under federal law if used to determine gender or <span data-term-id=\"56695114\">sexual orientation<\/span> to make <span data-term-id=\"56695119\">employment decisions<\/span>. Other questions about pregnancy, children, <span data-term-id=\"56695105\">childcare<\/span> arrangements, or a spouse\u2019s employment are also prohibited.<\/p>\n\n    <\/div>\n\n\n\n<p>Looking for a job is tough enough these days, especially at the <span data-term-id=\"56695101\">job <\/span><span data-term-id=\"56695126\">interview<\/span><span data-term-id=\"56695126\"> stage<\/span>. Many of the <span data-term-id=\"56695103\">interview questions<\/span> are simple enough: What was your favorite job? What is your biggest strength? What if the interviewer throws you a curveball and asks: Are you married?<\/p>\n<p>Can a <span data-term-id=\"56695101\">job <\/span><span data-term-id=\"56695109\">interviewer<\/span><span data-term-id=\"56695109\"> ask<\/span> that question? Shouldn\u2019t <span data-term-id=\"56695101\">job <\/span><span data-term-id=\"56695103\">interview<\/span><span data-term-id=\"56695103\"> questions<\/span> stay focused on the job and not touch your <span data-term-id=\"56695116\">personal life<\/span>? If the <span data-term-id=\"56695109\">interviewer asks<\/span> questions that cross the line and become discriminatory, an <span data-term-id=\"56695118\">interviewee<\/span> should know how to respond.<\/p>\n<p>The Equal Employment Opportunity Commission (<span data-term-id=\"56695113\">EEOC<\/span>) provides guidance about <span data-term-id=\"56695102\">marital status<\/span> and other family questions during the <span data-term-id=\"56695121\">hiring process<\/span>. In general, such questions are discriminatory and could form the basis of a <span data-term-id=\"56695111\">discrimination claim<\/span>. If an HR <span data-term-id=\"56695109\">interviewer asks<\/span> you such a question, contact an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> and the <span data-term-id=\"56695113\">EEOC<\/span> at once.<\/p>\n<h2><strong>Employment and the Civil Rights Act<\/strong><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\"><span data-term-id=\"56695128\">Title VII of the Civil Rights Act<\/span><\/a> prohibits employers from making <span data-term-id=\"56695119\">employment decisions<\/span> based on the applicant\u2019s gender. <span data-term-id=\"56695102\">Marital status<\/span> is not included in the law, but asking about children or <span data-term-id=\"56695117\">relationship status<\/span> can be one way to covertly ask about gender or <span data-term-id=\"56695114\">sexual orientation<\/span>.<\/p>\n<p>Some states have expanded Title VII to include discrimination based on <span data-term-id=\"56695102\">marital status<\/span>. For example, California\u2019s <a href=\"https:\/\/calcivilrights.ca.gov\/employment\/#:~:text=The%20Fair%20Employment%20and%20Housing%20Act%20(FEHA)\" target=\"_blank\" rel=\"noopener\">Fair Employment and Housing Act (FEHA)<\/a> explicitly prohibits employers from asking <span data-term-id=\"56695125\">prospective employees<\/span> about their <span data-term-id=\"56695102\">marital status<\/span>.<\/p>\n<h2><strong>How Is Asking About <span data-term-id=\"56695102\">Marital Status<\/span> Discriminatory?<\/strong><\/h2>\n<p>It may seem unclear how asking if you\u2019re married is discriminatory in the <span data-term-id=\"56695121\">hiring process<\/span>. Sometimes it can seem like friendly small talk. However, a <span data-term-id=\"56695132\">prospective employer<\/span> may try to remove <span data-term-id=\"56695133\">potential employees<\/span> if they believe:<\/p>\n<ul>\n<li>Women will quit if they get pregnant, or cost too much in maternity leave<\/li>\n<li>Parents with families will demand <span data-term-id=\"56695105\">childcare<\/span><\/li>\n<li>An interviewer may use the question to reveal<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/sexual-orientation-discrimination-in-the-workplace.html\"> <span data-term-id=\"56695114\">sexual orientation<\/span><\/a>, which is discrimination against LGBTQ+ individuals<\/li>\n<li>Employers may presume that married <span data-term-id=\"56695115\">job applicants<\/span> will refuse travel or relocation if offered<\/li>\n<\/ul>\n<p>Employers should make <span data-term-id=\"56695134\">hiring decisions<\/span> based solely on a worker\u2019s qualifications. <span data-term-id=\"56695127\">Discrimination laws<\/span> attempt to create guidelines for employers to follow during the <span data-term-id=\"56695120\">recruitment process<\/span>. These laws are not always successful.<\/p>\n<h2><strong>What Employers Can and Cannot Ask During an Interview<\/strong><\/h2>\n<p>The <span data-term-id=\"56695124\">interview process<\/span> should remain entirely <span data-term-id=\"56695130\">job-related<\/span>. Questions should be job-focused and used to determine whether the <span data-term-id=\"56695118\">interviewee<\/span> can perform the job. In some <span data-term-id=\"56695112\">small businesses<\/span>, employers may ask questions to gauge whether a\u00a0<span data-term-id=\"56695125\">prospective employee<\/span>\u00a0will work well with\u00a0other employees, but they should not stray into unlawful territory.<\/p>\n<p>Some <span data-term-id=\"56695108\">illegal <\/span><span data-term-id=\"56695103\">interview questions<\/span> include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/age-discrimination-in-employment.html\"><strong>Age or date of birth<\/strong><\/a>: It\u2019s illegal to ask this unless a minimum age is required, such as for a position that handles alcohol or marijuana<\/li>\n<li><strong>Race or national origin<\/strong>: It is lawful to inquire if the candidate is legally authorized to work in the U.S. or will need a visa, but not to specifically ask about national origin or race<\/li>\n<li><strong>Gender, <span data-term-id=\"56695114\">sexual orientation<\/span>, or pregnancy status<\/strong>: Removed from federal regulations in 2025 by an executive order<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/religious-discrimination-at-work.html\"><strong>Religion<\/strong><\/a>: Employers can availibility on holidays or overtime<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/ada-disabilities-your-rights-as-an-employee.html\"><strong>Disability or other medical conditions<\/strong><\/a>: Essential functions of the job and the ability of the applicant to perform them are permissible to ask about<\/li>\n<\/ul>\n<p>It is not discriminatory to ask <span data-term-id=\"56695129\">legal questions<\/span> to find qualified applicants. <span data-term-id=\"56695129\">Legal questions<\/span> and requirements can include:<\/p>\n<ul>\n<li>\u201cCan you work on weekends, including Saturdays and Sundays?\u201d<\/li>\n<li>\u201cCan you travel more than 50 miles from the office if necessary?\u201d<\/li>\n<li>\u201cAre you willing to work onsite instead of remotely?\u201d<\/li>\n<li>\u201cCan you work last-minute overtime to finish a project?\u201d<\/li>\n<\/ul>\n<p>This is not an exhaustive list.<\/p>\n<h2><strong>What Should I Do if I Am Asked These Questions?<\/strong><\/h2>\n<p>Your first step should be to evaluate the questioner\u2019s intent. Sometimes a question is just a question. Asking about spouses and children is a common icebreaker, and even human resources interviewers can ask innocent questions. If that\u2019s the first question you\u2019re asked, you may want to sidestep it and move on with the interview.<\/p>\n<p>If the question occurs later during the interview, seems out of place, or makes you feel uneasy, you have a few options:<\/p>\n<ul>\n<li><strong>Focus on the job<\/strong>: Redirect your answer to the position instead of the question. For instance, \u201cDo you have children?\u201d could receive the reply, \u201cI am a good time manager and have experience multitasking.\u201d<\/li>\n<li><strong>Decline to respond<\/strong>: You do not have to answer questions unrelated to the job itself. This applies to questions about religion, <span data-term-id=\"56695114\">sexual orientation<\/span>, or pregnancy.<\/li>\n<li><strong>Terminate the interview<\/strong>: If the interviewer keeps asking personal questions, you may want to either voice an objection or leave. The interviewer is required to respect your boundaries.<\/li>\n<\/ul>\n<p>After such an experience, you might want to consult an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56695106\">employment law<\/span> attorney<\/a> and see if you have an <span data-term-id=\"56695122\">employment discrimination<\/span> case. If you believe you may have lost a job because of your <span data-term-id=\"56695102\">marital status<\/span>, you could have a <span data-term-id=\"56695111\">discrimination claim<\/span>.<\/p>\n<p>You can make a claim with the <span data-term-id=\"56695113\">EEOC<\/span>, but <span data-term-id=\"56695102\">marital status<\/span> is not a protected class. You have 180 days to file with the <span data-term-id=\"56695113\">EEOC<\/span>. If the state or local agency has a similar law, the extension is 300 days. In some states, you can file a <span data-term-id=\"56695111\">discrimination claim<\/span> for marital discrimination. Your attorney will tell you if you live in those states.<\/p>\n<h2><strong>Get <span data-term-id=\"56695104\">Legal Advice<\/span> From an <span data-term-id=\"56695106\">Employment Law<\/span> Attorney<\/strong><\/h2>\n<p>Title VII protects the employment rights of some groups, but not all.
